representing the applicant, met with the Board to discuss the request for
Special Use Permit and the submission of the Voluntary Lot Merger
application.<span style=3D'mso-spacerun:yes'>&nbsp; </span>He asked that the
Board begin by reviewing the lot merger.<span style=3D'mso-spacerun:yes'>&n=
bsp;
</span>He said he client would like to join the two lots together.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>He pointed out that the duplex was=
 constructed
wholly on the left lot and the septic system was on the lot on the right.<s=
pan
style=3D'mso-spacerun:yes'>&nbsp; </span>Attorney Groff said after discussi=
ng the
matter with his client, they wanted to merge the lots.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>The merger would solve the setback=
 issue
with the existing duplex.<span style=3D'mso-spacerun:yes'>&nbsp; </span></p>

<p class=3DMsoNormal style=3D'text-align:justify'><o:p>&nbsp;</o:p></p>

<p class=3DMsoNormal style=3D'text-align:justify'>Mr. Gowan asked how the d=
uplex
was built on a lot with less than two acres and wanted to know if a variance
had been granted.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Attorney Gr=
off
said there were two separate lots and built in the configuration shown.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>He understood by talking to the ow=
ners
that they may have believed they were building closer to being on the lot l=
ine;
he didn&#8217;t know the answer to the question but believed merging the two
lots was the simplest solution.<span style=3D'mso-spacerun:yes'>&nbsp; </sp=
an>Mr.
Gowan agreed.<span style=3D'mso-spacerun:yes'>&nbsp; </span>He explained to=
 the
new Board members that a voluntary lot merger required no action of the Boa=
rd,
it was a simple form signed by the Chairman.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>He felt in this case the merger wo=
uld make
sense since the lot was technically non-conforming without the merger and w=
ould
require zoning relief.<span style=3D'mso-spacerun:yes'>&nbsp; </span></p>

<p class=3DMsoNormal style=3D'text-align:justify'><o:p>&nbsp;</o:p></p>

<p class=3DMsoNormal style=3D'text-align:justify'>Mr. McNamara reviewed the
Voluntary Lot Merger application form and saw that the lot numbers didn&#82=
17;t
correspond to the lot numbers shown on drawing provided.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Attorney Groff believed the lot nu=
mbers
were originally taken from the tax bill.<span style=3D'mso-spacerun:yes'>&n=
bsp;
</span>Mr. McNamara wanted to make sure they referenced the same property.<=
span
style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Gowan said the Planning Depart=
ment
could review and simply change the form if need be.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Attorney Groff said the original p=
lan
referenced the lots as &#8216;a&#8217; and &#8216;b&#8217;; and the tax map
identified them map 9-82 and 9-82-1.<span style=3D'mso-spacerun:yes'>&nbsp;
</span>Mr. Gowan said he would use the map and lot numbers.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>He said if the form listed the num=
bers
incorrectly, the form could be corrected.<span style=3D'mso-spacerun:yes'>&=
nbsp;
</span>Attorney Groff said the &#8216;a&#8217; and &#8216;b&#8217; were on =
the
subdivision plan, and suggested removing them from the form and only using =
the
tax map numbers.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Gowan ma=
de the
change (eliminated a &amp; b) and noted that otherwise, the numbers were
appropriate.<span style=3D'mso-spacerun:yes'>&nbsp; </span></p>

<p class=3DMsoNormal style=3D'text-align:justify'>Mr. Doherty asked what th=
e new
lot number would be.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Gowan
believed the new number would be lot <st1:date Month=3D"8" Day=3D"9" Year=
=3D"1982"
w:st=3D"on">8-9-82</st1:date>, but would double check.<span
style=3D'mso-spacerun:yes'>&nbsp; </span></p>

at the
house numbers were because 2,4 &amp; 8 were listed.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Attorney Groff was unsure why the =
house
numbers were assigned.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Cu=
lbert
said if the lot line was eliminated, the total lot would then be 3.16
acres.<span style=3D'mso-spacerun:yes'>&nbsp; </span>He wanted to know if t=
he
lots were combined if the applicant would come in for another lot since the=
re
would then be enough road frontage along <st1:Street w:st=3D"on"><st1:addre=
ss
 w:st=3D"on">Hayden Road</st1:address></st1:Street> and <st1:Street w:st=3D=
"on"><st1:address
 w:st=3D"on">Windham Road</st1:address></st1:Street> to allow for another
lot.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Attorney Groff said that=
 was
one of the options, but would need to come back to the Board with the
request.<span style=3D'mso-spacerun:yes'>&nbsp; </span>He said right now, t=
he
applicant wanted to combine the lots.<span style=3D'mso-spacerun:yes'>&nbsp;
</span>Mr. Culbert wanted to be sure the applicant understood if they came =
back
it would be under the new zoning.<span style=3D'mso-spacerun:yes'>&nbsp;
</span>Attorney Groff said that fact was understood.<span

