OPEN FORUM

Fire Fighter Richard Hane= gan – Horribles Parade – He reported that the 10^th Horri= bles Parade would be held November 1, 2009 beginning at 4:30pm at Memorial School and ending at Lyons Park. There will be many fun attractions= for families, such as hay rides, pumpkin strolls, and movies. Food and beverages will also be se= rved free of charge.

The Selectmen commended a= nd thanked the Fire Department, Mr. Hanegan and the volunteers for their suppo= rt and involvement in the community.

APPOINTMENTS

Health Officer Candidate Interview – Dr. Srilatha Kodali

Mr. Gaydos stated that the position of Health Officer was filled by the Deputy Health Officer (Paul Zarnowski). He said the previ= ous plan was to split the position and have Mr. Zarnowski handle septic systems etc. and have a different person (with medical experience) act as health officer and handle other items. In the absence of a health officer, Fire Chief James Midgley was ensuring that= all information flowed smoothly; he would also be the main contact for the Heal= th Officer and Mr. Gaydos would be available for administrative items. He explained that the Selectmen wo= uld need to make a recommendation to the state for a health officer and in turn= the state would appoint the Health Officer.&nb= sp; The appointment would stand until rescinded by the Board.

Mr. Gleason questioned wh= en Dr. Kodali would find the time for the position. Dr. Kodali stated that she wanted = to do community work. She commended= those who were doing volunteer work within the Town.

Mr. Lynde understood that= the Health Officer had a variety of duties and questioned if the position would= be handling business and daycare inspections.= Mr. Gaydos said the restaurant inspections went through the state and had specific guidelines. A st= ate inspector comes to Pelham and inspects all the restaurants. Mr. Gaydos said a member of the Fi= re Department conducted the daycare inspections. Mr. Lynde asked if Dr. Kodali woul= d work in conjunction with Chief Midgley. Mr. Gaydos said Chief Midgley would be the Health Officer’s pr= ime contact. He said if they need= ed other administrative help, he would be their contact.

Mr. Haverty asked if Mr. Zarnowski would still convene the Board of Health. Mr. Gaydos said he would because A= rticle K’s were septic issues.

The Selectmen were being = asked to make a recommendation to the Commissioner of the Department of Health and H= uman Services to appoint Dr. Kodali as the Town’s Health Officer.

Mr. McDevitt commented th= at Dr. Kodali was highly qualified for the position and he was happy she came forward. He believed two applications had been received and said the other person deserved an interview. Mr. Gaydos said the other applicant wasn’t available to attend the meeting. Mr. McDevitt reiterated that Dr. K= odali was very qualified, but wanted to make sure the other applicant had the opportunity to have an interview.

It was noted that Dr. Kod= ali was a Pelham resident who had a business in Town and that she had fifteen years experience being a primary care doctor.&nb= sp;

Mr. Haverty said that the Selectmen had received another application and wanted to afford the applica= nt to speak with the Selectmen. = He thanked Dr. Kodali for volunteering.

Conservation Commission Member Appointment for term ending April= 30, 2010 – Christine McCarron

Ms. Christine McCarron ca= me forward to discuss her application for appointment to the Conservation Commission. She told the Sele= ctmen that she had a lot of outdoor leadership experience and was interested in t= he protection of wildlife and preserving land and providing recreational opportunities to the residents of Town.&nb= sp; She had a great passion for the environment. She said her time had become avail= able and would like the opportunity to give back to the Town.

Mr. Haverty asked if ther= e was an open position on the Conservation Commission. Mr. Gaydos left the room to review= the Board’s positions.

Mr. Lynde appreciated whe= n people gave back to the community. H= e said in doing so everyone benefited. Ms. McCarron stated that she had been attending the Conservation Commission meetings as well as attending meetings at the Nashua Regional Planning Commission. She said she had = been learning a lot, all the members were being very helpful.

Mr. Gaydos came back from= the Selectmen’s office and told the Board that there were two positions available.

MOTION:

(Lynde/Gleason= ) To appoint Ms. Christine McCarron to the Conservation Commission effective immediately with a term ending April 30, 2010.

Article K Waiver Requests:

The Selectmen then voted = to convene as the Board of Health with Deputy Health Officer Paul Zarnowski as Chairman.

