OPEN FORUM

Mike Sherman told the Boa= rd that two gentlemen from the Department of Transportation (‘DOT’) wer= e in Town surveying and taking elevations to get ready to turn the planning over= to David Scott to start designing the new bridge for <= st1:address w:st=3D"on">Main Street. He wondered if the Selectmen or Mr. Gaydos had spoken to the DOT or Mr. Scott or had anything to report. Mr. Gleason had no information; Mr. Scott had not spoken to the Selectmen.&nbs= p; He was only aware that the project had been delayed to 2017, proposed under the (state’s) new 10-year plan. Mr. Gleason asked Mr. Gaydos if he= was aware the DOT was in Town. He= said the state didn’t notify the Town they were coming. Mr. Sherman told the Selectmen tha= t the DOT spoke to his neighbor and had shot elevations around the brook. They had brought a small boat and measured the culvert sizes on the bridges.= Mr. Gaydos said the DOT may have been conducting a survey of the condition of the bridges and issue a survey that is available for the public. Mr. Gleason thanked M= r. Sherman for bringing it to the Selectmen’s attention and asked Mr. Ga= ydos to find out why the state was in Town.

APPOINTMENTS

Phillip Currier = 211; Presentation of Easement for the New M= uldoon Park Driveway<= /o:p>

Mr. Gleason said the Selectmen expressed gratitude to Mr. Currier for= the magnanimous gesture of donating an easement to the Town.

Mr. Phillip Currier came forward.&nb= sp; He had the original easement signed and notarized; Mr. Gaydos had the mylar plan that would be recorded along with it. He assumed the Selectmen had revie= wed the documents, which had been signed off on by Town Counsel. He hoped (the easement) would faci= litate safety along with traffic safety/flow in and out of the park. He presented the easement to the Selectmen.

Mr. Gleason reiterated the Selectmen’s gratitude. He said safety had always been a c= oncern and appreciated the donation.

Mr. McDevitt echoed Mr. Gleason and stated further that (the easement) was a considerable improvement in safety and couldn’t wait for it to = be done. He and the other Selectmen thanked= both Mr. and Mrs. Currier.

Mr. Gleason noted it was no small contribution, he had been working w= ith Mr. Currier since 2005 to bring the easement to conclusion. He felt all the sports organizatio= ns should be grateful as well. <= span style=3D'mso-spacerun:yes'>

Ron Hannon, PERC Di= rector – Discussions Regarding:

Mr. Ron Hannon, PERC Director came forward to discuss the facility. He listed the things they were inv= olved in, recognitions received and programs they hoped to develop. Two of which were the following:

Pick/Buy Back Program = – Earlier in the year a limited liability= was put together. Mr. Hannon said= his idea was if something came in it could stay out for the day; at the end of = the day all the items went into the dumpster.&= nbsp; No one takes anything out of the dumpster. If someone wants an item, they wil= l have the opportunity to purchase it at the price of the metal (for that day) from the hauler. Everything at the facility is a commodity. Mr. = Hannon said no one would take anything apart.&nbs= p; If there was something someone wanted, they would put it on the scale and come in below and give them the item.&= nbsp; The facility would do well because they wouldn’t have a haulin= g fee added onto the income side. I= t was noted that people wouldn’t hang around waiting for items.

Mr. Viger asked if the employees at the facility would be able to sus= tain extra attention by people looking to purchase items. Mr. Hannon didn’t see the pr= ogram as being like a store. He sai= d people came in now with items such as televisions, refrigerators, air conditioners, C&D; it would be just one more item that they would handle.

Mr. Gaydos emphasized that he spoke with the Town’s insurance carrier and attorney. The Town’s attorney came up with a limited liability agreement. A person would sign off indicating= they knew what they were receiving. He also noted if a person were to buy an item, such as a lawn mower, brought it home, took the wheels off and brought it back to the facility; it would be counted as a disposal. Mr. Ha= nnon commented that the facility wouldn’t buy items back from people.

