Ms. Emily Lamport addressed the Selectmen on behalf o= f the forty children who live at Stonepost Village. She discussed the negative change= s that would occur if the cul-de-sac was removed.

Mr. Danevich said the plan had not yet been submitted= and noted that the Selectmen had no authority at this point, other than discussion. He said the purp= ose for the site walk would be for ‘fact-finding’. Mr. Torra questioned if the site = walk should wait for a formal application.&nbs= p; Mr. Danevich said the interest also involved the weather and he wou= ld rather observe the site prior to the winter (and snow on the ground). Mr. Gaydos said he had previously outlined the process (contained in RSA 231) for road layout and believed that’s where the discussion began.&= nbsp; He assured the residents that there would be plenty of opportunity = for the public to speak. Mr. Dom= enico noted that there were strict timelines that had to be followed once a plan= was officially submitted; a plan might not be able to be delayed if it was submitted in the winter. Mr.= Torra questioned what the point was for discussing the site if a plan had not yet been submitted. Mr. Danevich= said he was unfamiliar with the parcel and was interested in the land in connec= tion with the Town’s Master Plan. Mr. Lynde said the RSA laid out a clear set of procedures that would have to be followed. Mr. Gay= dos said a petition had been received. Mr. Torra didn’t feel it was the job of the Selectmen to make= an engineer’s job easier and felt if two separate plans had to be submi= tted, they should be.

Bryan Christiansen, Comcast Cable Presentation

Mr. Bryan Christiansen (Manager of Government and Com= munity Relations for Comcast in New Hampshire) and Mr. Rob Travers (Interim Direc= tor of Government & Community Relations, New England North) met with the Selectmen and provided an overview of the transition of the Adelphia cable system to Comcast and Time Warner (if appro= ved) under court approved bankruptcy proceedings

Mr. Danevich wanted to know if the Adelphia contract = would be assumed by Comcast as-is. Mr. Travers said Comcast would assume the contract as-is and would meet all the obligations contained therein. Mr. Danevich asked if there would be any change in the services/channels provided. Mr. Travers said a= t this point under the bankruptcy proceedings they were limited to what they could discuss regarding future plans. He discussed the AT&T acquisition and the fact that they had added servic= es to those people after the acquisition. Mr. Danevich asked if there would be any rate changes and if consideration was being given to closing offices. Mr. Travers said there was nothin= g in the deal that would require/suggest that there would be any changes in rates. He said Comcast would= abide by any obligations in the license and noted there was a customer service o= ffice in Nashua. Mr. Danevich asked how high-speed internet would be handled. M= r. Travers said they currently had some outsourced agents, but were in the pr= ocess of bringing it in-house. Mr. Danevich asked if Comcast was able to handle small business use versus just residential. Mr. Travers sai= d they had people on call 24-hours a day and expected that would continue.

Mr. Lynde asked for an explanation between Comcast an= d Time Warner. Mr. Travers said Time Warner was purchasing the Adelphia systems along with Comcast, and most of= the New Hampshire s= ystems would be transferred through an exchange agreement to Comcast; ultimately Comcast would be the operator of the system.

Mr. Gleason wanted to know if it was procedure to make systems compatible with Comcast’s other systems and questioned if Pelham’s system would be problematic in any respect. Mr. Travers said at this point th= ey haven’t been able to go into that type of detail. Mr. Gleason asked if Pelham could= expect comparable service as that in surrounding communities. Mr. Travers expected after the de= al there would be.

Mr. Bergeron questioned when the change would happen.= Mr. Travers said the plan was for= the deal to close in the first quarter of 2006; however, it was subject to the bankruptcy court.

Mr. Lynde asked what Comcast’s feelings were re= garding PEG access. Mr. Travers said Comcast supported public access in many forms. Mr. Lynde asked if the Town would= have to sign something. Mr. Trave= rs said they had a resolution (explaining the two-step process) (form 394) that the Board would have to sign by October 12, 2005. If the resolution was not signed, it would still be deemed approved by default.

Mr. Danevich asked what differences a typical residen= t would notice. Mr. Travers believed= after Comcast was operating for a period of time, the Town could review what ser= vices the surrounding communities had; the environment is competitive. Mr. Danevich questioned if Comcast provided any service/assistance to the public access system. Mr. Travers said Comcast could me= et with the Town’s advisory committee as needed.

Mr. Gaydos was asked to provide the Selectmen with th= e form 394 for review and place an agenda item on the October 4, 2005 meeting.

