representing the applicant, came forward to discuss the proposal.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Zohdi reviewed the plan set pr=
ovided
to the Board showing the existing conditions as well as the proposed
improvements to the parcel.<span style=3D'mso-spacerun:yes'>&nbsp; </span>T=
hey
will be requesting waivers for the following: 1) Section 248-32 -<span
style=3D'mso-spacerun:yes'>&nbsp; </span>the number of parking spaces &#821=
1; 84
spaces required &#8211; 35 spaces requested, and 2) Section 248-41,e to all=
ow a
septic system under the parking area.<span style=3D'mso-spacerun:yes'>&nbsp;
</span>He noted they would also be requesting a variance from the Zoning Bo=
ard
for the setbacks, as well as needing a waiver from the Planning Board to
Section 248-31, C - setback to allow parking and building to be within 50ft=
. of
a wetland.<span style=3D'mso-spacerun:yes'>&nbsp; </span></p>

<p class=3DMsoNormal style=3D'text-align:justify'><o:p>&nbsp;</o:p></p>

<p class=3DMsoNormal style=3D'text-align:justify'>Mr. McNamara asked if the=
 waiver

</span>Mr. Zohdi said the waivers were noted on the plan.<span

bmit a
written request for the waivers delineating the reasons for the requests.<s=

the plan and discussed the site building, drainage and tank.<span

treatment swales.<span style=3D'mso-spacerun:yes'>&nbsp; </span>They are
requesting two curb cuts onto Route 38 from the New Hampshire Department of
Transportation.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Zohdi sai=
d they
are also requesting a curb cut from the Town so they could have access from=
 <st1:Street
w:st=3D"on"><st1:address w:st=3D"on">Pulpit Rock Road</st1:address></st1:St=
reet>.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>The lighting and landscaping was
specified within the plan.<span style=3D'mso-spacerun:yes'>&nbsp; </span></=

<p class=3DMsoNormal style=3D'text-align:justify'>Mr. McNamara asked if the
proposed lighting was Dark Sky compliant.<span style=3D'mso-spacerun:yes'>&=

</span>Mr. Zohdi answered yes.<span style=3D'mso-spacerun:yes'>&nbsp; </spa=
n></p>

proposed erosion control, general maintenance and procedures were detailed =
in
the plan.<span style=3D'mso-spacerun:yes'>&nbsp; </span>There were also
specifications for the pavement, sidewalks and handicap access.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>The drainage detail was outlined.<=
span
style=3D'mso-spacerun:yes'>&nbsp; </span>There was a depiction of the
Island/Apron detail.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Zohdi
noted that the plan included a copy of a septic design his office had done =
in
2002.<span style=3D'mso-spacerun:yes'>&nbsp; </span>They would like to keep=
 that
system; the plan will show the area for a system in the future.<span
style=3D'mso-spacerun:yes'>&nbsp; </span></p>

<p class=3DMsoNormal style=3D'text-align:justify'>Mr. McNamara asked Mr. Go=

the plan contained enough information for the Board to accept it for

n told
the Board that it was a complete plan and advised that they accept it for

Environmental conducted a study of the parcel.<span

assessment of what the wetlands were doing, which included a site specific =
soil
map report.<span style=3D'mso-spacerun:yes'>&nbsp; </span>He discussed the
history of the site, wetlands and current drainage flow.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>He then discussed the wetland and =
its
functions.<span style=3D'mso-spacerun:yes'>&nbsp; </span>He said the storm =
water
was effectively being treated and was infiltrating because of the sands and
gravels.<span style=3D'mso-spacerun:yes'>&nbsp; </span>He said from a stand=
point
of flood control potential, it was very good.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Gove said because the soil had=
 sands
and gravels, the ground water use potential was high.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>He stated there was not much run o=

</span>He commented that the development would enhance the wetland system

consideration that many actions are being proposed that will have a net pos=
itive
effect on the site: <i style=3D'mso-bidi-font-style:normal'>Send a positive
recommendation to the Planning Board and Zoning Board of Adjustment because
this proposal improves significantly upon the existing situation with the
following conditions: 1) The proposed overflow of parking approximately 14
which would require significant filling in the WCD will be held in reserve =
and
only built if use of the site proves it is necessary.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>If it is determined that this park=
ing
must be built that pervious paving be required.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>In addition, if a gas station is n=
ot
approved, parking spaces should be added to the front of the building where=
 the
gas station is being proposed.<span style=3D'mso-spacerun:yes'>&nbsp; </spa=
n>This
proposed parking area is adjacent to Route 38 on the southerly portion of t=
he