MOTION:

Mr. Zarnowski opened the = Board of Health meeting.

Map 31 Lot 11-273<= span style=3D'mso-spacerun:yes'> - 50 Woekel Circle, Owner Henry Rousseau – The waivers requested were as follows: 1) Section 295-16 – 75ft. from well to an effluent disposal area, 60ft. being requested; and

2) Section 295-16 -= 75ft. from the well to the tank and pipes, 50ft. being requested.

Mr. Lee Kavanaugh came fo= rward to present the request. He said = the lot was outside the limit of the Shore Line Protection Act. The system was not in failure, but= it was reacting slowly. The proposed system was designed with a waste water alternative system which would have = the least impact on the yard contours. The seasonal high water table was at 26inches. The old system is underneath the h= ouse; the sewage pipes and effluent disposal area are both within the 75ft. well radius, but the tanks and disposal area are both outside of the 50ft. limit= .

Mr. Gleason asked if the = current system was in failure. Mr. Kavanaugh said it wasn’t working correctly and the owner wanted to ha= ve a modern system and improve the situation.&n= bsp; Mr. Gleason asked if the intent was to leave the existing system in place. Mr. Kavanaugh said the= y were going to pump it out and fill it with sand. He said it wouldn’t be broke= n up because they couldn’t access it under the house.

Mr. Haverty asked if ther= e was a requirement to have an engineer do the plans. Mr. Zarnowski said the forms used = were old, a person needed to be a permitted designer to design septic systems. Mr. Haverty reviewed the request t= hat indicated the septic system couldn’t be improved. He asked why that was. Mr. Kavanaugh said the well radius encompassed most of the lot and there was no where else the system could be placed.

Mr. Gleason asked if ther= e was any conflict with the Wetland Protection Act. Mr. Zarnowski answered no. He said it only covered 250ft. fro= m the pond and only a small portion of the lot was within that. He said the applicant would be usi= ng a Clean Solutions System which would provide treatment, unlike the existing system that was in the water table. He said they would be allowed to be 50f= t. from the septic tank to the well if they were using SDR 26 pipe or better.<= span style=3D'mso-spacerun:yes'> He said the sewer line was a Pelham specific waiver, the state didn’t have one. He said 60ft. for the Clean Soluti= ons System was quite a large distance. The well is in the front of the house. Mr. Zarnowski said the applicant h= ad pushed the system as far back on the lot as they could.

Mr. Gleason asked if the = dwelling was year round or seasonal. M= r. Zarnowski said it was a year round residence.

Mr. Zarnowski asked that = the existing pipe be severed at the tank (if they could get to the tank) and to= be blocked off where it came from the house so it couldn’t be used again. An approval could be s= ubject to having it shown on the plan.

MOTION:

(Gleason/Lynde= ) To grant to waivers to Map 31 Lot 11-273 (50 Woekel Circle) against Section 295-16: 1) waiver the requirement of 75ft. to well to effluent disposal a= rea to an actual of 60ft. and 2) Section 295-16 – requirement of 75ft. = to the well, tank and pipes to be waivered to 50ft. Granting of the waivers is condi= tioned upon the sealing of the exit tube from the house of the existing sewer line.

VOTE:

(5-0-0) The motion carried.

Map 31 Lot 11-272 - 52 Woekel Circle, Owner Lee Kavana= ugh – The waiver request was under Section 295-15, requiring lot sizi= ng to be a minimum of one acre or approved by the planning board. The lot being discussed was 4732SF= ; the setbacks and design for the lot conformed to all other requirements and wouldn’t require additional waivers.= Mr. Zarnowski noted if the Article K was granted the applicant would need to go to the Zoning Board of Adjustment for any approval for developin= g on a substandard lot.

Mr. Lee Kavanaugh reviewe= d the plan with the Board. He provi= ded the Board with a copy of the tax map to show that the lot was not in a congested area.

