OPEN FORUM

Mr. Mike Sherman, Old Bridge Street, told the Selectmen that he had written a letter to DOT Engineer David Scott= who would be doing the new design on the Main Street Bridge to make him aware that the Town had passed a Warrant Article for a flood st= udy. He said Mr. Scott came back with a letter that contained a number of questions; that letter was forwarded to t= he Selectmen Chairman and Planning Director Jeff Gowan. The letter was also forwarded to a hydraulic engineer (Tim Millet) and to the DES Dam Bureau who were very concerned with alterations to the bridge, which they believed wou= ld alter the flooding throughout the Town.&nb= sp; Mr. McDevitt replied that the Selectmen would have Mr. Gowan attend = an upcoming meeting to address the flood study. Mr. Sherman said FEMA was doing a = study of the Merrimack River and recalled that Pelham was going to try to tie into that study. He said it might be a good idea, e= ven if the Town wasn’t tied in, to get some type of feedback as to what information was gathered regarding flooding. If the Merr= imack River backed up it would also back Beaver Brook up.

Mr. Paul McDonough, Mammoth Road discussed utilities and questioned if Pennichuck could tap a well in the ar= ea on top of Jeremy Hill. Mr. Mc= Devitt said Pennichuck was free within the rules of the Public Utilities Commissio= n to put a line anywhere in Town. = Mr. McDonough said he spoke with people in that area and heard they were concerned with t= he possibility of development. He stated he was glad that the fire house would be constructed and felt the Selectmen should be commended on what they put into it.

PUBLIC HEARING: Disposition of Old Fire Station

Mr. McDevitt said the Sel= ectmen had a number of discussions regarding the disposition of the old fire station. He said the last tim= e they met there was some sentiment to accept public input, if there was any public input to be had.

Mr. Gleason indicated he = received correspondence from Greg Farris, which he read into the record. In summary, Mr. Farris suggested p= ossibly using the old fire station for storage of Parks and Recreation equipment in= the event the School requests the usage of the classrooms within the Municipal Building currently being used for storage.

There was no public input= .

Mr. Viger reiterated what= he spoke about at the last meeting regarding the fire station. He said when he was pushing for th= e new fire station his position was that the existing fire station had no useful life, whether it be for storage of equipment, or people etc. It was his opi= nion that they should allow the federal funds being used for the roundabouts to = take out as much of it as possible.

Mr. Gleason had seen correspondence indicating that the Congregational Church may not be interes= ted in parking spaces; therefore the entire resource could be committed to green space. Mr. Gaydos said that c= omment was made by Phil Currier, who would further discuss the parking spaces with members of the church. He sai= d it was Mr. Currier’s opinion that parking there may be difficult for peo= ple to navigate through the roundabout area to get to the church; he thought th= ey had ample parking at the church. Mr. Gaydos said reference was made to the fact that prior to the old fire stati= on being built, the area had been all green space and it might be nice to see = it return. Mr. Gleason felt time= was of the essence because they were slated to meet with the DOT April 18^t=
h. He felt the Selectmen needed to pr= ovide the DOT with a decision rapidly.

Mr. Haverty wanted to be = clear that the design of the roundabout area was locked whether or not the fire station was taken down; removing it would have no impact in the design of t= he roundabout. He discussed the suggestion for using the old station and had concern with it being another building for the Town to maintain. <= /span>He felt the building was in a drastic state of disrepair and the more responsi= ble thing would be to take the building down.&= nbsp; He didn’t see it as having any useful life and felt taking it = down was the more fiscally responsible thing.&n= bsp;

Mr. Gleason asked if ther= e were adequate Town facilities to store the recreation equipment. Mr. Gaydos answered yes.

Mr. McDevitt commented th= at there had been informal discussions with the School Board for a couple years regarding the use of the (unfinished) classrooms in the Municipal Building<= /st1:PlaceType>. He noted the additional space with= in the building that could be used for storage.&n= bsp;

Parks & Recreation Di= rector Brian Johnson, who was seated in the audience, was invited to speak regardi= ng storage, although he wasn’t prepared to speak on the topic. Mr. McDevitt asked him what the department was currently doing for storage and what their needs would be in= the future. Mr. Johnson said he w= as unaware of the structural shape of the fire station, but would love to have= the building. He said the departm= ent currently didn’t have a lot of storage space and kept certain equipme= nt outside throughout the year. = He noted that the fire station building was currently the hot water source for= the ice rink. He said if he were = asked if he wanted the fire station the answer would be absolutely.

