PUBLIC HEARING – To Accept the Donation of a Defibrillator= to the Town Municipal Building from the Pelham Fire Fighters Association with = an approximate value of $1400

There was no one present in the public. The Selectmen had no comments.

MOTION:

(Viger/Lynde) To accept the donation of a defibrillator to the <= st1:PlaceType w:st=3D"on">Town Municipal Building from the Pelham Fire Fighters Association with an approximate value of $1400.

VOTE:

(3-0-0) The mo= tion carried.

APPOINTMENTS

Sign Gumpa= s Pond Federal Agreement

Mr. Gleason revi= ewed the document and requested clarification on a few items. He questioned if the Board could s= ign the agreement in the absence of the clarifications. He commented that the Board could delegate Mr. Gaydos to sign.

MOTION:

(Viger/Lynde) To give Mr. Gaydos the authority to sign the agreement, provided that the changes are addressed to the Selectmen’s satisfaction.

VOTE:

(3-0-0) The mo= tion carried.

OTHER BUSI= NESS

Discussion= – Conservation Request to Reclassify Class VI Roads

Mr. Gaydos said = the Selectmen had a conversation with Deb Waters who brought up a method that t= he Town may use to control access in the type of vehicles that are on the road= in the Gumpas Pond area. He said= the point was brought up that prior to making a decision, the Selectmen should = be aware of the designations of the areas.&nb= sp; He provided the Selectmen with a section from the book “A Hard Road= to Travel” put out by the Municipal Association. He reviewed the type of rights maintained for various types of roads/trails. To change the classification would= take a vote by Town Meeting; the Conservation Commission, who controlled the property, could put a warrant out at Town Meeting to essentially discontinue the Class VI road, or being in charge of the area, they could simply name i= t a ‘trail’.

Mr. Viger confir= med that the purpose was to make the roads trails rather than Class VI roads to alleviate the Town’s responsibility to maintain it. Mr. Gaydos noted the Town didnR= 17;t have that responsibility now. Mr. Viger’s point was it would be beneficial for the Town to have a warra= nt at Town Meeting to change the Class VI roads to trails to alleviate any fut= ure burden. Mr. Gaydos said if th= e Town wanted to close them, they could. He some people questioned what would change (with a reclassification).

Mr. Gaydos said = the point was to determine what the locations currently were. This would be a discussion item fo= r the future.

Mr. Lynde believ= ed at this point there was no further action on the Selectmen’s behalf; if anything it would be through Forestry/Conservation Commission to pursue.

Review of = May 2011 Revenue & Expenses

Mr. Gaydos revie= wed the revenue and expense reports through the end of May, 2011. The information represented approximately 42% of the year. He provided status information for each of the departments.

ACTION ITE= MS REVIEW

The Selectmen re= viewed the pending action items.

Regarding the se= cond access for Muldoon Mr. Gaydos explained when reviewing the roadway the High= way Safety Committee would like the access a two-way roadway. Little League would like to move t= heir outfield 10ft.out. The site w= as reviewed and it was found the outfield could be moved 8ft. without a dredge= and fill permit. A dredge and fill permit would cost the project more money and put the project out another year. Little League said they= could go with 8ft. Mr. Gaydos said = the project would accommodate the full size of the road being 50ft. and Little League will have 8ft. to move their fence out.

TOWN ADMIN= ISTRATOR / SELECTMEN REPORTS

Mr. Lynde reminded people that the first concert would be held on the Village Green (weather permitting) June 22, 2011. He informed that during the concer= ts, the Library would be open.

Mr. Viger had no report.

Mr. Gaydos stated for the next meeting he would have the first set of tests done on mosquitoes. He = will be asking the Board if they would continue with the program. Several towns have dropped out of it. He informed they would be putting a cross walk on Ma= in Street by the Pine Valley Golf Course to give = people notice of pedestrians. <= /o:p>

Mr. Gaydos informed that the Route 38 (paving) project was a state project that they scheduled. =

Mr. Gleason had no report.

It was noted tha= t when the Board returned, after the non-public session, the Board would not take = any other action publicly, except to possibly seal the minutes of the non-public sess= ion and to adjourn the meeting. T= he Board entered into a non-public session at approximately 7:18 pm.

The Board return= ed to public session at approximately 7:45pm.

BOARD OF SELECTMEN ACTION ITEMS

March 22, 2011=

Mr. Gowan to advise Selectmen whether the CIP will be instituted= ; ~~Mr. McDevitt will contact Planning Director Gowan re: Planning Board’= ;s intentions for (reforming)~~ CIP (Planning Board to make final decis= ion- Selectmen resolved 4/12/11- left open for further resolution by Mr. Go= wan; 5/10/11 Mr. Gaydos to follow up with Mr. Gowan re: status)(6/7/11 Mr. McDevitt said the Chairman of the Planning Board would set the CIP on = the shelf for the time being because there was no public interest – after discussion with Selectmen, he said he would go back to Planning = and ask that they reconsider);
Speak with Garden Club re: decorating round-about and possible lighting in future (Mr. McDevitt);

March 29, 2011=

Mr. Gaydos to provide schedule for 2^nd egress at Muld= oon; presentation of plan (4/12/11 – plan to be received 4/13/11 Mr. Gaydos will request Highway Safety Committee recommendation; 5/10/11 Mr. Gaydos said when he received the easement agreement and the deed is drawn up – that paperwork will be forwarded to Mr. Phil Currier = for review/approval)(6/7/11 – Mr. Gaydos said they were awaiting Mr. Currier’s comments on the easement deed / Mr. McDevitt said the Planning Board was awaiting information from Selectmen as to the traff= ic flow at the Muldoon Park property line / Highway Safety Committee recommended both egresses be two-way traffic, and during the winter to close the Nashua Road access)(6/21/11 – Mr. Gaydos provided an update that the access would be the full 50ft. and the Little League w= ould be able to move their fence out 8ft);
Mr. Gaydos to speak with Police Chief regarding schedule for enacting Pawn Broker Ordinance (4/12/11 – Mr. Gaydos informed th= at the Police Chief was doing a lot of work with policies in accordance w= ith being a certified agency, once completed he will work with Legal on the Pawn Broker Ordinance)(4/26/11 Police Chief rewriting the ordinance -u= pon completion will be reviewed with Mr. Gaydos then given to Selectmen);<= /li>
Planning Board to make recommendation to Selectmen regarding Art= icle #14 (portion of Mulbe= rry Lane, portion of Shephard R= oad and all of Lannan Dri= ve);
Mr. Gaydos to put timeline together for = Castle Hill Road (6/7/11 easement being c= ompleted that would allow the Crawfords to access their property);
Future discussion regarding sidewalk from Senior Center to roundabout (4/12/11 – to be added as an action item on the agenda for the next Department of Transportation meeting to determine cost savings) (6/7/11 – the Town to decide if they still want the sidewalk – a meeting should be scheduled with DOT to find out if= May date is still viable).

Mr. McDevitt researching appropriate sign= age for Raymond Park (where parcels are located and what names were allowed per deeds) (= 6/7/11 Mr. McDevitt said research was completed and would like to discuss with the Board after the meeting of 6/28/11);

Mr. Gay= dos to contact the Congregational Church to find out how long they would allow the Town to use their property;
