OPEN FORUM

Mike Sherman, Old Bridge Street said in March-Nov= ember, 2003 the Selectmen and Highway Safety Committee (among others) met to deter= mine what streets they would change the names of and renumber. This went into effect July 1, 2008. To date he could not get deliverie= s from companies such as UPS, Dracut Appliance, unless he listed his old address.<= span style=3D'mso-spacerun:yes'> His neighbors had the same problem= . Mr. Sherman asked if mutual support (from surrounding towns) would be able to find his home. Mr. McDevitt said it wasn’t unusual for Pelham’s dispatch to give responding towns directions to where they were going. Mr. Sh= erman said his mail was correct, but questioned why the latest GPS couldn’t find= the correct address. Mr. Gaydos s= aid it wasn’t the first time the question came up. He said as the Town found out about companies that weren’t updated, they provided them with the informati= on but it was up to those companies to update their information (data base). Mr. Viger suggested verifying with= the Fire Chief what happens on an emergency basis. Mr. Gleason asked Mr. Gaydos to ge= t back to Fire Chief Midgley and Police Chief Roark to acquaint them with the prob= lem and ask if they were aware of it and if there was any remedy that the Town could enforce.

APPOINTMENTS

Deb Waters, Forestry Committee and Camille Pattison, NRPC – Discussion Draft of Scope of W= ork and Project Map regarding the proposed iTRac Program Class VI Road Study

<= /p>

Ms. Deb Waters, Pelham Forestry Committee and NRPC representatives Camille Pattison and Tim Roache came forward to discuss the Class VI road s= tudy under the iTRac Program. The = Board was provided with information regarding the scope of work. She explained that the actual stud= y was under the transportation program “iTRac” which was integrating transportation and community planning.&nbs= p; She said they were concerned due to problems in the Gumpas Pond area= ; as they began their review they realized there were a lot of Class VI roads on Town land. The three main are= as reviewed were Raymond Park, Gumpas Pond Conservation Area, and Peabody Town Forest along with some newly acquired land. Forest Management Plans have been done and issues relating to the Cl= ass VI roads have been raised; they have struggled with what work could be done= on the roads and how they could be dealt with in relation to the forest land on those roads.

Mr. Gleason asked what intent the iTRac study would be and if it would come up with a solution to address issues.= Ms. Pattison explained that the iTRac program was provided through t= he free services of Nashua Regional Planning Commission (‘NRPC’).<= span style=3D'mso-spacerun:yes'> She said the intent was to determi= ne what could be done regarding the Class VI roads. There were five tasks outlined: 1) determine what other communities are doing; 2) review of road classificatio= ns; 3) conversation with Fire Chief to determine if there was any benefit to maintaining any portions of roadways for emergency purposes; 4) analysis all information to determine an approach; and 5) create a short report the Town could consider what actions to take. Mr. Roache commented that they were thinking ahead for what the prop= osed areas may require. As an exam= ple, he said under task 3, for neighborhoods under Gumpas Pond there may be a discussion of having a connection through to Mammoth Road for emergencies. Under task 4, a possible solution = may be road improvements bringing them up to Class V to open them to other parcels.

Mr. McDevitt questioned what specific problems were they trying to solve. He also wanted to know= what possible solution would come out of it.&nb= sp; Ms. Waters was reluctant to speak about solutions, the proposal was = the first step in evaluating the Class VI roads; they wanted to keep an open mind. She said the problem fo= r her started when they first did forestry work at Gumpas Pond when she received a phone call that forestry equipment had been vandalized. She discussed the occurrences that had been going on and stated that the situation was serious and the Police had intervened. Mr. McDevitt was sympathetic to the situation, but didn’t understand how a transportation study would get people to obey the law. Ms. Waters didn’t have an an= swer how it would fix the situation. She said within the scope of the study the road classifications were addressed,= but they didn’t know what would come out of the study.

Mr. Gleason asked if it was a fair assumption that the study was a fa= ct finding exercise to find out what options were available and it was a free service provided by NRPC. Ms. Pattison answered yes. She sa= id if the Town was to look at potentially changing some of the road designations,= it may or may not have an impact, but the reality was there was an enforcement issue occurring. It may provi= de options the Town could pursue. Mr. Roche said Pelham can’t be the first town experiencing problems; part= of the assessment under the first task was to conduct research to that regard.=

Ms. Pattison explained that their timeline showed the process beginni= ng in October and going through January, but it would be more realistic (due to holidays) for it to run into February/March (approximately 5 months).