for any change to the physical structures, just that there be a change in o=
wnership;
duplex to condominium.<span style=3D'mso-spacerun:yes'>&nbsp; </span>It was=
 noted
there was plenty of room for an alternate location of the leach field in the
even the existing failed.<span style=3D'mso-spacerun:yes'>&nbsp; </span>The=
re was
certification that the existing system was adequate.<span

 w:st=3D"on">Webster Avenue</st1:address></st1:Street>.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>When the plan was originally broug=
ht in
the proposed lot was non-conforming (by lack of frontage) and the applicant
decided to put it aside and come forward with only the 9-lot subdivision.<s=
pan
style=3D'mso-spacerun:yes'>&nbsp; </span>The Board negotiated with Spar &am=
p;
Spindle (and the applicant) and instead of open space (which is required and
there had been much debate about during the original hearings) the Town
preferred a Right of First Refusal document established with the organizati=
on
(Girl Scouts).<span style=3D'mso-spacerun:yes'>&nbsp; </span>This document =
would
allow the Town the first right to purchase the property if the Girl Scouts
decided to put all, or a portion of the land up for sale.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Gowan said one of the conditio=
ns for
approval of the 9-lot subdivision was the recording of the Right of First
Refusal document prior to the plan being recorded.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>He explained that the proposed lot
(considered the 10<sup>th</sup> lot) was called out in the agreement but
because it was not actually subdivided it was difficult to describe in the

the applicant that the subdivision needed to occur.<span

property lines of entire parcel- boundary survey; and 4) locus map

proposing to move the overhead wires from across the lot to the property li=

so they hook up to the existing poles in order to service the Girl Scout
lot.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Culbert asked if a w=

said they didn&#8217;t request a waiver because they were relocating the ex=
isting

stment
felt that the proposed (10<sup>th</sup> lot) had been described and
contemplated in the original 9-lot subdivision, just not delineated.<span

 the
fact that to secure a Right of First Refusal on the remainder property the =
lot
would have to be dealt with; the Board of Adjustment felt that the variance
criteria had been met.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Cu=
lbert
asked if obtaining additional frontage was reviewed.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. McNamara said it was.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>He said if the lot was made to be
conforming, there would be less property protected by the Right of First
Refusal.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Culbert asked ho=
w much
land would need to be added so the lot would have the required frontage.<sp=

subdivision process) was the Town negotiating with the Girl Scouts the Righ=

became important for them to come up with a legal description which had to
leave enough land for the tenth lot; therefore, putting off the tenth lot f=
or a
later date, put it in the forefront.<span style=3D'mso-spacerun:yes'>&nbsp;

without taking a lot of land out of the land that was part of the Right of

</span>He said he suggested coming in now for the tenth lot so it could be
recorded with specificity at the Registry of Deeds.<span

Refusal (less the 9-lot subdivision and less the land needed for a tenth lo=

Mr. Culbert said he was confused by the fact that someone came up with a
non-conforming lot as part of the negotiation for the Right of First Refusal
because there had been plenty of area to have 200ft. of frontage.<span

een
lost (from the Right of First Refusal) would have been miniscule compared to

Adjustment was concerned regarding storage of materials on the property; the
only thing stored on the property was lawn mowing equipment and two trucks
(which is allowed in the Special Exception).<span

style=3D'mso-spacerun:yes'>&nbsp;</span>if any of the conditions for the Sp=
ecial
Exception weren&#8217;t met, it would not exist any more.<span

alk he
noticed that the lot would be large enough to accommodate what they stored

f the
fence would provide adequate screening and the location of the storage pad =
was

McNamara said the abutters had a concern regarding drainage off the
applicant&#8217;s driveway which the board didn&#8217;t get into because it=

looked to be more from recent development in the area versus something that=
 the
applicants did.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Montbleau=

Sousa said at this time part of it was gravel; they were considering possib=
ly

</span>Mr. McNamara said it was more for visual because they weren&#8217;t

said in the photographs circulated he saw the pad and a cinderblock wall ar=

it and questioned if there would be additional containment or a channel aro=

e had
designed the pad as requested so that nothing would leak outside of it.<span

