May 10, 2005

The Selectmen began review and decided to defer the de= cision until the next meeting because a vote by three attending members of the May= 10^th meeting was needed for such decision. Mr. Gleason provided suggested amendments which would be forwarded to the Selectmen for review at the next meeting.

OPEN FORUM=

Ms. Deborah Waters representing the Little Island Pond Watershed informed that the Opening Ceremony for the Little Island Pond Con= servation Area was held and had good attendance.&nbs= p; She noted that the Governor presented a commendation which will be displayed (along with photographs) in the lobby of the Town Hall.

Jean-Guy̵= 7;s Used Cars & Parts, Inc., 180 Marsh Road, Pelham, NH 03076

Mr. Gaydos informed that Mr. Jean-Guy Bergeron operates Jean-Guy’s Used Cars & Parts, Inc. at 180 Marsh Road and had filled out a complete application and was inspected by the various departments that deal with such inspections. He sai= d the Pelham Fire Department on March 29, 2005 inspected the property and felt it complied with the applicable codes and standards. The only note was that two fire extinguishers were overlooked from last year’s service, but had been brought into compliance. Mr. Gaydos said Health Officer Paul Zarnowski submitted a letter that indicated he inspected the property and f= elt there had been great improvements regarding the runoff and erosion control = on the site. It was noted that v= acuum systems had been implemented for the extraction of fluids from vehicles resulting in no uncontrollable spillages; this system was demonstrated for = Mr. Zarnowski. A point of entry filtration system for the water supply had been put in place, current testi= ng for the water supply had been received and appeared to be within acceptable limits. Building/Code Inspect= or Roland Soucy indicated he had inspected the property and recommended that t= he current licenses be renewed. = Mr. Gaydos said a letter had been received by Weston Solutions, Inc. who was wo= rking on behalf on the Department of Environmental Services (‘DES’).<= span style=3D'mso-spacerun:yes'> The report was lengthy and the conclusion indicated that a number of water supply wells where MtBE was fou= nd to meet or exceed the requirements had decreased over the last year from 9 = in March, 2004, to 6 in July, 2004 to 5 during this sampling effort in Novembe= r, 2004. Overall Weston Solution= s wanted to continue the sampling. Mr. Gaydos said based on the Town inspector’s reports and the conclusions from the State don’t indicate any obstacles to the renewal of the license.

Mr. Domenico noted that the Weston report indicated th= ey were unable to collect samples from nine residences due to resident coordination issues. Mr. Gayd= os said historically, there had always been a certain percent of households th= at weren’t available when the testers came. He said overall if there was a pro= blem in a household, they would make several attempts to come back.

Mr. Danevich said he liked the inclusion of the checkl= ist supplied by the Fire Department.

Mr. Ray Belleville, 176 Marsh Road, who abutted Jean-Guy’s Used Cars & Parts opposed the issuance of a full year license. He said he was in co= ntact with Weston Solutions and inquired about the well readings, the response he received was that Mr. Bergeron wouldn’t allow them on his property and would hire his own firm. He s= aid he then contacted the DES who informed that one well read 1450 parts of MtBE.<= span style=3D'mso-spacerun:yes'> He said he noticed since the Sprin= g that his readings had increased and was now over the 13 parts per billion safety standard set by the state. Mr. Belleville said Mr. Bergeron had been brought to court and was found guilty= of negligence in the operation of the junkyard. He said on the first day of court = Mr. Bergeron’s business was visited and there was nothing parked in front= of the gates, however there were now two transport trucks parked outside the gates. Mr. Belleville didn= 217;t feel a full license should be granted until the entire matter was cleaned.<= span style=3D'mso-spacerun:yes'> He said his land was contaminated = and his house value had decreased. He= said when asked in court, Mr. Bergeron said he didn’t know where the contamination came from. He s= aid the 1450 parts per billion would eventually seep into his well because he w= as downhill from Mr. Bergeron.