Mr. Viger asked who would make up the review committee. Ms. Pattison said the make up of t= he committee would be at the determination of the Town. Anyone with an inertest or experie= nce would be beneficial. Ms. Wate= rs said Ms. Pattison had met with the Forestry Committee, but Conservation Commission members Paul Gagnon and Chris McCarron would also be involved.

MOTION:

(Lynde/Viger) To authorize the NRPC to proceed.

VOTE:

(3-1-0) The mot= ion carried. Mr. McDevitt voted= no.

Mr. Gleason asked that the Selectmen are kept informed. He would like to know who would be involved in the committee.

PUBLIC HEARING: To = Discuss the Amendments to the Town of = Pelham Junkyard and Automotive and Recycling Ordinance

Mr. Gaydos explained that the statutes had read that all renewals had= to be as of April 1^st. The statutes have changed to July 1^st. To reflect this change, the Town&#= 8217;s ordinance approval date has been changed to July 1^st and indicated that applications mu= st be filed by June 1^st of each year providing a full month to review properties. Anyone wanting to= open a recycling or junkyard would have to go through the entire approval process for a new license; there was a completely different section in the ordinance addressing new applications. =

The only change in the Ordinance was the filing date for a renewal and the date that a license would go into affect.

Mr. Gleason opened the hearing up to the public. No one came forward with comments.= Mr. Gaydos stated that the criteri= a had been met to enable the Selectmen to take a vote on the matter.

Mr. McDevitt made the motion to approve the revisions. Mr. Lynde seconded. Mr. McDevitt commented that several years ago the Board of Health had adopted a signific= ant number of regulations regulating junkyards. He said it might cause confusion h= aving this ordinance and the Board of Health regulations in place. He suggested that the Selectmen (a= s the Board of Health) revisit those regulations to determine what they wanted to keep in place because people that wish to follow the law may become confused. <= /p>

Jeff Gowan, Planning Department Director – Discussions

Proposed Planning Depa= rtment Fee Increases – The Sel= ectmen were provided with a breakdown comparing the current fee schedule with the = proposed fee increases. Mr. Gowan said= an analysis had been done to show what the 2011 number would have been had the proposed increases been in place. The largest increase would have been in electrical permits. Another document was the compariso= n of Pelham’s rates to Windha= m, Plaistow, Derry, <= st1:place w:st=3D"on">Merrimack, Hudson and Londo= nderry. Mr. Gowan said the proposal was to= raise the fees to be consistent with other communities; in many cases, those rais= ed fees would still be lower.

Mr. Gleason questioned if a recommendation had been provided to the l= and boards for increases. Mr. Gow= an said the lion share was under the purview of the Selectmen; he had not yet = made a proposal to the land boards. Mr. Gaydos said the percentage, evenly weighted across the board, was a 32% increase. The key large incre= ases were all commercial.

Mr. McDevitt said Pelham needed to be equitable with other communitie= s, but wondered if the timing was wise. He said they were trying to be cognizant of the cost of living and d= oing business in Town. He said in = the depths of a recession was probably not a good time to raise taxes. He would rather do something when = times were better. He agreed with t= he spirit of the proposal, but didn’t like the timing. He wouldn’t support an acros= s the board increase at this time because of the economic conditions.

Mr. Lynde believed the purpose of the fees was to support the Planning Department and their costs. He didn’t believe that during the past ten years the Town didn’t h= ave an increase in costs. He felt= it was appropriate to update the fee schedule.

Mr. Viger commented that the fees collected didn’t offset anyth= ing in the Planning Department; they could show revenue, but they went back into the general fund to offset taxes. He was concerned with some of the jumps in the residential side and feared that people may do things without obtaining a permit. He understood the purpose of the f= ee increase, but also felt that the timing may not be right.

Mr. Gowan anticipated the views and suggested only raising the commer= cial rates. He said currently comm= ercial building was more robust than it had been in twenty years.

Mr. Gleason asked that the discussion be suspended for the Selectmen = to conduct their Public Hearing (scheduled for a specific time). He will ask Mr. Gowan to readdress= the Selectmen later in the meeting.

