The amendments to the minutes were as follows: page 2,= 1^st paragraph – the word ‘Club’ was added to the following – ‘..with the Salem Boys & Girls Club to…’; 4th paragraph – the word ‘said’ was replaced with ‘voic= ed concern over’ in the following ‘Mr. Haverty voiced concern over= the logistics of running…’; the ending times/motion were added. There were also minor grammatical amendments.

OPEN FORUM

Mr. Paul McDonagh, 7 Mammoth Road began by thanking the Boards for handling issues that come forward. He discussed the role of the Polic= e and Fire Departments and the scope of calls they receive. He focused on the Police Department’s budget and felt there should be more funds allocated to = help back the department. Mr. Glea= son said the budget was prepared by the Chief and submitted to the Selectmen for approval; he didn’t recall the Selectmen ever cutting the salaries. Mr. McDonagh wanted people to unde= rstand the stress of the Police Officers and hoped someone would have thoughts to = help the Officers. Mr. Gleason said there wasn’t a member of the Board that didn’t fully support or appreciate the efforts of the Police Department. He said the ultimate responsibilit= y of citizens was to appear before the Budget Committee and attend the Deliberat= ive Session. He said the ultimate authority for budgets and contract approval lay with the people at the vote= in March.

Mr. Gaydos provided an up= date regarding the Police union contract. He said the Police had gone a couple years without a contract. The T= own had recently concluded remediation and was encouraged to each go back to th= eir respective sides; the Board authorized a counter offer on September 17, 2007 and now = awaited a response. He said they wanted= to be able to bring a contract to the tax payers.

APPOINTMENTS

Corcoran Consulting – Will Corcoran: Cyclical Assessing Updates

Mr. Will Corcoran and Ms. Monica Gordon met with the Selectmen to provide an explanation of the Assessing Update Process. He provided information regarding = the impact of the 2006 revaluation. He also outlined the market changes during that same time. He showed a graph of the ratio cha= nges between 2006 and 2007. Mr. Co= rcoran explained that there were two revaluation alternatives: 1) continue with 5-year revaluations - 2006 cost $4= 50,000 every five years; or 2) begin cycled revaluations – projected costs $40,000 per year - $200,000 over five years. He discussed the revaluation versu= s the update components. He explain= ed the state assessment review and how assessment changes would be addressed. He said after the assessment was d= one a notice of preliminary review would be mailed to taxpayers and they would ha= ve the opportunity to review their changed assessments and speak to an apprais= al representative.

Mr. Lynde questioned the way the analysis was done. Mr. Corcoran explained that typica= lly revaluation companies were from out of state. He said his company was within the= state and had become very familiar with the Town and kept an eye out for changes.= He said they would conduct the revaluation cycle by doing 25% each year and the last year they would do commercial/industrial. When t= hey did each section they would also include any property that pulled a building permit or any property that was sold even if it wasn’t in the particu= lar sector. Mr. Lynde said his concerns were not the market value, but rather t= he variance between properties. = He said he wanted to make sure they were still being fair to people and not ju= st valuating at 100%. Mr. Corcor= an was also not fond of 100% valuation and felt 95% was close enough. He said there was a range of value= for any property. Mr. Lynde said = the COD was the most important figure and asked if it was fair to assume that t= he COD would remain low throughout the whole process. Mr. Corcoran said that was correct= , the smaller the number the more fair the assessments were for one property agai= nst another.

Mr. Lynde wanted to know how the public could be educa= ted regarding changes in their tax bills. Mr. Corcoran said education was important. He said the Town could conduct wor= kshops to explain the changes. He us= ed Gilford, NH as an example where information workshops had been conducted.