Mr. Jean-Guy Bergeron of Jean-Guy’s Used Cars &a= mp; Parts, Inc., 180 Marsh Roa= d, said he hired Nobis to test t= he one well in his home and two wells on his business property. He believed one well currently rea= d .02 and two were .08 which was like not having MtBE. He said there were six or seven we= lls drilled just above bedrock; one of which was removed (along with soil) that= had low numbers, however after it was done, the numbers skyrocketed. Mr. Bergeron said while the case w= as in court it was found out that Weston Solutions (and Mr. Ricker) were making an agreement to also be hired by opposing counsel to testify against him. He said he asked the state if he c= ould hire someone other than Weston Solutions (Mr. Ricker) to do work at his facility and the state agreed; therefore, Mr. Bergeron hired Nobis who was currently doing the testing. =

Mr. Bergeron discussed the manner in which water was b= eing pumped and disbursed above bedrock on his property. He said in bedrock, water could co= me from just about anywhere. He = noted that the court case was being appealed in the Supreme Court.

Mr. Danevich questioned if trucks were being parked ou= tside the fence after business hours. Mr. Bergeron said in 1986 Pelham took Jean-Guy’s Used Cars & Parts to court and said it was the opinion of the justice that he was allowed to do = what he was doing at the facility. He said the ruling was public record. Mr. Danevich asked if there was any objection to keeping the trucks behind the fence. Mr. Bergeron noted that the two trucks in question were for sale and didn’t expect they would be there for long. Mr. Danevich asked if Mr. Bergeron would be amenable to keeping the trucks behi= nd the fence to keep up the appearance of the residential area. Mr. Bergeron agreed to move the two vehicles in question.

Mr. Gleason questioned who contracted Weston Solutions= and if they were acting in the capacity of a state appointed agency. Mr. Bergeron said Weston worked fo= r the state and as of last year they worked for both the state and Mr. Belleville= ’s counsel. Mr. Gleason asked if= the state documented (and informed Weston of their approval) their approval to = have someone else test Mr. Bergeron’s site. Mr. Bergeron said Ms. Sara Kirn wa= s the DES coordinator for the area and believed there were two or three companies that did similar work for the state. Mr. Gleason said if access was denied to Weston, they couldn’t have done a thorough review of the property. Mr. Bergeron said the Board didn&#= 8217;t have the numbers for his three wells, but indicated he didn’t have MtBE. Mr. Gleason said the lack of evide= nce was a missing piece of the puzzle. Mr. Gaydos noted it was normal to be behind and pointed out that the information being reviewed was from November, 2004 and the information from= the tests taken in 2005 wouldn’t be available until June or July, 2005. He said the Selectmen would see the report when it was produced at which time the state would pass judgment and= the Selectmen had the right to suspend licensing and hold a set of hearings per= the Health Ordinance.

Mr. Domenico asked if there were monitoring wells on M= r. Bergeron’s property. Mr. Bergeron believed there were seven monitoring wells (15ft.-20ft. deep) above bedrock (close to his septic system) and three artesian wells. Mr. Domenico questioned who was responsible for remediation if contamination was found in surrounding wells. Mr. Bergeron said if contamination was above 13 parts per billion the state would notify the per= son and provide bottled water until a filtration system could be installed. The state funds the effort. Mr. Bergeron said he chose to pay = for his own systems which were checked every three months.

Mr. Gleason questioned if vehicles other than the two vehicles (for sale) mentioned earlier would be parked in front of the fence. Mr. Bergeron said the = 1986 court ruling allowed retail vehicles to be in front.

Mr. Belleville discussed the bedrock wells and said on= e of which had a reading of 7000 parts of MtBE, which he believed Mr. Bergeron w= as upset by this and didn’t want Weston conducting the tests. He said his home was still highly contaminated and would take years to settle. He felt a temporary license was al= right and wanted Mr. Bergeron to take responsibility. Mr. Gleason questioned what Mr. Belleville wanted Mr. Bergeron to do. Mr. Belleville said Mr. Bergeron was doing some things. He said Mr. Bergeron still wouldn’t admit the MtBE came from his property. He said the property was cleaned u= p when the court reviewed the site and wanted it kept like that all the time.