Mr. McDevitt noted that t= he space where the fire station currently stood was vacant from 1907 to 1972; in 1907 the old Town Hall had burned down and the area was green space. He said the Planning Board had a z= oning sub-committee who was seriously entertaining proposing a change in March, 2= 013 that would change the center’s zoning into something similar to a mix= ed use. He said if that was the = case, the presence of a Town storage facility in the middle of it all would only = drag it down and not increase property values.&= nbsp;

Mr. Gleason wanted to kno= w if the building were considered for a potential storage facility, would it necessi= tate putting a new septic system in. Mr. Gaydos said if the building had water, it would need sewer. It occurred to him that they would= have to find a new water source for the ice rink because he couldn’t imagi= ne putting a new septic system into a building that was loaded with mold and h= ad major problems with a leaky roof.

Mr. Haverty stated that h= is intention with having a new fire station was not to add a building to the repository of buildings that the Town maintained. He said there would have to be some degree of maintenance the building would require, and didn’t feel that was the deal made with the voters. &n= bsp;



MOTION:

(Viger/Gleason) To move forward with the State of New Hampshire’s plan to remove the existing f= ire station as part of the federally funded roundabout project.

VOTE:

Mr. Gleason wanted it on = record if the SAU (split) went forward that the Town find adequate space for the P= ark & Recreation equipment. M= r. Gaydos noted it wasn’t only Park & Recreation storage, the old Assessing, tax records, planning records, Town records, computer work etc. = were being stored.

Park & Recreation Dir= ector Brian Johnson came forward and discussed the expenditure requests. Being the Trust Funds liaison for = the Selectmen, Mr. Gleason commented regarding the monies contained within the funds. With regard to the Ray= mond Park Trust Fund, he noted as long as the invoices fell within the maintenan= ce of the facility, they would fall within the intent of the trust fund. With regard to Veteran’s Par= k, there were adequate funds to cover the request.&= nbsp; He said if the Selectmen approve the expenditures, the Trustees of t= he Trust Funds should honor the requests.&nbs= p;

MOTION:

(Gleason/Viger) The Board of Selectmen approve the invoices for $195. 00 against the Veteran’s Memorial Park Fund as part of the maintenance and upkeep; $1,150.00 against the Raymond Park Public Trust Fund which constitutes maintenance and upkeep; $785.50 for the Raymond Park Trust Fund which is = part of the maintenance and upkeep.

Dog Park<= /st1:PlaceType> Discussion

Attorney David Groff and = Ms. Sally-Ann Major came forward discuss a proposed dog park. Information was provided to the Selectmen for a proposed dog park that included a diagram, map of the park = and color photos. The idea was to create a fenced-in (6ft. in height/chain link) dog park at Raymond Park approximately 125ft.x75ft. The fence bid was received at $11,000; which would be raised through donations,= no Town money would be requested. The increase to insurance would be approximately $100; mainly due to the fence. Attorney Groff comment= ed with utilization of the park there would probably be less vandalism. He said they were seeking the Selectmen’s blessing for pursuing funding, getting the fence construc= ted, allowing a donation to be made to the Town and establishing rules for use of the park.

Mr. Gleason saw that the = proposal requested the Town plow the road to the fenced in area and have trash picked up. Park & Recreation Dir= ector Brian Johnson (who was seated in the public) commented that they currently didn’t have the road plowed because they didn’t use the field in the winter; it was heavily used in the Spring through Fall mainly in the evening hours and some weekend use. He believed they would need additional barrels at the dog park becau= se the barrels that were at the park would be removed once the sports season ended. Mr. Gleason asked if t= he dog park would be seasonal or year-round. Attorney Groff believed they would like to use it year-round. Mr. Gleason asked if the Highway A= gent had commented. Mr. Gaydos sai= d the road would have to be brought up to standard in order to plow it.

Mr. Gaydos discussed the insurance and liability. He s= aid some work would need to be done on the road and the appearance would need t= o be maintained (such as keeping the trash picked up).

