PLANNING BOARD

TOWN OF PELHAM, NEW HAMPSHIRE 

Notice is hereby given in accordance with RSA 675:3-7, the Pelham Planning Board will hold a public hearing to discuss zoning amendments proposed for the 2009 Town Meeting.  This public hearing shall take place on December 3, 2008 at 7:00 pm at the Town Hall, 6 Village Green, Pelham, New Hampshire.  The proposed amendment is as follows:

To Amend Article IV Establishment of Districts, Sections 307-15(A) and 307-16(B).The purpose of this warrant article is to expand Pelham’s business zone along Bridge Street (Route 38) northerly of Rita Ave. and southerly of Balcom Road to help broaden the commercial tax base and to create meaningful employment opportunities by accommodating new business development that could include family dining restaurants and other amenities. This new business district [B5] is intended for businesses such as professional office space, banks, medical services, educational facilities, health clubs, recreation facilities, family entertainment, retail shopping, grocery stores and eating and drinking establishments with consumption limited to the premises. Businesses prohibited from this new business district [B5] include new or used car dealerships, junk yards, gas stations, car washes, fast food restaurants with drive through windows and single tenant "Big Box" retail buildings that exceed 75,000 square feet. Additionally, no structure shall exceed forty (40) feet in height excluding chimneys and other accessory structures not intended for human occupancy. Approval of this warrant article will rezone the following properties from Residential [R] to Business Zone 5 [B5] but would not make residential uses of the properties within it non-conforming because residential uses are allowed by right within all business districts:

  Approx. 44.65 acres of land known as Tax Map 22, Lot 8-85;  the 1.33 acre parcel of land known as Tax Map 22, Lot 8-91; the 5.67 acre parcel of land known as Tax Map 22, Lot 8-89; the 4.0 acre parcel of land known as Tax Map 22, Lot 8-88; the 1.1 acre parcel of land known as Tax Map 22, Lot 8-108; the 26.26 acre parcel of land known as Tax Map 15, Lot 8-86; the 6.8 acre parcel of land known as Tax Map 15, Lot 8-76; the .73 acre parcel of land known as Tax Map 22, Lot 8-39; the 3.44 acre parcel of land known as Tax Map 22, Lot 8-83-1; the approx. 4.5 acre parcel of land known as Tax Map 22, Lot 8-37; the .21 acre parcel of land known as Tax Map 22, Lot 8-36; the 2.34 acre parcel of land known as Tax Map 22, Lot 8-38; and the 1.24 acre parcel of land known as Tax Map 22, Lot 8-84.