Mr. Bergeron discussed the 7000 number. He said there was a well that was removed (along with 3 or 4 loads of material in a ten-wheeler) that had low numbers, and when they were done, the numbers were high. He said recently, after he hired N= obis the monitoring wells were reviewed and found to have broken pieces. He paid to have extensions put on = with covers and locks to ensure the tests were conducted properly. He said he was doing everything he= could to comply.

Mr. Danevich summarized that the Selectmen had a compl= eted application; all criteria with the Fire Department inspection had been met = and was recommended for renewal; the Health Inspector had conducted his inspection and recomm= ended renewal; the Building/Code Inspector had reviewed and recommended renewal; Weston had completed a partial review of the property and noted the situati= on had improved (by the state implemented program) over the last twelve months. Mr. Danevich said the ordinance allowed three courses of action: 1) approve; 2) deny; or 3) grant= a 90-day license. Mr. Gaydos discussed the regulations regarding the 90-day license and said the Board w= ould have to be specific regarding what items had to be addressed including crit= eria for such. It was noted if the Selectmen renewed a license and obtained data at a later date they would ha= ve the right to re-open the application.

Mr. Domenico wanted the opportunity to review the 1986 justice ruling as well as obtain the on-site test results for both the moni= toring and artesian wells. Mr. Gleas= on said he had three concerns: 1) new analysis; 2) 1986 analysis; and 3) data = from the well removed.

Mr. Gaydos suggested that Mr. Gleason and Mr. Domenico= have a conference with Ms. Sara Kirn of the&nbs= p; DES to guide them through the reports. Mr. Gleason wanted to ensure due diligence and preferred information in writing. Mr. Gaydos said he would try to se= t up a meeting prior to the next Selectmen meeting.

The Selectmen continued the hearing to the May 24, 2005 me= eting.

Jack Mansur&#= 8217;s Auto, 76 Dutton Road, Pelham, NH 03076

Mr. Gaydos said an application had been received from = Jack Mansur’s Auto of 76 Dutton Road, Pelham, NH. He said a full junkyard license isn’t provided, however there was a consent decree of 1997 entered in= to which contained nine items reviewed by the inspectors. He said the certified plot plan ha= d been provided to the Town, however he would have to locate it. Mr. Gaydos said the Fire Department conducted an inspection on April 7, 2005 and discussed the items needing compliance; the Fire inspector returned to the site on May 9, 2005 and had indicated the items were complied with. Health Inspector Paul Zarnowski indicated that the site appeared to be more organized than in previous years. The Building/= Code Inspector Roland Soucy had reviewed the property and recommended the renewa= l of the current licenses.

Mr. Gleason recalled an e-mail forwarded to the Select= men by an abutter who expressed some concern.&nbs= p; Mr. Gaydos handed out a copy of the e-mail to the Selectmen for review. He said an owner who resided in the area wanted to request some solution to extreme runoff from = the site, down Dutton Road and ultimately into Little Island Pond.&nb= sp; The resident indicated in the past the runoff was captured by a retention pond however it no longer occurred. The resident requested water testi= ng both on the site and across the road for MtBE and other petrol chemicals. Mr. Gaydos said Mr. Zarnowski didn’t see any soils or indication of spills on the property. He said the state normally reviewe= d the information and felt they would probably pick it up. He said the runoff situation would= be reviewed by Highway Road Agent Don Foss and through compliance with the Fed= eral Storm Water Runoff and Drainage program the Town was mandated to be part of. Mr. Gleason asked Mr. Jack Mansur of Jack Mansur’s Auto if he would work with the Town to address any runoff issues. Mr. Mansur answered yes. He said the Gre= en Yard program would also address such.

Mr. Mansur discussed the Green Yard program which work= ed with recyclers and provided help/information to businesses regarding how to= run safely and properly recycle. = Mr. Gaydos said Green Yards was a program set up by the state in conjunction wi= th the federal government. It is= a volunteer program that helps correct the practices of recyclers.

