<p class=3DMsoNormal>The applicant owns 3 lots of record and is merging 3 p=
arcels
of land with a proposed use of retail stores including an already existing =
gas
station.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Advanced Pool and <s=
pan
class=3DGramE>Spa <span style=3D'mso-spacerun:yes'>&nbsp;</span>currently</=
span>
located at the <st1:place w:st=3D"on"><st1:PlaceName w:st=3D"on">Pelham</st=
1:PlaceName>
 <st1:PlaceType w:st=3D"on">Plaza</st1:PlaceType></st1:place> is to relocat=
e into
the northerly section of this proposed mini-mall as he is downsizing his
business from 12,000 s.f. to 1,500 <span class=3DSpellE>s.f</span>.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>A variance will be needed because =
the space
that will house Advanced Spa &amp; Pool is in the WCD.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Issues with these parcels is that =
they
are surrounded by wetlands and a dredge and fill permit will be sought for
1,500 <span class=3DSpellE><span class=3DGramE>s.f</span></span><span class=
=3DGramE><span
style=3D'mso-spacerun:yes'>&nbsp; </span>A</span> bituminous plant is locat=
ed to
the south and east sides of these parcels (name of this plant is Keating an=
d is
located on the NH/MA border on route 38). Keating has constructed dense gra=
vel
berms on the north side of their premises.<span style=3D'mso-spacerun:yes'>=
&nbsp;
</span>Mr. Maynard said there will be drainage improvements, ditches, and a
basin/treatment swale before any runoff enters into the wetlands and will m=
eet
state system regulations/requirements.</p>

<p class=3DMsoNormal><o:p>&nbsp;</o:p></p>

<p class=3DMsoNormal>Mr. Maynard said the building at the northerly end of =
these
3 parcels was ripped down and reconstructed on the same footprint as the or=
iginal
building.<span style=3D'mso-spacerun:yes'>&nbsp; </span>The building was in=
 worse
shape than previously thought.<span style=3D'mso-spacerun:yes'>&nbsp; </spa=
n>He
said that abutters had been notified by the Planning office when the concep=
tual
plan case was heard by the Planning Board.</p>

</span>Jeff Gowan, Planning Director said he has had extensive conversations
with the owner/developer.<span style=3D'mso-spacerun:yes'>&nbsp; </span>The=
 consensus
is that the impact into the WCD is not at the edge of a significant prime
wetland and that this site should be looked at for its individual complexit=
y,
that it is a gateway property to the town of <st1:place w:st=3D"on"><st1:Ci=
ty
 w:st=3D"on">Pelham</st1:City></st1:place>.<span style=3D'mso-spacerun:yes'=
>&nbsp;
</span>Mr. Gowan said that the present owner has a good track record, where=
as
Moe&#8217;s Flea Market was an eye sore.<span style=3D'mso-spacerun:yes'>&n=
bsp;
</span>He said it will be an attractive business.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>He also said that the Planning Boa=
rd
does pay attention to the Conservation&#8217;s input.</p>

<p class=3DMsoNormal>BACK TO THE BOARD:<span style=3D'mso-spacerun:yes'>&nb=

</span>Mr. Maynard spoke about the uses for this retail space.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Presently only Advanced Spa &amp; =
Pool
have negotiated as tenants.<span style=3D'mso-spacerun:yes'>&nbsp; </span>No
other tenants have been negotiated with due to having no time line when the
units will be available.<span style=3D'mso-spacerun:yes'>&nbsp; </span>A dr=
astic
reduction in parking spaces will be negotiated with the Planning Board says=
 Mr.
Maynard.</p>

<p class=3DMsoNormal><o:p>&nbsp;</o:p></p>

<p class=3DMsoNormal>Mr. Gowan said many people have indicated to him that =
they
would like to see an upscale restaurant in town, something more than sandwi=
ch
shops.<span style=3D'mso-spacerun:yes'>&nbsp; </span>He said he could not s=
upport
a restaurant at this location due to the need for a much bigger parking area
and the need for more septic space.<span style=3D'mso-spacerun:yes'>&nbsp;
</span>This location would not support a restaurant.</p>

<p class=3DMsoNormal>A site walk is planned for <st1:time Minute=3D"30" Hou=

w:st=3D"on">8:30 a.m.</st1:time> on Saturday, November 24<sup>th</sup>.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>The Planning Board will be notifie=
d of
the site walk in the case that they would like to do this together.</p>

<p class=3DMsoNormal>Angie Vincent, along with Brendon Shaughnessey of NRPC=
 gave
a presentation on a pilot program that they are working on for well-head
protection and for which a grant has been approved.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Pelham was chosen to study areas of
possible contaminates.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Three =
areas
were sited to be studied and they are looking for sub-committee persons fro=
m the
Conservation Commission.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Ms.
Vincent said that a &#8220;windshield survey&#8221; had been conducted and
showed four unprotected areas which could impact land owners. <span
style=3D'mso-spacerun:yes'>&nbsp;</span>She named Route 38/Main Street/Atwo=
od
Road, Highland Ave &amp; Loretta Ave., Highland Ave &amp; Route 38 and anim=
al
farms.</p>

<p class=3DMsoNormal><o:p>&nbsp;</o:p></p>

<p class=3DMsoNormal>Ms. Vincent is seeking 3-4 volunteers from the public =
as the
project gets into phase IV.<span style=3D'mso-spacerun:yes'>&nbsp; </span>J=

</span>An alternative water source for persons found to be in areas of
contamination is Pennachuck Water that runs along <st1:Street w:st=3D"on"><=
st1:address
 w:st=3D"on">Marsh Road</st1:address></st1:Street>. Threats to water source=
s,
both private and public, are service stations and junk yards said Ms. Vince=
nt. </p>

<p class=3DMsoNormal><span style=3D'mso-spacerun:yes'>&nbsp;</span>NRPC wil=
l be