</span>3) All roof runoff for the proposed building be directed to dry well=

4) The proposed site plan has a landscaping design prepared with significant
enhanced planting. In addition, as discussed at the PCC meeting on Septembe=
r 9,
if possible, have the invasive species removed from the southwesterly porti=
on
of the lot in the WCD and replaced with native species.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>5) Move the proposed fuel storage =
tanks
to the northerly portion of the lot near route 38 and <st1:Street w:st=3D"o=
n"><st1:address
 w:st=3D"on">Pulpit Rock Road</st1:address></st1:Street> as far away from t=
he
wetland and WCD as possible.<span style=3D'mso-spacerun:yes'>&nbsp; </span>=
6) Use
grass pavers in the proposed access area to the south of the proposed build=

from the edge of the loading dock toward the currently proposed area of the

be cleaned out to allow water to flow freely out of the wetland on the

xisting
condition of the site and the building location.<span

y on
the site was one catch basin (76ft.x12&#8221; corrugated pipe) that went
directly to the wetland with no treatment.<span style=3D'mso-spacerun:yes'>=
&nbsp;
</span>He then reviewed the proposed plan with the pump island and undergro=
und
tanks.<span style=3D'mso-spacerun:yes'>&nbsp; </span>He said the Conservati=
on
Commission suggested not constructing the proposed additional parking unles=
s it
was needed.<span style=3D'mso-spacerun:yes'>&nbsp; </span>He said the decis=
ion
regarding the parking would be the Planning Boards.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Zohdi stated that the Conserva=
tion
Commission also wanted grass pavers (from the <st1:Street w:st=3D"on"><st1:=
address
 w:st=3D"on">Pulpit Rock Road</st1:address></st1:Street> egress), which wou=
ld
need approval from the Planning Board and the Fire Chief.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>He requested that the Board&#8217;s
decision wait until the Highway Safety Committee had the opportunity to
comment.<span style=3D'mso-spacerun:yes'>&nbsp; </span>He showed the wetlan=
d area
on the parcel.<span style=3D'mso-spacerun:yes'>&nbsp; </span>He discussed t=
he
proposed drainage and the treatment swales; a full drainage study has been
submitted for review.<span style=3D'mso-spacerun:yes'>&nbsp; </span></p>

grass pavers would affect the water treatment.<span

aving
porous pavement; the area would need to be raised so the water could be tre=
ated

then reviewed an artist&#8217;s rendition of the proposed building as well =
as
the floor plan.<span style=3D'mso-spacerun:yes'>&nbsp; </span>He showed the=
 Board
the locations of the proposed lights.<span style=3D'mso-spacerun:yes'>&nbsp;
</span>He noted that they were still working on the landscape design.<span

contemplation for a canopy at the gas station pump.<span

said the Board members might want to see what the canopy looked like.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>He hoped that the canopy would ref=
lect
some of the architectural elements of the proposed building.<span

to have their architect draft a rendering to be presented at the next meeti=

the type of gas that would be sold at the station.<span

may want to see alternative designs for comparison.<span

like to have a separate wine and cheese store, something related to the same

ting
would have a greater effect on the neighbors than the existing.<span

ated

</span>Mr. Dadak questioned what the hours of operation would be.<span

four hours, because if the owner was selling gas, they would like to be open

anopies

canopies were similar to a ceiling with a box like fa&ccedil;ade around the=
m,
and open at the top.<span style=3D'mso-spacerun:yes'>&nbsp; </span>He expla=
ined
that the canopy housed the lights for nighttime illumination plus the
fa&ccedil;ade lighting for product branding.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Montbleau warned they would ha=
ve to
be careful not to trap gasoline vapors (under certain conditions) inside the
enclosed area because of electrical fixtures.<span

