e and
Fire Departments and the scope of calls they receive.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>He focused on the Police
Department&#8217;s budget and felt there should be more funds allocated to =
help
back the department.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Glea=
son
said the budget was prepared by the Chief and submitted to the Selectmen for
approval; he didn&#8217;t recall the Selectmen ever cutting the salaries.<s=

style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. McDonagh wanted people to unde=
rstand
the stress of the Police Officers and hoped someone would have thoughts to =
help

there wasn&#8217;t a member of the Board that didn&#8217;t fully support or
appreciate the efforts of the Police Department.<span

awaited a

Selectmen to provide an explanation of the Assessing Update Process.<span

the
impact of the 2006 revaluation.<span style=3D'mso-spacerun:yes'>&nbsp; </sp=
an>He
also outlined the market changes during that same time.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>He showed a graph of the ratio cha=
nges
between 2006 and 2007.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Co=
rcoran
explained that there were two revaluation alternatives: 1) continue with<sp=
an
style=3D'mso-spacerun:yes'>&nbsp; </span>5-year revaluations - 2006 cost $4=
50,000
every five years; or 2) begin cycled revaluations &#8211; projected costs
$40,000 per year - $200,000 over five years.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>He discussed the revaluation versu=
s the
update components.<span style=3D'mso-spacerun:yes'>&nbsp; </span>He explain=
ed the
state assessment review and how assessment changes would be addressed.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>He said after the assessment was d=
one a
notice of preliminary review would be mailed to taxpayers and they would ha=
ve
the opportunity to review their changed assessments and speak to an apprais=
al

<p class=3DMsoNormal>Mr. Lynde questioned the way the analysis was done.<sp=

style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Corcoran explained that typica=
lly
revaluation companies were from out of state.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>He said his company was within the=
 state
and had become very familiar with the Town and kept an eye out for changes.=
 <span
style=3D'mso-spacerun:yes'>&nbsp;</span>He said they would conduct the
revaluation cycle by doing 25% each year and the last year they would do
commercial/industrial.<span style=3D'mso-spacerun:yes'>&nbsp; </span>When t=
hey
did each section they would also include any property that pulled a building
permit or any property that was sold even if it wasn&#8217;t in the particu=
lar
sector. Mr. Lynde said his concerns were not the market value, but rather t=
he
variance between properties.<span style=3D'mso-spacerun:yes'>&nbsp; </span>=
He
said he wanted to make sure they were still being fair to people and not ju=
st
valuating at 100%.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Corcor=
an was
also not fond of 100% valuation and felt 95% was close enough.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>He said there was a range of value=
 for
any property.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Lynde said =
the
COD was the most important figure and asked if it was fair to assume that t=
he
COD would remain low throughout the whole process.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Corcoran said that was correct=
, the
smaller the number the more fair the assessments were for one property agai=
nst

<p class=3DMsoNormal>Mr. Lynde wanted to know how the public could be educa=
ted

</span>Mr. Corcoran said education was important.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>He said the Town could conduct wor=
kshops
to explain the changes.<span style=3D'mso-spacerun:yes'>&nbsp; </span>He us=
ed <st1:place
w:st=3D"on"><st1:City w:st=3D"on">Gilford</st1:City>, <st1:State w:st=3D"on=
">NH</st1:State></st1:place>
as an example where information workshops had been conducted. </p>

<p class=3DMsoNormal>Mr. Viger wanted to know if the process could be done =
by the
towns or if the law required it to be done by outside sources.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Corcoran said a few of the tow=
ns
could do it themselves in-house, but the vast majority call in companies to
perform the appraisals.<span style=3D'mso-spacerun:yes'>&nbsp; </span>He sa=
id the
only place they did the assessing was in the towns that they served.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>He said currently there were not m=
ore
than four companies that did the work.<span style=3D'mso-spacerun:yes'>&nbs=

