OPEN FORUM

Mr. Mike Sherman, Old Bridge Street came forward and commented that at a previous meeting Mr. Gaydos brought up the = fact that the Town had a FEMA grant that contained approximately $167,000. He asked if the grant could be use= d for funding other things, such as the flood study or maybe removing trees from = the brook between the bridges that were causing flooding issues. Mr. Gaydos said if permitted, the Selectmen could do that, but he believed a permit was needed to remove trees from the waterway. Mr. Sherman wanted to know if there were other uses the grant could be used for. Mr. Gleason said the Selectmen wou= ld be discussing the flood study funding later in the meeting.

APPOINTMENTS

Fire Department - New Employee Introduction

Fire Chief James Midgley = came forward and introduced the Fire Department’s new Firefighter, James T. Midgley. He provided an emplo= yment history summary to the Selectmen and discussed Mr. Midgley’s credentials. Chief Midgley commented that there were eight firefighters that applied for the position;= he had no part in the selection. Mr. Gleason stated that the Chief’s integrity was not in question. The Selectmen knew that he was doi= ng the best job for the Town and respected the selection process.

The Selectmen welcomed Firefighter James Midgley.

Fire Chief Midgley discus= sed the recent storm event that he said was well forecasted/predicted. He provided the Selectmen with a debriefing by outlining what was done during preparations and how incidents= were handled during that time period. He discussed the difficulties encountered with the communications systems. He explained the restoration process. Chief Midgley said s= ome of the things they looked at and identified as potential problems were the IT Systems communication, staffing needs should be evaluated for the overall command structure, more robust EOC staffing needs, long term planning for Police and Fire systems or improved reliability, outreach with elderly and = how to bring information to the public about generator safety. These areas will be reviewed to se= e how they can be addressed in the future.

Mr. Gleason said because = of the power outage, there was difficulty communicating with the population relati= ve to safe havens, generators etc. and questioned if there was anything that t= hey should be doing to try to communicate better during a storm. Chief Midgley said (in thinking ou= tside the box) he knew of another town purchasing an AM license; they have a transmitter and transmit on AM. He commented that during the recent storm the cell tower was still up so they = were able to send information via Citizen Alert (through the Police). Mr. Haverty asked how many people subscribed to Citizen Alert. = Chief Midgley didn’t have the number; it was a Police Department program.

Mr. Gleason asked if the = Chief would be taking the lead to pull together some kind of comprehensive plan to address the issues. Chief Mid= gley answered yes. Mr. Gleason questioned if he needed any support from the Selectmen. Chief Midgley said they had alread= y been working with the Police Chief and the state. Mr. Gleason wanted to know if ever= ything was readily available for the Chief during the last storm, in terms of cooperation, equipment and support. Chief Midgley said they should look at possibly subcontracting who t= he tree companies were. He said = some of the tree companies brought in to work cleared areas well beyond their scope.

Mr. McDevitt said he list= ened to the police scanner during the recent event and commented that the number and frequency of calls was out of control.&nbs= p; He said the Town didn’t have the staffing to respond to every = call with the speed in which they normally did.= He said the Board should consider listing this as a priority item to address with the Police and Fire Chiefs.&n= bsp; He also commented that they should look at having a Deputy Chief or = some kind of officer position.

Mr. Lynde discussed the r= ecent storm and commented that he was impressed with the initial period of assessment. He discussed a situation at his address and had no complaints with the work that had been = done or the response time for getting that work done.

Mr. Gleason asked the Chi= ef to pull together a corrective action plan to address issues identified during the recent storm event. The Selec= tmen will schedule a discussion. He asked what the Chief’s impression was of the electric company’s overall performance. He also = asked if the Chief felt it would be appropriate for the Selectmen to pursue a dia= log with them relative to lessons learned and corrective actions for Pelham. Chief Midgley believed that a disc= ussion should occur, if for nothing else, the issues that occurred during the storm. His initial impression= was that they ‘dropped the ball’ in the beginning. He discussed some of the situation= s that had occurred. He told the Sel= ectmen that National Grid had already been informed that there were issues that ne= eded to be discussed and they needed some clear cut guidelines.