Mr. Haverty asked if everything was sold on an ‘as is’ ba= sis with no refund. Mr. Hannon re= plied everything was covered in the agreement.&n= bsp;

Mr. Gleason asked if the limited liability was something people signe= d or were provided a copy. Mr. Gay= dos stated people had to sign the agreement.&n= bsp; It was a short agreement outlining that items were being sold for pa= rts and if that item was brought back they would pay a disposal fee. Mr. Gleason commented that the Town would need to maintain the record. Mr. Hannon stated they currently maintained those records and submit= ted a revenue report to the Town Clerk’s office. Mr. Gaydos noted that all the pape= rwork matched up with the revenue. = He said if the paperwork started getting large, the records could be scanned a= nd put on disc.

There was a consensus of the Board that Mr. Hannon should proceed with the activity immediately. Mr. Hannon will provide Mr. Gaydos with the rules/regulations they will have for the picking process.

In looking at all communication related things, Mr. Haverty asked Mr. Hannon about the scrolling message board.&= nbsp; Mr. Hannon said they would be taking the glass crusher out and putti= ng up a message board of things that were happening at the recycling center. The PERC discussions were suspende= d at this time so the public hearing could be conducted.

PUBLIC HEARING : 2nd of 3 Public Hearings to discuss the Town of Pelham’s Pawn Shop Ordinance as Proposed by the Pelham Police Department

Police Chief Joseph Roark came forward.

Mr. Gleason asked Chief Roark to discuss the Muldoon egress and what = the Highway Safety Committee was reviewing.&nb= sp; Chief Roark said the major concern was the brush being thick at the location and the Budget Committee wanted the assurance that prior to the eg= ress being officially opened that the brush was cut back so the sight lines in b= oth directions were adequate. He = was sure the finished product would meet all the safety requirements necessary. =

Mr. Gleason opened the Public Hearing to discuss the Town of Pelham’s Pa= wn Shop Ordinance. He said during the last hearing there were recommended changes; those changes have since been made. The revised document had been posted and made available for public review. Chief Roark noted all= the locations that the document was made available. He said one business owner had con= cerns, but through a series of discussions, some with Mr. Gaydos, he didn’t = feel that business fell within the Ordinance.&n= bsp;

Mr. Gaydos discussed the application renewal due date. He believed the renewal license (a= pplication) information should be April 1= ^st so the Town would have the information for a month before they approve lice= nse May 1^st. Chief Roa= rk believed the date change was in context with the spirit of the previous conversation= and wasn’t a material change. Mr. Gleason asked if there were any further changes contemplated. Chief Roark asked if the Ordinance= was a ‘fluid’ document that could be changed as they saw the need to = do so, or if it would have to go to Town vote. Mr. Gaydos said they already had T= own vote; it was a ‘fluid’ document, but if changes were going to be made public hearings had to be held.

Mr. Gleason opened the discussion up to the public. No one came forward to speak.

Mr. Gleason asked that the next public hearing be scheduled for October 11, 2011

Ron Hannon, PERC Di= rector – Discussion Con’t…

Home Pick-up Program &= #8211; Mr. Hannon asked that the Selectmen con= sider there were a lot of elderly, sick or handicapped people in the community. There were also people in the comm= unity who didn’t have the ability to move certain items or where to go to f= ind someone with a pick up to help them. He would like to put together a bulk pick-up service by the Transfer Station with a $25 fee (not including disposal fee). Items would have to be outside or = in the driveway; they wouldn’t enter homes.= Pick ups would be scheduled during non-busy times; they would try to= do it during one day. The facili= ty had a truck available as well as the lift gate.