PUBLIC HEARING : 3rd of 3 Public Hearings to discuss the Town of Pelham’s Pawn Shop Ordina= nce as Proposed by the Pelham Police Department and Possible Vote

Police Chief Joseph Roark came forward for the discussion.

Mr. Gaydos informed that several hearings had been conducted and they= had established the fact that there was no business in Town that fell under the category. He reviewed the amendments that had been made. He stated there had been two public hearings without changes to the ordinance;= unless there was a further change, the Selectmen could vote.

Mr. Gleason opened the public hearing to public comment. No one came forward.

Mr. Gleason asked Police Chief Joseph Roark if he was comfortable wit= h the ordinance. Chief Roark said h= e was very comfortable with the ordinance. He said if concerns developed, they could always come back and adjust the policy. The idea was to h= ave a policy in place should this type of business came into Town. He felt it was good process that v= etted out concerns. He was hopeful = for a supportive vote. Mr. Gleason asked if he had received any public input. Chief Roark said he had received i= nput and had spoken to one business owner that had a lot of questions. He said they had taken the message= board feedback (from March) and incorporated those suggestions into the new versi= on of the ordinance. He was hope= ful everyone’s concerns had been addressed.

MOTION:

(McDevitt/Lynde) To approve the Town of Pelha= m’s Pawn Shop Ordinance.

VOTE:

(4-0-0) The motion carried.

Chief Roark thanked the Selectmen for the support. He felt it was a good ordinance fo= r the Town.

Planning Department Pr= oposed Planning Department Fee Increases (continued discussion)

Mr. Gleason commented that the Town had incurred more cost but wanted= to ensure the proposed increases were fair.&n= bsp; He recognized there were tough economic times.

Mr. Lynde reviewed the Town Reports of 2001 and 2010 pointing out the Town inspector’s salaries in comparison to the fees collected. Mr. McDevitt felt the information = was compelling, but not enough to change his mind in the depths of a recession. =

Mr. Gaydos questioned if re-inspections were necessary if the inspect= or collected that additional fee. Mr. Gowan said the system was that the inspectors received a stipend, if the project was not ready for the inspection or they failed, there was a re-inspection fee. This fee w= as not counted as revenue because it went directly to the inspector; Mr. Gowan guaranteed that the system was not abused.=

There was a brief discussion regarding what type of construction woul= d be charged the fees. Mr. McDevitt was not opposed to having the commercial fees increased as long as it wasn’t a disincentive for people building in = town. To see which direction the Selectm= en were leaning, the motion was made to vote regarding the fees presented

MOTION:

VOTE:

(2-2-0) The mot= ion failed. Mr. McDevitt and Mr. Viger voted no.

After further discussion, the Selectmen requested a breakdown specifi= cally identifying those elements that were strictly ‘commercial’ vers= us residential. The discussion w= ill be scheduled for the November Selectmen’s meeting.

Mr. Gleason went on to follow the set meeting agenda. (Mr. Gowan continued to speak late= r in the meeting)

Deb Waters Forestry Committee – Discussion of Proposed Rules & Regulations for the Gu= mpas Pond Conservation Area

Forestry Committee members Paul Gagnon, Deb Waters, Gayle Plouffe, and Bob Lamoreaux came forward to discuss problems occurring at the Gumpas Pond Conservation Area. Ms. Waters= said they would like to post the rules and regulations at the two entrance points. Mr. Gagnon reviewed t= he proposed rules, permitted uses and prohibited uses with the Selectmen.

Mr. Gleason asked if the $500 fine had been run through the Police Department, and if the Town had the authority to charge it. Police Chief Joseph Roark came for= ward and said he believed if the violations and fines were contained in an ordin= ance they would have means of enforcement. He discussed the areas in Town that people were discharging fire arm= s; as the Town turns from agricultural to a bedroom community, this type of la= nd conflict arises. He suggested= that there be an ordinance regarding the rules for the conservation areas with specific fines clearly delineated so when that person was cited, the Police could cite an Ordinance.