Mr. Viger wanted to know if the process could be done = by the towns or if the law required it to be done by outside sources. Mr. Corcoran said a few of the tow= ns could do it themselves in-house, but the vast majority call in companies to perform the appraisals. He sa= id the only place they did the assessing was in the towns that they served. He said currently there were not m= ore than four companies that did the work.&nbs= p;

Mr. Gleason felt the question that the Town would see = was from people feeling that their house was over-assessed. He wanted to know how the average = tax payer would be affected if the Town was assessed in sections. Mr. Corcoran said if they just low= ered the assessments by 5% nothing would happen to the tax bills. He said the Town could raise no mo= re money than what was authorized through the budget process. Mr. Lynde said the Town should hav= e comparison information of what the tax rate would have been if an adjustment was not m= ade. Mr. Corcoran said that information= was available and felt it could be conveyed to taxpayers even though it would b= e a complex process.

There was no public inpu= t.

Mr. Gaydos asked for clarification of the cycled updates. Mr. Corcoran explain= ed how the phases of the revaluation would occur.=

Mr. Lynde wanted to know what would happen if the residential property values in different areas of Town either increased or decreased at different rates. Mr. Corcoran said they would move the areas that were too high, down and move t= he areas that were too low, up. = He said the residential file is consistently very close and they review for th= at type of change. He said the i= dea of the updates was to reflect the value increases/decreases in the assessments= . He said this would ensure that no taxpayer was paying more/less of their fair share of the common tax burden = each year. He said he was open to discussions. Mr. Gleason conf= irmed that the adjusted value figures would come before the Selectmen prior to ma= king an overall assessment. Mr. Co= rcoran answered yes and indicated further that it wouldn’t come as a blanket recommendation, there would be impact studies and additional information. He said they couldn’t do any= thing without the authority of the Board of Assessors (Board of Selectmen).

Mr. Gleason thanked Mr. Corcoran and Ms. Gordon for me= eting with the Selectmen and explaining the assessment process.

Article K Waiver Application – Owner: Janice Wiegman, 3 South Shore Drive, Map 30 Lot 11-206

The Selectmen adjourned so they could convene as the B= oard of Health with Deputy Health Officer Paul Zarnowski as Chairman. Mr. Zarnowski called the Board of = Health meeting to order. He indicate= d that the Board would review an Article K application for a conversion of seasona= l to year round – Section 295-17 of the Waste Disposal Regulations. The request was submitted for 3 South Shore Drive – Map 30 Lot 11-206.

Mr. Lynde asked that the Board review what the Town Ordinances say regarding conversion to year-round. He believed the last time the Board discussed the topic there was mixed opinion if the Board had the authority = to do it. His assumption was tha= t a variance was still required for a conversion. Mr. Zarnowski said a variance was = not required for a conversion; there was no ordinance for a seasonal to annual residence. He said everything= was listed as ‘residential’. Mr. Lynde recalled that Article K didn’t allow for the conversion. Mr. Zarnowski read aloud a portion of Section 295:17 and 24 of the Pelham Health Ordinance, wh= ich was adopted Nove= mber 1, 1977 and updated in either 1990 or 1991. Article K was worked on in 1976 and came in 1977 further discussed in the early 1980’s (1982?). Part of the reason for bringing conversion before the Board because there was no such restriction in Zoning; and expansion would require an app= licant to go in front of the Board of Adjustment.= The State Administrative Rules indicate no waivers to the rules will= be granted for conversions.

Mr. Joe Maynard of Benchmark Engineering, representing= the applicant, met with the Board of Health to discuss the Waiver of Article K request and to represent the plan. <= /span>He said the design incorporated all the Article K regulations pertaining to se= tback to lake and distance to neighboring wells and wetlands. He said they worked with Mr. Zarno= wski who witnessed the test pit and has preliminarily reviewed the design. He said even thought the lot had e= nough room to put a conventional system, the applicant has chosen to use a Clean Solutions system. Mr. Maynard= said the state requirements would be met and they were before the Board for the conversion.

Mr. Zarnowski asked if the lot was large enough to mee= t the state criteria for the proposed use. Mr. Maynard answered yes; the calculations show that the lot could support a system large enough for three-bedrooms. He discussed the way the calculati= ons were done. Mr. Zarnowski note= d if a person had an existing lot of record, the state would allow a system design= ed for two-bedrooms with a specific design.&n= bsp; He said the state didn’t classify a vacant lot as ‘seasonal’ or ‘year-round’.