Mr. McDevitt asked if con= sideration could be given to creating a shelter in the new area behind the Senior Center. Chief Midgley said he had already = had discussions with emergency management about doing so. He said as soon as the building wa= s done he had discussions about potentially getting a grant for a generator; power= and heat were the issues for using the space as a shelter. He said the fall back was the schools. He noted once a gene= rator was in place, the building would be self-sufficient and could be used as a warming shelter or senior area where people could spend the night.

Mr. Haverty asked the Chi= ef to think of a way to answer the non-emergent/safety resource problems and enga= ge someone to help the Town with it. He shared the concerns regarding general communications to citizens. He felt they should come up with a= way to communicate to residents when all other conventional methods failed.

Chief Midgley said it wou= ld be at least a couple weeks before he would be ready to come back to the Selectmen.

Mr. Gleason said Chief Mi= dgley should be commended for his dedication and commitment to the Town. He said the Town was lucky to have= a capable group of professionals looking after its well being.

Ron Hannon, PERC Director – Construction & Demolition Debris Collection

Mr. Hannon read aloud a p= repared statement that outlined what had been occurring at the facility and the man= ner in which the department’s budget was prepared.

Mr. Gleason understood th= at Mr. Hannon, at the Budget Committee’s request, was going back to the Budg= et Committee with a modified 2012 budget.&nbs= p; Mr. Hannon said they had asked him to do so. He went through his budget one inv= oice at a time and explained that what hit his budget were the uncertainties. He believed there should be some s= ort of collaboration between the departments to put money into a fund for unpredic= table occurrences outside the budgets.

Mr. Lynde understood the = point and felt it was applicable to all departments. He felt the Board was flexible eno= ugh, if there was a legitimate reason to over expend the budget, they would allow it.

There was a brief discuss= ion regarding how the Budget Committee viewed budgets and setting aside surplus “contingency” funds. Mr. Gleason said the only thing the Selectmen could ask was for Mr. Hannon to put together the best budget based upon his knowledge and ability= to run the facility. He assured = Mr. Hannon if he ran into unanticipated difficulties that needed to be addresse= d, he could come back to the Selectmen. He said they had the authorities within the RSA’s to be responsible for the bottom line of the budget and had the ability to move m= oney within that bottom line to address issues.=

Mr. Haverty said he went = to the facility and was impressed with what Mr. Hannon had done. He appreciated the programs that h= ad been put in place. He explain= ed that he looked at department budgets as pieces of the Selectmen’s budget. He said per the voter’s authorization at Town Meeting they only had a certain amount = to spend. If there was a departm= ent that had a difficult year and needed additional funds, they would be taken = from another department. Mr. Haver= ty said the departments should understand that the Selectmen may need to look = at each of the departments to defer items/projects and re-appropriate funds to meet another department’s needs.&nbs= p; He said when the Selectmen say they’ll help a department out t= he first place they’ll look to make cuts is within that department’= ;s budget.

Mr. Hannon discussed C&am= p;D collection. He felt they shou= ld look at allowing commercial accounts in Pelham (such as contractors doing w= ork on homes in Town) to utilize the facility with a fee structure ahead of it. He said the materials were coming into the facility anyway with no way to stop it. He said the fee structure could po= ssibly be set up with an annual fee as well as having a disposal cost. He felt they would be able to iden= tify the people bringing C&D in. Mr. Hannon said they were seeing the revenue, but they weren’t seeing the revenue it was costing to send it out the door. He noted that the projected revenu= e for C&D was way off; it had been projected at $5000, but came in (285% high= er) at $14,000 in revenues.

Mr. Gleason wanted to kno= w if the Selectmen were to authorize commercial C&D if the facility could handle it. Mr. Hannon said they woul= d be able to handle it because it was already coming in. He said they would approach the ve= hicles and inform them the facility was contemplating commercial accounts and they would have to register for a special permit.

