APPOINTMENTS

Park & Recreation Impact Fees

Planning Director Jeff Go= wan and Park & Recreation Director Brian Johnson came forward to discuss the proposed impact fee that had been previously discussed with the Board. Mr. Gowan said the impact fee was = set up with two components: one for Park & Recreation and the other for the Senior Center. A memo, drafted by Mark Fougere, s= howing how the fee schedule was set up (and alternate options) had been provide to= the Selectmen for review. Mr. Gay= dos said the question for the Selectmen was whether they wanted to pursue the impact fee, or table it.

Mr. McDevitt said he was concerned with the gym being identified as being located at Pelham Veteran&= #8217;s Memorial Park (‘PVMP’), which seemed to be premature. He understood the need to plan, bu= t was concerned with the Town’s backlog of capital projects. He believed if the Selectmen suppo= rted the gym, it would send a message to the voters that they would be adding another capital project onto the already long list. He said he would like to see that portion removed from the impact fee and leave the Senior Center portion. He explained that the voters already had a chance to ‘weigh in’ on the Senior Center and placing money into a capital reserve fund.

Mr. Lynde said there had = been a growing need for an indoor recreation facility. He didn’t see that it would = be placed on the ballot for several years, and questioned if funds should be collected for it through an impact fee.&nb= sp; He wouldn’t want to forego the revenue source that could help offset the future cost.

Mr. Danevich noted that v= oters supported placing funds into capital reserve account for the Senior Center. He commented that voters had turne= d down the gymnasium twice. He suppo= rted the park and recreation program and would be comfortable with the impact fe= e if it didn’t specify a gym at PVMP.&nbs= p; He noted there was an area behind Lyon’s Park that may be more cost effective to expand. He didn’t want to lock the T= own into one specific solution. <= /p>

Mr. Gaydos asked if Mr. F= ougere indicated the Town could have the Senior Center impact fee u= nder parks and recreation. Mr. Gow= an stated that the impact fee would be in two parts. He noted Mark Fougere developed the impact fee so it would be possible to have just the Senior Recreation Impact Fee. Mr. Gaydos asked Mr. Gowan to run = that scenario past Attorney John Ratigan for an opinion.

There was further discuss= ion regarding the manner in which the impact fees could be addressed. Based on the discussion, there was= a consensus to not take action at this time and wait for Attorney RatiganR= 17;s opinion. It was noted that a = public hearing would be needed.

Mr. McDevitt made a motio= n to schedule a pubic hearing regarding the proposed impact fee for senior recreation projects. Mr. Dane= vich seconded the motion. Mr. Lynde asked if someone could come forward at the public hearing to support the gym. Mr. McDevitt said the pu= blic hearing would be on a specific subject; the Selectmen were asked what subje= ct would be discussed. He said t= he Selectmen could decide later to discuss the impact fee for the gym.

MOTION:

(McDevitt/Dane= vich) To schedule a public hearing to hear public input on the proposed impact fee, which would be to support senior recreation projects.

VOTE:

(3-1-0) The motion carried.= Mr. Lynde voted no.

Fire Impact Fee Proposal from Mark Fougere

Planning Director Jeff Go= wan and Fire Chief Michael Walker came forward to discuss the Fire Impact Fee. Mr. Gowan stated after the discussi= on to change the Fire Impact Fee schedule, he and the Chief hoped to do it themse= lves but found it more complicated than they anticipated. He said Mark Fougere gave a propos= al of $5500 to update the impact fee schedule and believed the previously collect= ed fire impact fees could be used to do so.&n= bsp; Mr. Gowan stated that he checked this with Attorney John Ratigan and= was told the impact fees could not be used.&nb= sp; He explained that the schedule was based on the previous Fire Chief’s vision of the department (substations first and then a central station) and was set up to only collect for residential building. A suggestion was to set up the fee= to assess a type of structure as opposed to the square footage.

Mr. Gaydos stated there wasn’t a question that the impact fee needed to be updated, it was a question of where the money would come from. He asked Mr. Gowan if he had money= in his budget for this. Mr. Gowa= n said he had approximately $2000 in his budget. Mr. Gaydos asked the Board if they = wanted to approved Mr. Gowan moving forward to revise the impact fee so it would reflect more accurately the future needs of the community.

