Bob Sherman presents Eagle Scout Project

Boy Scout Troop 610 Leader, Mr. Bob Sherman and Mr. Jo= seph DeVita met with the Selectmen to discuss Mr. DeVita’s Eagle Scout project. The project will entail clearing o= ut the area around the paths near the Town Beach at Veteran= 217;s Memorial Park to make the area safer. The general area is between the field and the lodge.

Mr. McDevitt asked if the Park & Recreation Direct= or had reviewed the project. Mr. She= rman answered yes.

Mr. Danevich arrived.

PUBLIC HEA= RING: Land Purchase Map 26 & 27 Lot 2-79, Hinds Lane – Proposal to Purc= hase Land for Conservation Purposes

Conservation Commission Chairman and member of the Open Space Committee Bob Yarmo met with the Selectmen to discuss the opportunity= to purchase 135 acres (with approximately 8 in Hudson) which was believed to be a significant opportunity for the Town. He proposed that the Town purchase the parcel for $780,000 out of the current use fund (totaling $1,456,529).&nb= sp; He reviewed the Town tax map as well as the Gumpas/Musquash watershed map to show the location of the parcel.&nb= sp; He said by reviewing the tax map it was difficult to identify the frontage onto Hinds Lane, which they were still working on. Mr. Yarmo said West Environmental reviewed the property and indicated that it was heavily wooded with significant wetlands and the topography sho= wed both mild slopes and steep slopes. The parcel also has significant timber value. An addendum to the West report had= been received (and would be forwarded to the Selectmen) that more accurately identified the soil types, the amount of wetlands and some of the attribute= s to the parcel. Mr. Yarmo said du= ring the site walk it was noted there were approximately nine junk cars on the parcel and there had been significant ATV/monster truck damage, which would require some restoration. Bar= s and gates had been suggested in the West report. He informed that the property abut= ted the Gumpas/Musquash area (400-500 acres) and the New England Forestry Foundation (140 acres) as well as a Town parcel and additional New England Forestry Foundation parcel. He ended by noting that the parcel had the opportunity to provide a significant wildlife corridor and habitat.

Mr. Dave Hennessey, 71 Dutton Road a real estate broke= r (selling/marketing/real estate mortgage banking for thirty years) (currently Manager Coldwell Banker Residential Brokerage Portsmouth) said he set up an automatic feed between himself and the members of the Conservation Commission and Open Space Commi= ttee to notify if a Pelham land listing came in they would receive it; as a resu= lt, a listing came in for $940,000. He said they went through the process used to evaluate raw land and went on to explain the information reviewed when evaluating raw land. He said the only comparison was the Tamposi land, which was also a large parcel. Mr. Hennessey said the parcel was = being purchased, not from the $3,000,000 bond (to take buildable land out of circulation), but rather from the Conservation Fund for conservation land.<= span style=3D'mso-spacerun:yes'> He said when determining the numbe= r of finished lots that could possibly come from the parcel was approximately was thirty-= five to thirty-eight. He noted that there were multiple offers on the table for the parcel each of which being = over $940,000; however, the person who purchased the property had passed on it a= fter discovering the difficulties of developing the land. He discussed the negotiation proce= ss and the said the Town’s initial offer had been turned down, so it was increased to $780,000, which was what the seller was willing to take on the open market.

Mr. Bergeron reviewed the appraisal that indicated the= re were 171.43 acres, not 135 acres as being discussed. He wanted to know what happened to= the additional 36 acres. Mr. Henn= essey said some of the property had been subdivided. He noted that his appraisal was do= ne independent of the appraisal provided.&nbs= p; Mr. Bergeron questioned if there was an appraisal on the 135 acres b= eing proposed. Mr. Hennessey discu= ssed the appraisal and was unsure if the frontages shown were actually there. He believed the parcel was worth l= ess than the amount being paid. M= r. Bergeron asked if they knew where the additional 36 acres were. Mr. Hennessey said he didn’t= know.