There was a discussion ab= out the materials coming into the facility. Mr. Hannon believed at least 50% of the C&D to be furniture. Mr. Gaydos asked if trash tipping = budget proposed for 2012 was good. M= r. Hannon believed they would either hit or be below the number. Mr. Gaydos asked when he could pul= l the actual C&D number for 2012. Mr. Hannon said the C&D number was nice because the items had been in one of the other budget lines, but they would get paid for it now. There was a need to try to identif= y the commercial organizations to establish how much C&D would be added to the stream to help determine the disposal costs. Mr. Hannon believed they could ide= ntify the contractors in Town.

Mr. Gaydos said there wou= ld need to be a plan provided to the Selectmen outlining the proposed structure and noted that a public hearing would also need to be scheduled to change the ordinance. He said Mr. Hannon= would also need to discuss what funding would be required to cover the expenses of the C&D and provide a breakdown of the offsetting revenues. If (after the public hearing= ) the Board approved the proposal, Mr. Hannon would then go to the Budget Committ= ee for a discussion during reconsideration.&n= bsp; Mr. Gaydos suggested that Mr. Hannon outline the proposal and set a discussion with the Selectmen.

Mr. Hannon discussed a qu= ote received for trucking metals; in the past the trucking number was not inclu= ded in the metals budget line. He= said the same procedure would be followed, the Town would get paid for the metals and the trucking would be deducted. Mr. Gaydos noted that the same company also handled other items. They provide a detailed invoice wi= th a breakout, however when they send a check it reflected the net amount for all the revenues.

Mr. Hannon asked if there= was something he had to do about the glass crusher. Mr. Gaydos said the glass crusher = had no value because it wasn’t being used anymore. Mr. Hannon said he put it up on the NRRA’s bulletin board and there had been some interest in it. He said he was looking to barter something that he may need. T= he Selectmen said it was okay to go ahead.&nb= sp;

There was a brief discuss= ion regarding what days the facility would be closed due to holidays. Christmas and New Year’s Eve= fall on Saturdays. Mr. Hannon aske= d that he alter the facility hours on those days to be open from 8am-2pm. Mr. McDevitt wanted to ensure that they didn’t set a precedent under the union contract. The Selectmen had no objection to amending the facility hours on the specified dates.

Warrant Article Review

Mr. Gleason said the prop= osed warrant articles were scheduled to go before the Budget Committee. The Selectmen reviewed the followi= ng warrant articles as identified by Mr. Gaydos. (See Attachment “A”).

There was a discussion regarding Article E - Shall the Town vote to raise and appro= priate the sum of $3,900,000 for the purpose of constructing a fire station and to approve withdrawal of $2,100,000 of unassigned residual fund balance to off= set this cost. Additionally, $423= ,393 will be withdrawn from the fire impact fee account, leaving a balance of $1,376,607 to be raised by taxation.

The $2.1 million figure (of unassigned residual fund balance) came from Mr. Gaydos calculating the number to be close to $1 per $1000. Mr. McDevitt asked if = the balance of the $1.4 million would be spread out over a period of time or if property taxes would be charged that amount in the first year. Mr. Lynde said all of it was money= that the Town would have (it’s cash) put into either the General Fund or the F= und Balance, it wouldn’t matter, it ($2.1 million) was all earning interest. It would keep earni= ng until the Town spent it. He s= aid the warrant article was appropriating money for 2012 ($1.37 million) and wo= uld be on the tax rolls (raised by taxes) when the tax rate was set in November. In 2013, they will = be asking for $1.37 million less from the taxpayers. Mr. Gleason said the question was = if there would be a cash flow problem in having the outlay of money for the fi= re station between March and the time that the tax bills went out in November = to cover the expense. Mr. Gaydos= said they shouldn’t have a cash flow problem; most of the construction exp= ense wouldn’t be until later in the year as construction was finishing. Mr. McDevitt speculated if the fir= st payment showed up in the October 2012 tax bill, when the tax rate was set in 2012, = they may be in a position to have additional fund balance to offset the amount.<= span style=3D'mso-spacerun:yes'> Mr. Lynde believed by having the proposed warrant article they were assuring that the tax impact in the succeeding year for the fire station was zero (2013). He said they were also trying to e= nsure that the maximum tax impact of the fire station in 2012 was $1 on the tax r= ate, because they were taking the bulk of the money out of the fund balance and = were also using impact fees.