Mr. Gleason said there were three problems that had to= be addressed the first being the runoff situation. Mr. Gaydos said as part of the Fed= eral Storm Water Protection Act the Town had to address and assess problems; this area would be included. Mr. G= leason said the second issue was the abutter’s request for ground water test= ing on site and across the road. = Mr. Gaydos said the Town would speak with the state under Green Yard who they w= ould assess it and determine if there was evidence leading them to believe there should be testing. Mr. Gleason asked if there had been an increase in the number of employees. Mr. Mr. Mansur said there had been= no increase.

Mr. Domenico questioned if Mr. Mansur had a vacuum sys= tem like Mr. Bergeron’s. Mr. Mansur answered yes and mentioned he had a gas buggy.

There was no public input.

Mr. Danevich said the Selectmen had three options: 1) approve the renewal; 2) deny the renewal; or 3) grant a 90-day license (with explicit reasons for compliance). Mr. Gleason said he would be willing to grant the license with the condition that the Town would make sure that the two abutter concerns were cleared relative to the runoff and water testing.

(Gleason/Domenico) To approve the renewal request effective as of April 1, 2005 and expiring March 31, 2006, with the condition that the Town assumes responsibility clearing the two abutter concerns: 1) runoff,= and 2) water testing.<= /u>

OTHER BUSI= NESS

Citizen Co= rps – Approval of Agreement

Mr. Gaydos said that the Citizen Corps worked with Mr. Bergeron a few weeks ago. Mr. Bergeron said he had proposed the acceptance of the grant and the Selectmen= had some questions. Mr. Danevich = asked that the Fire Chief provide a description of what the Citizen Corps was.

Fire Chief E. David Fisher explained that C.E.R.T. sto= od for Citizens Emergency Response Team funded by the Federal Government (through Homeland Security). He said C= ERT was a volunteer program made up of citizens that would assist the Town̵= 7;s emergency response in the event of a disaster. He informed that Pelham’s CE= RT was one of the top in the area for participation, innovation and aggressiveness= to have the program up and going. He strongly recommended that the Selectmen consider the grant. Chief Fisher said at this point the money was already set aside for Pelham and once the grant was signed it wou= ld immediately be given. If the = grant is not signed, the money would go to another town. The grant is broken down dollar for dollar. The original request = was for $60,000, however the grant was cut to $16,756 which would be a start in= the process. Chief Fisher said th= ere were ‘no strings attached’, the Town would not have to pay a portion of the grant and there were no guarantees to the state or federal government. The only thing th= at is asked is that an area be provided to store equipment and set up an of= fice, the money for which would be provided by the government. Chief Fisher said it was asked tha= t an elected government representative Chair the Counsel and sign the documents.=

Mr. Gleason asked if the money (expenditure) was subje= ct to audit. Chief Fisher answered yes. Mr. Gleason asked who the administrative help would be. Chief Fisher said a council was in = place and would decide regarding who would fill the secretary position. Mr. Gleason asked who would be in control of the computer equipment. Chief Fisher said it would be under control of a locked building. The equipment would be assigned to= a specific person. Mr. Danevich= said when grant money was provided for an item, it could only be used for that particular item. He noted tha= t the items would be outside of the Town’s Technology Plan and against the grant to use it for administrative purposes.

Mr. Domenico confirmed that anything procured by the g= rant would be used to increase emergency capabilities as opposed to enhancing existing service or equipment in that we would be in compliance with the non-supplanting amendment included in the agreement. Chief Fisher answered yes.

(Domenico/Gleason) To authorize Mr. Bergeron to sign= the grant and accept the funds for the Pelham CERT program.

