CALL TO ORDER

The Chairman, William McDevitt, opened the meeting at approximately 6:30 pm.

July 27, 2004=

MOTION:=

(Bergeron/Derby) To approve the July 27, 2004 meeting minu= tes as amended.<= /p>

The amendments to the minutes were as follows: page 2= , 6^th paragraph - the following ‘…the presented plan (25,000 gallon)’ shall be amended to read ‘the presented plan (2500 gallon)’; page 3 Budget Review – the word ‘the’ was deleted.

NON-PUBLI= C SESSION – Hiring an Assistant Assessor

Mr. McDevitt said the Selectmen had placed an adverti= sement and had a number of people apply for the position. The Selectmen did not enter into a non-public session, but instead made the following motion:

(Bergeron/Derby) To hire Ms. Anne Susan Snide as th= e Town of Pelham Assessing Assista= nt effective immediately subject to the standard probationary period.

Hiring Po= licy

Mr. McDevitt said the Selectmen had a previous discus= sion regarding a Hiring Policy. He wanted to know if further action could be delayed until additional Board members were present. Mr. Ga= ydos noted that there was another Police Officer who was ready to be hired, pen= ding a decision. Mr. Bergeron fel= t the policy was okay as composed. The Selectmen decided to wait to make a decision regarding the policy until additional Board members were present.&nb= sp;

Transfer = Station Free Speech

Mr. McDevitt said the Selectmen discussed at their la= st meeting the use of the Transfer Station for free speech.

Mr. Lynde arrived.

He felt the policy was fairly restrictive and therefo= re drafted a proposed policy that would be less restrictive. He read the proposed policy aloud= . (see ATTACHMENT ‘A’)

(Lynde/Bergeron) To adopt the proposed policy (ATTA= CHMENT ‘A’) effective immediately.=

Fire Stat= ion Study Committee – Membership cap

Mr. McDevitt said a letter had been received from the= Fire Chief relative to the Fire Station Study Committee. It was noted that there were two applicants pending for the committee.&nbs= p; The Fire Chief requested that any new applications be held until the Fire Station Study Committee held its organizational meeting. There was no objection by the Sel= ectmen to keep the two applicant’s names on a list until such time that additional people were needed for the committee.

Receiving= Gifts – Jr. Leader Program Fund

Mr. Gaydos said the Jr. Leader Program was part of the Summer Camp program (comprised of Town residents 13 -15 years old) who ass= isted the camp in various capacities and received community service hours. The Jr. Leaders are not paid, but traditionally rewarded with a trip at the end of the season paid for throu= gh funds raised. Mr. Gaydos sai= d the funds usually went through the FRIP account, however this account is now inactive and the Jr. Leaders need a legitimate agency to accept and disbur= se the funds. He recommended th= at the Selectmen (who had the authority to accept and disburse through a public hearing) allow the Jr. Leaders to raise the funds and pass them to the Treasurer until a public hearing was held to allow disbursement of the funds.

There was a brief discussion regarding Mr. GaydosR= 17; recommendation and clarification how the funds fell under the Town gift po= licy.

(Lynde/Derby) To approve the process (of funds rais= ed by Jr. Leaders to be held by Town Treasurer) with the understanding that a public hearing would be held to disburse such funds.

Audit Dis= cussion – Operating Control Procedures

Mr. McDevitt said he previously mentioned to the Sele= ctmen of his concern that the Town didn’t have good control over the way c= ash is handled. He said he quest= ioned if additional money could be paid (to the Municipal auditor) to have this = aspect further reviewed. Mr. Gaydos= came up with a no-cost solution. = He said the Town’s insurance company offered a program where they would pay = to have a consultant come in and review the Town’s operation and provide awareness to current and future situations.

Mr. Lynde asked if the Town could have the services t= his year. Mr. Gaydos said arrang= ements would be made to have the services by the end of the year.

There was no objection by the Selectmen to have Mr. G= aydos proceed.

Request t= o use Municipal Property during Old Home Day

Mr. McDevitt said correspondence had been received fr= om the Assistant Pastor Eric Craven of the Crossroads Baptist Church requesting use of Municipal property during Old Home Day. The request was to film a tribute= to Pelham soldiers given the fact that Old Home Day would be held September 1= 1^th and send it to the men and women. Mr. McDevitt felt the request should be forwarded to the Police and= Fire Department as done last year.

Fire Depa= rtment Resignation

Fire Chief E. David Fisher received a resignation let= ter from Father Edward Richard, Chaplain who forwarded it to the Selectmen for acceptance.

Budget Re= view

Health Offic= er – Town Meeting appropriation for 2004 was $4100. The request for 2005 $4250.