The Board discussed if th= ey would move forward at this time and the associated impacts. It was noted that there are certain times of year when building surged; in the fall and in the spring. Mr. Gowan said he would review his budget to find the additional funds and present the information back to Mr. Gaydos.

There was a general conse= nsus of the Board to have Mr. Gowan move forward to review his budget, and present = the information to Mr. Gaydos. A = public hearing would also need to be scheduled as soon as possible.

Scheduling Immediate Public Hearing to change Hillcrest Lane (off Jericho Road) to Garland Drive

Planning Director Jeff Go= wan noted that there were a number of hearings in 2003 to review ‘sound alike’ and other road name issues.&n= bsp; He discussed an issue that had come up regarding Hillcrest Lane. In summary there are two Hillcrest= Lanes that don’t connect to each other, one remained named Hillcrest, and t= he other had a portion of it changed on July 1, 2008 to Morgan Lane. This change left the first half of the road (from Jericho Road to Garland Drive) still named Hillcrest Lane so the problem of two roads (with the same name) not connecting remains. Mr. Gowan said the Highway Safety Committee was prepared to do the notifications to the residents on Hillcrest (from Jericho) as well as Garland Drive, if they felt it was the appropriate step to take.

Mr. Danevich questioned w= hy the problem wasn’t picked up during the process. Mr. Gowan believed there was discu= ssion regarding the road name change, but at the time of the hearings more focus = was placed on the renumbering of streets.

There was further discuss= ion regarding the request to contact residents and conduct a public hearing. Mr. Lynde made a motion to schedul= e a public hearing. Mr. Danevich seconded the motion for discussion. He reviewed the spreadsheet that indicated which roads would have th= eir names changed. He saw that Garland Drive was not part of the first phase changes. He said changing a portion of Hillcrest to Morgan would have created= two separate segments, which he didn’t believe they would have done. Mr. Gowan said in reviewing the mi= nutes from the 2003 meetings, he found no discussion regarding the renumbering of= the entire Garland Drive. Mr. Danevich said he seconded the motion, but would like the opportunity to review the Selectmen’s minu= tes of November 18,= 2003. Mr. Lynde believed there was discu= ssion of changing a portion of H= illcrest Lane to Garland Drive. Mr. Gowan said there had been a discussion at one of the public hear= ings that the first entrance of Hillcrest Lane would become Garland Drive, but there was no continuing discussion of how the rest of Garland would be renumbered. He said = the beginning portion couldn’t have just a name change, because the number sequence wouldn’t work. Mr. Danevich said a public hearing would be needed.

Mr. Danevich withdrew his second. Mr. Lynde withdrew his motion. Mr. Danevich said he = wanted the opportunity to review the minutes from 2003 to see what was done for notifications so he could come back with a recommendation.

Mr. Danevich asked Mr. Go= wan if there was an update on the map source companies (i.e. Mapquest). Mr. Gowan stated that in the past = the Department of Transportation had shared that information, but had since had= a policy change. Mr. Danevich said road names were public record and almost 9= 0% sure NRPC would get the information to the map source companies. There was further discussion about= how to have the Town’s roads updated.&nb= sp; Mr. McDevitt, whose son is Vice President at Tele Atlas, said he wou= ld work with Mr. Gowan to find out how the information could be updated.

Park & Recreation Donation Acceptance from FLIR Systems, Inc. – Brian Johnson, Di= rector Parks & Recreat= ion

Park & Recreation Dir= ector Brian Johnson informed that some Pelham residents work for FLIR Systems, In= c. which has a site giving program. He was contacted and asked for a wish list.&n= bsp; The company then approved a $3000 donation for Muldoon Park ground covering for the playground. Mr. Johnson said it was a generous donation and asked if it could be accepted.

