OPEN FORUM

Mr. Leo Thibeault, Simps= on Road, who is an NRPC Commissioner and member of Context Sensitive Solutions, wan= ted people to know (in case they weren’t aware) that the Town had Federal money ($3.9 million) for the Town Center that would be dispersed in four years. He wanted to dispel r= umors regarding the funding.

Mr. Thibeault saw on the= agenda that Selectmen Domenico was going to be replaced (because he was leaving T= own) and felt that the position should go to the person the voters had chosen a= s the third candidate. He asked th= at consideration be given to placing a warrant article on the next ballot to = cover this type of situation. He f= elt the position should be filled by someone who ran for the position, if they were still interested. He believe= d there should be something in writing to cover this type of situation. Mr. Gleason felt it was important= for the Selectmen to interview candidates in open forum. He said the RSA provided guidance= on people that resign and the Selectmen have the right to appoint someone. He said in the event the Selectme= n are unable to appoint a candidate, any petitioner may appeal to the court; the court could then make the appointment for the Town.

Mr. Paul McDonough, 7 Mammoth Road, discussed the Town Center and the typ= e of traffic lights that were being considered. He didn’t know what type of lights were being reviewed, but w= anted to let the Selectmen know he was not in favor of traffic lights that hung = from a cable. Mr. Gleason informe= d Mr. McDonough that the Context Sensitive Solution group were reviewing several options and were taking public input regarding such. He suggested that Mr. McDonough participate in the next meeting, which was scheduled for July 19, 2007 at the Fire = Department training room.

Mr. William Pultar, 7 Berthel Street, wanted to know the disposition of his case. Mr. Gleason informed him that the disposition of the case was read = during the previous Selectmen meeting (May 15, 2007) and also the final letter fr= om the Town’s attorney (that was forwarded to Mr. Pultar) indicating th= at the issue was closed. He said he would be happy to retransmit the letter.<= span style=3D'mso-spacerun:yes'> Mr. Pultar thought he should have received the letter within 30-days of filing. Mr. Gleason explained (as he did = at previous meetings) that at the point Mr. Pultar filed his complaint there = was no policy in effect covering a grievance by a taxpayer; the policy was ena= cted in December, 2006 and if his complaint came in after that point he would h= ave a basis for requesting disposition. <= /span>Mr. Gleason further explained that the Town had no mechanism in place to addre= ss citizen complaints until the policy was written last year, at Mr. Pultar’s urging. Mr. Pultar said he m= ade a recent citizen complaint. Mr. Gleason said the complaint was not grandfathered. Mr. Pultar said the complaint he = made was that he was given a false policy.&nbs= p; Mr. Gleason said this was discussed at the previous meeting and reiterated that there was no policy in effect. Mr. Pultar said he wrote a letter requesting clarification to which he had no response. Mr. Gleason said he sent a letter indicating that the issue was closed; there was a letter from the TownR= 17;s attorney (John Rattigan) stating that the issue was closed. Mr. Pultar asked if complaints wo= uld be placed in Town records. Mr. = Gleason said under the new policy (which had previously been provided to Mr. Pulta= r), when complaints are forwarded to the Selectmen or Town Administrator there would be commission of 2 or 3 people to review the complaint and provide a formal disposition at the completion of their investigation. This went into effect in December, 2006.

Mr. Pultar said he had a= concern regarding a well and a septic system which the state didn’t recommend. Mr. Gleason said = that issue was a Board of Adjustment issue that dated back to 2003. Mr. Pultar discussed a situation = where a pool was placed on top of a septic and said the Town was the only one in t= he area that allowed this placement. He was concerned with contamination and wanted to know who would be responsible if it occurred. = Mr. Gleason suggested that Mr. Pultar discuss the situation with the Planning Director and review the regulations. Mr. Gaydos said this issue had already been addressed by former Hea= lth Officer Paul Zarnowski several years ago.= He said he would ask Mr. Zarnowski to contact Mr. Pultar regarding = his concern.