<p class=3DMsoNormal>Mr. Gleason felt the question that the Town would see =
was
from people feeling that their house was over-assessed.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>He wanted to know how the average =
tax
payer would be affected if the Town was assessed in sections.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Corcoran said if they just low=
ered
the assessments by 5% nothing would happen to the tax bills.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>He said the Town could raise no mo=
re
money than what was authorized through the budget process.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Lynde said the Town should hav=
e comparison
information of what the tax rate would have been if an adjustment was not m=
ade.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Corcoran said that information=

available and felt it could be conveyed to taxpayers even though it would b=
e a

residential property values in different areas of Town either increased or

Corcoran said they would move the areas that were too high, down and move t=

areas that were too low, up.<span style=3D'mso-spacerun:yes'>&nbsp; </span>=
He
said the residential file is consistently very close and they review for th=

dea of
the updates was to reflect the value increases/decreases in the assessments=

style=3D'mso-spacerun:yes'>&nbsp; </span>He said this would ensure that no
taxpayer was paying more/less of their fair share of the common tax burden =
each

irmed
that the adjusted value figures would come before the Selectmen prior to ma=

answered yes and indicated further that it wouldn&#8217;t come as a blanket
recommendation, there would be impact studies and additional information.<s=

discussed the topic there was mixed opinion if the Board had the authority =

t a
variance was still required for a conversion.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Zarnowski said a variance was =
not
required for a conversion; there was no ordinance for a seasonal to annual
residence.<span style=3D'mso-spacerun:yes'>&nbsp; </span>He said everything=
 was
listed as &#8216;residential&#8217;.<span style=3D'mso-spacerun:yes'>&nbsp;
</span>Mr. Lynde recalled that Article K didn&#8217;t allow for the
conversion.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Zarnowski read
aloud a portion of Section 295:17 and 24 of the Pelham Health Ordinance, wh=
ich
was adopted <st1:date Month=3D"11" Day=3D"1" Year=3D"1977" w:st=3D"on">Nove=
mber 1, 1977</st1:date>
and updated in either 1990 or 1991.<span style=3D'mso-spacerun:yes'>&nbsp;
</span>Article K was worked on in 1976 and came in 1977 further discussed in
the early 1980&#8217;s (1982?).<span style=3D'mso-spacerun:yes'>&nbsp;
</span>Part of the reason for bringing conversion before the Board because
there was no such restriction in Zoning; and expansion would require an app=
licant
to go in front of the Board of Adjustment.<span style=3D'mso-spacerun:yes'>=
&nbsp;
</span>The State Administrative Rules indicate no waivers to the rules will=
 be
granted for conversions.<span style=3D'mso-spacerun:yes'>&nbsp; </span></p>

<p class=3DMsoNormal>Mr. Joe Maynard of Benchmark Engineering, representing=
 the
applicant, met with the Board of Health to discuss the Waiver of Article K
request and to represent the plan.<span style=3D'mso-spacerun:yes'>&nbsp; <=
/span>He
said the design incorporated all the Article K regulations pertaining to se=
tback
to lake and distance to neighboring wells and wetlands.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>He said they worked with Mr. Zarno=
wski
who witnessed the test pit and has preliminarily reviewed the design.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>He said even thought the lot had e=
nough
room to put a conventional system, the applicant has chosen to use a Clean
Solutions system.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Maynard=
 said the
state requirements would be met and they were before the Board for the
conversion.<span style=3D'mso-spacerun:yes'>&nbsp; </span></p>

<p class=3DMsoNormal><o:p>&nbsp;</o:p></p>

<p class=3DMsoNormal>Mr. Zarnowski asked if the lot was large enough to mee=
t the
state criteria for the proposed use.<span style=3D'mso-spacerun:yes'>&nbsp;
</span>Mr. Maynard answered yes; the calculations show that the lot could
support a system large enough for three-bedrooms.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>He discussed the way the calculati=
ons
were done.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Zarnowski note=
d if a
person had an existing lot of record, the state would allow a system design=
ed
for two-bedrooms with a specific design.<span style=3D'mso-spacerun:yes'>&n=

</span>He said the state didn&#8217;t classify a vacant lot as
&#8216;seasonal&#8217; or &#8216;year-round&#8217;. </p>

