MINUTES

CALL TO ORDER – approximately 6:30pm

PRESENT:	Mr. Douglas Viger, Mr. = Edmund Gleason, Mr. William McDevitt, Mr. Robert Haverty, Town Administrator Tom= Gaydos
ABSENT:	None.

MINUTES REVIEW

MOTION:

(Gleason/Haver= ty) To approve the De= cember 7, 2010 meeting minutes as amended.

VOTE:

(4-0-0) The motion carried.

OPEN FORUM

None.

OTHER BUSINESS

Mr. Gaydos had a draft of= the Town Meeting Warrant for the Selectmen to review. He also had a rough draft of the Voter’s Guide for review. Mr. Viger questioned when the final draft of the Voter’s Guide had to go = to the printer. Mr. Gaydos said = it would need to be ready shortly after the Deliberative Session (February 8, 2011= ).

PUBLIC HEARING – Blasting Ordinance

Fire Chief James Midgley and Fire Inspector John Hodge= came forward. Chief Midgley asked = that the Selectmen consider placing the proposed Blasting Ordinance onto the Tow= n Warrant. He said the Ordinance was spearhea= ded by an incident that occurred several weeks ago. He informed that currently the Tow= n has Blasting Regulations that essentially had no ‘teeth’. He commented that the incident was= a wake up call for them to address the issue; a rock approximately 1ft. x 1ft= .x 8in, weighing 80lbs-100lbs was propelled 675ft. through a swimming pool. He discussed the state regulations= . Chief Midgley said with the Blasti= ng Ordinance they were trying to give the Town some control and address a numb= er of issues. He told the Select= men that the proposed Ordinance was adopted by Windham due to the I93 project. Wording was amended to better fit Pelham. Chief Midgley stated = that the Ordinance was not an attempt to regulate display fireworks; it was regu= lated under New Hampshire Code of Administrative Rule= s, Saf-C Section 1600. He said d= isplay fireworks were covered under Saf-C Section 5000.

There was a brief explana= tion regarding how blasting licenses were obtained. Mr. Gleason questioned if the prop= osed Ordinance would have covered the incident that occurred. Chief Midgley answered yes. He provided a brief overview of the Ordinance and the key areas. =

Mr. Viger asked how the O= rdinance would be distributed to blasters that came into Town. Chief Midgley stated there were th= ree communities using an ordinance. He said anytime blasting occurred in the community, they had to go to the Fire Department as part of the state regulations; at that point they would be gi= ven the regulations and Ordinance. The Selectmen did not object to the Chief being the Blasting Administrator.

Mr. Gleason questioned if= the fee structure was compatible with other towns that had an ordinance. Chief Midgley answered yes.

Mr. McDevitt asked that t= he word ‘videotape survey’ be amended to read ‘video survey’. He believed the intent was to have a good quality video survey no matter what kind. There were no objections to the ch= ange.

Mr. Viger read aloud the = proposed Warrant Article.

There was no public input offered.

MOTION:

(Gleason/McDev= itt) To accept the Warrant Article for the Blasting Ordinance as written.

VOTE:

(4-0-0) The motion carried.

Mr. Gaydos state= d that the Blasting Ordinance, in its entirety, would be posted at the Town Hall a= nd at the school where voting would take place. It would also be available at the = Post Office. Mr. Viger asked that = it be included in the Voter’s Guide, mentioning that the Ordinance would not regulate display fireworks. <= /p>

REQUEST FOR NON-PUBLIC SESSION

MOTION:

(McDevitt/Glea= son) Request for a non-public session per RSA 91-A:3,II, a (Personnel)

It was noted tha= t when the Board returned, after the non-public session, the Board would not take = any other action publicly, except to possibly seal the minutes of the non-public session and to adjourn the meeting. The Board entered into a non-public session at approximately 6:50 pm.

The Board returned to public session at approximately 7:17 pm.

MOTION:

(Gleason/Haver= ty) To seal the minutes of the non-public session indefinitely.

VOTE:

(5-0-0) The mo= tion carried.