Mr. Gaydos said when initially discussing the program with Mr. Hannon= he spoke to the Town’s insurance carrier. He it seemed they had the ability,= with the lift gate on the truck, to take some of the heavy items with very little effort on behalf of the employees. <= /span>

Mr. Gleason asked if the program was within the scope of the union contract. Mr. Gaydos hadnR= 17;t receive any comments and looked at it as job security because it was another service. He said the employee= s had been enthusiastic about the new programs, such as the recycling and doing t= he pick ups. Mr. Gleason was con= cerned about the legality and whether it was exceeding the intent of the union contract. Mr. Gaydos didnR= 17;t believe it was.

Mr. Hannon didn’t envision people lining up for the service. He said he had nothing against the unions, but could always have the part timers handle it if there was an issue.

Mr. Gleason asked if this would create a situation for people to abuse the system. Mr. Hannon said t= here was always the opportunity for that to happen. The program was viewed as a revenu= e and service to the Town. Mr. Hann= on said they may not get any calls.

Mr. Haverty questioned who decided who got the service and who would not. He asked if the service = was open to everybody. Mr. Hannon answered yes. Mr. Gaydos said= with the proposed new services they kept running the same tests, such as: 1) if = they had the man power to do it; 2) what are the liabilities; 3) are employees b= eing exposed to dangerous situations. &nbs= p; He said as long as they kept answering the same questions and they w= ere answered properly, he felt they could continue with the ideas. Mr. Hannon said there was a rhyme = and reason for everything they did at the facility.

Mr. McDevitt was concerned about associated costs, such as fuel, and = wear and tear on the truck. He sug= gested trying the program on a two month basis and have Mr. Hannon come back to provide actual costs. Mr. Han= non understood. Mr. McDevitt said knowing the true costs would help them to determine whether the $25 pick up= fee would cover those costs and how much of it was a deterrent to people. Mr. Gleason would also like to tes= t the program to see its acceptability with the people. Mr. Gaydos discussed how they arri= ved at the $25 fee based on time and average miles to and from the facility. He agreed with tracking the actual= s.

There was a brief discussion how to proceed. Mr. Gaydos suggested hav= ing Mr. Hannon include an item on his bi-weekly report. Mr. Hannon asked Mr. Gaydos if he = would look into the liability of the employees going onto private property with t= he Town truck. Mr. Gaydos said t= hey didn’t seem to think it would be a liability if the item was down on = the corner. The worker’s co= mp. liability would be if they were shoveling items into the back of the truck (i.e. construction debris), which wasn’t the intent. Mr. Gaydos said the fact that they= had the lift made a huge difference. Mr. McDevitt commented if a person was handicap or unable to move it= ems he didn’t know how they= would get those items to the end of the street.&= nbsp; Mr. Haverty discussed liability and was more comfortable with having= items located outside in an accessible location for removal. Mr. Gleason said it could be adver= tised as curb side pick up.

There was a consensus of the Board to allow Mr. Hannon to proceed with the service/marketing beginning October 1, 2011. The Sele= ctmen would like a summary report indicating how the program was running. Mr. Hannon said he could put toget= her a report showing locations/mileage, how long it took them to do pick ups, and= a breakdown of costs. He would = put an update in every bi-weekly for the Selectmen to see how the program was running.

Mr. Gaydos stated he had been working with Mr. Hannon who spoke about= a lot of programs that sounded interesting.&= nbsp; He said he made it clear that there was an approval process that was needed. In this spirit, there= was a program they were working on. Mr. Hannon said he had been thinking about the containers and how he could cont= ain the trash area inside the building without stopping traffic. He said he looked at a trailer on = wheels (and showed a photograph of it) that was almost the same size as the one us= ed at the facility. He was think= ing that the trailer could have a bar attached to the front and be put at the f= acility. The trailer was hydraulic with one battery, and could dump all the waste into the building for them. This would eliminate the multiple = trips, mess, and wear on the bobcats. Mr. Hannon outlined items that had increased hauling costs (i.e. tires, brush) = and discussed the convenience of having the hydraulic trailer that could be use= d to deliver these items to local vendors therefore saving money. He said the trailer could also be = used at the facility for other purposes. The approximate cost for the hydraulic trailer is $7000. He wanted to let the Selectmen kno= w what was possibly going to be proposed, although he still had to work out the nu= mbers for cost savings. =