Mr. Gleason asked if the = lot had been approved by the Planning Board at some point in time. Mr. Kavanaugh said he didn’t= look it up at the Registry of Deeds, but knew that the lot was subdivided in the 1940’s. Mr. Gleason con= firmed that the applicant would be going to the Zoning Board because lot was non-conforming. Mr. Kavanaugh= said he would. Mr. Gleason confirm= ed that the intent was to construct a house on the lot. Mr. Kavanaugh answered yes. Mr. Gleason saw that the well at 54 Woekel would provide water to the lot being discussed. He asked if the intent was to sell= the property. Mr. Kavanaugh answe= red no. Mr. Gleason asked if consideration was given to placing the septic system on his property (54 Woekel). Mr. Kavanaugh said he wouldn’t have to because he complied with every other requirement exc= ept for lot size.

Mr. Zarnowski reviewed the language contained in Section 295-15. Mr. Haverty asked if the lot had received Planning Board approval. Mr. Zarnowski said the lot was not approved by the Planning Board. It was created in 1942. Mr. Zarn= owski said if the Town didn’t have the requirement, the applicant would hav= e to look to the state; the state allows any lot to be built with two bedrooms as long as the setback criteria was met.

Mr. Lynde had a problem w= ith the request. He said when applicant’s come forward they have a hardship and the end result is t= he improvement of an existing situation. He said in this case, the applicant was asking for a waiver to a lot that was one tenth the required size in the Town so a house could be built. He didn’t feel t= hat the request was consistent with Article K and the Town’s Regulations. He said the appl= icant wasn’t being deprived of a place to live, he had a vacant lot. Mr. Zarnowski said the section was= put in during 1977, specifically for the = pond lots. Mr. Lynde said the hist= ory was that the lots were called ‘coffee lots’ meant for summer ho= mes, not year-round residence. He didn’t feel the request was consistent with the intention of Article K.

Mr. McDevitt said the req= uest sounded more like a question for the Zoning Board. He questioned if a denial would de= prive the owner of reasonable use of the land.&n= bsp; He noted that the lot had been in place since the 1940’s. He said the Board had not had this= type of waiver.

Mr. Gleason commented hav= ing the water come from another lot, the lot was not self-sustaining. He didn’t see a hardship bec= ause the applicant was currently living at 54 Woekel. Mr. Kavanaugh told the Board that = the intention was for his son to live in his current home and he would build a smaller home on the lot in question for himself. He reiterated that he complied wit= h all the objective criteria of the Town’s Regulations, but didn’t co= mply with the Town’s subjective criteria.= Mr. Gleason didn’t feel comfortable creating a new system on a non-conforming lot.

Mr. Zarnowski commented, = in his experience, that the Board had never had this type of situation before the Board.

Mr. McDevitt stated he wo= uld like to educate himself on the legal aspects of the request.

Mr. Lynde said it was the intention of Article K to ensure there was sufficient area on a lot to treat the effluent and also have a viable area for a replacement system. Mr. Kavanaugh noted that the lot in question would fit a larger septic system that the one being requested (or = what the state requires), and there was sufficient area for a replacement system.

Mr. Zarnowski discussed t= he technical aspects and gave a comparison of the Town’s and the state’s requirements. T= he Board discussed how they would proceed and decided to postpone final resolu= tion (pending additional information) until the next meeting of the Board of Health.

Highway Safety Committee, Police Chief Joseph Roark – Recommended Signage Requests

Planning Director Jeff Go= wan, representing the Highway Safety Committee (‘HSC’) came forward = to discuss the recommended signage additions as follows: 1) stop signs at the intersection of Tiger Avenue and Therriault; 2) stop signs at the intersect= ion of Garland Drive and Morgan Avenue; 3) stop signs at the intersection of Garland Drive and Birch Lane; and 4) stop sign at the intersection of Island Pond Road and Dutton Road.

The Selectmen discussed t= he recommended signage. Mr. Lynd= e said he would prefer to not have a stop sign at the intersection of Morgan Avenue and Garland Drive based on the steepness of Garlan= d Drive and possible difficulty going up the hill during the winter.

MOTION:

(McDevitt/Lynd= e) To approve (Item #1 as requested = by the HSC) the installation of stop signs on Tiger Avenue at the intersection = of Therriault Drive.

VOTE:

(4-0-0) The mo= tion carried.

