PLANNING BOARD MEETING

February 6, 2006

NEW BUSINESS

Map 29 Lot<= /st1:place> 7-95 Quiznos Sub /= Brown, Andrew – Pelham Plaza/150 Bridge Street – Site Plan Revi= ew of Proposed Sub Shop

Mr. Andy Brown and Mr. Patrick O’Connell met with the Board to discuss the proposed sub shop. Mr. Brown discussed the water usage (6100 gallons per month/205 gallons per day). Mr. Scanzani noted that the applic= ant was requesting to use 1/7 of the allowable water capacity. The applicant indicated they were = not proposing to install a fryalator. Per t= he Town Health Officer’s letter, as long as no fryalator was installed t= he septic could handle the proposed, per the engineering report.

Mr. Gowan said he spoke with the Health Officer and met with the owner of the <= st1:place w:st=3D"on">Pelham Plaza. He said the owner had copious water meter readings for the entire make up of plaza businesses and shared the information with Herbert Associates, who did calculations. Subsequently, the Health Officer forwarded comments to the Planning Director, which stated his opinion that = the proposed use would not exceed the designed capacity of the existing sewage disposal system. The Health O= fficer (Paul Zarnowski) recommended that the project be conditionally approved sub= ject to a final sewage disposal capacity report being compiled with all the prop= er information (prior to a Certificate of Occupancy being issued). Mr. Gowan discussed parking; he no= ted that there were a total of seven tables in the shop (requiring seven parking spa= ces) and there would be a total of four employees (requiring two additional park= ing spaces).

Mr. Brown said the hours of operation would be from 11am – 9pm (but no later than 10pm) (seven days per week) based on th= e other businesses in the plaza which would be gauged within the first month. The only light usage would be the (street) sign and possibly a couple of neon signs in the window saying ‘Quiznos’.

Mr. Danevich asked if the applicants were planning to change the exterior of the building or have additional lighting. Mr. Brown answered no. He noted that the only change to the outside sign would be to change the name (sign) plate (on the existing sign). Mr. Danevich asked if the plan included a public restroom. Mr. Brown said the plan showed two handicap accessible bathrooms.

There was a brief discussion regarding the recommended condition (per the Health = Officer regarding the fryalator). The= Board agreed if the applicant wanted to install a fryalator, they would need an ‘under-sink’ grease trap.

There was no public input.

(Danevich/Dunne) To app= rove the plan subject to: 1) the signage remaining consistent with the Town’s regulations and zoning; 2) grease traps to be installed prior to installa= tion of fryalator or any other grease generating product; and 3) additional de= tail about water usage in the plaza versus the amount that ends up in the sept= ic system to be submitted prior to Certificate of Occupancy being issued.

Map 15 Lot<= /st1:place> 8-251 Mendes, David – <= st1:Street w:st=3D"on">23 Hobbs Road – Request for Special Use Permit to convert a Duplex into a Condomini= um form of ownership

Mr. Scanzani said the following three applications were related to the same thing. They were three indivi= dual duplexes in which the owner wanted to change the form of ownership into a condominium type; which required a Special Use Permit. The requirement was to assure that= the septic system was installed properly by a licensed installer and could hand= le the situation.

Ms. Ouellette read the li= st of abutters aloud. There were no persons present who did not have their name r= ead, or who had a problem with notification. The file did not contain any written correspondence from abutters.

Attorney David Groff representing the applicant discussed the three proposals with t= he Board.

There was no public input.

Mr. Yarmo pointed out that there appeared to be a shared driveway with this req= uest and the request for 13-15 = Hayden Road. Mr. Danevich said the driveways were existing and for a change of ownership, the Board didn’t have the applicant change the entire landscape. Mr. Groff said the driveway remained the same as when it was built in 1983. He said the only thing the Board reviewed was the septic system.

There was no representative in attendance to present the proposal to = the Board. The Board left it up t= o the applicant to contact the Planning Office to reschedule.