Mr. Gleason questioned how the Selectmen would proceed= with the article to the Budget Committee. Mr. McDevitt wanted to know what would remain after the $2.1 million= was taken out. Mr. Gleason said t= here would be $145,000 remaining. = He said an additional amount would for 2011 would be added to that figure; the speculated 2011 amount was in excess of $500,000. He said it would run the fund bala= nce down lower than recommended by the state; though not unprecedented by towns that were trying to have something accomplished for infrastructure. Mr. Gaydos said the savings of int= erest and various overhead and administrative costs of borrowing money were well offset by using the cash and assets the Town had. The figures were reviewed; after withdrawing $2.1 million from the fund balance, there would be a residual of approximately $145,000; excluding what would be contributed at the end of December, 2012.

Mr. Haverty, questioned (assuming approval of the arti= cle) if there would be any value in moving the money out of the fund balance int= o a separate account. Mr. Gleason= said the warrant article was legal documented proof to restrict the money.

Mr. Gleason asked if the Selectmen were happy with the numbers contained in the article. Mr. Gaydos said if the guaranteed maximum price came in at less than $3.9 milli= on (for the total project); the number could be revised downward. Mr. Lynde provided a brief explana= tion of the fund balance and how it was used.&n= bsp; Mr. Gleason read aloud the definition of fund balance as contained i= n a Local Government Center guide for government bodies.

The Selectmen continued their review of the proposed w= arrant articles.

The decision was to drop the following warrant article= s:

Article G : Sh= all the Town vote to raise and appropriate the sum of $100,000 to be placed in the Compensated Absence Trust Fund for the purpose of disbursing accrued time (annual vacation and sick leave) to terminating employees as required by law and/or negotiated contracts?

Article I: Sha= ll the Town vote to raise and appropriate the sum of $100,000 to be placed in the = Tallant Road/Willow Street Bridge Capital Reserve Fund? = This funding is for the Willow= Street Bridge replacement which is identified by the State of New Hampshire as being sub-standard an= d is eligible for 80% grant reimbursement. = There is approximately $224,000 in this fund. (Majority Vote Required)=

Mr. Gaydos will revise Article J to clarify the language. He will also meet w= ith Conservation Chairman Paul Gagnon regarding Article K to specify which parc= els will be included. After a bri= ef discussion, Mr. Gaydos noted he would revise Article L to reflect the prefe= rred language of the DRA.

The Selectmen discussed if they would fund Article M (= Beaver Brook flooding study) from the FEMA Fund.&= nbsp;

MOTION:

(Haverty/McDevitt) To modify Article M (Beaver Brook Flood Study) to be (a warrant article) = funded with FEMA money.

Janua= ry 10, 2012 Presid= ential Primary Election Poll Location

MOTION:

Brian Johnson, Director of Parks & Recreation Certified Park & Recreation Professional (‘CPRP’) Designation <= /u>

Mr. Gaydos informed that = Park & Recreation Director Brian Johnson received his Certified Park & Recreation Professional designation. He said it is a national test/program; each year he will have educat= ion credits. The Selectmen offered congratulations to Mr. Johnson for his diligence and successful completion. A letter of congratulations will be drafted and signed by the Selectmen expressing thei= r gratitude.

Tax Rate Discussion

Mr. Gleason said the tax = rate had been established at $21.41. M= r. Lynde commented that the Town’s total valuation decreased last year b= y 3.6%. He said the reason for such was th= e market analysis resulted in a lowering on average of everyone’s property value. The impact to the R= 20;average” homeowner would be approximately $300.&nbs= p; Tax bills are being prepared and will be mailed out shortly; the due date is Decembe= r 12, 2011.

Selectmen meeting location change for 11/22 & 12/6 to Media Center at the Elementary School

The PES Media Center has been scheduled, however= if PTV is able to make necessary improvements at the Senior Center, the meetings will be held there.

TOWN ADMINISTRATOR&= #8217;S / SELECTMEN’S REPORTS

Mr. Gaydos, Mr. Lynde and Mr. Haverty had no reports.