Ms. Deborah Waters, member of the Open Space Committee= , met with the Selectmen to provide an overview of the plan, the Conservation cri= teria and how the parcel matched up with the regional and local objectives and criteria. She showed a build-= out analysis map that showed buildable land as designated by NRPC. She also showed a Regional Environ= mental Priorities Program (‘REPP’) map (the program was funded by DES = and managed by NRPC) in which conservation commissions were asked to identify k= ey parcels they would like to protect. She said one of the parcels on the map was the subject parcel being discussed. Hudson had also identified their priori= ty parcels, one of which is adjacent to the Gumpas/Musquash area. Ms. Waters provided the Selectmen = with a copy of the selection criteria and checklist for open space acquisitions. She then discussed the West Environmental report which states that the parcel has high value in terms of environmental advantages. She= also addressed the future stewardship of the property; West Environmental indica= ted there was some timber value. = She had discussions with various folks in state agencies who offer free service= s and said they would assist the Town with the stewardship. She also noted there was a person = that would draft forestry plans at no cost to the Town.

Mr. Bergeron noted that the Mark Standish appraisal (<= st1:date Month=3D"3" Day=3D"27" Year=3D"2003" w:st=3D"on">March 27, 2003)= showed 171 acres, but the Selectmen were being told that there was 135 acres being purchased. He questioned wher= e the additional acreage was. Ms. W= aters said the 135 acres (127.5 acres in Pelham and 8.3 acres in Hudson) came from the listing sheet. Mr. Bergeron questioned the measure= ments and asked if there was concern for the additional 35 acres. Ms. Waters was aware that some lan= d was sold off after the appraisal was done.&nbs= p; Mr. Lynde reviewed the appraisal.&n= bsp; There was further discussion regarding the acreage of the parcel.

Mr. Danevich felt it was good news that the purchase w= ould come from funds the Town already had and that there would be no tax payer impact. He asked if the land = would be placed under permanent conservation protection; the way it’s being acquired under RSA 36,a talks in terms of recreation and wanted to know if there was a potential for passive recreation. Ms. Waters said the proposed purch= ase and sales agreement had gone to Town Counsel for review, who in turn indica= ted that conservation land could not be purchased outside of the Town limits, but the Selectmen could, if it was used for recreational purposes. She said Town Counsel suggested tha= t it be written that Conservation would be buying the land within the Town limits and the Selectmen would buy the land outside of the limits. Mr. McDevitt asked if the agreement under which the land was being acquired preclude recreational uses of any sort. Ms. Waters said the Conservation Commission was operating under RSA 36a and suggested that ther= e be a clarification of the limits of the RSA.&= nbsp; The piece in Hudson was operating under RSA 35b for use as recreation. Mr. Danevich asked that Mr. Gaydos (through legal counsel) provide the Selectmen with the difference between R= SA 35b and 36a with respect to the restrictions of the passive recreation use = of the land.

Mr. Danevich asked if the Town had to pay taxes to Hudson on the land contained in Hudson. Ms. Waters said Town Counsel was a= sked about the land purchase in Hud= son; the answer is no, Hudson could not charge taxes if it was purchased under RSA 35b. Mr. Danevich asked that the presen= tation package include the meeting minutes from the Conservation Commission meeting which should also include the full vote of the members.

Mr. Lynde thought the land would be valuable for the T= own to acquire. He understood the importance of protecting the Musquash land. He discussed the possibility of re= creation and didn’t feel there was a question regarding passive recreation. Mr. Lynde then explained the fores= try management plan process and h= ow to help the health and growth of the forest, which at the same time would gene= rate income for the Town.

Mr. Bergeron asked if a new registered map had been ma= de of the property, and if not yet, when it would be generated. Mr. Yarmo said the engineer had 90= % of the property line done and as soon as it was available it would be forwarde= d. Mr. Bergeron felt when the land was purchased, there should be a map of what is being purchased.

PUBLIC INPUT

Ms. Wendy Smegelski, 12 Locks Lane/Gumpas Pond said she = had lived on Gumpas Pond most of her life and discussed the parcel and noted th= at it was currently being used for passive recreation (i.e. dog walking, hiking). She would like to ha= ve the land remain as conservation land and not be developed.

Mr. Allen Smegelski, 12 Locks Lane was in favor of the T= own purchasing the property. He n= oted that the parcel was a watershed area for Gumpas Pond.