Mr. Lynde noted that Adelphia had recently done a re-= build of the Town’s network and wanted to know if Comcast saw the need for further upgrades. Mr. Traver= s said they had not as of yet done due diligence on the plan; in the future they = would review further and upgrade if necessary.&= nbsp;

The Selectmen thanked the gentlemen for meeting with = the Selectmen.

Fire Depa= rtment Chief David Fisher, Ambulance Purchase

Fire Department Chief David Fisher and Lieutenant Rob= ert Chatel (EMS Coordinator) met with the Selectmen to discuss refurbishing an ambulance. Chief Fisher expl= ained that through a Capital Reserve line item money had been put away so in the event a new ambulance needed to be purchased the money would be available.= He said three ambulances had been purchased in that fashion. H= e said the last time an ambulance was purchased he explained that in the future, = the box could be lifted out (replacing any damages with the box update wiring/tubing), the chassis could be removed and the box could be placed o= n a new chassis at approximately half the cost of a new ambulance. He noted that the current cost fo= r a new ambulance was approximately $130,000; he proposed to have a contract signe= d to refurbish Ambulance 2 (1994) at a total cost of $77,000. The chassis and cab if paid in ad= vance would have a $1000 cost savings. C= hief Fisher said they had gone out to bid (received three) and chosen the lowest bidder; the initial commitment would be for $32,543 which would cover the chassis. He asked that the Selectmen vote to allow the vehicle to go out and be refurbished. Mr. Gaydos said the total cost wo= uld be $70,436. He noted that the c= urrent balance of the Trust Fund was $100,871 of which $80,000 was available (due= to warrant article wording).

Mr. Domenico asked how long the ambulance would be ou= t of service. Chief Fisher said i= t was expected that the ambulance would be out of service 90-100 days; however, = no service would be lost because arrangements had been made with the person d= oing the repairs to give the Town a loaner ambulance for that period of time.

Mr. Gleason asked if the wording of the Trust Fund authorized the Selectmen to expend the money without a public hearing. Mr. Gaydos said it did and review= ed a portion of the language. The= re was further discussion regarding how the invoices could be handled. Mr. Gaydos said the Selectmen had= the option to approve the entire expenditure of $70,000 and as the expenses ca= me through they could be approved through the manifest. It was noted that the timeframe f= or the chassis was relatively short, the remaining would be invoiced within approximately 120 days at which point the ambulance would be back.

Mr. Bergeron clarified a statement he made at a previ= ous meeting. He said he thought = the Town had already done this type of replacement, but was mistaken. He asked how many conventional-ty= pe ambulances the Town had. Chi= ef Fisher said the Town had two conventional and two box-type, this would be = the first to go through this process. He said they believed this was the best process to provide the Town= with a ‘new’ vehicle.

Mr. Gleason suggested that the Selectmen consider re-= writing the warrant article language to clearly delegate this type of decision to = the Selectmen and eliminate any ambiguities in the future.

(Lynde/Gleason) To authorize the expenditure of up = to $70,436 to acquire a new chassis and transfer the box of Ambulance 2 to the chas= sis to give the Town a completely refurbished and equivalent of a brand new ambulance.

PUBLIC HEARING: To Accept 3 Grants = from Hillsborough County Commissioners

Mr. Danevich said the Selectmen had the opportunity to review the grants, which had been approved.

There was no public input.

The grants were awarded to the Skate Park (lighting and emergency shelter), Park & Recreation (summer program), = and Fire Department educational materials (dealing with children).

Mr. Gleason asked if the grants would open Park & Recreation to people outside the Town because of the grants being Federal monies. Mr. Gaydos said the = grants were from Hillsborough County and would be audited and forwarded to the county to ensure the numbers match. He said the Town didn’t hav= e to make any accommodations to anyone other than the ‘program’ and there was no requirement to continue programs. Mr. Gleason asked specifically if= by accepting the grants that it meant anyone from the state/Hillsborough Coun= ty had a right to participate in the programs and the Town could not make it exclusive. Mr. Gaydos didn&#= 8217;t believe that the grant operated in that fashion.

PUBLIC HEARING: To Accept Grant fro= m FEMA – Reimbursement of Snow Emergency

Mr. Danevich said grant checks in the amounts of $25,= 458.18 (reimbursement for snow emergency – March 30, 2005) and $20,903.04 (reimbur= sement for snow emergency February, 2005). Mr. Gaydos said the Town was made aware through Representative Lynne Ober that there was a ruling by the Department of Revenue Administration t= hat the grants could be treated as a gift.&nb= sp; He said if accepted, the Selectmen had the ability to accept and ex= pend gifts.

