CALL TO ORDER – approximately 6:30pm

OPEN FORUM

Ms. Sandra Crawford, 13 Castle Hill Road came forward and read aloud a prepared statement regarding a complaint with= the Town specific to the use of a Town owned right-of-way off Castle Hill Road and regarding the violation of a recorded 30-ft.agreement and driveway permit. She said they had provided numerous photos, documents and an encroachment survey to the Town. She discussed the problems they ha= d over the last eight years since their original complaint in 2002. Ms. Crawford said in light of the documented conditions, she found it extraordinary that the Town was conside= ring transferring a right-of-way to an individual. She said they had been using the p= aper street for necessary access to her property for thirty-two years. She told the Selectmen she’d= asked to be put on the agenda four times and found it necessary to protect her property.

OTHER BUSINESS

Preparation for 2011 Deliberative Session

The Selectmen reviewed the proposed Warrant Articles that would be discussed at the 2011 Deliberative Session.

Article 2 – Fire Station. Fire Chief James Midgley came forw= ard and described to the Selectmen the presentation he would give the public. There was a brief discussion regar= ding what additional information would be helpful to have available.

Article 3 – Operating Budget. Mr. Gaydos said there would need t= o be an amendment to the $11,908,550. The default budget was recalculated for the MS-default report for the state and= came in at $67,000 more. When orig= inally going through the default budget items that were thought to be one-time expenses were removed; $67,000 was incorrectly removed from the Fire Depart= ment Operation Budget. The new ame= nded number is $11,975,550.

Mr. McDevitt questioned i= f an amendment was needed to add to the 2011 Highway winter maintenance budget. Mr. Gaydos circulated a memo earli= er requesting to reallocate the money charged to the Highway Block Grant which could have been charged to the Highway Operating Budget; if those changes w= ere made it would result in a $70,000 balance in the Highway Block Grant. Mr. McDevitt questioned if reclass= ifying money would eliminate the need to ask the taxpayers for additional funds for snow removal in 2011. Mr. Gay= dos said that was correct. Mr. Ly= nde asked for clarification regarding the use of the Highway Block Grant. Mr. Gaydos said the Highway Depart= ment would have money from the unspent 2010 Highway Block Grant warrant article = that could be carried over. Mr. Ly= nde wanted to know if they reclassified money out of the Highway Block Grant for winter maintenance if it would be taken away from what they would have spen= t on roads (maintenance). Mr. Gayd= os didn’t believe so.

Article 4 – = Tallant Road / Willow Street Bridge Capital Reserve Fund. Mr. McD= evitt questioned if the Town had an estimate as to the total it will cost to repl= ace the bridge. Mr. Gaydos answer= ed no; the State would update the number. It would cost at least one million.=

Article 5 – Highway Block Grant. No questions/comments. <= /p>

Article 6 – Collective Bargaining Agreement: International Association of Fire Fighters (Local 4546).= Fire Chief James Midgley summarized what he would discuss if questio= ns came forward.

Article 7 – Collective Bargaining Agreement: Pelham Public Works and Municipal Employees (Local 1801). Mr. Gaydos explained the cost brea= kdown; there are nineteen people covered. <= /span>

Article 8 – Forest Maintenance Fund. No questions/comments.

Article 9 – School Resource Police Officer. It was noted = if approved, the Police budget would be reduced by $5365 for the D.A.R.E. prog= ram.

Article 10 – Compensated Absence Trust Fund. An explanati= on of what the fund is will be discussed at the Deliberative Session. The DRA would like the Town to hav= e (no less than 12%) 15%-20% of the total appropriated funds in the fund balance (which includes the school). = The Town was currently at 8%-9%. =

Article 11 – Second egress from George M. Muldoon Park. No questions/comments.

Article 12 – Authorize Selectmen to license and inspect pawnbrokers. Mr. McDevitt fel= t it was imperative to get the words of the proposed ordinance into the hands of= the voters to stop misunderstanding. Copies will be made available for public review.

Article 13 –= Accept Moonshadow Drive= and Collins Way as ClassV public roads. Planning Director Jeff Gowan= will speak on the articles if need be at the Deliberative Session. There was further discussion how t= he article would be presented.

Article 14 – Accept a portion of = Mulberry Lane and Shephard Road and to accept all of = Lannan Drive as Class V roads. Planning Direc= tor Jeff Gowan will provide an explanation of the status of the roads.

Article 15 – Authorize Selectmen to accept public roads (= per RSA 674:40-a).

Article 16 – Authorize Selectmen to transfer and convey by deed a 50ft. wide area of land with frontage on Castle Hill Road. Mr. Gaydos said t= he article would need an amendment to correct the tax maps. There was a brief discussion regar= ding the extent the article could be amended; Mr. Gaydos will speak with Town Counsel.

Article 17 – Blasting Ordinance. Fire Chief Midgley will explain (a= t the Deliberative Session) how/why the ordinance came forward. Copies will be available for the p= ublic to review.