Mr. Bill Cook, 29 Hinds Lane was in favor of the Town acquiring = the parcel. He said if the Town didn’t acquire the parcel it would be developed, which would be detrimental to Gumpas Pond. <= /p>

Mr. McDevitt believed there were some issues to be wor= ked out and said the Selectmen would vote in a week or two.

Mr. Bergeron said the appraisal said there was a small building on the parcel; he questioned if it would remain, or be removed. Mr. Yarmo said it would need to be clarified, because it was not viewed during the site walk.

Mr. McDevitt asked that a site walk be set up with the Selectmen (also securing the permission of the owner). Mr. Yarmo said a site walk could b= e set up with the owner’s permission. Mr. McDevitt asked for clarification regarding the frontage on Hinds Lane.= Mr. Yarmo said the engineer had be= en contacted and he was assured by the owner that there was frontage onto Hinds Lane,= which would be clarified.

Mr. Lynde asked Mr. Yarmo if he could find out what the assessed value of the land in = Hudson. Mr. Yarmo said he would find out a= nd believed a significant portion was part of the Musquash swamp.

Mr. McDevitt said there would be a posting on the agen= da when the Selectmen would vote.

Richard Ha= negan – Citizens Emergency Certification Request to Town Owned Space

Firefighter/Prevention Officer Richard Hanegan met wit= h the Selectmen to discuss certain programs he was working with. He said the Community Emergency Re= sponse Team (CERT) had established a new counsel which provided Pelham with the opportunity to have a Medical Reserve Corps. and Volunteers in Police Servi= ce (VIPS) as well as more funds. He said if they went forward and had other programs and citizen involvement a place would be needed for materials/supplies and training area. The current storage trailer was not adequately protecting the resources. Firefighter Hanegan asked the Selectmen if they had any suggestions,= or could help find a location for the team, since it took hard work and three years to establish.

Mr. Lynde asked how much area was needed. Firefighter said he needed a room = large enough for training as well as office space for the administrator in charge= of the counsel. Storage space wa= s also needed for additional equipment which would be supplied through grants.

Mr. Bergeron said he was a member of the Pelham Citizen’s Corps. Counsel and discussed his understanding of the progr= ams (that were through Homeland Security) that Firefighter Hanegan was promoting. He suggested evaluating what space= the Town had for such programs. <= /p>

Firefighter Hanegan noted that there was not a VIPS pr= ogram in the state yet, and if formed, Pelham would be the first. He said a website had been created= to inform people of the CERT program (http://pelham.cert.nh.gov).

Mr. McDevitt asked if there were Federal funds availab= le to the Town to improve, or maintain whatever space was used. Firefighter Hanegan was advised if= a facility was established, it could be made into a headquarters for the Hillsborough County area; funds would be made available for maintenance, general repairs as well as other fund some of the administrative support.

Mr. Bergeron asked if the facility had to be handicap accessible. Firefighter Haneg= an believed most public buildings had to have handicap accessibility. If a facility was open to anyone participating, it would need handicap accessibility.

Mr. Danevich felt it was great that the CERT program w= as brought to Town and noted that Pelham was one of the only southern New Hampshire towns on the list (notably off the list was Manchester and Concor= d).

Mr. McDevitt said the next step would be for the Selec= tmen to determine available space and discuss further; an agenda item would be a= dded for the next meeting.

Firefighter Hanegan said the goal was to have 10% of Pelham’s population to have emergency skills.

VFW Presen= tation to Police & Fire Representatives

Pelham VFW Commander Charlie Mooskian went before the Selectmen and informed that the Pelham Post was officially the named the Jo= hn H. Hargreaves Memorial Post. = He said Mr. Hargreaves was very patriotic and had served in three wars. He informed that Mr. Hargreaves ha= d left a list prior to his passing, one item on the list was to present awards to those who had patriotic service to the community. Awards were presented to the Town, Police Chief Evan Haglund, Fire Chief E. David Fisher, Mr. McDevitt and Boy Scout Troop 25.

Mr. McDevitt expressed his appreciation for the presen= tation of awards.

OTHER BUSI= NESS

Bergeron A= uto Recycling /Junkyard License Review (Discussion)

Mr. Bergeron stepped down.