<p class=3DMsoNormal>Mr. Lynde asked for a description of the existing sept=
ic

Maynard said they believed the existing system to be a drum in the ground w=
ith
stone around it.<span style=3D'mso-spacerun:yes'>&nbsp; </span>There was no=
 real
data on it.<span style=3D'mso-spacerun:yes'>&nbsp; </span>The previous owner
indicated that the dry well was the actual septic system.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>It is located between the existing
dwelling and garage.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Also the
location of the existing system was that it was on top of the water table, =
or

would designate some areas adjacent to existing conservation areas as Town

asked if designation of the land as forestry land would preclude its use for
recreational or other activities.<span style=3D'mso-spacerun:yes'>&nbsp;
</span>Mr. Waters said she would have to do some research for the answer.<s=

style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Lynde didn&#8217;t believe tha=
t designating
land as forestry land restricted its use for recreational purposes.<span

<p class=3DMsoNormal>Ms. Waters said the second warrant article was for the

money that had been taken out as well as the balances.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>They wanted to discuss a slight ch=
ange
in the calculations.<span style=3D'mso-spacerun:yes'>&nbsp; </span>They wer=
e sure
if they wanted to take the commission off the proceeds before deposit into =
the
fund.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Ms. Waters said the rea=
son
for this was that they were getting into larger parcels where the commission
would be much larger.<span style=3D'mso-spacerun:yes'>&nbsp; </span>She sai=
d if
they total up the amount expected possibly in 2008 for revenues the commiss=
ion
amount they would need to expend would be approximately $22,000.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>She asked for guidance from the
Selectmen.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Lynde discusse=
d the
way the funds had been taken and suggested that they continue with the proc=
edure
they had used, which was to pay for the commission out of the proceeds and =
then
put the net into the fund.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Th=
ey
would then come in with a warrant article to withdraw money from the fund to
maintain the property and prepare such for sales.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Gaydos said it was a system th=
at had
worked for a long time because the value of the harvest changes and the
commission changes.<span style=3D'mso-spacerun:yes'>&nbsp; </span></p>

at the
amount of money that was appropriated for this year that the income would
exceed such and would also do the same next year. </p>

the need for the second egress at Muldoon, having been there on a regular b=

&#8216;no cost&#8217; item for Muldoon would be obtaining the deed for the

was
not subjecting the Town to a situation where a dog bites, frightens or
intimidates a child or an adult.<span style=3D'mso-spacerun:yes'>&nbsp; </s=

wasn&#8217;t against a Dalmatian, but his first responsibility was to a
liability that the Town might fact.<span style=3D'mso-spacerun:yes'>&nbsp;

<p class=3DMsoNormal>Mr. Haverty said the incident started with a Town empl=
oyee
(Fire Chief) bringing a Dalmatian, a pet, into a Town office, the Fire
Station.<span style=3D'mso-spacerun:yes'>&nbsp; </span>He said he was tryin=
g to focus
his thoughts on a uniform policy that was enforceable across all
departments.<span style=3D'mso-spacerun:yes'>&nbsp; </span>In his opinion p=
ets
brought in by employees presented an unmitigated liability and a risk to
everyone in the office.<span style=3D'mso-spacerun:yes'>&nbsp; </span>He sa=
id any
pet brought into an office had the ability to physically harm someone.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Haverty understood all the
&#8216;feel good&#8217; reasons for having animals in Town offices, but fel=
t it
was a liability and risk.<span style=3D'mso-spacerun:yes'>&nbsp; </span>He =
said
the Selectmen had the responsibility to protect Town against unreasonable r=
isks
and to draft a policy to be enforced uniformly across all departments.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Haverty said the Selectmen had=
 spent
time discussing the issue over the past couple weeks and given their other
priorities it was an unreasonable amount of time on an issue about
someone&#8217;s personal pet.<span style=3D'mso-spacerun:yes'>&nbsp; </span=
>He
wanted the issue resolved at the current meeting so they could move on to t=
heir
other priorities.<span style=3D'mso-spacerun:yes'>&nbsp; </span></p>

<p class=3DMsoNormal>Mr. Viger said he read Mr. Danevich&#8217;s policy and
wouldn&#8217;t be opposed to come up with different policies that may
contribute to such, or improve, or offer different suggestions.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>He wanted to put a couple policies=
 in
front of the people and get a consensus, then it would be up to the Selectm=
en
to figure out which policy would be the best fit.<span
style=3D'mso-spacerun:yes'>&nbsp; </span></p>