Mr. Gleason reminded res= idents that there was a program in effect until the end of June called Low and Moderate Income Owners Tax Relief Program which was open to any citizen in= the Town of Pelham who owned a home and was paying the state education tax. The income guidelines where those= who are single and make less than $20,000 per year, or those who are married a= nd make less than $40,000. Form= DP8 is available at the Town.

Mr. Gleason wanted the p= ublic to be aware that notice was given that Pennichuck East requested a 21% increa= se under the PUC with 12% being effective immediately. The 21% would be retroactive once Pennichuck East received approval. = If anyone is concerned regarding their Pennichuck bill a meeting is scheduled= for June 14, 2007 = 10am at the NHPUC.

Mr. Gleason advised that= the Selectmen meetings would be held at the Pelham Elementary<= /st1:PlaceName> Media Center beginning June = 12, 2007 through Septemb= er 18, 2007.

APPOINTMENTS

Eagle Scout Project: Troop 610 – Tom Glen<= /b>

Boy Scout Tom Glen said he had been working with Park= & Recreation Director Darren McCarthy to determine an Eagle Scout project. He said the project would consist= of two parts: 1) rebuilding an observation deck/bridge that had moved down stream= and was partially destroyed at Muldoon Park; and 2) build a new platform near the tra= il head of the trail at Muldoon<= /st1:PlaceName> Park. Mr. McCarthy discussed the plan a= nd was fully in support of the project.

The Selectmen discussed the project and thanked Mr. G= len for the back up information provided. Mr. Gleason asked when the project would be completed. Mr. Glen said he had to go before= the Eagle Board for approval (June 5, 2007) and hoped to complete the project by the end of June, beginning of July, 2007.

Mr. McCarthy took a moment to state his concerns rega= rding the mosquito control. He didn’t want residents to get a false sense of security and urged peo= ple to use insect spray to protect their children.

Re-Appoin= tments to Conservation Commission:

Paul Dadak, = 103 Sherburne Road - Mr. Dadak discussed his qualifications and believed being a member of the Planning Board provided a working partnership between the boards.&n= bsp; Mr. Lynde felt Mr. Dadak was doing a good job and appreciated him f= or re-applying. Mr. Danevich fe= lt Mr. Dadak was an asset for both Boards. Mr. Haverty also felt Mr. Dadak was an asset and thanked him for his time. Mr. Gleason also had no problems with his application.

Glennie Edwa= rds, 12 Tenney Road – Ms. Edwards was thanked for her volunteerism and dedication to= the Town. Mr. Lynde asked what M= s. Edward’s goal was for the next three years. Ms. Edwards felt she added a lot = to the commission with her knowledge of the Town’s history and her contacts= . Her goal was to continue on with input. She cared about the T= own and its upkeep. Ms. Edwards said= she recently came across information regarding possible land for purchase that= she would pass along. She said s= he enjoyed her position on the Conservation Commission and asked to remain in= her capacity as an alternate. Mr. Danevich recognized Ms. Edwards as the Conservation Commission’s Recording Secretary and thanked her for her work. He supported her request as an Alternate. Mr. Haverty thank= ed Ms. Edwards for her time and recognized her as an asset to the Commission. Ms. Edwards discussed the other a= spect of her job, which she enjoyed. Mr. Gleason also thanked Ms. Edwards for her work on the Commission as a membe= r and as the Recording Secretary. = Ms. Edwards asked that information be posted that the Commission was in need o= f a couple new members because one of the current members was leaving.

Selectmen Candidate Interviews and Possible Vote=

Anthony Chia= nca – Mr. Lynde asked for background information and what Mr. Chianc= a saw as his role as Selectmen. Mr. Chianca said he moved from Bo= ston approximately 11 years ago and had been volunteering in the community for = the past 4 years. He said being a Selectman would give him the opportunity volunteer and serve the community.