Mr. Lynde asked for a description of the existing sept= ic system and its location. Mr. Maynard said they believed the existing system to be a drum in the ground w= ith stone around it. There was no= real data on it. The previous owner indicated that the dry well was the actual septic system. It is located between the existing dwelling and garage. Also the location of the existing system was that it was on top of the water table, = or it was in it. The new field w= ould meet the Town’s 4ft. requirement.&nb= sp;

Mr. Lynde confirmed that the applicant was not request= ing waivers to the Town’s requirements for septic systems. Mr. Zarnowski said that was correct. Mr. Lynde also confi= rmed that the applicant was only requesting permission to put a conforming system and to allow conversion from a seasonal dwelling to a year round dwelling a= nd to install a conforming septic system on the property. Mr. Zarnowski said that was correct.

Deb Waters – Forestry

Forestry Committee members Deb Waters and Bob Lamourea= ux came forward to discuss two proposed warrant Articles for the upcoming ball= ot in March, 2008. The first art= icle would designate some areas adjacent to existing conservation areas as Town forest. Ms. Waters read the proposed warrant aloud. Mr. G= leason asked if designation of the land as forestry land would preclude its use for recreational or other activities. Mr. Waters said she would have to do some research for the answer. Mr. Lynde didn’t believe tha= t designating land as forestry land restricted its use for recreational purposes.

Mr. Danevich asked that the lot lines be verified sinc= e the information would be contained in a warrant. Ms. Waters and Mr. Gaydos would wo= rk together on this.

Ms. Waters said the second warrant article was for the annual budget. She reviewed t= he money that had been taken out as well as the balances. They wanted to discuss a slight ch= ange in the calculations. They wer= e sure if they wanted to take the commission off the proceeds before deposit into = the fund. Ms. Waters said the rea= son for this was that they were getting into larger parcels where the commission would be much larger. She sai= d if they total up the amount expected possibly in 2008 for revenues the commiss= ion amount they would need to expend would be approximately $22,000. She asked for guidance from the Selectmen. Mr. Lynde discusse= d the way the funds had been taken and suggested that they continue with the proc= edure they had used, which was to pay for the commission out of the proceeds and = then put the net into the fund. Th= ey would then come in with a warrant article to withdraw money from the fund to maintain the property and prepare such for sales. Mr. Gaydos said it was a system th= at had worked for a long time because the value of the harvest changes and the commission changes.

Mr. Gaydos asked the status of signs. Ms. Waters said they had two signs= they were struggling with. One of = which was put on the back burner, the other had been brought forward. Mr. Gaydos said they had prototype= s done and said he would help if they needed the work done.

There was a brief discussion regarding the current bal= ance of the fund. Ms. Waters discu= ssed some of the bids that had been coming forward. Mr. Gleason told Ms. Waters that s= he should be prepared when defending the warrant in Deliberative Session and to note that they planned to replenish the balance with ample monies. Mr. Lynde felt they could state th= at the amount of money that was appropriated for this year that the income would exceed such and would also do the same next year.

The Selectmen concurred = with the proposed warrant articles as stated.

Warrant Article Discussions

The Selectmen reviewed the proposed warrant articles t= hat had been submitted. There wer= e a total of twenty-one proposed articles.&nbs= p; Mr. Danevich reviewed the warrant articles from last year’s warrant and questioned what the Selectmen would like to do with them: 1) se= cond egress to Muldoon $170,000 and 2) upgrade Sherburne Hall and six classrooms. Mr. Haverty discu= ssed the need for the second egress at Muldoon, having been there on a regular b= asis for sports. Mr. Danevich said= the ‘no cost’ item for Muldoon would be obtaining the deed for the transfer of land for the egress. He said they knew where the egress would be placed. Mr. Gaydos said there was still a question as to whether it would be an easement or an outright deed; there w= ere some planning issues to review. The Selectmen would add a placeholder for Sherburne Hall.

