Presentation to Historical Society – Pelham Library & Memorial Building Listed on the National Register of Historic Places

Mr. Gleason read aloud a plaque presented to the Pelham Library & Memorial Building for being listed on the National Register of Historic Places on April 15, 2011.= Mr. William Hayes came forward to = accept the plaque. The Selectmen congratulated Mr. Hayes.

Eagle Scout Project Presentation – Jacob Wormald

Life Scout Jacob Wormald of Troop 25 came forward and discussed his proposed Eagle Scout project. He planned on making a patio at the Pelham Public Library; the size of which w= ould depend on the cost and the amount of fund raising earned, but would between 15ft.x15ft and 20ft.x20ft. The Library Trustees have approved of the patio.

Mr. Viger asked where the patio would be located. Scout Wormald said it would be loc= ated to the right of the building and provided a brief description.

Mr. Lynde asked for a description of how the patio would be installed. Scout Wormald desc= ribed the construction process, which would take approximately two weekends to complete. <= /p>

There was further discussion regarding the materials used to construct the patio area. Scout Wormald anticipated completing the project during the summer. Mr. Gleason questioned if any heavy/electric tools would be used. Scout Wormald was unsure. Mr. Gleason confirmed that due care would be exercised if such tools were to be used. Scout Wormald understood.

Mr. Viger questioned what means were being used for fundraising. Scout Wormald stated he would raise funds through car washes and bake sales.&n= bsp; Mr. Viger asked what timeframe was set out for the project. Scout Wormald hoped to complete the project before the end of summer.

Mr. Gaydos asked how much money was needed. Scout Wormald believed the cost wo= uld be approximately $600-$800.

Mr. Lynde wanted to know if the Library had indicated how they would = make use of the patio. Scout Worma= ld stated that the Children’s Librarian expressed an interested in the p= atio for their summer reading program.

Mr. Gleason questioned if a weed barrier would be placed under the pa= tio blocks. Scout Wormald said he= would be using a specific type of sand that would prevent weed growth. The Selectmen commended Scout Worm= ald on his efforts toward making Eagle Scout and wished him the best of luck.

MOTION:

(Lynde/McDevitt) To grant Scout Jacob Wormald permission to construct a patio on the right side of the Pelham Public Library of a size of 15ftx15ft up to 20ft.x20ft. with a crushed stone walkway between the Library door and the patio.

VOTE:

The Selectmen directed Mr. Gaydos to sign-off on the project for Scout Wormald’s paperwork.

TOWN ADMINISTRATOR’S /= SELECTMEN REPORTS=

Mr. Haverty, Mr. Viger, M= r. McDevitt and Mr. Lynde had no reports.&nbs= p;

Mr. Gleason asked if the Selectmen had the opportunity to review the proposed budget review schedule.

Mr. Gaydos stated he had = been working with Senior Center Director Sara Landry during the past week. He said she would have everything = set up quickly. He commented that he= had worked with Mr. Phil Currier to set up the easements at Muldoon Park. They had to have a survey done bec= ause of the close proximity to the gas pipeline. He said he would like to have the project done this summer.

Mr. Gleason asked that Mr= . Gaydos inform the Finance Director that the budget review schedule looked adequate. Mr. Gaydos question= ed how the Selectmen wanted to handle the Cemetery and the Library. Mr. Gleason didn’t feel the Selectmen had to have them come in, but commented it would be nice to have their figures available. Mr. = Gaydos said he would ask them to have their budget numbers submitted by a certain date. Mr. Viger suggested ask= ing them, as a courtesy, to provide information regarding what they were working on/planning. Mr. Gleason felt= it might be an excellent opportunity to have the Budget Committee liaison sit and review their budgets.