<p class=3DMsoNormal>Mr. Danevich said the policy was prompted by the Fire =
Chief
requesting to have a fire dog.<span style=3D'mso-spacerun:yes'>&nbsp; </spa=
n>He
said the fire dog was an American icon.<span style=3D'mso-spacerun:yes'>&nb=
sp;
</span>He said it had been adopted by the National Fire Protection Associat=
ion;
Sparky the Fire Dog.<span style=3D'mso-spacerun:yes'>&nbsp; </span>He felt =
it
warranted an exception in this case.<span style=3D'mso-spacerun:yes'>&nbsp;
</span>He agreed that the Selectmen didn&#8217;t have to take action at the
present meeting and felt strongly about a &#8216;blanket&#8217; statement a=
bout
animals.<span style=3D'mso-spacerun:yes'>&nbsp; </span>He felt a public com=
ment
period would be good.<span style=3D'mso-spacerun:yes'>&nbsp; </span>He gave
examples of animal related activities (cat and dog rabies clinic, reptile
shows) and questioned what would happen to them if all animals were banned.=

style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Danevich said this was a speci=
fic
problem that was well understood by the fire industry that had a tremendous
amount of research about dogs in the workplace.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Danevich then read the draft D=
og in
Workplace Policy.<span style=3D'mso-spacerun:yes'>&nbsp; </span></p>

<p class=3DMsoNormal>Mr. Lynde recalled seeing the dot at Old Home Day.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>He said on the &#8216;face&#8217; =
of it
he saw no problem with the Fire Chief having the Dalmatian at the Fire Stat=
ion,
but there were issues of concern.<span style=3D'mso-spacerun:yes'>&nbsp;
</span>He said he viewed the Chief as a responsible person, who would not h=
ave
an animal on the premises that would affect his/or his men&#8217;s ability =
to
perform their job.<span style=3D'mso-spacerun:yes'>&nbsp; </span>He said the
areas described in the policy where the dog could not be were reasonable.<s=
pan
style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Lynde said there were some pos=
itive
aspects of the Dalmatian, such as encouraging people to come down to the
station.<span style=3D'mso-spacerun:yes'>&nbsp; </span>He said he would exp=
ect
that a reasonable approach be taken and felt the draft policy outline was a
good first step.<span style=3D'mso-spacerun:yes'>&nbsp; </span>He said he
didn&#8217;t want to start a trend with people bringing their dog to work.<=

know what objective and criteria there was to say that the pet would be used
for public safety and awareness.<span style=3D'mso-spacerun:yes'>&nbsp;
</span>Mr. Danevich questioned what constituted a &#8216;pet&#8217;. <span
style=3D'mso-spacerun:yes'>&nbsp;&nbsp;</span>Mr. Haverty said there was a
standard listing as to what was commonly accepted as a pet.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Specifically in regard to the Fire
Department Dalmatian provision, he didn&#8217;t feel that the dog served any
functional requirement.<span style=3D'mso-spacerun:yes'>&nbsp; </span>He
didn&#8217;t feel the Selectmen should authorize a department to have a
mascot.<span style=3D'mso-spacerun:yes'>&nbsp; </span>He felt the Board cou=
ld
create a policy that generally allowed/disallowed pets in Town buildings and
then create a mechanism by which those Town departments could apply to the
Selectmen (via the Town Administrator acting as their agent) for a specific=
 one
time exceptions.<span style=3D'mso-spacerun:yes'>&nbsp; </span></p>

<p class=3DMsoNormal><o:p>&nbsp;</o:p></p>

<p class=3DMsoNormal>Mr. Gleason discussed the policy of dogs not being all=
owed
on Town recreational property, which some people don&#8217;t listen to.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>He said if a dog bites a child or
individual, the tendency of today&#8217;s society was to sue the Town.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>He understood the altruistic objec=
tives
of having a dog, but felt in the final analysis the Selectmen should look at
the potential liability to the Town in the event the dog did something that
wasn&#8217;t anticipated.<span style=3D'mso-spacerun:yes'>&nbsp; </span></p>

<p class=3DMsoNormal>Mr. Haverty felt the Selectmen had other things to foc=
us on

Town buildings (specific verbiage to be worked off-line), but would allow f=