all be
open to the atmosphere for ventilation. <span

expected to see an economic prong to the application for the area

ted
that the wetland and WCD severely restricted the site and the variance was
needed for any development.<span style=3D'mso-spacerun:yes'>&nbsp; </span>M=
r.
Hennessey questioned if a development could still be done on the site using=
 the
same building footprint and not requiring a variance.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Attorney Mason stated they could d=
o a 9200SF
redevelopment which wouldn&#8217;t be as functionally efficient as the
proposed.<span style=3D'mso-spacerun:yes'>&nbsp; </span>He said for economi=
c reasons
there had to be reasonable business functionality with the proposal.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>He explained that for any branding
company to come to the site, a certain level of pumps and gallon volume wou=
ld
be required.<span style=3D'mso-spacerun:yes'>&nbsp; </span>He noted to have=
 a convenience
store, the owner would need a certain amount of square footage and shelf sp=
ace
available to make it feasible.<span style=3D'mso-spacerun:yes'>&nbsp;
</span>Attorney Mason said there were practical reasons to make the design
smaller, but economic reasons that say 7000SF is what the applicant needs in
order to have a reasonable plan.<span style=3D'mso-spacerun:yes'>&nbsp;
</span>Mr. Hennessey requested that the statement just made should be attac=
hed
to the area variance application as the economic argument.<span
style=3D'mso-spacerun:yes'>&nbsp; </span></p>

<p class=3DMsoNormal style=3D'text-align:justify'><o:p>&nbsp;</o:p></p>

<p class=3DMsoNormal style=3D'text-align:justify'>Mr. Hennessey addressed c=
riteria
#5, with which he was concerned because of the notation of the hours of
operation being twenty four hours.<span style=3D'mso-spacerun:yes'>&nbsp;
</span>He suggested that a 24-hour operation may have some impact on
surrounding properties values being diminished.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Hennessey in reviewing the
Town&#8217;s Master Plan, it looked like the site was on top of one of the =
Town&#8217;s
aquifers.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Gove answered
yes.<span style=3D'mso-spacerun:yes'>&nbsp; </span>He said the majority of =
the
area around the site was deep sand and gravel deposits.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>He said the wetland provided a lot=
 of
infiltration.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Hennessey q=
uestioned
if there should be pervious surfaces underneath a gas station over a Town
aquifer.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Gove stated that=
 the
area under and directly around the pumps should not be.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>He reviewed the site and the propo=
sed
runoff and drainage.<span style=3D'mso-spacerun:yes'>&nbsp; </span></p>

<p class=3DMsoNormal style=3D'text-align:justify'>Mr. O&#8217;Sullivan ques=
tioned
if there was a need to have an opinion from public safety based on traffic
(from the gas station) and the proposed hours of operation possibly being
twenty four hours.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Zohdi
commented that Wakefield Engineering worked twenty four hours during certain
times of the year.<span style=3D'mso-spacerun:yes'>&nbsp; </span>He said as=
 for
the gas station, they were still in the process of working on the hours.<sp=
an
style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Gowan stated that the Highway =
Safety
Committee would review the plan and consider the hours and traffic.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>He said there were a lot of concer=
ns
that both boards should address with regard to the nearby residential compo=
nent
behind the site.<span style=3D'mso-spacerun:yes'>&nbsp; </span>He said he w=
ould
bring the matter up with the Highway Safety Committee and bring their
recommendation back to the boards.<span style=3D'mso-spacerun:yes'>&nbsp; <=

<p class=3DMsoNormal style=3D'text-align:justify'>Mr. Hennessey discussed t=
he
culvert and questioned who was responsible for the ongoing maintenance of
it.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Gowan said if the cul=
vert
was located on private property it would be the owner&#8217;s responsibilit=
y;
if it was within the Town road easement it would be the Town&#8217;s
responsibility, or state&#8217;s depending upon the road.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Zohdi said in this case, the
Department of Transportation (&#8216;DOT&#8217;) would be responsible for t=
he
culvert.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Ouellette said t=
hat
information was found out when the culvert for Tony&#8217;s Brook was being
reviewed.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Zohdi said they=
 had
told the Conservation Commission that they would see to the culvert being
cleaned either by them (one time) or the DOT.<span

that had an agreement with the town&#8217;s emergency services.<span

concerned that eventually the porous surface would need to be replaced beca=

currently before the Board is thirty acres, the remaining lot is forty

feel the Board had jurisdiction on the Right of First Refusal because the l=

felt it might make sense to have a legal document indicating that the appli=