OTHER BUSINESS

Resignation of Park and Recreation Director, Darren McCarthy

Park & Recreation Director Darren McCarthy submitt= ed his letter of resignation effective October 20, 2007.&n= bsp; He and his family were relocating to Texas. Mr. Gaydos read the resignation letter aloud. The Selectmen wished Mr. McCarthy = well in his new endeavors and thanked him for his service to the Town.

Animals in Town Buildings

Mr. Gleason said the intent for the discussion regardi= ng animals in Town Buildings was to try to come up with an objective, well fou= nded policy that would benefit both the Town and the residents. Mr. Danevich provided the Selectme= n with a first draft of a policy.

Mr. Gleason explained his position. He said he was not in favor of ban= ning an icon, or dogs but recognized that not all people embrace dogs or having = them on the premises. His concern = was not subjecting the Town to a situation where a dog bites, frightens or intimidates a child or an adult. He wasn’t against a Dalmatian, but his first responsibility was to a liability that the Town might fact.

Mr. Haverty said the incident started with a Town empl= oyee (Fire Chief) bringing a Dalmatian, a pet, into a Town office, the Fire Station. He said he was tryin= g to focus his thoughts on a uniform policy that was enforceable across all departments. In his opinion p= ets brought in by employees presented an unmitigated liability and a risk to everyone in the office. He sa= id any pet brought into an office had the ability to physically harm someone. Mr. Haverty understood all the ‘feel good’ reasons for having animals in Town offices, but fel= t it was a liability and risk. He = said the Selectmen had the responsibility to protect Town against unreasonable r= isks and to draft a policy to be enforced uniformly across all departments. Mr. Haverty said the Selectmen had= spent time discussing the issue over the past couple weeks and given their other priorities it was an unreasonable amount of time on an issue about someone’s personal pet. He wanted the issue resolved at the current meeting so they could move on to t= heir other priorities.

Mr. Viger said he read Mr. Danevich’s policy and wouldn’t be opposed to come up with different policies that may contribute to such, or improve, or offer different suggestions. He wanted to put a couple policies= in front of the people and get a consensus, then it would be up to the Selectm= en to figure out which policy would be the best fit.

Mr. Danevich said the policy was prompted by the Fire = Chief requesting to have a fire dog. He said the fire dog was an American icon.&nb= sp; He said it had been adopted by the National Fire Protection Associat= ion; Sparky the Fire Dog. He felt = it warranted an exception in this case. He agreed that the Selectmen didn’t have to take action at the present meeting and felt strongly about a ‘blanket’ statement a= bout animals. He felt a public com= ment period would be good. He gave examples of animal related activities (cat and dog rabies clinic, reptile shows) and questioned what would happen to them if all animals were banned.= Mr. Danevich said this was a speci= fic problem that was well understood by the fire industry that had a tremendous amount of research about dogs in the workplace. Mr. Danevich then read the draft D= og in Workplace Policy.

Mr. Lynde recalled seeing the dot at Old Home Day. He said on the ‘face’ = of it he saw no problem with the Fire Chief having the Dalmatian at the Fire Stat= ion, but there were issues of concern. He said he viewed the Chief as a responsible person, who would not h= ave an animal on the premises that would affect his/or his men’s ability = to perform their job. He said the areas described in the policy where the dog could not be were reasonable. Mr. Lynde said there were some pos= itive aspects of the Dalmatian, such as encouraging people to come down to the station. He said he would exp= ect that a reasonable approach be taken and felt the draft policy outline was a good first step. He said he didn’t want to start a trend with people bringing their dog to work.<= span style=3D'mso-spacerun:yes'> He said he would support looking a= t it as a promotional/positive advertising point of view without impeding any To= wn operation.

Mr. Danevich suggesting having the policy put out for = public comment and consideration from the Board members and revisit it in two weeks.