Mr. McDevitt said the Board gave Mr. Bergeron a 90-day license (April 6,= 2004)that would expire in July. The lic= ense was granted pending receipt of information from New Hampshire Department of Environmental Services (DES). Mr. Gaydos said on Ap= ril 6, 2004 the 90-day license was granted, April 7, 2004 the Town received a report dated March 4, 2004 that had been circulated= to the Board. He was informed that t= here was an additional report from DES that he had not received. Mr. Gaydos noted the information contained in the report regarding the current status; essentially the report indicated that tests were being made and there was no note of non-complianc= e.

Mr. McDevitt said the letter was not specific to the Selectmen and apparently was mailed out to the residents in the Marsh Road area. He said the Selectmen w= ould not be taking any action at this time.&nbs= p;

Mr. Lynde said the Selectmen had inquired about the st= atus of Mr. Bergeron’s operation in connection with compliance with the st= ate, which the letter doesn’t address.&nb= sp; Mr. Gaydos believed Mr. Bergeron obtained a statement from the state= on his own behalf. Mr. McDevitt = said the Selectmen should have a similar statement informing if the actions take= n by Mr. Bergeron were consistent with what the state had asked him to do. Mr. Gaydos said he had been in tou= ch with the state for over a month waiting for reports that had already been d= one. He was hesitant to make the administration responsible for not gathering information. Mr. McDevitt said if he were Mr. Bergeron, he would do everything he could to make sure that DES provided the Selectmen with information of compliance with requirements. He said it wouldn’t hurt the Selectmen to request the information. He said the issue would be revisited.

Mr. Bergeron returned to the Board.

Skateboard Ordinance Review

Mr. McDevitt said the Selectmen had voted to restrict = skateboarding from in front of the Library and the sidewalk in front of the Municipal Center; signs were added and the Police were enforcing. The Police informed if the Town wa= nted any ‘teeth’ to the restriction, an ordinance should be passed.<= span style=3D'mso-spacerun:yes'> Police Chief Evan Haglund obtained= examples of skateboard ordinances for review. Mr. McDevitt said if the Selectmen wanted to propose something more specific it would need to be done before Town Meeting. There was a discussion regarding t= he question if an ordinance was necessary, or if certain areas should be poste= d as no skateboarding. It was note= d that an ordinance made it possible for Police to enforce the no skateboarding signs. Mr. McDevitt said ther= e was a sign at the entrance of the Municipal Building, and sugge= sted placing additional signage in front of the Library. He said if there continued to be a problem, the Selectmen could revisit the issue. Mr. Danevich believed if an ordina= nce was passed it would make skate boarding a crime. Mr. Lynde didn’t feel passin= g an ordinance would make skate boarding a crime. He said an ordinance would help pr= otect Town property.

Status on = Tax Takings

Mr. Gaydos said there were three properties that were = due for deeding by the Tax Collector for non-payment of taxes. A short history of notices for each property was provided to the Selectmen.&nb= sp; Mr. McDevitt said he had asked the Planning Director to investigate = what was on the other side of the property on William Drive Off property since it bordered Windham. He asked that the Selectmen not ma= ke a decision regarding the parcel until further information. He then discussed the Bush Hill property, which had a wetland and said he wanted to know what was holding t= he water on the property. He sug= gested that the Conservation Commission and Selectmen review the property before taking any action. Mr. Lynde = said if the property was taken, the owner would have three years to redeem it. Mr. McDevitt said the last propert= y was land and buildings on Home= stead Road which had multiple notifications returned unclaimed.

Mr. McDevitt said there was further work to be done regarding the parcel on Ho= mestead Road and asked Mr. Gaydos to keep the Selectmen informed about how it proceeded.

Assessing = Office Staffing

Mr. Gaydos said with the vacancy of the Assessor’= ;s position an outside agency was asked to come in and review the status of paperwork, outside inspections etc. To fill there were three part-time temporary positions filling the coverage of the office. The a= gency recommended hiring a full-time clerk that would benefit from training they = were providing, and would also maintain consistency within the department. Mr. Gaydos said the part-time pers= onnel could remain on-call, but felt it was an ideal time for the Town to select a person as an Assessing Technician or Assistant Assessor. The position didn’t require certification because they would be working under the direction certified personnel. The union currentl= y had a grade-six Assessor Assistant position.&n= bsp;

Mr. Bergeron said he would like to move forward and advertise for the position. H= e said the Town was behind and felt it was important to fill the position.