There was a discussion regarding the regulations of Town parks, patrol and enforcement. Mr. McDevitt= asked if thought had been given to providing a reward for arrest and conviction.<= span style=3D'mso-spacerun:yes'> He felt they should consider adopt= ing an ordinance and look into being able to offer a reward. Chief Roark said he could find a w= ay to get more officers in the area to become more of a presence. He felt a reward was a good idea.<= span style=3D'mso-spacerun:yes'> He’d like to review the possibility of having citizen observers to be a presence in targeted areas.=

Mr. Gleason believed there was a beneficial effect to inform people o= f the purpose of the park. He said = the remaining question was how to go after people that deliberately went against the rules. Chief Roark said an ordinance could be drafted to be stricter than the RSA’s. Mr. Viger suggested creating a neighborhood watch group. The= re was continued discussion regarding how to proceed with enforcement at the parks; Chief Roark wasn’t opposed to having the Police phone number on the proposed signs for the Gumpas Conservation Area. Mr. Gagnon asked if there were any= fines for dumping. Chief Roark said= there was a specific RSA for dumping. Mr. Gagnon said the number one problem was the discharge of firearms, the second was dumping. He asked if the Selectmen would approve posting signs with the permitted and prohibited use= s specifying to contact Police of violations.

There was concurrence of the Selectmen to proceed with posting permitted/prohibited uses, eliminating the $500 fine and note violations ar= e to be reported to the Police Department.

Ms. Waters discussed Raymond Park’s forestry operation. She told the Selectmen that there = was a delay until possibly Spring, 2012 and asked how they felt about such. Mr. Gaydos said his concern would = be mud season. Park & Recreation= will be asked about their schedule and if there would be any conflicts with fore= stry schedule and possible flexibility with such.

Mr. Gleason asked if Forestry would be bringing a warrant article for= ward for the ballot. Ms. Waters sa= id they may request a warrant article for Raymond Park; they would like to rec= ycle the revenues from forestry and put it back into the park. There were also some parcels that = needed to be designed as Town parks. The wording of the Capital Reserve was discussed in relation to funding forestry. <= /p>

Draft of BOS Road Acceptance Policy – = The Selectmen were provided with a draf= t of the policy put together by Steve Keach of Keach Nordstrom (Planning Board’s engineering review firm); Town Counsel also reviewed the docu= ment. Mr. Gowan reviewed the document and explained how the maintenance surety would be held/waived. The consensus of the Board to appr= ove the policy.

Scope of Proposed Floo= d Study – Mr. Gowan understood the Sele= ctmen had a timeframe regarding warrant articles. He forwarded a draft to the Select= men along with a proposed scope for the study.=

The warrant article would be reviewed with other warrant articles dur= ing the Selectmen’s review.

Discussion Regardin= g Police Grant

Mr. Gaydos explained that the Police submitted an application for the COPS grant which paid 100% of the cost for a School Resource Officer for th= ree years with the understanding that the Town would keep the officer for the fourth year. He said when the application was made, the federal government cancelled the grant, however, = this year they decided to fund it. Pelham was one of three communities within the state awarded the grant. He told the Selectmen = he was meeting with the Police Chief to review the grant and its particulars. He would then come back to the Sel= ectmen and discuss their findings. <= o:p>

TOWN ADMINISTRATOR’S /= SELECTMEN’S REPORTS

Mr. McDevitt attended an open house at Dr. Kodali’s office. He noted that the building was an impressive facility that contained a lot of room for expansion.

Mr. Lynde said several months ago, he received permission to work thr= ough NRPC to see if the Town could receive lower electric rates. That group was ready to go out wit= h a bid package and needed permission to have Mr. Gaydos sign. Mr. Gaydos said the Board had disc= ussed the topic and the letter had already been sent. He explained how the committee was proceeding.

Mr. Viger stated he witnessed an automobile accident and was impressed with the Town’s emergency responders respect and professionalism duri= ng the incident.

Mr. Gaydos informed that the MS5 was received; a meeting will be set = for the Selectmen to conduct review.

Mr. Gleason provided an update regarding the recent Budget Committee meetings and how they were proceeding.

· Mr. Gaydos to provide Selectmen with backup information regarding the Ambulance Capital Reserve Fund (warrant article and RSA) and the Selectmen’s authority (8/2/11 wording that initially appeared to be straight forward isn’t – further review is needed)(8/9/11 – Mr. Gaydos to = meet with Mr. Gleason to see if they come to the same conclusion regarding the information / Mr. Gleason said the information was ambiguous.