OTHER BUSINESS

Fire Station Discussion Update

Mr. Gleason asked the status of the action items and if there was anything new the Selectmen should be aware of. Mr. Gaydos reviewed the action ite= ms discussed during the fire station round table meeting as follows:

1) Establish a temporary building on the property at the back of the existing fire stati= on – cost determination and timeframe schedule – Mr. Gaydos believed they were looking at getting a price on a worst case scenario. After researching, he believed the= cost was in the range of $140,000-$150,000 this would be a housing for ambulances only;

2) Review a temporary steel structure adequate to the Fire Chief’s needs to determine whether there’s a price advantage in going to that approach – Mr. Gaydos stated that Mr. Soucy was working on this item and h= ad indicated he hadn’t heard back from the company but continued to foll= ow up;

3) Selectmen to review ability to build a fire station at a different location – if so, is it at the Transfer Station – determination if the land is viab= le – Mr. Gaydos stated a couple locations had been reviewed. If locating at Newcomb Field, a fi= eld would be lost and there would be site improvements needed, such as widening= the roadway and building the area up. He noted that Fire Chief Midgley’s concern was the traffic. There was also an issue with acqui= ring land for use as an alternate entrance into the Transfer Station

4) Mr. Gowan to contact DOT to find out if demolition costs included- Mr. Gayd= os informed that Mr. Gowan had not received an answer yet;

5) Review proposed cost for steel building (using existing design) located on the Mil= ls property.- Mr. Gaydos stated that he and Mr. Soucy were looking at cost= s on the internet and gathering information.&nb= sp;

Mr. Gleason asked if Dave Mermelstein of Trident spoke with Mr. Soucy relative to his findings on steel buildings. Mr. Gaydos said it would be diffic= ult to discuss because Mr. Soucy didn’t have the answers yet. He said Mr. Mermelstein had contac= ted two manufacturers; one looked at just the steel frame and the other would handle all aspects. He said t= here was a broad range of services that could be provided.

Mr. Gleason asked the Selectmen, if they were to proceed with a tempo= rary structure, how they wanted to handle the associated cost package. He didn’t want to go to the = Budget Committee with a number that was based on assumption. Mr. Haverty believed the Selectmen needed to decide on ‘what’ before they decided on ‘how much’. He felt there sh= ould be further discussion regarding a new station and what implications those p= lans may have on the budget and then make some decisions based on that. Mr. Gaydos said he was taking the = worst case scenario of if the fire station was not approved, they would need the structure (an insulated, heated, ambulance barn). He said he could have an estimator= give them and up-to-date estimate on what the material, labor etc. costs would be. This number could be used= as the worst case scenario to be put into the budget. Mr. Gaydos said if the fire statio= n is approved and a construction schedule could be put together, they may not ne= ed a permanent structure and could get away with something more temporary and fo= r a lot less money. He noted ther= e was a law in regard to keeping the ambulances at a certain temperature.

Mr. McDevitt believed there was an expectation if a temporary building were constructed on the Congregational&nbs= p; Church’s land that at some point the Town would be donating th= at building to them if the Town built a new fire station. He said the decision was whether t= o have the building be a big insulated structure, or not. He assumed the Town didn’t h= ave room on its own land to build the building. Mr. Gaydos didn’t believe th= ere was room on Town land. Mr. Gleason’s perspective was that a building would need to be constructed regardless of if the fire station was approved (it may just be an interim building). He said if the round-about went in the (fire department’s) response time would be impacted; the only relief would be to put some sort of building up. Mr. Gleason believed the Selectmen= were going to have to put money in the budget to do something. He felt there was some validity in= the suggestion to assume the worst case scenario. He said they should put money in the budget that would solve the response time problem for after the roundabout went in.

Mr. Haverty said during the roundtable meeting there was a comment ma= de to put a one-time cost for the fire station in the budget by emptying surpl= us, or FEMA etc. For the sake of argument, he said if the Selectmen decided to go that route, the implicatio= ns that would have on the budget would be starkly different than if they decid= ed to go with a 20-year bond. He= would rather know that type of information prior to putting money into the budget= for a temporary or permanent building. <= /span>

Mr. Viger believed one cost would replace the other; if the new centr= al station was approved, the cost for the temporary structure would be removed from the budget. He felt both options should be explored completely prior to moving forward with either one.