Mr. Haverty saw there were pictures of a dog park contained in the information pack and questioned whe= re that park was located. Ms. Ma= jor said the park was located in P= ortsmouth. Mr. Haverty commented that the pro= posed area at Raymond Park was an overgrown field and asked if the Town would nee= d to maintain the property. He ask= ed what the proposed grounds would be like.&n= bsp;

Mr. Viger asked if the pr= oposed area was currently in the location where Boy Scouts held their camporees and hike-a-thons etc. Mr. Johnson= said the Boy Scouts camped on the Parade Field.= Mr. Viger asked if there were any deed restrictions on the property = for the proposed use.

Mr. McDevitt said he hear= d of dog parks in urban areas and questioned if there was a need for one. He said it was an isolated area and wasn’t sure who would use it. Ms. Major believed if the people in Town knew the park was there, th= ey would use it. She discussed t= he use of the dog park in Derry. Attorney Groff said the dog park w= ould be an off-leash area.   <= /p>

Mr. Gleason asked who wou= ld assume responsibility for maintaining the field and making sure that there wasn’t a lot of vandalism. Ms. Major said most communities had a group of people that provided oversight to the parks. She s= aid the intent would be to do the same in Pelham. Mr. Gleason asked if Mr. Johnson h= ad any consideration for the Selectmen. Mr. Johnson felt the dog park was a wonderful idea; he told the Selectmen in his experience, the responsibility would eventually fall to Pa= rk & Recreation. He said to = think that the park would be free was not the case; the road would need to be plo= wed, holes would need to be filled and trash would need to be picked up.

Mr. Gaydos asked if consi= deration was given to Muldoon Park. Ms. Major replied that Paul Gagnon (Conservation Commission Chairman/Forestry Committee Member) discussed the = park and felt that Muldoon was already overused. She said Mr. Gagnon felt bringing p= eople to an area that wasn’t used as much would be a better idea. After discussing the problems conc= erning Muldoon; Mr. Johnson commented that Muldoon was pretty well used. He said the two feasible areas wou= ld be Pelham Veteran’s Memorial Park or the Raymond Park area. He understood the problems at Muld= oon, but believed that park was just about at capacity. McDevitt asked if there = were problems with cell phone coverage at the Parade Field at Raymond Park simil= ar to the soccer field area. Mr. Johnson answered yes; it was a dead zone.&= nbsp; Mr. Gaydos said there was a cell tower recently installed last year, owned by AT&T. He was tol= d that there was a period of time that AT&T wanted exclusive use of the tower = for one year and that period had now passed.&n= bsp; He was told if the Selectmen wanted to speak with AT&T and Veriz= on about putting more arrays on the tower, the Town may have some sway to get AT&T to allow it. Mr. McD= evitt felt the Town should do so. <= /p>

Mr. Gleason recommended d= eferring the item until such time as the deed restrictions could be researched. Mr. McDevitt said the park was mad= e up of various pieces along with similar deed restrictions. He believed the portion being disc= ussed was the Gage portion (oldest portion) of the park that may have some restrictions that would need to be researched. Mr. Haverty wanted input on the co= st for maintaining the area.

The Selectmen would resea= rch answers to the questions and discuss the topic at the next meeting in two weeks.

Ms. Major asked if there = were any ordinances regarding signage to be placed on the fence that would name their donors. The land restrictions= would be researched.

Planning for Joint School Board, Budget Committee & Board of Selectmen Meeting

Mr. McDevitt urged the Se= lectmen if they had topic for the meeting to contact him. He said there was no firm date yet= , but anticipated it to be during the second week of April.

Review of Old Warrant Articles, Capital Reserves & Trust Fun= ds

At the recommendation of = the auditors, Mr. Gaydos reviewed with the Selectmen a list of warrant articles= and determined which of them could be closed with the balance transferred into = the general fund with contribution to the fund balance.

Mr. Gaydos said the audit= or identified the 2006 Police and Fire matching grant as something that should last five years unless there was authorization to put money in. He said the Town had the FEMA fund= and both the Police and Fire departments said it was more of an appropriate pla= ce to use funds and suggested turning the grant money fund back. He said another reason was the fun= d had turned into a revolving account and shouldn’t be used as such. He commented that the warrant arti= cle had not been used properly and should be closed and turned back to the gene= ral fund.

MOTION:

(Gleason/Haverty) To move the money $12,241.66 (2006 Police and Fire matching grant) back i= nto the general fund.

VOTE:

(4-0-0) The motion carried.