Mr. Danevich thanked Mr. Chianca for volunteering. He asked Mr. Chianca what his top= priorities were for the Town. Mr. Chian= ca said he would take the role of the person leaving and educate himself about that role. Mr. Danevich asked if = he was familiar with the Selectmen priority list or other projects. Mr. Chianca said he wasn’t,= but gathered information from various outlets (i.e. newspaper, PTV, website).<= span style=3D'mso-spacerun:yes'> Mr. Danevich said there were thre= e top priorities (Town Center, Fire Station and High Sch= ool) and asked Mr. Chianca for his position regarding such. Mr. Chianca said he saw himself a= s a liaison with the residents and would research items. He saw a need for a central fire station, and understood that there had to be a balance between all the municipal needs to make residents comfortable. He said he would like to see a ne= w fire station, as long as the numbers were set and the project was ‘doable’. He saw= a need for a new high school and felt bringing information to other boards and wo= rking together was important. Mr. Danevich asked what Mr. Chianca hoped to accomplish in ten months. Mr. Chianca said he would educate himself and look to the other Selectmen for help.

Mr. Haverty noticed that Mr. Chianca didn’t run= for the position and wanted to know what brought him forward at this time. Mr. Chianca said he saw being a Selectman as another way to serve and be involved with the community. Mr. Haverty understood that Mr. C= hianca volunteered in other capacities and asked what they were. Mr. Chianca said currently under = a Fire Department grant he was helping with community education. Mr. Haverty asked what Mr. Chianc= a felt were the challenges facing the community/Selectmen. Mr. Chianca said he tried to leav= e his personal opinions out and instead listen to the community. Mr. Haverty asked if Mr. Chianca = would run for re-election in March, 2008. Mr. Chianca answered yes.

Mr. Gleason asked what Mr. Chianca perceived to be th= e major issues facing the Town and what recommendations did he have to address such. Mr. Chianca said with = the cost of living going up, items should be done step by step, keeping in min= d the rising cost of construction. Mr. Gleason asked what specific talent, experience or capability he would brin= g to the Board. Mr. Chianca said communication and trust was important between residents and the Selectmen.= Mr. Gleason asked what measures h= e would recommend to address the tax situation.&n= bsp; Mr. Chianca noted the Town had been reassessed and would educate hi= mself on other ways to relieve tax payers. Mr. Gleason asked what his impression was regarding the Town’s infrastructure and what he recommended.&n= bsp; Mr. Chianca said more grants should be reviewed.

Doug Viger &= #8211; Mr. Lynde asked what brought Mr. Viger to the Board, what he wanted to accompl= ish and how it would be approached. Mr. Viger said he was currently on the Budget Committee and saw a need with th= e CIP items being identified and had been a member of the CIP for the past three years. He felt running for Selectmen would allow him to better identify the CIP objectives and get th= em accomplished.

Mr. Danevich asked Mr. Viger his opinion regarding th= e top three Town priorities (T= own Center, Fire Stati= on and High School). Mr. Viger said= he was in tune with the Town Center proposals, = but felt the best plans had not yet been determined. He didn’t feel all options had been reviewed. H= e saw it as a priority, but not a top priority.= His top two priorities were the Fire Station and the High School. He wanted the Selectmen and the C= IP to come up with a plan and present such to the Town’s people. Mr. Danevich wanted to know if he= was in favor of a new central station, or putting additional funds into the exist= ing station. Mr. Viger was in fa= vor of a new central station, but wanted the plan to be ‘real’. He wanted the layout put out to T= he Dodge Report to open it up to contractors throughout the state so real num= bers could be obtained and presented to the tax payers. Mr. Danevich asked his opinion re= garding the high school. Mr. Viger s= aid there were still a lot of questions up in the air. He felt the fire station was more= in line with fitting into the needs of the Town because of having a complete plan. However, he felt the h= igh school was equally important. Mr. Danevich asked how the transition would be from the Budget Committee to the Selectmen. Mr. Viger looked = forward to the transition. He said t= he Budget Committee was checks and balances and hoped being on the Board of Selectmen would benefit both sides.