Mr. Domenico said he would like Mr. Gaydos to discuss= with Highway Agent Don Foss which roads needed line painting as a matter of pub= lic safety. Mr. Gaydos said Mr. = Foss had indicated to do all the roads he normally did the estimate would be ju= st under $17,000.

Mr. Danevich suggested that the Selectmen hold off ma= king a decision until the next scheduled meeting to they would have the opportuni= ty to review which roads would need painting.&n= bsp; Mr. Gleason felt that all these funds should be allocated back to t= he Highway Department as opposed to holding it for something else.

Mr. Danevich asked that Mr. Gaydos discuss with Mr. F= oss and propose at the next meeting those items needing attention.

OTHER BUS= INESS

Town Anne= x – Heating Situation

Mr. Gaydos said there had been a broken fixture at th= e Annex that had since been replaced with a donated fixture and all the materials = that belong to the Selectmen had been secured and CERT now had a place to call home. He said there was a he= ating issue and wanted to have the Selectmen’s approval to work with the F= ire Chief and CERT to devise a rental agreement. Fire Chief David Fisher said CERT= could not pay ‘rent’ but could provide assistance to the landlord in maintaining a building. He s= aid they would be glad to sign a letter of commitment stating that CERT would assist in the maintenance and operation of the building. Mr. Gaydos said he would like the Selectmen’s approval to meet with CERT to find out what assistance w= as available. He discussed some= of the items that needed to be addressed. =

Mr. Gleason believed the stipulation from the governm= ent was that the money that came in (from CERT) could not be used to enhance Town assets or to undertake tasks that should be undertaken by the Town. He didn’t want to jeopardize federal funds. Chief Fisher = said there were some funds available through the federal grant (through the stipulations) to be able to ‘assist’ and work with the Town for some of the items. He said h= e would have to discuss with Mr. Gaydos exactly what would be done. He pointed out that CERT was audi= ted. He said they would not in any fas= hion try to jeopardize their credibility with the federal government.

Mr. Gaydos said if the Board was interested, he could= get some bids on a heating system and its installation for the Selectmen’= ;s review. Mr. Lynde supported obtaining information and felt CERT was a valuable resource for the Town a= nd area. He said he would want a breakdown of costs.

Mr. Bergeron said he was told that there were possibl= y forty additional CERT volunteers. = He pointed out that the Town had an emergency fund and felt it fit under that classification. He felt it m= ade sense to spend a little money to get the items done.

Mr. Domenico felt CERT was an asset. He was not comfortable expending = any additional funds into the Annex until the Town received the report from Castagna Consulting regarding the additional space at the Municipal Building= . His goal would be to consolidate = the Town groups into the Mun= icipal Building. Mr. Bergeron noted that there was= no money appropriated to have work done at the Municipal Building= , which would delay action until March, 2006 with possibly a warrant article. He said (for the An= nex) it was minimal costs, the Town had the money and there were volunteers that c= ould really use it. Mr. Domenico = was concerned if the Board received the report from Castagna and the Selectmen wanted to move forward to finish the rooms (at the = Municipal Building= ) there would be direction regarding the course to be presented to the voters. Mr. Lynde asked if i= t was envisioned there was sufficient class space to meet CERT’s needs and= the Town’s other needs. He questioned how the space in the Municipal Building compared = to the space in the Annex.

Mr. Gleason believed there was a need for CERT, but w= as reluctant to commit Town resources to a building that was in serious code violation and in his opinion didn’t have a long-term future in the Town. He said there was Town liability in the building’s upkeep.= He wanted to review other avenues.=

Mr. Danevich pointed out that there was currently a T= own employee in the building and didn’t feel the situation was short-ter= m and said there were no guarantees regarding funding for the Municipal Building= space or that CERT would be around in five years. He believed the Town had to make a decision regarding the heating situation.= He said there was a minimal amount of time before the heating season.

Mr. Gaydos said he could get a price regarding heatin= g for the next meeting. He said he= would review the code enforcement officer’s letter and get prices to bring= the items into compliance. Mr. L= ynde felt the Annex should be viewed as a Town asset and maintained as such.

Mr. Danevich said there would be no further action re= garding the Annex until further information was received by Mr. Gaydos.

Chief Fisher informed that the CERT team had been act= ivated and would assist with the disaster situation that occurred from Hurricane Katrina. &nb= sp;

Set Time = for Site Walk – Oc= tober 1, 2005

Mr. Danevich asked the Selectmen if they wanted to co= nduct a site walk in the Stonepos= t Road area to review Town property. Mr. Lynde believed a site walk should be done if a road was proposed to be laid out. Mr. Gaydos said he coul= d make RSA 231 (road layouts) available for the Selectmen to review. Mr. Gleason asked if there was an easement that went into the Town property. Mr. Gaydos said there was no current easement.

