CALL TO ORDER – 6:30pm

APPOINTMENTS

2009-2011 Landscaping Bid Recommendations- Possible Award

Mr. Gaydos stated that six bidders submitted a bid. He explained what was included in the bid.&nb= sp; He then provided the bid amounts and the companies that submitted to= the Town. The recommendation from= Mr. Gaydos and Park & Recreation Director Brian Johnson was to award the th= ree year bid to Boyden in the amount of $328,989. Mr. Gaydos provided an explanation= of the bid process that was followed. <= /span>

Mr. Haverty questioned if= the bid packages were complete, or if there were any that were missing materials. Mr. Gaydos stated that TruGreen on= ly bid on the fertilizing and were not considered. Mr. Haverty asked if there was any= thing from the companies that would disqualify a vendor. Mr. Gaydos stated that the bidders= were pretty much on equal footings. Mr. Haverty asked if all six companies attend the bid opening. Mr. Gaydos said not all six were present, but had been notified.

MOTION:

(Haverty/Lynde= ) To follow the recommendation of Town Administrator Tom Gaydos and Park & Recrea= tion Director Brian Johnson to award the three-year landscape contract of $328= ,989 to Boyden Landscaping.

VOTE:

(4-0-0) The motion carried.

OPEN FORUM

Mr. Joe Paquette, 9 Sprin= g Street Extension saw that in the sample ballot there was $4.7 million to be raised= for a new fire station that would be offset by tax impact fees. He questioned how much was contain= ed if the impact fees. Mr. Gaydos s= aid there was approximately half a million.&nb= sp; Mr. Haverty clarified that the funds were ‘building impact fees’ not ‘tax impact fees’. Mr. Paquette questioned why the to= tal funds would have to be raised if the amount was going to be offset. Mr. Gaydos noted that the warrant article was submitted by petition. He said regardless of the money that would be put into the project, authorization was needed to raise the $4.7 million. He said the article reads ‘u= p to $4.7’ and explained if the cost was less, the Town would only have to raise what was needed. Mr. Pa= quette wanted to know how the Town’s people could be assured that the half million would be spent on the new fire station. Mr. McDevitt said if the money wasn’t going to be spent on the fire station, it would have to be giv= en back.

PUBLIC HEARING – to adopt the New Fire Station & Recreation Impact Fee Schedules

Planning Director Jeff Go= wan reviewed the Fire Impact Fee Schedule and summarized how the fee was structured.

Mr. Haverty recalled that= the Planning Board didn’t oppose splitting the recreation fee schedule (recreation building / senior center recreation). He confirmed that the Selectmen wo= uld be able to enact one, or both of the fees.&nb= sp; Mr. Gowan said that was correct.

PUBLIC INPUT

Mr. Joe Paquette, 9 Sprin= g Street questioned what the impact fee was for.&nb= sp; Mr. Gowan stated that the Seniors were planning an expansion (additi= on to existing building). An ana= lysis was done to determine how much of the proposed space would be for recreation purposes; impact fees can only be used for future needs. The Senior Recreation Fee would be= used for future growth based on the impact of building. Impact fees are charged at the tim= e a building permit is pulled for construction.

Mr. Paquette asked if the= re were any ‘hard’ numbers for what the new fire station would cost the taxpayers. Mr. Viger stated t= hat there were variables such as the bond rate and length of the note. There was a brief discussion regar= ding tax impacts; Mr. Gaydos stated (based on rough numbers) if the note had a twenty year term there would be an impact of $.35 - $.40 per thousand.

Mr. Leo Thibeault, Simpson Road questioned when the taxpayers would have in increase in taxes if the propos= ed fire station passed. Based on= his understanding of work still to be done, Mr. Thibeault didn’t see that there would be an impact until 2011. Mr. Viger said he wanted to keep the discussion to the issue of accepting impact fees. Mr. Ga= ydos stated that quite a bit of work had already been done and they would be rea= dy to go out to bid by June or July. He said if bids were awarded in July (2009), work would begin in Aug= ust (2009) and be finished in 2010. The first increase would be in 2011; part of it (depending on the impact fee schedule) could be absorbed by the impact fees.

After further discussion,= the following motions were made: <= /span>

(Danevich/Have= rty) To adopt the Fire Station Impact Fee Schedule as presented in the 2009 plan.=

VOTE:

(4-0-0) The mo= tion carried.

A motion was made by Mr. = McDevitt to adopt the Recreation Impact Fee as written September 4, 2008 as it applies to the= Senior Center and specifically to exclude the gym fee.&n= bsp; Mr. Haverty seconded the motion.&nb= sp; Mr. Danevich asked if the impact fee schedule would be amended to include the fact that only the senior portion was adopted. He felt it would be confusing if t= he gym fee was to remain in the schedule. Mr. Gowan pointed out if the Selectmen were to adopt the fee schedul= e as shown on page twelve, it would clearly indicate the Selectmen’s intent. Mr. McDevitt amended = his motion to read: To adopt the Recreation Impact Fee as presented in the publ= ic hearing March 3, = 2009; specifically adopting that portion outlined on page twelve which applies on= ly to the Senior Center. Mr. Haverty seconded the motion. Mr. Danevich questioned if the doc= ument would be updated to reflect the motion.&nb= sp; Mr. Gowan didn’t feel that the document needed to be updated.<= span style=3D'mso-spacerun:yes'> Mr. McDevitt said he would let his motion stand. He asked that M= r. Gowan update page twelve of the fee schedule to indicate that the fees were adopted. He also asked that t= he impact fee analysis (for the Senior Center and Fire) be included with the minutes. &nbs= p;

(Haverty/Lynde= ) To adopt the Recreation Impact Fee as presented in the public hearing March 3, 2009; specifically adopting that portion outlined on page twelve which applies = only to the Senior Center.

VOTE:

(4-0-0) The mo= tion carried.

TOWN ADMINISTRATOR’S / SELECTMEN’S RE= PORTS

Mr. Gaydos had no report.

Mr. Haverty discussed Senate Bill 99 and that he had asked Senator Mike Downing= to reconsider his support and found that he had already reconsidered. Senator Downing assured Mr. Havert= y that he would vote in opposition to the bill and speak against it on behalf of Pelham on the Senate floor. <= /p>

Mr. Viger spoke for the Selectmen when he told Mr. Danevich it was an honor to serve with him on the Board. =

Mr. Danevich thanked the Selectmen. He discussed the numerous things he had been involved with during his years as Selectmen and thanked all the people who helped the Town through the years.= He also discussed the stipend give= n to the Selectmen and the ways in which he had contributed the full amount back= to the Town for various activities and causes such as fundraisers. He said there were certain open it= ems he wanted the Selectmen aware of. The first being the technology plan, which he would like to continue with an ac= tive role. The skate park lights project; all the equipment was acquired, but there was a lack of funding for installation. The third item = was the codification project that needed final organization and posting. Mr. Danevich said it had been an h= onor being on the Board.

Mr. McDevitt commented that people don’t always understand the commitment= of the Board members. He said th= at he and the taxpayers appreciated the personal sacrifices made by Mr. Danevich.=

It was noted tha= t when the Board returned, after the non-public session, the Board would not take = any other action publicly, except to possibly seal the minutes of the non-public session and to adjourn the meeting. The Board entered into a non-public session at approximately 7:29 pm.

The Board returned to public session at approximately 8:35pm.