Mr. Haverty had some concerns with the draft policy. He felt the policy should not just= cover ‘dogs’, which was too specific, but rather it should cover ‘pets’. He wanted= to know what objective and criteria there was to say that the pet would be used for public safety and awareness. Mr. Danevich questioned what constituted a ‘pet’. Mr. Haverty said there was a standard listing as to what was commonly accepted as a pet. Specifically in regard to the Fire Department Dalmatian provision, he didn’t feel that the dog served any functional requirement. He didn’t feel the Selectmen should authorize a department to have a mascot. He felt the Board cou= ld create a policy that generally allowed/disallowed pets in Town buildings and then create a mechanism by which those Town departments could apply to the Selectmen (via the Town Administrator acting as their agent) for a specific= one time exceptions.

Mr. Gleason discussed the policy of dogs not being all= owed on Town recreational property, which some people don’t listen to. He said if a dog bites a child or individual, the tendency of today’s society was to sue the Town. He understood the altruistic objec= tives of having a dog, but felt in the final analysis the Selectmen should look at the potential liability to the Town in the event the dog did something that wasn’t anticipated.

Mr. Haverty felt the Selectmen had other things to foc= us on and waiting two weeks would further distract them from more important matters. He made the following motion: To direct the Town Administrator to draft a policy prohibiting pets= from Town buildings (specific verbiage to be worked off-line), but would allow f= or specific mechanisms by which a department, or group, or board could petition the Board of Selectmen for a special one-time exception to allow these anim= als for reasons of ceremony, or other events.&= nbsp; Mr. Viger seconded the motion.

There was further discus= sion regarding how the Selectmen wanted to proceed.

Mr. Gleason asked if it was the decision of the Board = to go forward with the policy after public exposure. Mr. Danevich said the policy was a working draft. Mr. Viger saw = the document as such. He said he = was hoping to have the opportunity make adjustments to it. Mr. Lynde said he wanted whatever mechanism allowed them to get feedback and to understand the ramifications = of a policy they would potentially adopt. He said he wasn’t ready to vote on anything at this point. Mr. Gleason said the motion failed= and asked the Board once again what the Board wanted to do. He questioned if they wanted to pu= t it back on the agenda in two weeks after public exposure. The majority of the Board was in f= avor of having further discussion in two weeks.= Mr. Haverty said he would not give the matter anymore thought and wo= uld recuse himself from the vote in two weeks.=

Mr. Danevich requested to make a public clarification = of a newspaper article contained in the Lowell Sun where he was misquoted. H= e read the article aloud. He wanted = to be clear that he was not aware of Police K-9 Zahn nipping or biting or doing anything to anybody.

Request for Town Master Plan Contract with NRPC – Signing<= o:p>

Mr. Gleason said the Selectmen had received a copy of = the Town Master Plan Contract with NRPC to authorize them to proceed. He said he had been asked to execu= te it. He said he had been told = that the Planning Director had the money in his budget for it. Mr. Gleason asked what the schedul= e was for execution of the items. M= r. Gaydos said he could provide the update.&n= bsp; Mr. Gleason also asked for verification that the numbers contained in the document for the schools were actually the numbers the school used in preparation of their budget. = Mr. Gaydos would verify the information.

American Red Cross of Merrimack Valley: Statement of Understanding

Mr. Gaydos said the agreement was one that was signed = with the American Red Cross annually. He went on to review the document and read it aloud. He said the Town got more from the= Red Cross than they gave to them and highly recommended signing the agreement.<= span style=3D'mso-spacerun:yes'>

(Danevich/Lynde) To sign the annual statement of understanding between the American Red Cross of Merrimack Valley and the = Town of Pelham by the Selectmen’s authorized agent, Tom Gaydos.