A public hearing to accep= t the donation would be scheduled for two weeks.=

Budget Review (Financial Director Janet Gallant came forward to review the proposed budgets):

Planning Department – Planning Director Jeff Gowan came forward to review the requested 2009 budget. The 2008 operating budget was $274,142. The 2009 proposed b= udget request is $255,910 (a decrease of $18,232). Mr. Gowan reviewed the line items contained in the budget.

Town Clerk/Tax Collector – Town Clerk Dottie Marsden came forward to review the proposed 2009 budget. The 2008 operating budget was $189,552. The 2009 department request is $186,298 (a decrease of $3254).= The Selectmen reviewed the line items contained in the budget.

Elections – Town Clerk Dottie Marsden reviewed the propos= ed budget. The 2008 budget was $16,512. The proposed 2009 bu= dget request is $8634. The Selectm= en reviewed the line items.

OTHER BUSINESS

Sherburne Hall Donations

Mr. McDevitt said of the = $42,000 that the Sherburne Hall Committee had in private money, some of it was individuals who made donations over $500.&= nbsp; There was a question if a public hearing was necessary (retroactivel= y) to accept it. Mr. Gaydos stat= ed another question was if the total amount of funds could be accepted as one sum. Mr. Lynde noted that the= re had been a public discussion at a Selectmen’s meeting indicating what a person would get for the different level of donation amounts. It was noted that there were bids = in hand and the work was ready to be done.&nb= sp;

Mr. McDevitt noted that t= he names of the donors were public record.

There was a consensus to = schedule a public hearing to accept the donations as one sum of money.

TOWN ADMINISTRATOR/SELECTMEN REPORTS

Mr. Gaydos informed that = there was a budget for the work to be done at Sherburne Hall and they had bids in hand for much of the work that would be done. It was the Sherburne Hall Committee’s intent to inform the Selectmen of the winning bidder and = get the work done by the beginning of September.

A job description had been developed for the Health Officer position.= Mr. Gaydos said he would like to work with one Selectmen to work on = the description and bring it back to the Board for approval. Mr. McDevitt volunteered to work w= ith Mr. Gaydos.

Information was provided = to the Selectmen from the Local<= /st1:PlaceName> Government Center. Mr. Gaydos noted that they wanted = the Town to make a decision (by September 5, 2007) who would be the voting delegate.

Mr. Gaydos stated that th= e last policy change for the Transfer Station indicated that recycling and separat= ion was mandatory. He said this h= ad never really been enforced and the Transfer Station Superintendent Bruce Ma= son suggested that the Selectmen come up with a warning reminder and after a resident receives a couple reminders they would be suspended from using the Transfer Station for a period of time.&nbs= p; There was a brief discussion regarding the suggestion of having a warning system. Mr. Gaydos sa= id they would come up with a progressive program that the Selectmen could approve. Mr. McDevitt stated = that there was a committee reviewing methods to encourage recycling. He was not aware of a method that = would work. Mr. Lynde felt that the= re was a mandatory policy that should be enforced. He said there should be some conse= quence and the committee would review the process. Mr. Danevich saw the policy as a Selection action that changed the process; in the event something occurred = they would have action and authority to enforce it. He couldn’t envision the Town adding staff to look through trash. Mr. Haverty believed a proposal/recommendation for an enforcement mechanism along with a penalty structure should be drafted. Mr. Gaydos said he would ask the committee what their thoughts were.

Mr. Gaydos informed that = correspondence had been received from the Cemetery Trustees that they regretfully accepted= the resignation of Jeanette McCoy as a Trustee. The Selectmen discussed how to app= roach the vacancy. Mr. Gaydos would advertise the opening.

Mr. Danevich stated that = he met with the subcommittee of the Council on Aging who were working through the plans and facility usage. He = said they intended, and hoped for Selectmen support, to place a warrant article = on the ballot for $100,000 to be placed in the capital reserve fund.

Mr. McDevitt said a public hearing would have to be held for paint.&n= bsp; A local company would be making a donation of approximately 65 gallo= ns of paint. He asked that the p= ublic hearing be scheduled for the next possible meeting. Mr. Haverty said it would be sched= uled for two weeks.

Mr. Lynde stated weather permitting, a concert would be held on the village green. He noted that concerts would also = be held for the next two weeks as well.
