Land Purchase Map 26 &amp; 27 Lot 2-79, Hinds Lane &#8211; Proposal to Purc=

Land for Conservation Purposes<o:p></o:p></u></b></p>

<p class=3DMsoNormal>Conservation Commission Chairman and member of the Open
Space Committee Bob Yarmo met with the Selectmen to discuss the opportunity=
 to
purchase 135 acres (with approximately 8 in <st1:City w:st=3D"on"><st1:place
 w:st=3D"on">Hudson</st1:place></st1:City>) which was believed to be a
significant opportunity for the Town.<span style=3D'mso-spacerun:yes'>&nbsp;
</span>He proposed that the Town purchase the parcel for $780,000 out of the
current use fund (totaling $1,456,529).<span style=3D'mso-spacerun:yes'>&nb=
sp;
</span>He reviewed the Town tax map as well as the Gumpas/Musquash watershed
map to show the location of the parcel.<span style=3D'mso-spacerun:yes'>&nb=
sp;
</span>He said by reviewing the tax map it was difficult to identify the
frontage onto <st1:Street w:st=3D"on"><st1:address w:st=3D"on">Hinds Lane</=
st1:address></st1:Street>,
which they were still working on.<span style=3D'mso-spacerun:yes'>&nbsp;
</span>Mr. Yarmo said West Environmental reviewed the property and indicated
that it was heavily wooded with significant wetlands and the topography sho=
wed
both mild slopes and steep slopes.<span style=3D'mso-spacerun:yes'>&nbsp;
</span>The parcel also has significant timber value.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>An addendum to the West report had=
 been
received (and would be forwarded to the Selectmen) that more accurately
identified the soil types, the amount of wetlands and some of the attribute=
s to
the parcel.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Yarmo said du=
ring
the site walk it was noted there were approximately nine junk cars on the
parcel and there had been significant ATV/monster truck damage, which would
require some restoration.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Bar=
s and
gates had been suggested in the West report.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>He informed that the property abut=
ted
the Gumpas/Musquash area (400-500 acres) and the New England Forestry
Foundation (140 acres) as well as a Town parcel and additional New England
Forestry Foundation parcel.<span style=3D'mso-spacerun:yes'>&nbsp; </span>He
ended by noting that the parcel had the opportunity to provide a significant
wildlife corridor and habitat.<span style=3D'mso-spacerun:yes'>&nbsp; </spa=
n></p>

<p class=3DMsoNormal>Mr. Dave Hennessey, 71 Dutton Road a real estate broke=
r (selling/marketing/real
estate mortgage banking for thirty years) (currently Manager Coldwell Banker
Residential Brokerage Portsmouth) said he set up an automatic feed between
himself and the members of the Conservation Commission and Open Space Commi=
ttee
to notify if a Pelham land listing came in they would receive it; as a resu=
lt,
a listing came in for $940,000.<span style=3D'mso-spacerun:yes'>&nbsp; </sp=
an>He
said they went through the process used to evaluate raw land and went on to

lots that could possibly come from the parcel was approximately was thirty-=

there were multiple offers on the table for the parcel each of which being =

$940,000; however, the person who purchased the property had passed on it a=
fter
discovering the difficulties of developing the land.<span

ss and
the said the Town&#8217;s initial offer had been turned down, so it was
increased to $780,000, which was what the seller was willing to take on the

style=3D'mso-spacerun:yes'>&nbsp;</span></p>

<p class=3DMsoNormal>Mr. Bergeron reviewed the appraisal that indicated the=

were 171.43 acres, not 135 acres as being discussed.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>He wanted to know what happened to=
 the
additional 36 acres.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Henn=
essey
said some of the property had been subdivided.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>He noted that his appraisal was do=
ne
independent of the appraisal provided.<span style=3D'mso-spacerun:yes'>&nbs=

</span>Mr. Bergeron questioned if there was an appraisal on the 135 acres b=

the appraisal and was unsure if the frontages shown were actually there.<sp=

<p class=3DMsoNormal>Ms. Deborah Waters, member of the Open Space Committee=
, met
with the Selectmen to provide an overview of the plan, the Conservation cri=
teria
and how the parcel matched up with the regional and local objectives and
criteria.<span style=3D'mso-spacerun:yes'>&nbsp; </span>She showed a build-=
out
analysis map that showed buildable land as designated by NRPC.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>She also showed a Regional Environ=
mental
Priorities Program (&#8216;REPP&#8217;) map (the program was funded by DES =
and
managed by NRPC) in which conservation commissions were asked to identify k=
ey
parcels they would like to protect.<span style=3D'mso-spacerun:yes'>&nbsp;
</span>She said one of the parcels on the map was the subject parcel being
discussed.<span style=3D'mso-spacerun:yes'>&nbsp; </span><st1:City w:st=3D"=
on"><st1:place
 w:st=3D"on">Hudson</st1:place></st1:City> had also identified their priori=
ty
parcels, one of which is adjacent to the Gumpas/Musquash area.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Ms. Waters provided the Selectmen =
with a
copy of the selection criteria and checklist for open space acquisitions.<s=

style=3D'mso-spacerun:yes'>&nbsp; </span>She then discussed the West
Environmental report which states that the parcel has high value in terms of
environmental advantages.<span style=3D'mso-spacerun:yes'>&nbsp; </span>She=
 also
addressed the future stewardship of the property; West Environmental indica=
ted
there was some timber value.<span style=3D'mso-spacerun:yes'>&nbsp; </span>=
She
had discussions with various folks in state agencies who offer free service=
s and
said they would assist the Town with the stewardship.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>She also noted there was a person =
that
would draft forestry plans at no cost to the Town. </p>