McNamara explained the pad was put underneath the storage area to keep

submitted photographs of the pipe (taken approximately 3 years ago) .<span

oposed
fence (on the applicant&#8217;s lot) would shield Mr. Mullin&#8217;s proper=
ty.<span

style=3D'mso-spacerun:yes'>&nbsp; </span>He continued his discussion regard=
ing the
drainage pipe that he felt was not working and was currently covered up due=
 to

</span>He said the location of the pipe was currently unknown because it was
covered.<span style=3D'mso-spacerun:yes'>&nbsp; </span><span
style=3D'mso-spacerun:yes'>&nbsp;</span>He said at this point<span
style=3D'mso-spacerun:yes'>&nbsp; </span>he was okay with the drain pipe be=
cause
nothing was coming out of it and would &#8216;let it ride&#8217;; however, =
he
wanted his concern about the drain noted in the event that there were future

<p class=3DMsoNormal style=3D'text-align:justify'>Mr. Mullin said he had an=

</span>He indicated that he spoke with the Sousas about the wall and they s=
aid
they would fix the wall.<span style=3D'mso-spacerun:yes'>&nbsp; </span>He a=
lso
wanted to make sure that the maintenance free fence would be put up.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Other than these items, Mr. Mullin=
 had
no problem with the applicant&#8217;s request.<span

<p class=3DMsoNormal style=3D'text-align:justify'>Mr. Pat Gendron, represen=
ting his
Mother Lucille (who lives across the street) had a couple issues, one of wh=
ich
is the water coming off the lot creating a puddle.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>He said the foundation drain had b=
een an
issue since the (applicant&#8217;s) house was built.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>He said another issue was the fact=
 that
his Mother had a shallow well (15ft. deep).<span
style=3D'mso-spacerun:yes'>&nbsp; </span>He was concerned with fluids or
chemicals leaving the property and polluting the well.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. McNamara said the applicants
wouldn&#8217;t have storage on the property.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Gendron said lawn mowers and
equipment leak.<span style=3D'mso-spacerun:yes'>&nbsp; </span></p>

the site plan had been submitted approximately eight-nine months ago, appea=

in front of the Board and then went to the Zoning Board of Adjustment and w=
ere
granted a variance for a portion of the building (590SF) that would be in t=
he
Wetland Conservation District (&#8216;WCD&#8217;).<span
style=3D'mso-spacerun:yes'>&nbsp; </span>He said since that time they had b=
een
working on the plan and conducted many meeting with the Planning Director as
well as meeting with Stantec (Town Engineer).<span

already answered on the plan and they were working on responding to the

garden was essentially a bio-retention system that recharged the ground

ger
Group (Town&#8217;s environmental consultant) reviewed the system for a
different project, they really liked it.<span style=3D'mso-spacerun:yes'>&n=

</span>He said this type of system should be done in a sandy soil type, whi=
ch
the proposed site was.<span style=3D'mso-spacerun:yes'>&nbsp; </span></p>

<p class=3DMsoNormal style=3D'text-align:justify'>Mr. Doherty said Stantec =
seemed
to have a problem with sand, sediment and decomposing leaves encrusting the=
 top
of the water garden so the water can&#8217;t penetrate.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>He wanted to know if someone would=
 rake
the top so a layer of clay wouldn&#8217;t form over the top and stop the
functionality.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Gospodarek=
 said
it would have to be watched; there would be a bio mat that forms.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>He said when the rain garden starts
filling up (it should be only be 6 inches) someone would have to go in and
&#8216;scuff&#8217; it up, move some of the mat.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>He noted as the mat grew it tended=
 to
reduce the frost level and allow it to work in the winter better.<span

asked to review other methods to further reduce the numbers.<span

example because their population was 3x-4x that of Pelham and they managed

requested for wetland and Wetland Conservation District (&#8216;WCD&#8217;)

thing may be to deed that area to the Town/Conservation Commission.<span

steepness of the proposed lot and the concern of runoff due to trees being
cut.<span style=3D'mso-spacerun:yes'>&nbsp; </span>She was also concerned a=
bout
the proposed septic systems being uphill from her well.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>She discussed the close proximity =
of the
abutting homes and felt the proposal was &#8216;cramming&#8217; the lots
in.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Ms. Green discussed the f=
act
that there was a lot of wildlife in the area and a large ecosystem which was
very important.<span style=3D'mso-spacerun:yes'>&nbsp; </span>She felt it w=
as
worth while to make the property conservation land.<span