Mr. Lynde said at some point in time, if the new central station weren’t approved, the Town would have to replace not just ambulances,= but also a fire engine. He questi= oned if a new fire engine would fit in the existing station. He said if not, any temporary buil= ding would have to be capable of housing the engines because otherwise they may = end up building two temporary buildings. Mr. McDevitt believed if the ambulances were taken out of the station and put into a temporary building, there would be more room left within the station. It was noted that th= e Fire Chief’s concern was that new fire engines were longer than the existi= ng fire engines. Mr. Lynde asked= if there was a cost estimate for the septic system. Mr. Gaydos answered no. He said they could come up with a = design for a worst case scenario. Mr. Lynde asked if the roundabout would impact the septic system. Mr. Gaydos said it would. Mr. Lynde said the septic would ne= ed to be part of the cost package. =

Mr. Gleason stated that time was rapidly descending upon them in term= s of the budget process. He said t= hey had to pull together a cohesive plan of what they wanted to do, how they wa= nted to do it, and what resources it would take to make it happen.

Mr. Gaydos commented with regard to the equipment. He said because ambulances didn= 217;t have a lot of weight to them comparatively, they wouldn’t have to put= in a floor/concrete pad that handled equipment such as the combination truck.<= span style=3D'mso-spacerun:yes'> The building would be planned to a= llow for an addition with a heavier concrete pad to accommodate the bigger trucks.

Mr. McDevitt said the first thing they had to find out was how long t= he Congregational Church would allow the Town to use their property. Mr. Gaydos said there had been a v= ery informal discussion several years ago.&nbs= p; The building design included a separate entrance in the rear of the building because some people from the Church indicated their desire for Old Home Day storage. The general thought was if the building were constructed to accommodate some of the storage, it would be a bonus for them.&nbs= p; Mr. Gleason said a more formal discussion was needed; they may be agreeable to a short-term situation, but reject a long-term arrangement.

Mr. McDevitt asked that a septic design cost be obtained. Mr. Gaydos will gather the information. The Selectmen ag= reed that further discussion was needed at the next meeting in two weeks.

APPOINTMENTS CONTINUED

Building Permit Discussion: Shayne Gendron of Ed Herbert & Associates - Property: Linda = Costa / Map 36, Lot 10-17 - 25 Hillc= rest Lane

Mr. Shayne Gendron came forward regarding a building permit discussion for the property located at 25 Hillcrest Lane. He said the parcel contained approximately seven acres. He provided a brief history of the area. Originally when the subdivision wa= s done in the late 1950’s, the section of road in front of the parcel was ne= ver put through. In looking at th= e tax map it appears that Hillcr= est Lane connects through to the other side; however, it doesn’t. Mr. Gendron’s client questio= ned if it were possible to put a single-family&nb= sp; home on the parcel. Th= ey were advised that there were quite a few permitting processes they would ha= ve to go through. The biggest pr= oblem was the parcel wasn’t on a Town approved road, therefore the lot didn’t have frontage. A= nother problem was a wetland that crossed the front of the property; there was no = way to access the property without going through that wetland.

Mr. Gendron informed that they received a Zoning Board of Adjustment approval to put a single-family home with an in-law apartment. Gove Environmental has flagged all= the wetlands and did a dredge and fill permit.= Because of the size and disturbance to the wetland (under 1000SF) it= was an expedited permit. The Plan= ning Board has approved a Special Permit. Mr. Gendron stated he had been working extensively with Planning Dir= ector Jeff Gowan from the beginning. He said this was a situation that had been brought before the Board a couple t= imes during the last few months by his office and what they had come to was an agreement of liability. Town Counsel has reviewed the documentation of what they’ve used in the pa= st for other properties. Mr. Gen= dron pointed out that the property was interesting because it wasn’t a Cla= ss VI road and it wasn’t really a Town-owned right-of-way. Town Counsel decided to handle it = by treating it as a private road, which was the intention of the agreement bet= ween the Town and the applicant. M= r. Gendron reviewed the plans they showed the lot’s location as well as a conceptual plan. The Conserva= tion Commission requested a walking trail easement from the right-of-way area through the Wetland Conservation District. Mr. Gendron said they would enter the parcel from Hillcrest, travel approximately 100ft., then turn and cross= the wetland along approximately 700ft. of road/driveway to the garage. There would be minimal grading. All the test results were excellen= t; they didn’t expect to be doing any blasting.