Mr. Gleason asked how the trailer would be towed. Mr. Hannon said they had put a bal= l on the back of the truck. Mr. Ga= ydos commented that conceptually it sounded great, but all the details hadn̵= 7;t been worked out yet. He said = the huge savings would be to eliminate a couple of the dumpsters they currently had. Mr. Gleason said the soo= ner the numbers could be put together, for feasibility and payback, the better;= possibly before reconsideration. Mr. V= iger stated it was an item Mr. Hannon identified, there was public discussion, a= nd if the department had money at the end of their fiscal year it could be purchased based on surplus. M= r. Gaydos said his concern was the start up cost of the bins. He didn’t want to be in a po= sition of rushing a decision. He wan= ted to work out the details. Mr. Gle= ason felt Mr. Hannon should start his research; in looking at the cost of the trailer, what would be the avoided costs, tradeoffs, revenues and paybacks. Mr. Hannon said he = could probably get one of the vendors get the trailer for the Town, but he felt t= he Town should own it for flexibility of using it for hauling.

Mr. Hannon told the Selectmen he would like to put together a PERC Scholarship Fund. He said som= ething like a 50/50 raffle and the 50% went toward the scholarship fund to a Pelham High School student looking to get into the environmental field. The Sele= ctmen felt it was a good idea, but wanted to proceed cautiously. They told Mr. Hannon to gather information so it could be put to counsel for opinion.

OTHER BUSINESS=

Approval of Revised Hawker/Peddler/Itinerant Vendor License

Mr. Gaydos noted that a public hearing wouldn’t be needed becau= se they weren’t changing the Ordinance.= He wanted the Selectmen to know that the way the license worked would change to now have a ‘location’ and clearly state where a hawker/peddler could operate from. <= /span>The new application will be more specific regarding the dates of operation and location. <= /p>

Mr. McDevitt stated one of the critical links was communication with Police dispatch. Mr. Gaydos discussed the Police procedure when receiving a call questioning a vendor.<= span style=3D'mso-spacerun:yes'>

There were no further questions raised.

Discussion: Proper Procedures to Follow Regarding any Issues That May Arise With Property Acqu= ired for Non Payment of Taxes

Mr. Gaydos said he wanted to establish a procedure whereby the Board = of Selectmen would know a good thirty days in advance when a property was on t= he list for deeding. This would = give the Selectmen the opportunity to review it and determine if there are any problems with a property. Mr. Gaydos said in the nine years he’d been working for the Town there had only been a handful of such properties.&nb= sp; He said the procedure would be a reporting mechanism from the Tax Collector to the Selectmen thirty days in advance indicating people who were due to be deeded. =

Mr. Viger said there were provisions that the Selectmen would have to accept the property. He asked= if the Town was stuck with the liability of property if someone defaulted on t= heir taxes. Mr. Gaydos said if the= Tax Collector recorded the deed, the Town would own the property; therefore they should have the buffer of thirty days to review.

Mr. Gaydos proposed generating a procedure for the Selectmen to revie= w. He said it wouldn’t take lon= g to do. He wanted to make sure the timing worked with the Tax Collector.

Mr. McDevitt said a number of years ago they had a procedure, the Town Clerk would give the Selectmen a computer print out; however the laws had changed giving the Town the opportunity for review. He stated it was critical that the Selectmen have the opportunity to review.&= nbsp; Mr. Gaydos replied that the proposed process mimicked the old process. He said all he was l= ooking for was the print out for the Tax Collector, but the process would specify = when it was done. This would give = the Town the opportunity to inspect the property. The key element was that the property wouldn’t be registered until the checklist was complete.