Mr. McDevitt noted that he had spent time with Park & Recreation Director Brian Johnson, for the PTV program, discussing the department and = various activities. The program will = be run at various times on Pelham cable access channels. He thanked Mr. Johnson for his assistance.

Mr. Gleason reported the activities of the recent Budget Committee meeting. He said they voted o= n the School budget and opted to cut $1.9 million from that budget. Of the money cut, $750,000 and $64= 0,000 were to be moved into warrant articles for the High School sprinkler and HV= AC system. He commented that he = was meeting with NRPC to discuss additional reductions in government spending a= nd review another iteration of the 10-year plan. He will be meeting with the Counci= l on Aging during the next week who will discuss voting funds to help ready the = Senior Center (for PTV) for government meetings. <= /span>

ARTI= CLE B: Shall the Town vote to aut= horize the Selectmen to enter into a 3 year lease-purchase agreement for $14,004 f= or the purpose of obtaining a new Ford Focus to replace the current Planning Department vehicle and to further raise and appropriate the sum of $4,668 f= or the first year’s payment for that purpose? This agreement will have a non-appropriation and non-replacement clause as prescribed by state statute= . The current Planning vehicle has over 150,000 miles and will not pass inspectio= n.

ARTI= CLE C: Shall the Town vote to change the purpose of the existing Library Renovation – ADA Expendable Trust Fund to include any construction/ renovation at the Library and to appoint the Library Trustees as agents to expend. The present value of the Fund is $xx,xxx. This Article requires a 2/3 majority = vote per RSA 35:16.

ARTI= CLE D: Shall the Town vote to raise and appropriate the sum of $210,000 for the purpose of purchasing a new, fully equipped ambulance and to remove $87,440 plus interest to date from the Ambulance Trust Account and thereby closing = that account? The balance will be funded by withdrawing $90,000 from the Ambulan= ce Replacement Revolving Account and $32,560 from the FEMA account. No funds will be raised through ta= xation.

ARTI= CLE E: Shall the Town vote to raise and appropriate the sum of $3,900,000 for the purpose of constructing a fire station and to approve withdrawal of $2,100,= 000 of unassigned residual fund balance to offset this cost. Additionally, $423,393 will be wit= hdrawn from the fire impact fee account, leaving a balance of $1,376,607 to be rai= sed by taxation.

ARTI= CLE F: Shall the Town vote to approve a Department of Justice “COPS” g= rant in the amount of $196,057 for the purpose of equipping and funding a new po= lice officer for three years with the condition the town must fully fund that officer in the fourth year?

ARTI= CLE G: Shall the Town vote to raise and appropriate the sum of $100,000 to be plac= ed in the Compensated Absence Trust Fund for the purpose of disbursing accrued time (annual vacation and sick leave) to terminating employees as required = by law and/or negotiated contracts?

ARTI= CLE H: Shall the Town vote to raise and appropriate the sum of $xxx,xxx for repair, maintenance and upgrading of Town roads, to be offset by the State Grant fo= r highway maintenance? This is a Special Warrant Article. (Majority Vote Required)

ARTI= CLE I: Shall the Town vote to raise and appropriate the sum of $100,000 to be plac= ed in the Tallant Road/Willow Street Bridge Capital Reserve Fund? This funding is for the Willow Street Bridge replacement = which is identified by the State of New Hampshire as being sub-standard and is eligible f= or 80% grant reimbursement. Ther= e is approximately $224,000 in this fund. (Majority Vote Required)

ARTI= CLE J: Shall the Town vote to raise and appropriate the sum of $xx,xxx, net proceeds from timber harvesting on Raymond Park, for the purpose of forest management, trail maintenance, security and other costs associated with the maintenance and c= are of Raymond Park? Funds reques= ted come from the net revenues produced by timber harvesting. NO PORTION OF SAID AMOUNT TO BE RA= ISED BY LOCAL TAXES. This is a non-lapsing account per RSA 32:7. It will also ident= ify those actions of the Town or State which contribute to the flooding and whi= ch the Town or State or both should modify or stop. This study is to be paid from the Federal Emergency Management Agency ( FEMA) account and will have no impact= on the tax rate. (Majority Vote Required)