Fire Chief Fisher said the Fire Department had applied= for a Federal Storm Grant and were notified that approximately $31,000 would be recovered for the snow storm in January, 2005. He also informed that the governme= nt had increased Federal Storm Grant funds to Hillsborough County= for the March, 2005 storm. An application for those funds would be filed. He questioned if the recovery money could be put back into the accounts. Mr. Gaydos said the Town spoke with the Department of Revenue Administration (‘DRA’) who indicated this was a reimbursement to the Town. It’s the DRA’s opinion that the funds should be considered as general revenue = to the Town, however if the Town needed to raise additional funds (because the cost of the incident put the Town behind in their budgets) they could petit= ion for a special town meeting. M= r. Gleason confirmed that the funds would go into the general account, and questioned if in the event a special election was considered the money coul= d be recovered as a budget line item. Mr. Gaydos answered yes; the Town’s people could always appropriate the money. Mr. Gl= eason said the money would be appropriated with the full knowledge that the money existed in the general account so it would be a no tax impact item. Mr. Gaydos answered yes.

Mr. Danevich asked if the money would have to go throu= gh town process to move it back to the Highway Department to complete programs. Mr. Gaydos said if additional funds were to be raised it would have to go through town vote. Mr. Danevich questioned if the gra= nt money could be allocated to repair the Highway Department’s truck that was currently out of service. Mr. Gaydos said the Selectmen could choose to ask the taxpayers to repair the truck, however the Selectmen should discuss the vehicle given its age. Mr. Danevich said in working with a default budget, funds were moved from the Highway Department and questioned= how those funds could be restored. Mr. Gaydos said the Selectmen could either find the money elsewhere in the budg= et, or ask the Town’s people.

Location o= f CERT program

Mr. Gaydos said he had some conversations with the Fire Chief and the CERT group regarding the usage of the second floor in the Old Town Hall. He said it was apparent through his discussions with representatives= of the VFW that they wanted to have complete control of the building. It was becoming more and more diff= icult for CERT to have a secured area. Mr. Gaydos said at this time the second floor at the Annex was avail= able and seemed to be an ideal location. There would be some additional grant funds available to offset certa= in services (i.e. telephone, computer). Mr. Gaydos asked that the Selectmen allow CERT to completely move ou= t of the Old <= st1:PlaceType w:st=3D"on">Town Hall and into the second floo= r of the Annex. Mr. Gleason was agreeable to the move, provided that there was no expenditure of funds to refurnish the building or make any repairs to accommodate them. He didn’t want any CERT money going into repairing the building since there hasn’t been a determina= tion regarding the disposition of the building.= Mr. Danevich said there may possibly be maintenance of operation, bu= t no construction. Mr. Gleason was= fine with that. Mr. Gaydos said th= ere would be discussions regarding who would assume what costs. He said there would be no lease agreement; there would just be an agreement that CERT would occupy and have sole custody of the space. He= said with the Selectmen’s approval and agreement would be drafted. Mr. Gaydos noted that there were s= till certain items that would have to be moved out of the space. It was desired to have CERT move a= s soon as possible.

Mr. Gleason reiterated Mr. Domenico’s comment th= at the expenditure of CERT’s money should not be used to enhance current Town operations or facilities.

The Fire Chief understood that the use of the Annex was temporary. As the program gre= w they would settle into a permanent space. Mr. Danevich noted CERT was a direct benefit to the Town.

(Gleason/Domenico) To authorize moving the CERT prog= ram from the second floor of the Old Town Hall to the = second floor of the Annex in a temporary capacity.

Update/Dis= cussion & Possible Vote Re: Revaluation

Mr. Gaydos said it was clear at the last meeting that additional data was needed before any decision could be made. He said the place to start was to = speak with those companies interested in completing the revaluation. He and Mr. Gleason met with a tota= l of four companies. Mr. Gleason s= aid all four companies agreed to beginning in September, 2005 and completing by= October 31, 2006, thereby meeting the contractual obligations for cost and for schedule. Confirmation letters will be sent = to the Town with the understanding t= hat the Town would not sign a contract until possibly September.