Mr. Haverty asked Mr. Viger to discuss the platform f= or which he ran for Selectmen during the last election. Mr. Viger felt the major issues/C= apital Improvement projects should be identified and prioritized. Mr. Haverty (who was also a CIP m= ember for the past three years) felt the CIP had done a good job trying to sched= ule the major capital items. Mr.= Viger said the CIP plan had not been adopted by the Boards in Town. Mr. Haverty asked what Mr. Viger = felt was the best approach to making the CIP a working document. Mr. Viger said the CIP had raised= the minimum amount to $50,000 for items to appear on it. He said they had also met with Department Heads and eliminated items from the document and prioritized it= to show what needed to be done each year.

Mr. Gleason asked what specific capability/talent Mr.= Viger felt he brought to the Board. Mr. Viger said he would bring his experience from the Budget Committee and CIP= as well as familiarity/understanding of the projects coming forward. Mr. Gleason asked what approach c= ould be used to minimize the tension between the Budget Committee and the Selectmen. Mr. Viger said communication was key. Mr. G= leason asked what measure he recommended to address the tax situation in Town. Mr. Viger said there might be a s= erious revenue problem in Town, but was unsure how to address it. Mr. Gleason said statements had b= een made that the Town had a low tax rate.&nb= sp; Mr. Viger said there is a large percent of the budget that was contractual and not controllable. &n= bsp; Mr. Gleason asked what his impression was of the Town’s infrastructure and his recommendations.&n= bsp; Mr. Viger said his philosophy was to have a plan (i.e. Technology P= lan) and apply such to the Town buildings and needs.

The Selectmen discussed how they would proceed. Based on the fact that there were= two candidates and that the agenda stated that a possible vote would occur, the Selectmen decided to vote. T= he Selectmen discussed the candidates and their experience and made the follo= wing appointment.

Article K Waiver Application – Kyle and Glenda Nagel, 9 Wood Road, Pelham, NH

The Board of Selectmen temporarily adjourned to conve= ne the Board of Health with Chairman (Deputy Health Officer) Paul Zarnowski. Mr. Zarnowski called the Board of= Health to order.

Mr. Zarnowski said the Board would review a request w= aive Article K, Section 295-16 – setback distance to a pond; 125ft. requi= red by Pelham request for approximately 100ft.

Mr. Jim Herrick came forward to represent the plan. He said the waiver was requested = for the 125ft. requirement to Long Pond. They designed a new septic system for 9 Wood Road. Mr. Herrick said the best location (based on the soils) for the system was approximately 110ft. from the pond. He said the well would= also be relocated; the work was currently being contracted with a well company.= He said they couldn’t move = the system further from the pond and keep it in good soil and not destroy the parking area.

Mr. Lynde asked what the setback was from the front p= roperty line to the proposed leach field. Mr. Zarnowski said it was 60-feet.= Mr. Herrick explained that they did test pits at the parking area a= nd found the soils to not be as good as the proposed location. He said it looked like the area h= ad been filled with loam and other materials.&nbs= p;

Mr. Danevich asked if the existing system would impro= ve the current situation. Mr. Zarno= wski said the existing well was approximately 20ft. from the septic system. He said the situation would be im= proved immensely. He said the propo= sed location was the best treatment place for the system. Mr. Danevich asked what year the = house was built. Mr. Herrick said = based on the Assessor’s card and deeds, the house and lot were created in = 1930. Mr. Danevich confirmed that the c= urrent owner purchase the house in December, 1987. Mr. Herrick said that was correct= .

Mr. Gleason clarified the location of the existing septic. Mr. Herrick explaine= d that the proposed system would have a septic tank and pump chamber. He then showed the location of the system. Mr. Gleason understo= od that a septic had to be 100feet away from the pond. Mr. Zarnowski said it could be 50= feet away from a pond if SDR26 pipe was used.&= nbsp; The proposed system used SDR26 pipe.