Highway Safety Committee: Update Request/New recommendations

Mr. Gaydos reviewed the following service requests sub= mitted by the Highway Safety Committee:

1= ) = dated August 10, 2007<= /st1:date> – dead end sign to be installed at the beginning of Pete’s Way;=

2= ) = dated August 12, 2007<= /st1:date> – dead end sign to be installed at the intersection of Hillcrest and = Melody Lane= ;

3= ) = dated August 14, 2007 (may require public hearing) – to add a three-way sto= p at the intersection of Shepard Road & Harley Road and also at Shepard Road & Mulberry Lane; and

4= ) = during September 27, 20= 07 meeting – to ask to have a cross walk and cross walk warning signs installed on Marsh Road in the vicinity of Village Green.

Mr. Gaydos believed that the cross walk and warning si= gns would require a public hearing and an official ordinance passed so the Poli= ce could cite such ordinance in the event of a traffic violation.

There was a consensus of the Selectmen to allow with t= he Highway Safety Committee to proceed with the requests.

TOWN ADMINISTRATOR / SELECTMEN’S REPORTS

Mr. Lynde discussed a situation that he witnessed over= the weekend involving the injury of a teenager who was skateboarding on Debbie Drive. The teenager sustained head injuries and was transported via Med Flight to Mass General Hospital where he i= s now recovering. He said the actio= ns of the Fire Department were commendable. Mr. Lynde said he joined the Planning Director and Dave Justice (UNH= Granite State Project) on September 19, 2007 to do a boundary perambulation. He said for each boundary found a = GPS reading was done. He said on = September 21, 2007 he attended a NH Municipal Advocacy Committee where some of the Legislation fr= om the past session was discussed. He said one thing they had some success with was passing legislation relative = to the NH retirement system.

Mr. Danevich said he had the opportunity to have his c= ar washed by the Pelham Memorial School Chess Club. He said they did an awesome job and donated part of his annual stipend. He said he had never taken a dollar from the Town for serving in his role as Selectmen. He said he reinvests back into the Town.

Mr. Haverty provided a report with regard to the Fire Station Committee. He said on Friday, Septembe= r 14, 2007 an RFQ/RFP had been sent out for construction management services. Submission deadline was Friday, September 28, 2007= . Tuesday, October 2, 2007 a conference call was condu= cted to review and rank the five responses; they agreed on the top two they want= ed to interview. Thursday, October 4, 2007 in= terviews were conducted and Eckman Construction was the construction management firm= of choice. He said Eckman would = be providing the estimating services for the Fire Station Committee which would get them through Budget Committee review with defendable documented figures. Mr. Haverty said at = this point they had an agreement with Eckman which needed a motion to appoint Mr. Gaydos to execute the contract, pending legal review, for a fee not to exce= ed $1500 through Budget Committee review.&nbs= p;

Mr. Gaydos provided the Selectmen with a revised Debt Service/Interest Plan. He sai= d they adjusted the Fire Truck and the Interest on the TAN Notes and on the BAN Notes. He asked that the Sele= ctmen support the revisions so they could be presented to the Budget Committee la= ter in the week.

Mr. Gaydos said the reason the Construction Manager was brought on now was not only to do the estimating, but they would also be reviewing the way that the architect design the station and looking for bet= ter ways to construct to save money. He then reported that Park & Recreation’s 1^st Annual Golf Tournament would be held October 20, 2007 and were seeking people to sign up. He said if anyone was interested in sponsoring a team or a hole the Park & Recreation website had information. The proceeds wil= l benefit the scholarship fund for summer camp.

Mr. Gleason said he met with NRPC on September 19, 2007. He said they indicated that the te= n-year plan update looked like current revenues estimates for the time frame would= put project out approximately twenty-two years. He said they were also instituting= a Regional GIS and Technical User Group and were seeking volunteers from the various towns to participate; the first meeting would be held November 15, 2007 at 12pm. He said he received a letter from = National Grid indicating that they sent letters to residents and business owners ind= icating that they regretted any inconvenience those residents or business owners had experienced.

Mr. Gleason then read aloud his resignation letter eff= ective October 10, 200= 7. He expressed his sincere gratitude= to the current Board of Selectmen and to the many dedicated Town employees he = had the pleasure of working with and the wonderful, unselfish volunteers who had been supportive of his efforts on behalf of the Town.