Mr. Gleason asked Mr. Gaydos to proceed getting a policy put together= and scheduled on an agenda.

Public Hearing to b= e held regarding the Amendments to the Pelham Junkyard and Automotive and Recyclin= g Ordinance on Tuesday, October 11, 2011 at 7pm

Mr. Gleason announced that a public hearing would be held October 11, 2011 at 7pm relative to the Junkyard Ordinance. It was noted that = the only change was to the date of renewal.&nb= sp;

Discussion

Mr. Gleason stated he had been to NRPC on two occasions and found it relevant that the state was redoing the 10-year (transportation) plan, which meant that the federal funding was drying up in some areas; quite a bit of = work had been deferred. A new 10-y= ear plan is being proposed, most of which is road maintenance. The round about and Main Street Br= idge were still contained within the plan. Mr. Gleason attended a financial seminar and received information regarding the Town. Next year= the Town would have a reduction of approximately 5% in state support and probab= ly more later on. The state was obligated to provide the level of funding that it currently was for adequate education; the balance of the cuts had to be picked up elsewhere. Mr. Gleason provided an analysis of impact on the retirement system (cost sharing). The Town would be seeing less mone= y as time went on; more and more burden would be passed on to the Town by the state.

Mr. Gleason stated there was Legislation passed, Article 234 authoriz= ing towns to institute tax limitations (spending caps). Their feeling was the town may see warrant articles coming from the people in the next couple years indicating they wanted a tax cap; the caution was there were two different things R= 11; tax caps and spending caps. According to what they were told (at the meeting) was if the voters imposed tax caps or spending caps, they would apply to the budgets being put forward for the year. Once th= ey got through the budget process and went to deliberative session, they could be modified by the people at deliberative session. The advice the Town received was t= o be on alert, there may be attempts by people to institute tax caps.

Mr. Gleason informed that he attended a broadband stake holders meeti= ng with NRPC. He said he wasn= 217;t qualified to participate at a high level, but attended because they wanted participation from Pelham and other communities in the area. He said the subject went beyond wh= ether the town had broadband, or needed it. The question raised was whether the current broadband was adequate in terms of download speed, and if there was competition. Mr. Gleason said they conducted a quarterly review, and Pelham would be well represented if they could get someone to participate who was versed in broadband width, satellites etc. He said the Federal Government had authorized a study that was handled by the University of New H= ampshire, who returned it over to the various regional planning commissions to review. The data gathered is representative of what the broadband companies were saying, but may not be accurate in terms of what was really happening in a community.

Mr. Haverty stated that there had been a dramatic change in how people used their internet service over the last couple years. He believed the intent of the meet= ing was to figure out how people were using the internet and if it was sufficie= nt or if there were infrastructure improvements needed to make to meet the needs. He felt they were maki= ng a concerted effort to establish what infrastructure improvements need to be m= ade based on how communities were using it.&nb= sp; Mr. Gleason said they may want someone from Town to review the data = base for accuracy and determine if it represented the Town. He believed they needed someone technically orientated to represent Pelham and determine what the needs wou= ld be in the future and find out if the current infrastructure would support it.

Mr. Gleason made a public appeal to interested persons. He said there would be a quarterly meeting Tuesdays at 9am, the next meeting would be held January 10, 2012. The ide= a was to review the Town and determine whether or not it was adequate and where t= he study should go.

Mr. McDevitt missed the point why NRPC felt the need for towns to get involved. Why the free market= couldn’t do it, without government conducting studies. Mr. Viger believed the information= was going back to the Federal Government who was doing a study so the rate commission could raise rates based on the services they were providing. Mr. Gleason said it was indicated = that when the needs were reviewed, the government would formulate a program to improve the communications/services within the area. To focus the government on certain= areas that were deficient. Mr. Gayd= os believed a lot of discussions came from the north country and situation that had risen from them not having certain services because of their lack in density.