Mr. Danevich stepped ou= t of the room (see below for his return).

Mr. Lynde confirmed that the applicant was drilling a= new well down by the pond to achieve the required distance between the well an= d the septic system. Mr. Herrick a= nswered yes. Mr. Lynde asked if the property was seasonal. Mr. H= errick said the property was only used seasonal.=

OTHER BUSINESS

Municipal Pest Management Co= ntract

Fire Department Lieutenant Robert Chatel and Health O= fficer Marlene Demers met with the Selectmen to discuss mosquito control. Mr. Gleason noted that the Town p= assed a $40,000 warrant article for mosquito control. He understood Mr. Gaydos had disc= ussed the program with Lt. Chatel and Ms. Demers and they had done extensive wor= k to identify a program that would be successful for the Town and would make a recommendation. Ms. Demers s= aid the gentleman they spoke to owned two companies, Municipal Pest and Swamp, Inc= .; one company would conduct surveillance and the other would do the larvicide. The cost would be= $17,500 for surveillance and $15,000 would cover the larvicide. Lt. Chatel explained that each ye= ar the surveillance would become easier since the first year is a learning year.<= span style=3D'mso-spacerun:yes'> Mr. Gleason confirmed that the co= mpanies were certified providers. Lt. Chatel answered yes they would go to the various agencies for approvals. He said if any residents had conc= erns regarding wet areas, contact information was contained in newspapers and o= n the Town website. Ms. Demers dis= cussed the importance of controlling the mosquitoes at the larvicide stage and sa= id additional funds would be needed for adulticide control. Lt. Chatel said (of the $40,000) = they recommended keeping $7500 in reserve in case adulticide was needed.

Mr. Gleason asked if the program constituted any risk= to the population (or children). Ms. Demers said the MSDS sheets were lacking in the first proposal, they asked= for that information to be provided to ensure that the insecticides would not = harm humans or the ecology.

Mr. Lynde understood that the request was to spend up= to $32,500 ($17,500 for testing and $15,000 for application of larvicide in selected wetland areas). Lt.= Chatel said that was correct.

Mr. Danevich returned. =

Mr. Lynde asked if the chemicals were bio-friendly an= d if they had the potential to contaminate water. Ms. Demers answered no. She explained the chemical form a= nd how it killed the larvae. Mr. Ly= nde asked if the sites to be treated were identified. Lt. Chatel said they had obtained= maps and information from Park & Recreation Director Darren McCarthy and th= ey walked some of the areas (that may not have been known) with Mr. Morrison = (of Municipal Pest). He reiterat= ed that in future year the identification process would become easier. Ms. Demers said at this point the= re appeared to be approximately 825 acres that would be treated. She said they would continue to r= eview sites until the middle of October because there was no historical data to = work from. Mr. Lynde asked for clarification of the spray that would be used. Lt. Chatel discussed the method u= sed for the larvicide. He said pelle= ts were contained in a pressurized back pack that was then sprayed. He said the only time a ‘sp= raying’ would be done is in the event of a threat of EEE. Mr. Lynde said he had a negative reaction to area spraying, but the approach suggested seemed to be a win-w= in situation. Ms. Demers said an adulticide spray would be used if a mosquito was found to have matured and= were disease carrying. Lt. Chatel= said they were in the process of drafting a protocol/policy in the event of an = EEE threat. Ms. Demers said beca= use of the lack of historical data they were unable to determine the threshold for what needed to be done and when.