Mr. Gleason asked if the language on the recorded deed would indicate there was an easement to the Town. Mr. Gendron said it was Mr. Gowan’s intention to record the wh= ole plan with the note on it; this would need to be done prior to any permits b= eing issued. Mr. Gleason asked for= the road width. Mr. Gendron said = the driveway width was 14ft. He s= aid they met with the fire department and discussed what they felt would be adequate for them to gain access to the property. Fire Chief Midgley was recommendin= g that the driveway be kept to the Town standard of 14ft. wide; all the radiuses w= ere designed to handle a WB50 turnaround which is larger than a fire truck. There was a turnout half way up the driveway where two fire trucks could pass each other.

Mr. Lynde reviewed the property outline and questioned if there was a piece that was not shown up in back. Mr. Gendron said the entire property was shown on the plan. There was a power line easement to= ward the back of the parcel that was believed to be owned by the Town. Mr. Gendron shared what he knew ab= out the surrounding lots. He said the proposed parcel was all part of a single family house lot. The owner w= as not proposing to do anything else with the property; they had been granted a variance for a single-family home. The owner was trying to maintain as much privacy as possible. The owner would be responsible for maintaining/plowing the driveway.

Mr. McDevitt suggested that the Town put two signs at the end of Hillcrest Lane; one indicating ‘end of Town maintained road 100ft. ahead’ and the other ‘end of Town road pass at own risk’.=

Mr. Gleason confirmed that Attorney Ratigan was in concordance with t= he agreement. Mr. Gaydos replied yes.

Mr. McDevitt made a motion to sign the agreement and approve the request. Mr. Gleason asked th= at it be stipulated to have the road be 14ft wide. Mr. Gendron said they indicated to= the Conservation Commission that the road width would have to be determined by = the fire department. He said they= also went through the planning process with the width being 14ft.

MOTION:

OTHER BUSINESS CONTINUED

Discussion – Village Green Usage Policy=

Mr. Gaydos stated there were a number of different people asking to u= se the Village Green. He provide= d the Selectmen with items to get a conversation going if they wanted to set up a policy: 1) any equipment brought on to the Village Green needed an approved plan; 2) any uses not wanted; 3) parking regulation while Town Hall is open= ; 4) electrical usage; 5) number of people and 6) waste receptacles.

Mr. Lynde believed a policy should be in place. He discussed some of the uses that= had taken place. Mr. Gaydos said = the uses they didn’t want should be discussed as well. Mr. McDevitt believed the basis for starting (a policy) was so permission was needed for organized use. He said there was a statutory responsibility by the Town to take care of Town property and to make sure t= hose that use it also take care of it. He said they would have to be careful not to discriminate on the bas= is of ideas. He strongly discour= aged use by any kind of organized sports.

Mr. Viger felt it would be productive to make a general outline of the type of things they wanted and then leave it up to Mr. Gaydos’ discre= tion to review them on a case by case basis.&nb= sp; Mr. Gleason said there had to be some mechanism to have people ident= ify the use for which they intended so it could be determined if limitations we= re needed. He said all recreation activities should go through the Park & Recreation department.

Mr. Haverty believed they needed to preserve the Village Green. He said there were fields for recr= eation and there was also room in Town for pieces of land that weren’t active recreation based and were reserved for ceremony and passive recreation. He felt active uses, such as socce= r, baseball and lacrosse could degrade/deteriorate that (Village Green) space = and cost the Town to restore it. = He questioned what enforcement mechanism would be used if the Selectmen decided the space could be used for passive recreation. Mr. Lynde said if someone was usin= g the space, they should be asked to fill out a form. He commented that if people were g= oing to use the Village Green there had to be a proviso that they would bear the cost of fixing it in the event something was damaged.