<p class=3DMsoNormal>Mr. Bergeron noted that the Mark Standish appraisal (<=

Month=3D"3" Day=3D"27" Year=3D"2003" w:st=3D"on">March 27, 2003</st1:date>)=
 showed 171
acres, but the Selectmen were being told that there was 135 acres being
purchased.<span style=3D'mso-spacerun:yes'>&nbsp; </span>He questioned wher=
e the
additional acreage was.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Ms. W=
aters said
the 135 acres (127.5 acres in Pelham and 8.3 acres in <st1:City w:st=3D"on"=

 w:st=3D"on">Hudson</st1:place></st1:City>) came from the listing sheet. <s=

ments
and asked if there was concern for the additional 35 acres.<span

be placed under permanent conservation protection; the way it&#8217;s being
acquired under RSA 36,a talks in terms of recreation and wanted to know if
there was a potential for passive recreation.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Ms. Waters said the proposed purch=
ase
and sales agreement had gone to Town Counsel for review, who in turn indica=
ted that
conservation land could not be purchased outside of the Town limits, but the
Selectmen could, if it was used for recreational purposes. <span
style=3D'mso-spacerun:yes'>&nbsp;</span>She said Town Counsel suggested tha=
t it
be written that Conservation would be buying the land within the Town limits
and the Selectmen would buy the land outside of the limits.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. McDevitt asked if the agreement
under which the land was being acquired preclude recreational uses of any
sort.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Ms. Waters said the
Conservation Commission was operating under RSA 36a and suggested that ther=
e be
a clarification of the limits of the RSA.<span style=3D'mso-spacerun:yes'>&=
nbsp;
</span>The piece in <st1:City w:st=3D"on"><st1:place w:st=3D"on">Hudson</st=
1:place></st1:City>
was operating under RSA 35b for use as recreation.<span

(through legal counsel) provide the Selectmen with the difference between R=

35b and 36a with respect to the restrictions of the passive recreation use =

creation
and didn&#8217;t feel there was a question regarding passive recreation.<sp=

ow to
help the health and growth of the forest, which at the same time would gene=

Team (CERT) had established a new counsel which provided Pelham with the
opportunity to have a Medical Reserve Corps. and Volunteers in Police Servi=
ce
(VIPS) as well as more funds.<span style=3D'mso-spacerun:yes'>&nbsp; </span=
>He
said if they went forward and had other programs and citizen involvement a
place would be needed for materials/supplies and training area.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>The current storage trailer was not

</span>Firefighter Hanegan asked the Selectmen if they had any suggestions,=

could help find a location for the team, since it took hard work and three

<p class=3DMsoNormal>Mr. Lynde asked how much area was needed.<span

enough for training as well as office space for the administrator in charge=

needed for additional equipment which would be supplied through grants.<span

Citizen&#8217;s Corps. Counsel and discussed his understanding of the progr=

 the
Town had for such programs.<span style=3D'mso-spacerun:yes'>&nbsp; </span><=

<p class=3DMsoNormal>Firefighter Hanegan noted that there was not a VIPS pr=
ogram
in the state yet, and if formed, Pelham would be the first.<span

people of the CERT program (http://pelham.cert.nh.gov). </p>

the Town to improve, or maintain whatever space was used.<span

facility was established, it could be made into a headquarters for the <st1=

available for maintenance, general repairs as well as other fund some of the

<p class=3DMsoNormal>Mr. McDevitt said the Selectmen had been provided with=

breakdown of what legal fees had been paid by towns.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Pelham committed to $5000 in 2003,=
 which
had been paid; and additional request of $5000 was made in 2004, of which $=
2500
had been committed and paid &#8211; and an additional $2500 would be paid if
there was money (to be determined in July).<span
style=3D'mso-spacerun:yes'>&nbsp; </span>He said Ms. Karen White of the Wat=
er
District said it would be appreciated if the Town saw it fit to pay the
additional $2500 toward the commitment.<span style=3D'mso-spacerun:yes'>&nb=
sp;
</span>The total commitment was $10,000 ($7500 of which had been paid).<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Gaydos understood that commitm=
ents
had been made, but requested holding off until there was a better view of t=
he
budget.</p>

<p class=3DMsoNormal><o:p>&nbsp;</o:p></p>

<p class=3DMsoNormal>Mr. Danevich said if all the towns paid their commitme=
nts
there would be $17,500 generated and noted that there was a $13,900
deficit.<span style=3D'mso-spacerun:yes'>&nbsp; </span>He questioned what w=
ould
be done in the event of a deficit.<span style=3D'mso-spacerun:yes'>&nbsp; <=
/span>Mr.
Bergeron believed there were other expenses not listed.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Danevich asked if there would =
be any
additional requests for funds.<span style=3D'mso-spacerun:yes'>&nbsp; </spa=
n>Mr.
Bergeron didn&#8217;t believe Pelham would be asked for more.<span

Hookset had withdrawn and said that <st1:City w:st=3D"on"><st1:place w:st=
=3D"on">Windham</st1:place></st1:City>
was still involved, but had not paid anything.<span

d back
to the communities.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Berge=
ron
said when <st1:City w:st=3D"on"><st1:place w:st=3D"on">Nashua</st1:place></=
st1:City>
acquires Pennichuck Corp. and its assets, revenue bonds would be applied for
and distributed.<span style=3D'mso-spacerun:yes'>&nbsp; </span>He said if t=

can&#8217;t acquire Pennichuck the towns would be out the money. </p>

acknowledged and signed by employees annually during their review.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Gaydos said the document could=

be paying employees double time and a half for coverage.<span

was asked to find out the cost for keeping the Transfer Station open.<span