Mr. Lynde concurred that something should be done quic= kly and believed continuity was important, as well as the interaction with the public. He believed there wer= e two options of approach: 1) to hire an assessor and an assistant (which had not been budgeted); 2) have an assistant assessor and contract the pick-ups to an outside firm. He said if an assessing clerk was filled, the Town should be prepared to support the added position, or contracting the services out.

Mr. McDevitt felt it was clear that the Town was past = the point of being able to have one person in the department. He asked if the request was to aut= horize Mr. Gaydos to advertise for a grade six Assessor Assistant. Mr. Gaydos discussed the pay scale= and suggested that the position be advertised similar to the Tax Clerk position.

Raymond Pa= rk Engineering

Mr. Gaydos informed that he would be receiving a quote= by Friday.

Highway De= partment Backhoe

Mr. Gaydos said after the discussion at the previous Selectmen’s meeting it was agreed to support Mr. Foss obtaining three prices; once the prices were brought before the Board a decision would then= be made. He said he had advised = the Board that it was legal for the Board to purchase the item out of the Opera= ting Revenues because there had been a line item that indicated new equipment and transfers could happen from line item to line item (per RSA 32:10). He said it was correct, but only u= ntil July 16, 2004.<= span style=3D'mso-spacerun:yes'>

Mr. Derby informed that the Budget Committee would be discussing the situation on June 21, 2004.

Mr. Lynde understood that the method of payment would = be to utilize the Highway Block Grant money for the purchase of the backhoe. Mr. Gaydos said the Highway Block = Grant was feeding the line items appropriated.&n= bsp;

Mr. Danevich questioned what would happen if the backh= oe was not purchased. Mr. Gaydos sai= d Mr. Foss indicated that there were several projects that probably wouldn’= t be done; it may impact the ability to respond to emergencies (i.e. flooding); = emergency clearing during the winter would also be impacted.

Mr. McDevitt said the Selectmen work for Town Meeting = and in this case the request to purchase a backhoe was turned down. He said the Budget Committee, Sele= ctmen and CIP approved it, however with the information in front of them, 63% of = the people did not give permission to purchase a backhoe.

Mr. Lynde didn’t think the Selectmen, or the vot= ers at that time had the information being presented. The fact being presented was the b= ackhoe was in disrepair and the alternatives to purchase were worse than purchasing. He said the Selec= tmen were now in the position to make a decision that was in the best interest of the Town. He suggested having Highway Road Agent Don Foss explain the impacts of not having a backhoe.

Mr. Bergeron was unsure if dealerships sold backhoes a= s they did in the past and questioned the availability of renting a machine. Mr. Gaydos understood that the mac= hines were available. The rate per = hour was high and included a transportation charge. Mr. Gaydos said Mr. Foss indicated= the most economical rental would be to do so, on a monthly basis ($2500 per month). He said the machines available may not be brand new. Mr. Bergeron confirmed that backhoes were readily available for $2500 per month. Mr. Gaydos answered yes.

Mr. Derby said the voters said no to the backhoe; he questioned if the machine should be purchased (saving repair costs), or spe= nd money on something the Town wouldn’t have after Town Meeting next year. He felt it was prudent = to purchase the backhoe, which would save money on repairs and renting. Mr. McDevitt understood the reason= ing, but didn’t agree with purchasing the equipment.

Mr. McDevitt said it might be helpful if Mr. Foss info= rmed, outside of loading salt and sand, what major projects wouldn’t be don= e if he didn’t have a backhoe and what the rental costs would be to comple= te such. Mr. McDevitt asked if t= here were excavators in Town who might have a backhoe available for rent, rather than going to a heavy equipment dealer.&nb= sp; Mr. Derby said they may want their own person operating the machine. Mr. Lynde said in the past, the Town used to rent the equipment along with the operator, but foun= d it was more cost effective to own the equipment.

Mr. Danevich said he wanted to work with Mr. Gaydos an= d Mr. Foss to possibly come up with a creative way to handle the situation.