Mr. McDevitt believed Park & Recreation needed guidance from the Selectmen. He believed the enforcement mechanism would be through Park & Recreation. Mr. Haverty suggested working with= the organization to inform them, based on the Selectmen’s decision, that = they either needed to contact Park & Recreation to use the field, or inform = them that it wasn’t acceptable to use.&nb= sp;

Mr. Gleason believed Mr. Gaydos needed to draft something for an application process to identify the purpose and intended capacity. They would then need to speak with= Park & Recreation. Mr. Gaydos believed the application wouldn’t be very different from that used for Sherburne Hall. He said direc= tion should be given to Park & Recreation and Mr. Gaydos should be informed = if there were any problems. Mr. = McDevitt suggested that the application could be used as a model for use of any Town land. Mr. Haverty said Park &= amp; Recreation should be provided with more guidance. He said the Selectmen should decid= e what the acceptable uses would be, provide the framework, and an application process. Mr. Lynde believed t= he Park & Recreation Director had an understanding of what he wouldn’= ;t allow. He suggested having the Director come to the Selectmen with a list of acceptable uses.

After further discussion, the Selectmen agreed that they would like t= he Park & Recreation Director to come in and discuss uses for the Village Green.

Discussion – Vegetation at Town-owned Cul-de-sacs

Mr. Gleason said there was an ongoing issue because of repeated complaints. Mr. Gaydos stated= that they started looking at vegetated areas within cul-de-sacs, some were being nicely taken care of by property owners and other cul-de-sacs that weren’t being taken care of. He said the Highway Road Agent Don Foss had difficulty plowing certa= in areas and preferred that they were removed. Mr. Foss obtained prices from an excavator to pull the cul-de-sacs up, remove the material and evenly sloped. Gravel and asphalt wo= uld need to be brought in for those areas.&nbs= p; The estimated cost for an 80ft. circle was $11,000. Mr. Gaydos believed most of the cul-de-sacs were smaller.

Mr. Gleason asked how many cul-de-sacs there were. Mr. Gaydos said when they started looking at them, they had the number, but wasn’t sure how many would = need attention. He reiterated that= some of the cul-de-sacs were fine and nicely maintained.

Mr. Viger questioned if the Town had ever thought about dedicating the cul-de-sacs to certain people, such as a fallen soldier, and having sponsors maintain them.

Mr. Lynde was in favor of getting rid of the vegetated cul-de-sacs because they were a nuisance. He questioned if the outside pavement would be removed so the only thing remai= ning was a straight road.

Mr. Gleason recognized there was a problem, but in the current econom= ic environment he didn’t feel comfortable diverting any of the Highway Department’s money.

Mr. McDevitt said if a request came in, the answer should be that the Town would not be maintaining them. He said if residents wanted to submit an informal plan to the Town t= hey could maintain it themselves. Mr. Gleason agreed with Mr. McDevitt’s suggestion if residents wanted to maintain the areas they could submit a plan. There were no objections.

Comcast Franchise – Option to Extend

Mr. Gaydos requested the Selectmen’s approval to extend for one month. Mr. Gleason asked if it could be done in one month. M= r. Gaydos believed so.

(Viger/Haverty) To extend the Comcast Franchise contract for one month.

Discussion – Gumpas Pond/Conservation Area Trespass Issue<= o:p>

Mr. Gleason said a letter had been received from Deb Waters (Forestry Committee Member) relative to activity/shootings/trespass and movement of r= ocks at Gumpas Pond.

Mr. Lynde said Ms. Waters wanted to submit options to the Board, such= as reclassifying the roads to give them more ability to control access.

Mr. Gaydos said if a road was discontinued, the road would automatica= lly go back to the abutters. He didn’t know if that was the same for the trail designations. He needed to research the issue. Mr. Lynde said in regard to the Gu= mpas Pond road area, the Town owned on both sides so there wouldn’t be an impact. Mr. Gleason commented= that people were trespassing and didn’t feel that changing the road classification would deter them.

Mr. Haverty wanted to discuss the situation with the Police Chief and obtain his opinion because people were accessing the area, shooting and lighting fires.

Mr. Gleason asked Mr. Gaydos to review the legal ramifications of changing the classifications of the roads and to obtain the Police Chief’s opinion regarding the trespassing. Mr. McDevitt said there was a book= in the Selectmen’s office that contained information regarding the reclassification of trails. He believed Ms. Water’s request was broader than Gumpas Pond. He said it came down to enforcement.

Mr. Gaydos provided information and reviewed the April revenues and expenses with the Selectmen. =

· Historical Society to provide a list of work they anticipated would need to be done and the time frame for that work (5/10/11 –= Mr. Gaydos essentially had the number, it was just the Charter);