Update/Dis= cussion & Possible Vote Re: Special Town Meeting

Mr. Danevich believed there was a concurrence by the Selectmen that there was a need to move forward with a Special Town Meeting. He said the Departme= nt of Revenue Administration (‘DRA’) provided a compelling argument t= hat the Town must comply and come up with funding to maintain control.

There was a discussion regarding when a Special Town M= eeting would be feasible to be held. Mr. Gaydos will present specific dates to the Selectmen at the next meeting. Mr. Danevich said the Selectmen ne= eded to decide what would be include in the Special Meeting.

(Gleason/Bergeron) To begin preparations for a Speci= al Town Meeting for late August, 2005 to early September, 2005.

There was a brief discussion regarding getting a random sample opinion from the residents if they were receptive to holding a Speci= al meeting to fund the revaluation. Mr. Gaydos said he would ‘float’ some ideas.

VFW - Aven= ue of Flags

Mr. Danevich said based upon the minutes from the last Selectmen meeting, it was not clear if the Selectmen would be supporting th= e $1000 effort for the Avenue of Flags. Mr. Gaydos found through his research the $1000 appropriation was only containe= d in the 2004 default budget. He s= aid he spoke with the Cemetery Department and there were no funds there. He said the Selectmen had to decid= e if they would release the money. Mr. Gleason believed the American Legion was to come back and define the actual costs needed, rather than a general $1000 number. Mr. Danevich said a couple residen= ts had approached him and reminded him that the Town doesn’t ‘hand out checks’ but rather gives reimbursements that are auditable (i.e. Razorbacks). The Selectmen wa= nted to know the number of flags and the associated costs. Mr. Danevich said the item would be ‘tabled’ until the VFW contacted the Selectmen to be placed on = the agenda.

TOWN ADMINISTRATOR’S REPORT / SELECTMEN’S REPORTS=

Mr. Gaydos said he spoke with Transfer Station Superintendent Bruce Mason regarding a company coming to Pelham to set up a collection station (for a fee) in early September, 2005. He said Mr. Mason had already star= ted the flier distribution and advertising on PTV.

Relative to the transfer of the Old Town Hall to the VFW, Mr. Gaydos provided a description = of the items remaining at the Ol= d Town Hall that woul= d need to be moved. He also said the Selectmen should review options regarding the Old Town Hall sign and where it should be located.

Mr. Domenico said CIP met last week and reviewed the r= esults from the Town Meeting. A date= has been scheduled (May 26, 2005) to tour the Town and school buildings. He would like to h= old a meeting with CIP and the Selectmen once the Department Heads had the opportunity to meet with CIP and discuss their needs. Mr. Domenico said the work on the revaluation website was virtually complete and would be publicly accessible once the Selectmen had the opportunity review.

Mr. Bergeron said he was unable to attend the last Sel= ectmen meeting because he was invited to attend a meeting in Londonderry (by the Pelham School Board) to discuss House Bill 616. He discussed who attended and what= was discussed. He said there was = also a meeting on May 1= 2, 2005 held by the Senate Finance Committee to give those opposing HB 616 an opportunity to speak. He said= noted who testified and said a lot of the communities in the southern tier were b= eing affected. Mr. Bergeron said he spoke with Mr. Steve Williams of NRPC and was given an invitation (along wi= th the other Selectmen) to an Economic Development Forum and would be attending. He informed that t= he Merrimack Valley Water District would be holding their next meeting May 19, 2005 and he would be = in attendance.

Mr. Gleason said the DRA should be made aware that the Selectmen were proceeding with a special meeting.

Mr. Danevich informed that the Skate Park Committee me= t last Friday and noted that the project was nearing completion. The opening ceremony for the Skate Park was scheduled for June 11, 2005 at 9:30am. He said the Pelham Police Relief B= ike Rodeo would also be held June 11, 2005 at 10am= – 1pm.

Mr. Gaydos provided the Selectmen with a brief outline= of the Coupon Program discussed by Mr. Mason at the last meeting. He has asked Mr. Mason to review t= he actual coupon and how the program would function.
