Chairman Paul Gagnon brought the meeting to order at <= st1:time Minute=3D"33" Hour=3D"19" w:st=3D"on">7:33 p.m.

 

NEW BUSINESS:

 

Map 41, Lots = 10-146, 247, 248 – MZL Realty, LLC – Bridge Street

This case is represented by Joe Maynard of Benchmark Engineering.

 

The applicant owns 3 lots of record and is merging 3 p= arcels of land with a proposed use of retail stores including an already existing = gas station.  Advanced Pool and Spa  currently located at the Pelham Plaza is to relocat= e into the northerly section of this proposed mini-mall as he is downsizing his business from 12,000 s.f. to 1,500 s.f.  A variance will be needed because = the space that will house Advanced Spa & Pool is in the WCD.  Issues with these parcels is that = they are surrounded by wetlands and a dredge and fill permit will be sought for 1,500 s.f  A bituminous plant is locat= ed to the south and east sides of these parcels (name of this plant is Keating an= d is located on the NH/MA border on route 38). Keating has constructed dense gra= vel berms on the north side of their premises.=   Mr. Maynard said there will be drainage improvements, ditches, and a basin/treatment swale before any runoff enters into the wetlands and will m= eet state system regulations/requirements.

 

Mr. Maynard said the building at the northerly end of = these 3 parcels was ripped down and reconstructed on the same footprint as the or= iginal building.  The building was in= worse shape than previously thought.  He said that abutters had been notified by the Planning office when the concep= tual plan case was heard by the Planning Board.

 

PUBLIC INPUT:  Jeff Gowan, Planning Director said he has had extensive conversations with the owner/developer.  The= consensus is that the impact into the WCD is not at the edge of a significant prime wetland and that this site should be looked at for its individual complexit= y, that it is a gateway property to the town of Pelham.  Mr. Gowan said that the present owner has a good track record, where= as Moe’s Flea Market was an eye sore.&n= bsp; He said it will be an attractive business.  He also said that the Planning Boa= rd does pay attention to the Conservation’s input.

 

BACK TO THE BOARD:&nb= sp; Mr. Maynard spoke about the uses for this retail space.  Presently only Advanced Spa & = Pool have negotiated as tenants.  No other tenants have been negotiated with due to having no time line when the units will be available.  A dr= astic reduction in parking spaces will be negotiated with the Planning Board says= Mr. Maynard.

 

Mr. Gowan said many people have indicated to him that = they would like to see an upscale restaurant in town, something more than sandwi= ch shops.  He said he could not s= upport a restaurant at this location due to the need for a much bigger parking area and the need for more septic space.  This location would not support a restaurant.

 

A site walk is planned for 8:30 a.m. on Saturday, November 24th.  The Planning Board will be notifie= d of the site walk in the case that they would like to do this together.

 

PRESENTATION:

 

Angie Vincent, along with Brendon Shaughnessey of NRPC= gave a presentation on a pilot program that they are working on for well-head protection and for which a grant has been approved.  Pelham was chosen to study areas of possible contaminates.  Three = areas were sited to be studied and they are looking for sub-committee persons fro= m the Conservation Commission.  Ms. Vincent said that a “windshield survey” had been conducted and showed four unprotected areas which could impact land owners.  She named Route 38/Main Street/Atwo= od Road, Highland Ave & Loretta Ave., Highland Ave & Route 38 and anim= al farms.

 

Ms. Vincent is seeking 3-4 volunteers from the public = as the project gets into phase IV.  J= eff Gowan will lend his assistance as time permits.  For now the forum will be conducte= d at the Conservation’s regular meetings.=   An alternative water source for persons found to be in areas of contamination is Pennachuck Water that runs along <= st1:address w:st=3D"on">Marsh Road. Threats to water source= s, both private and public, are service stations and junk yards said Ms. Vince= nt.

 

 NRPC wil= l be assisted by personnel from NHDES.  The next meeting will be January 9, 2008 for phases 1, 2 & 3.

 

At 8:32= members went into non-public session to discuss possible land acquisition.<= /p>