Mr. Haverty said there were areas in Town that were w= et, but not designated as ‘wetlands’.= He confirmed that residents could contact Mr. Morrison regarding th= ose areas. Lt. Chatel said resid= ents could either contact Mr. Morrison, or him. Contact information is contained in local newspapers. Lt. Chatel encouraged any residen= ts who had concerns to make contact so testing could be done. Mr. Haverty asked if there any guidelines to identify an area of suspect. Ms. Demers said areas of suspect would be standing water, long gras= s or shrubbery. She said if peopl= e had concern, they should contact Mr. Morrison. <= /span>Lt. Chatel discussed another type of trap that would be placed in strategic ar= eas and would hang from trees. M= r. Haverty discussed identification and questioned if a similar approach to t= he revaluation should be taken. Mr. Gaydos said there would be very little co= st to provide identification badges. Lt. Chatel said there were approximate 25 people. Mr. Haverty thought it would be a= good idea to provide badges.

Lt. Chatel said a complaint had been made regarding t= icks at Muldoon = Park. He informed that Mr. MorrisonR= 17;s company also handled home maintenance pest control. He said they had offered to spray= Muldoon Park (25 acres) for no charge. He said once the spray was applie= d it took ten minutes to dry and could be done during the day when children wer= e in school. He said there was al= so a concern regarding poison ivy and they would spray for that at no extra charge.

Mr. Gleason wanted to know how to communicate to resi= dents that a pro-active approach was being taken regarding EEE. He wanted to get the word out tha= t there was a program and resident participation was essential. Ms. Demers said she had fliers th= at could be available at Town Hall and local businesses. Mr. Gleason appreciated the compa= ny offering to do tick and poison ivy control, but wanted to know the cost for such in the future. Ms. Deme= rs said they were told the cost would be minimal because the company would already= be conducting pest control. She= said they could ask for a quote. = Mr. Gleason wanted to identify the full scope for when a warrant article was drafted.<= span style=3D'mso-spacerun:yes'> He asked if there would an opport= unity to have a competitive bid in the future, even though there were only two certified companies in New Hampshire.&nbs= p; Ms. Demers said she contacted the other company and discussed their= process and felt it may be worthwhile putting it out to bid next year.

Mr. Lynde wanted to know what would be used to kill ticks. Lt. Chatel said it wa= s the same chemical used for larviciding. Ms. Demers said they had the MSDS information of the chemical which would be diluted to a weakened state when applying. Mr. Lynde didn’t view ticks= and poison ivy in the same light as mosquitoes that may carry West Nile Virus.= Ms. Demers said a study had been regarding Lyme Disease and the data showed that incidents of the disease h= ad significantly increased in recent years.&= nbsp; Mr. Lynde didn’t see the need to spray for ticks because he f= elt people had a personal responsibility to be aware and take care of it. Ms. Demers said there was a speci= fic complaint received for M= uldoon Park. She said they walked the area wit= h Mr. Morrison and there were certain areas of concern. Lt. Chatel suggested circulating = a flier containing information regarding mosquito control and ticks. Mr. Lynde wanted to emphasize that= people had a responsibility to eliminate mosquito breeding grounds.

Mr. Haverty discussed the importance of getting infor= mation to the public and the various ways it could be disseminated.

Mr. Gleason understood Mr. Lynde’s concern rega= rding spraying, but felt it may be appropriate for certain area with high popula= tion usage. He said he would defe= r to the health care/services experts. Ms. Demers said surveillance techniques would be done prior to recommending any further treatment. Mr. Gaydos asked if insect repellant would repel ticks. Lt. Chatel said it would offer so= me line of protection. He felt the b= est prevention was to control the ticks to a reasonable amount. Mr. Gaydos said he was concerned = with what would be put on the grass and what would happen if someone were to ingest = that grass. Lt. Chatel said they = had been assured that there would be no problem at all; the chemical dries wit= hin ten minutes. He said signs c= ould also be installed indicating that the field had been sprayed.

Mr. Gleason said the Town voters approved the impleme= ntation of mosquito control and felt a valid recommendation had been made.