E-911 Resident Requests for address changes – Terrace Circ= le, Waterside Drive

Planning Director Jeff Go= wan stated that a request had been received to renumber structures on Terrace Circle and Waterside Drive as well as an addre= ss change for a resident (Mr. Masterson) who resided at Mammoth Road and Marsh Road. He said none of the people making = the requests were present. He sta= ted that he could present their issues, but would speak on his interpretation on their concerns. He commented = that none of the Highway Safety Committee agreed with the resident’s desir= ed outcome.

Mr. Gleason asked if the petitioners were invited to attend the meeting. Mr. Gowan said he called the representative of Terrace = Circle who was told they could send a letter (if they were unable to attend the meeting) that could be read into the record; a letter was not received. He said he received a letter from a resident on Waterside Driv= e that indicated they would not attend the meeting. As a follow up, Mr. Gowan asked if= they were withdrawing their request, however, he had not received a response. Mr. Masterson was sent a letter explaining that there would be some discussion regarding his request and he would possibly be able to present his case.

Mr. McDevitt suggested if= someone wanted to change their address they should meet with the Selectmen. He said if they weren’t able= to attend the meeting, they should send a letter explaining in some detail the= ir request.

Mr. Gleason said the Sele= ctmen could defer the item until such time that the residents come in to discuss their case.

Mr. Haverty suggested tha= t the Selectmen didn’t have a request in front of them at this time. He said there was an agenda item, = but nothing formal from the residents. He said if the residents would like to either come in person, or send something in writing the Selectmen would take it up at that point. Mr. Gowan said he would share the information with the petitioners and let them decide how to proceed.

The Selectmen took no action.

Planning Director, Jeff Gowan – Department Update

Planning Director Jeff Go= wan came forward to provide the Selectmen with an update of the Planning Department. His report was br= oken into three sections: Planning Board, Board of Adjustment and information on= a number of projects.

Mr. Gleason questioned ho= w the budget reduction (by the Budget Committee) for code enforcement would affect the department. Mr. Gowan sta= ted it would have a significant effect and hoped to discuss the situation with the Selectmen how it could be approached. He was unable to attend the Budget Committee meeting because of a conflict with a Board of Adjustment meeting. He watched a recorded copy of the meeting (several times) to understand why the cut was made and the only rea= sons he could discern was that a couple members were not satisfied with code enforcement (on non-specified properties) near those individuals. He hadn’t had the opportunit= y to discuss the issues with those board members and was unclear how cutting the budget would help the situation. Mr. Gowan said he would also like to discuss the budget issue with t= he Selectmen because he felt the cutting of the budget was a policy decision.<= span style=3D'mso-spacerun:yes'>

Mr. McDevitt stated if wh= at was being reported was correct, he felt the Budget Committee greatly overstepped their bounds. He said they kn= ow their boundaries and the effectiveness of employees is a matter for the Selectmen only. Mr. Gowan sai= d he intended to be at budget reconsideration as well as the Deliberative Session and hoped to coordinate those efforts with the Selectmen.

Mr. Gowan continued to pr= ovide the Selectmen with an update of his department. They would be implementing the pla= nning and zoning modules of the Muni-Smart system. They would be addressing old bonds= and paying them back to the people who originally placed them.

Mr. Haverty questioned ho= w long the transition would take place between the Planning Board’s former engineering review company (Stantec) and the newly hired company (Keach &am= p; Nordstrom). Mr. Gowan said it= had been the Planning Board’s position (to date) that Stantec would compl= ete any project they had been involved in and do plan compliance and constructi= on monitoring for any project they reviewed.&= nbsp; One problem with that position was that some of the projects were on hold.

Mr. Gleason wanted to mak= e a recommendation to the Planning Board to make the transition as smooth and rapidly as possible. He didn’t feel it was good business practice to have them continue with = the process; the new company should be brought up to speed quickly. He said it didn’t make sense= to him to have Stantec be involved for the next five years on projects that we= re going on and on. Mr. Gowan sa= id it might be more persuasive if the Selectmen sent a letter to the Planning Boa= rd indicating their desires. The= re was further discussion regarding the transition between companies and how it co= uld be handled. Mr. Haverty sugge= sted rather than send a letter, let the Planning Board handle the situation proj= ect by project. Mr. McDevitt stat= ed that the residents chose to elect the Planning Board members. He felt the Selectmen should step = back and allow the Planning Board to have the opportunity to discharge their res= ponsibilities; if the people who elected them don’t feel they are doing so properly,= the resolution would be at the polls. After further discussion there was a general consensus that the Selectmen would take no action. Mr. Gowan noted that with any of the ‘parked’ projects that come up= he will bring the issue up with the Planning Board for discussion.