If anyone from the public was interested in volunteering, they should fill out and submit a volunteer application (found on the Selectmen’s website). At which point the Selectmen will conduct interviews. <= /span>

Mr. Gleason stated he and Mr. McDevitt would be attending an NRPC mee= ting at which they would be reviewing the traffic study for Sherburne Road/Mammoth Road. The meeting would be held in Pelham.

ACTION ITEM REVIEW<= o:p>

TOWN ADMINISTRATOR / SELECTMEN REPORTS

Mr. McDevitt and Mr. Viger had no report.

Mr. Haverty reported regarding the fire station project. They were going through the value engineering process with Berard Martel.&nb= sp; It was expected that Eckman would hold a meeting late October asking local representatives to come in who were interested in being part of the bidding process. Late Novembe= r, Eckman would provide the guaranteed maximum price. Mr. Haverty discussed the improvem= ents to the communication initiative. He previously asked the Board to allow him to undertake a pilot program with regard to a Town e-mail newsletter. The pilot went live and within the first 24hours of releasing the pi= lot, approximately one hundred people signed up to receive e-mail notifications = from the Town with regard to things happing within the Selectmen office and other departments. Mr. Haverty was working on a prototype of what the newsletter would look like and expected = shortly to forward a copy to the Selectmen for approval. He asked to work with Mr. Gaydos regarding some of the content and to launch the initial e-mail blast. By the time the Selectmen met agai= n he would be able to provide statistics. Efforts would continue to grow the e-mail address link.

Mr. Gaydos stated that Arthur Hayes had taken care of the Town clock = for over twenty years gratis. Mr. McDevitt explained that the Town clock was located within the Congregational Church tower for time in memorial. He said it was the Town’s responsibility to maintain it, but it was broken. Mr. Gaydos said t= he clock was 107 years old and was originally on a pendulum with cables. Somewhere along the line (50-60 ye= ars ago) it was retrofitted to be electrified.= He said recently a motor burned out that was last rebuilt in 1993; D= on Sturtevant (D.E.M.Electric) came forward and offered to work with Mr. Hayes to find a motor and see how the clock could get back to working. The clock repair was a total volun= teer effort. Mr. Viger asked if th= e Town would assume the cost of the replacement motor or anything that would come about. Mr. Gaydos said it had always been offered, but part of the gratis was that the volunteers had alw= ays taken on the job and gotten it done. They had never asked for money, but the Town was always there to pay.

Mr. Gaydos reported that = the work was moving along at the M= uldoon Park driveway. He emphasized that Keach-Nordstrom (Planning Board engineering review firm) had volunteered (free of charge) t= heir inspections so the Town could document they were in compliance with the permits. He said the necessary culverts were set in; at this point they were temporary culverts. He believed the Selectmen would be pleased to see how quickly the job was finished. Mr. Gaydos said he was working wit= h Park & Recreation Director Brian Johnson regarding the signage at the park.<= span style=3D'mso-spacerun:yes'> He indicated he was currently work= ing to set a meeting with Comcast to finish the contracts and get the internet pro= gram started. He reported that he = and the Chief were working with the state to review the Young’s Crossing/Route 38 area. The s= tate had requested data, which would be compared to what was viewed on site; aft= er which recommendations would be made.

Mr. Gleason reported that= the Budget Committee was in session and moving along well. He set the Selectmen’s posit= ion with the Budget Committee that the default budget is provided, but not something they are subject to review/correct. He commented that the Police Depart= ment was conducting an AARP driver safety education course held at the Pelham Po= lice Station October = 5, 2011; those interested should contact Lieutenant Brian McCarthy. He ended by reporting that the Tru= st Fund origin documents had now been scanned (into electronic versions) and w= as available on the Trustees website. <= /span>He thanked Executive Secretary Marie Maruca for her diligence in getting the information scanned and making it available on the website. The Selectmen were asked to review= the MS4 so there wouldn’t be a delay in the tax establishment.