Mr. Lynde then made a motion to award a contract valu= ed up to $15,000 to Municipal Pest Services Inc. of York, Maine for the purpose of applying larvicide to areas identified as high risk of producing mosquitoes that may harbor West Nile Virus. Mr. Haverty seconded the motion.<= span style=3D'mso-spacerun:yes'> Mr. Gleason asked if the motion s= hould include the limited spraying for ticks and poison ivy. He believed they should be author= ized to do it in limited areas that were highly used by children. Mr. Danevich said PVMP traditiona= lly had problems with poison ivy. Mr. Gleason said poison ivy control at PVMP was in the budget. Mr. Lynde confirmed that the comp= any, in the process of spraying, would take of ticks at the same time. Lt. Chatel said the spray was goo= d for 6-8 weeks and would have to be done in the fall. He said they would do it in the f= all at no charge. Mr. Gaydos asked = if they would only do it at Muldoon. Lt. Chatel understood that they would do any area needed and it was easier to control at the same time. Mr. Haverty suggested that the motion be amended to say that they would spray = larvicide as well as treat for ticks and poison ivy for the amount not to exceed $15,000. Mr. Lynde would lik= e to leave the motion as dealing with the ticks. Lt. Chatel pointed out that there= was no charge right now and asked if they could revisit the issue if they were no= tified of a complaint in a different location.&n= bsp; He said they could then bring a recommendation back to the Board. Mr. Gleason asked the Selectmen to consider Muldoon specifically, but noted the other potential area was PVMP. He felt it was up to T= own Officials to take every action within their ability to protect the children and beli= eved PVMP should be included. Mr. Danevich noted that the company was certified to do the applications. He agreed that signs should be posted.

Mr. Lynde asked that he be provided with a list of the official names of the chemicals that would be used. Lt. Chatel said they had a booklet listing everything that would be used.&nb= sp; Ms. Demers said they would get a full report that included testing information and what was used.

Mr. Gleason asked that periodic updates be made of the progress and the success of the program.&= nbsp; He also asked they define a full scope of the program next year so a warrant article could be drafted. He thanked Lt. Chatel and Ms. Demers for all the work they had put = into the project.

Senior Bus Use Application

An application had been received for use of the Senio= r Bus by the St. Patrick’s Women Guild.&n= bsp; Mr. Gaydos informed the group had received all the materials, fille= d out the application and paid the fee. The Senior Center Director had approved the use. Mr. Gaydos said they would put a = total of 30 miles on the bus.

The Selectmen had no objection to the use of the Seni= or Center Bus. Mr. Gaydos was a= sked to sign the form after which Mr. Gleason would sign.

Fire Station Planning Discussion

Mr. Gleason said Trident (an owner’s representa= tive) made a proposal to review the fire station proposal. He said ev= eryone was invited to participate in the conference call with two of the referenc= es, but only Mr. Haverty and himself were present when they spoke to two individuals (one of which was Chuck Morse). He said the consensus of opinion = was that there was a significant value to Trident doing an evaluation and the sooner they get into the process the better. He said Mr. Haverty found that Massachusetts n= ow mandates that an ‘owner’s representative’ be used on all contracts. He said they want= ed to set a policy on where to go with the fire station. He said they knew what they had w= as not successful and now they had to determine how to get to a point where they = could move forward with something. Mr. Haverty believed factors for the fire station warrant failing were due to = not knowing how to proceed, the values and the costs. He said in an attempt to move for= ward, they contacted people who had used Trident in the past to see what value t= hey derived to having them on board. He said the conversation was useful and showed the value of using Trident.

Mr. Gaydos provided the Selectmen with a brief summar= y of who Trident was and what service they provided. In summary, Trident is a represen= tative for owners on construction projects. Mr. Gaydos said using Trident would be a different approach than wh= at the Town had used in the past and outlined the approach that they would take w= hen reviewing the fire station plans. He noted that the engagement would be month-to-month.