Mr. Gowan provided a summ= ary of projects that would be moving forward and other projects that would be comi= ng in for review. He then discus= sed the Pelham Economic Development Committee would be meeting and discussing possibly making awards to businesses that made improvements to the Town. Mr. Gowan stated that he would rec= ommend to the Zoning Board of Adjustment (‘ZBA’) that they change the 20-day appeal periods to 30-days for appeals to administrative decisions of= the Planning Board based on administrative decisions to be 30-days. This was a recommendation by Attor= ney Ratigan which he fully supported and have made to the ZBA Chair for action = on their next agenda. . He ended by outlining the items the Planning Board would be submitting for the ballot.

The Selectmen thanked Mr.= Gowan for providing them with an update. <= /span>

REQUEST FOR NON-PUBLIC SESSION

It was noted tha= t when the Board returned, after the non-public session, the Board would resume th= eir public session. The Board ent= ered into a non-public session at approximately 8:43 pm.

OTHER BUSINESS

Discussion – Open Forum Guidelines

Mr. McDevitt stated that = the Selectmen had a discussion regarding creating guidelines for the Open Forum portion of their meetings. He= said court cases have stated clearly that the Selectmen had the latitude to regu= late the discussion. He made it cl= ear that the intent was to keep the forum open and allow time on the Selectmen’s agenda for any Pelham citizen to address the Board without prior arrangement; people were still strongly urged to contact the Town Administrator to be on the agenda. Mr. McDevitt read aloud the proposed policy.

There were no questions/c= omments regarding the policy.

MOTION:

(McDevitt/Lynd= e) To adopt, as the Open Forum Policy, the draft dated October 2, 2009.

VOTE:

Discussion – Warrant Articles

The Selectmen began to di= scuss warrant articles, it was their intent to have a general consensus for which articles would be deferred. M= r. Gleason asked the Selectmen to consider prioritizing the items that were es= sential, such as the new fire station and possibly the Senior Center addition. Mr. Haverty felt the Selectmen should have the fire station project cost re-estimated based upon= the present economy, the cost for which coming from the impact fees. There was a brief discussion regar= ding the project oversight and what it would consist of. Mr. Gaydos was asked to get a re-estimation of costs (from the construction management company) for the n= ew fire station based on the proposal that was previously presented to the vot= ers in 2008 for $4.28 million.

Mr. Gaydos then reviewed = the proposed warrant articles with the Selectmen as follows:

1= ) = School Resource Officer – Mr. Lynde felt this was a needed service. Mr. Haverty highly supported the position.

2= ) = Willow Street/Tallant Road Bridge Capital Reserve – deferred.

3= ) = Highway Garage Capital Reserve Fund – Mr. Gaydos informed that there was poss= ibly a large metal pole building that would be donated; there would still be associated expenses. Deferred= for more information.

4= ) = Highway Block Grant – no comments.

5= ) = Deputy Fire Chief – Mr. McDevitt understood the need for the position, but between this position and the School Resource Officer, he would have to sup= port the School Resource Officer. = Mr. Lynde and Mr. Gleason also understood the need, but opted to defer the arti= cle.

6= ) = Fire Station – previously discussed.

7= ) = Inspection vehicle (that has 106,000mi)– Mr. Haverty supported the article.

8= ) = Rehab existing Fire Station – There was a discussion whether or not to have= a warrant article for the existing station.&= nbsp; Mr. Haverty wanted to know when the last Town Meeting would be held = to accommodate a round-about in the center of Town. Mr. Gaydos believed if the Town ke= pt requesting a fire station, the state would hold off as long as they could u= ntil the Town said definitively what they would do. The Selectmen decided to only pres= ent a new fire station on the ballot. Mr. McDevitt commented that the Selectmen had a long tradition to recognize whe= n a member was absent if there was a ‘weighty’ discussion, the Board may revisit the topic if the absent member wanted to speak on the topic.