A site walk was scheduled for October 1, 2005 at 8am to review Stonepost Road; Mr. Gaydos will post such. It was noted that the site walk w= as open to the public.

Special M= eeting Results

Mr. Danevich said the voters approved the Special War= rant for the revaluation, fuel increase and Highway Department truck. (986-Yes / 352- No).

Award of = Truck Purchase

Mr. Gaydos discussed the Highway Department truck bid= s that had been put out in August; a copy of the specifications was available for review; three bids were received. The recommended bid for the truck was from Freightliner in the amou= nt of $55,470; the bid for the dump body was $30,990. The total truck cost, if approved= , would be $89,712. It was noted that McDevitt provided the lowest bid for a truck in the amount of $55,456, how= ever the truck would have been shipped from Indiana and the delay would jeopardize its being ready for winter plowing. The Freightliner truck is immedia= tely available and includes full warranties on the transmission, engine and chassis, It also includes provision of a s= pare rim and tire.

Mr. Danevich said there was no action at this point regarding fuel.

Revaluati= on Discussion

Mr. Gleason then discussed the revaluation. He said there were three adequate suppliers who would be brought in to get them to agree regarding the sched= ule and hold to their prices. He= said after meeting with the three companies a recommendation would be made to t= he Selectmen at the October 4, 2005 Board meeting as to who should be selected to perform the revaluation.

Discussio= n of 2006 Warrant Articles

Mr. Gaydos said the Selectmen needed to start thinkin= g about warrant articles so they could begin to be written. He discussed the possible warrant articles that should be discussed. There was further discussion by the Selectmen regarding additional warrant articles that should possibly be considered at a later meeting.

TOWN ADMI= NISTRATOR / SELECTMEN REPORTS

Mr. Gaydos said the revaluation was progressing. He said the Police and Supervisor’s contract would be addressed during non-public session.<= /p>

Mr. Domenico asked if there were any objections to se= nding a letter to the Budget Committee, Planning Board and Conservation Commission requesting a representative to be appointed to a Town Communication Commit= tee. He said that he and Mr. Gaydos wo= uld also be members. There was no objection to the process being organized as outlined by Mr. Domenico.

Mr. Bergeron said he, Mr. Gaydos and the Police Chief attended the Governor’s Advisory Commission regarding inter-model transportation 2007-2016 public hearing.&= nbsp; He reviewed the agenda items and noted that previously the Town was listed on the last page (recommended future list) of the State Transportat= ion Improvement Plan; however, in the new draft report (2007-2016), the Town w= as listed for high priority funds. Mr. Bergeron said he had a meeting with Commissioner Murray. Mr. Gaydos said the funds were no= t a grant, but an 80/20 funding bill with a lot of strings attached. He said the Town could manage the program; however the state was familiar with the regulations and had the network to address the issues (and handle the accounting). He said he would recommend to the Selectmen that the state manage the project. He said the Town needed to figure= out some of the design work (finalized in 2008) with construction possibly bei= ng as early as 2009. He noted ther= e would be a lot of public hearing to discuss such work. Mr. Bergeron said last Tuesday and Wednesday he had been invited to attend the Nashua Aldermen Water Committee Meeting for the interviews of the oversight company and the company for th= e operation of the water district. . He = said after the interview process the recommendation for oversight was RW Beck a= nd for operations Veolia. He pr= ovided the Selectmen with detailed minutes of Mr. George Sansoucy’s recommendations made to the entire committee. He ended by informing that he att= ended the Merrimack Valley Regional Water District meeting during the past week = with the Fire Chief. He noted tha= t he would be attending the NRPC meeting on Wednesday.

Mr. Lynde said the first Concert on the Common was he= ld with approximately 200 people in attendance and about $1000 was generated for t= he Sherburne Hall Fund.

Mr. Gleason said budget review had been initiated wit= h the Budget Committee and believed the general format had been acceptable. He said there would be a site wal= k of Town facilities on Saturday 24 September.=

Mr. Danevich noted that the Selectmen would hold a jo= int meeting with the School Board to explore the cost saving areas. He asked that the Selectmen discu= ss the suggestions brought forward by the Transfer Station Superintendent Bruce M= ason regarding the ‘pay-as-you-go’ and ‘coupon system’ programs. There was a brief discussion and interest in both programs.= Mr. Danevich said the Town boundaries needed to be reviewed. Mr. Gaydos said the Planning Dire= ctor wanted to be involved; Mr. Domenico offered his help. Mr. Danevich asked that the Selec= tmen review the new CIP and provide input.&nbs= p;