Treasurer &#= 8211; Town Meeting appropriation for 2004 was $7500.= The request for 2005 $7500.

Trust Funds = – Town Meeting appropriation for 2004 was $2040.= The request for 2005 $95.

APPOINTME= NT(S)

Pelham-Wi= ndham Cooperative Planning Committee

Mr. Bob Turnquist, Mr. Al Letizio, Ms. Diane Carpente= r, Mr. Richard Resmini and Ms. Jean Morrow members of the Pelham-Windham Cooperat= ive Planning Committee (‘PWCPC’) met with the Selectmen to provide informat= ion regarding the cost comparison of a Pelham only, versus a Pelham-Windham cooperative school; also to review possible curriculum expansion. It was noted that during the prev= ious meeting between the PWCPC and the Selectmen that there three possible opti= ons: 1) New Pelham High School on new site; 2) Co-op high school with Windham; and 3) = Renovate existing Pelham High School. However, the Pelham School Board = had recently made a decision after many discussions to not pursue the third option.

Following is a list of the Attachments which the PWCPC handed out and reviewed in detail:

ATTACHMENT #1 (6 pages) – Presentation to Pelham Board of Selectmen – August 3, 2004 <= /i>: contained the options being recommended, Team Design Study cost savings (w= hich include inflation adjustments), facility principal cost savings with co-op, bond savings with co-op, chart showing projected costs including inflation= .

ATTACHMENT #2 (1 page) – Pelham/Windham Cooperative High School – Cost Work Sheet: provided an interpretation/recommendation square footage per student and total proj= ected cost assuming today’s cost; additional breakdown showing the project= ed cost with an additional 5% a= ssuming the bid award date was March 2006.

ATTACHMENT #3 (3 pages)– Pelham/Windham Coop High School Presentation of Cost Comparisons – August 3, 2004: shows number of classrooms and the square feet= for each; breakdown of projected increase of enrollment and square feet per st= udent at build out.

ATTACHMENT #4 (3 pages) – Summary of costs and savings - shows contributions for Pelham= only compared to coop over a twenty year bond.

ATTACHMENT #5 (11 pages) – August 3, 2004: shows current Pelham High School curriculum of required courses and electives; Pelham High School TEACH Committee recommendations for curriculum of required courses, electives and expansio= n of curriculum from 2005 through 2010; Pelham/Windham Coop Planning Board suggestion for curriculum of required courses and electives.

The Pelham Deliberative Session will be held August 16, 2004, 7pm at Pelham Elementary = School. The Windham Deliberative Session = will be held August 17,= 2004 at Center School. Election Day will be September 14, 2004.

Budget Re= view Con’t…

Cable Televis= ion – Town Meeting appropriation for 2004 was $53,822. The request for 2005 $57,049. It was noted that the Cable Budge= t was funded in part by franchise fees paid by Adelphia.

Police Depar= tment – Town Meeting appropriation for 2004 was $1,768,816. The request for 2005 $2,000,680.<= span style=3D'mso-spacerun:yes'> Police Chief Evan Haglund informe= d that the Police Department would be restructured to include a Captain position = (from an internal promotion) additional personnel is not being requested.

Each line item in the budget was reviewed by the Sele= ctmen. There was a brief discussion rega= rding cruisers and if they should be included in the budget or submitted as a wa= rrant article. Mr. Gaydos recommen= ded placing the cruisers in the budget not only because the new law in affect = (if a warrant article is defeated the Selectmen could not purchase), but also be= cause of the health and safety issues. Chief Haglund discussed the cost savings in maintenance due to the purchase of t= he cruisers. It was noted that = when cruisers were retired, they were still utilized in other departments in Town. The Selectmen agreed, = and the following motion was made:

TOWN ADMINISTRATOR’S REPORT / SELECTMEN’S REPORTS

Mr. Gaydos informed that the Recreation Department re= cently had its water tested at Veteran’s Memorial Park and found that the w= ater quality results for drinking water and beach came back as ‘excellent’.

Mr. Bergeron read a memo aloud from the Cemetery Depa= rtment; the Board of Trustees had agreed upon the following fee schedule that woul= d be effective September 1, 2004 for all cemeteries in Pelham (resident fee lis= ted first/non-resident fee listed second): single grave lot $400/$1000; two gr= ave lot $800/$2000; three grave lot $1200/$3000; four grave lot $1600/$4000; cremation lot $200/$400; Veteran’s section opening fee $100; regular= opening fee $500/$500; baby opening fee $200/$200; cremation opening fee $250/$250= ; extra winter opening fee $300/$300; Saturday/Sunday/extra overtime $400/$400.

Mr. Derby had no report.

Mr. Lynde had no report.