9= ) = Transfer Station skid steer loader – Mr. Gaydos said there had been a discussi= on of possibly using a recycling trust fund for the purchase. Mr. Gleason believed the recycling facilities trust fund was a capital reserve for the building. It was suggested that the warrant = could be written to change the wording/purpose of the capital reserve fund so it could be used for equipment. &n= bsp;

1= 0) Restricting revenues from the sale of recyclables – fees collected to be placed i= nto a special revenue fund – Mr. McDevitt felt the article should be deferred. The Selectmen agree= d.

1= 1) Union Contracts (Support Staff, Supervisors, Fire Department) – no action taken.

1= 2) Town road acceptance – no action taken.

1= 3) Senior Center – Mr. Gleason drafted a proposed warrant article and read it aloud. His intention was to take it to the Seniors for discussion.

1= 4) Forestry Maintenance Fund – Mr. Gaydos stated that the Forestry Committee was = available to come in and discuss the article. The Selectmen would like the committee to meet with them.

1= 5) Raymond Park Trust Fund – Mr. Lynde stated that a fund had been set up for maintenance of the park, but the Town had been paying for the maintenance w= ithout the use of the fund. He sugge= sted discontinuing the fund and using the funds to create irrigation, septic sys= tem and to help get electricity. = Mr. McDevitt questioned if the money from timber harvest was supposed to go into that fund. Mr. Lynde didnR= 17;t believe so. Mr. Gleason said = there were two funds, the one being discussed designated the Boy Scouts as agents= and they were obligated to submit (to the Town) a yearly operating budget. Mr. Lynde said he suggested discontinuing the fund. There= were no objections.

&n= bsp;

Mr. McDevitt asked if the Selectmen would pursue a second egress to Muldoon Park. Mr. Haverty and Mr. Gleason felt it should be deferred. Mr. McDev= itt commented that there was a limit to= the permit for the egress and it might be year two of five years. He asked if there was any value in approaching the organizations that use the park. Mr. Lynde answered yes. He felt they should be willing to = help out. The Selectmen wanted to = know the cost for the second egress. Mr. McDevitt asked if the Police Chief would be presenting an ordinance for pawn shops. Mr. Gaydos said the Po= lice Chief intended to bring it forward.

Transfer Station Job Description

Mr. Gaydos read aloud the proposed job description. The Selectmen discussed the job qualifications. Mr. Gaydos will put a posting toge= ther that will be available for internal applicants first, and then listed for t= he general public. Applications = will be due November= 13, 2009.

Transfer Station Bids

Mr. Gaydos said the bids = were written, returned and opened when former Superintendent Bruce Mason was employed. Mr. Mason submitted= a written review that commented on the bids.= Mr. Gaydos discussed the responses that were received and said that = they were all very different; he read the bid amounts aloud. A criticism received was that the Town’s request was too broad. Mr. Gaydos discussed the options; there was no process the Selectmen were required to take at this point. After a brief discussion, the Selectmen chose to accept none of the = bids and will ask the companies to re-bid.

MOTION:

(Lynde/McDevit= t) The Selectmen have made the decision to not entertain any of the prior bids, therefore they are considered rejected.&= nbsp; The Selectmen ask the companies to submit their Best And Final Off= er, against the original Request for Proposal. Please note that the prior bids = are public documents and are open for inspection if you (the bidding companie= s) so choose.

TOWN ADMINISTRATOR’S REPORT / SELECTMEN’S REPORTS

Mr. Gleason met = with the Rockingham Regional Economic Development Committee and was appointed to the CEDS steering committee and will provide the Selectmen with a briefing after their next meeting. He said t= he Pelham Economic Development Committee held a breakfast that was very well attended.

Mr. Lynde and Mr. McDevitt had no report.

Mr. Gaydos repor= ted that he attended the Merrimack Valley Regional Water District meeting and inform= ed progress had been made, but the outcome wouldn’t be known for approximately one year. He al= so reported that the fire station repairs (to the bay doors) had been complete= d.

Mr. Haverty had = no report.

The non-public f= or the Review of Personnel Evaluations was deferred to the next meeting due to the late hour.