Proposed L= egal Counsel Request for Qualifications

Mr. McDevitt said the agenda item was to initiate disc= ussion on whether or not it was timely to review who provided counsel and if more = than one firm should be used. Mr. Danevich believed the topic stemmed from a broader conversation in looking periodically at all the contracts and at what duration were they awarded.

Mr. McDevitt asked if the Selectmen wanted to entertain proposals from a variety of firms, or one that had multiple experts. Mr. Gaydos said the qualifications= from a number of different types of attorney services would be reviewed.

Mr. McDevitt asked that a request for qualifications (= and fee structure) be sent out to various firms that do municipal work.

Water Dist= rict Legal Fees

Mr. McDevitt said the Selectmen had been provided with= a breakdown of what legal fees had been paid by towns. Pelham committed to $5000 in 2003,= which had been paid; and additional request of $5000 was made in 2004, of which $= 2500 had been committed and paid – and an additional $2500 would be paid if there was money (to be determined in July). He said Ms. Karen White of the Wat= er District said it would be appreciated if the Town saw it fit to pay the additional $2500 toward the commitment.&nb= sp; The total commitment was $10,000 ($7500 of which had been paid). Mr. Gaydos understood that commitm= ents had been made, but requested holding off until there was a better view of t= he budget.

Mr. Danevich said if all the towns paid their commitme= nts there would be $17,500 generated and noted that there was a $13,900 deficit. He questioned what w= ould be done in the event of a deficit. <= /span>Mr. Bergeron believed there were other expenses not listed. Mr. Danevich asked if there would = be any additional requests for funds. Mr. Bergeron didn’t believe Pelham would be asked for more.

Mr. McDevitt noted that Derry, Salem a= nd Hookset had withdrawn and said that Windham was still involved, but had not paid anything. He asked if the funds would be pai= d back to the communities. Mr. Berge= ron said when Nashua acquires Pennichuck Corp. and its assets, revenue bonds would be applied for and distributed. He said if t= hey can’t acquire Pennichuck the towns would be out the money.

Statement = of Safety Policy

Mr. Bergeron said on behalf of the Joint Law Safety Committee full support of the Selectmen was being sought regarding the Statement of Safety Policy, which he proceeded to read aloud. Mr. Danevich asked if the document= be acknowledged and signed by employees annually during their review. Mr. Gaydos said the document could= be added.

Mr. Lynde asked what prompted the document. Mr. Gaydos said it was part of the overall Joint Law Safety Program.

Mr. Bergeron said the committee was formed by randomly chosen employees. He recogniz= ed each of the committee members.

TOWN ADMINISTRATOR’S REPORT / SELECTMEN’S REPORTS=

Mr. Gaydos said June 11, 2004 was the due date for department heads = to submit their budgets. He asked permission to deliver the budget package to the Selectmen on June 25, 2004. There was no objection. Mr. Gaydos said the Board had prev= iously approved moving ahead with the Spring Street betterment project. The project will begin June 21, 2004 a= nd would be done within one hundred days. The wear coat on the road will over-winter before the final coat was laid down.

Mr. Bergeron reported that the Senior’s Annual Strawberry Festival would be held June 26, 2004 from 10am to 2pm. He acknowledged and named the Pelh= am Citizen Corps. Counsel.

Mr. Derby informed that the Budget Committee would mee= t on Monday.

Mr. Danevich provided a status update at the skate park. He said the paving (100= ft.x100ft) had been done at the skate park and thanked all those involved. He said the Hillsborough County= grant had been released and would be picking up the package. The money is due to be awarded in September.

Mr. Lynde said Park & Recreation would meet June 21, 2004.<= span style=3D'mso-spacerun:yes'>

Mr. McDevitt said there was a plan to close the Transf= er Station on July 3= , 2004 based upon Independence Day falling on a Sunday as well as compliance with = the Support Staff Contract. Mr. G= aydos noted if the Transfer Station were to remain open on Saturday, the Town wou= ld be paying employees double time and a half for coverage. There was a brief discussion; Mr. = Gaydos was asked to find out the cost for keeping the Transfer Station open. It was also suggested to adequately notify the public.