Mr. Gleason said his dilemma was they had a project identified at $7.3 million dollars and told people they thought they could= get it lower, but had nothing to validate, or substantiate such. He said the architect was not wil= ling to back off and he was looking for someone to do an intelligent engineering r= esearch of the documentation and ascertain if it was valid, or overstated. He said he wanted to know if ther= e were options within it. He said he didn’t have confidence in the number because of its ambiguity.

Mr. Lynde asked at what point Trident would be brough= t in and at what cost. Mr. Havert= y said the message from both people they spoke with indicated Trident had signifi= cant value in the design phase. H= e said the people they spoke to stated that what Trident saved them more than mad= e up for what they cost them.

The Selectmen further discussed using Trident and the benefits they provided. They= decided to pursue further. Mr. Gaydo= s said the cost for this phase would be $6000 per month and could be funded throu= gh impact fees. Mr. Gleason sai= d as they got into the process the Selectmen could set parameters/guidelines for what they wanted for the Budget Committee and a time line; the first step = was to validate the package. The= re was a consensus of the Board to explore the use to use Trident as the Owner= 217;s Representative.

Clarification of Laurette Guay Appointment as Trustee

Mr. Gleason informed that Ms. Laurette Guay was appoi= nted for Sheryll Lepine whose term would expire in 2008. Mr. Gaydos said there was still o= ne position to fill (that of Laura Domenico).

Parks & Recreation Advisory Board

Mr. Danevich said several applications had been recei= ved for the Park & Recreation Advisory Board and questioned if the Selectmen w= anted to appoint the people. Mr. G= aydos said he heard from Park & Recreation Director Darren McCarthy who indi= cated that the board traditionally didn’t meet during the summer. Appointments were deferred to September. Mr. Gleason asked= that Mr. Gaydos obtain Mr. McCarthy’s preference in writing as to whether or not to have a boa= rd.

Technical Plan Update – Victor Danevich

Mr. Danevich provided the Selectmen with a copy of the updated Technical Plan. He s= aid the bulk of the items for 2007 had been done.= He reviewed the document and indicated what had been deferred to ne= xt year and what systems had been updated/replaced. He also discussed a unit that wou= ld monitor the systems in the computer room.

TOWN ADMINISTRATOR’S REPORT / SELECTMEN’S REPORTS<= /o:p>

Mr. Lynde said Context Sensitive Solution met on May 17, 2007 a= nd reviewed potential solutions and impacts for the Town Center. He said three viable solutions we= re presented. He said in all in= stances they impacted the fire station property.&= nbsp; He said a computer model showed traffic impacts for the future. There were also considerations fo= r pedestrian and bike traffic. Mr. Lynde = said the Town was fortunate to be ‘earmarked’ for up to $3.9 millio= n and if there was an impact to the fire station, they would provide money for t= hat impact. He said the next mee= ting would be held J= uly 19, 2007 and the potential solutions would be rated.

Mr. Danevich had no rep= ort.

Mr. Haverty said the Planning Board was creating a sub-committee to review and recommend zoning changes; one item that would = be reviewed is ‘cluster zoning’.= Appointments to the sub-committee would be made at the first meetin= g in June. He then reported that = the CIP met with the Department Heads and were scheduled to meet with the School B= oard to discuss their capital needs. The CIP would be reconvened on June 23, 2007. Tentat= ively the CIP would be presented to the Planning Board in August; the CIP would = then be presented to the Selectmen and the Budget Committee in September. Mr. Haverty said in the past he h= ad suggested that the Selectmen do a ‘State of the Town Address’ = and asked if the Board concurred; if so, the content would need to be discussed.

Mr. Gleason said during the Context Sensitive Solution meeting it had been stated that there might be federal money available for= a functional replacement, Chris Waszczuk of Context Sensitive Solution was a= sked to quantify/qualify that information.&nbs= p;

Mr. Haverty said he attended the Memorial Day Parade/= Ceremony and thanked the American Legion for the nice cookout they had after which.=