The Selectmen continued t= heir review. Mr. Gaydos discussed = the Municipal Building loan proceeds. He said in 2004 they realized ther= e was money left over, which was basically interest that had accrued on money borrowed to do the Munici= pal Building. He said $50,000 was moved and then= realized there was additional money left over that had been building interest. He said the remaining amount ($40,= 977) could be returned to the operating budget and close the account, or they co= uld move it to the maintenance fund that was created in 2004 by Article #14. Mr. Viger asked how close to budge= t the Town was to the Municipal Building, and how many things had to be put off b= ased on coming close or being over budget on the account. Mr. Gaydos said the major items we= re done, there were some minor items put off.= He said the new library roof would need some attention this year. He discussed the maintenance fund = that currently contained approximately $81,000 and was meant to be for catastrop= hic losses. He said the question = was if the Selectmen wanted to use the $40,000 as part of the reserve, or as part = of the efforts to loosen up cash against the tax rate. Mr. Gleason said the money couldn’t be put back into the operating budget; it could either be put into the general fund (fund balance) or into the trust fund for Town buildi= ngs. Mr. Gaydos said if it were closed = now, it would go into the general fund; when the tax rate was set in the fall it would be part of the surplus.

Mr. Viger was inclined to= move the money into the capital reserve fund.&n= bsp; He felt it would be better served to offset future expense rather th= an loosening up money for tax. M= r. Haverty concurred with Mr. Viger. Mr. Gleason stated that they were facing a significant problem with a tax rate = that was going to be significant and felt they should put as much money into the fund balance as possible. He = said the capital reserve contained approximately $81,000, which was more than adequate. There was further discussion how to proceed.

(Gleason/Viger) To move $40,977.69 out of the Municipal Building Loan Proceeds into the General Fund.

VOTE:

(4-0-0) The motion carried.

Mr. Gleason reviewed the = Trust Funds and Capital Reserves. He requested that the trust fund for Pandemic $1,183 be closed. Mr. Gaydos believed to spend the m= oney or close the accounts it would require a Town vote. Mr. Gleason noted that the Senior Center capital reserve had $4,571 and could be transferred into the general fund.<= span style=3D'mso-spacerun:yes'> Mr. Gaydos said if the Selectmen w= ere agents to expend, the account could be closed and a Town vote wasn’t needed. Mr. Gleason will research.

Mr. Gaydos said he discus= sed the Perpetual Care money with Mr. Gleason.&nbs= p; He said he would research to see if the Town could legally recoup fr= om the fund. There were no objec= tions to Mr. Gaydos conducting research; he will coordinate with the Cemetery Trustees. Mr. Gleason discuss= ed the issues with perpetual care in that every grave site purchased with money pl= aced into perpetual care was considered an individual trust fund and any profit = or money expended could only be spent on that specific site. He said the Department of Justice = was very specific that perpetual fund monies couldn’t be used for general maintenance.

Sherburne Hall Usage Fees

Mr. Gaydos said they had = spoken about having a fee for usage of the facility; specifically the $50.00 refundable fee for cleaning. = He proposed that they increase the use fee by $25.00 and eliminate the $50.00 cleaning deposit. The reason = for the request was the practical matter of not having to challenge individual users and instead have the hall cleaned at one time; the $25.00 (per user) = would be placed into the Recreation Revolving Account that pays for the cleaning = as needed of the room. He read a= loud proposed wording that would amend the use policy/agreement.

MOTION:

(Haverty/Viger) To amend the rules governing the rental and use of Sherburne Hall that we= re originally adopted June 2, 2009, to increase the fees by $25.00 as specified during the discussion.

VOTE:

(4-0-0) The motion carried.

Operating Budget Year-to-Date

Mr. Gaydos provided the S= electmen with a report showing the budget status to date. The Town was where they expected t= o be with regard to revenues. He s= aid if the expenses appeared to look high; it was due to one time expenses that ha= d to be paid at this time of year. Mr. Gaydos felt the Town was doing very well and they were on target. Mr. Gleason said the Selectmen were given information in February indicating that revenues were expected to be $150,000 over expectations. He wanted to know how it affected the projection on 2012 revenues. Mr. Gaydos believed they would sti= ll be over the projections. Mr. Gle= ason asked that the fund balance projection sheet be updated for the next meeting. Mr. Gaydos said they= would visit it on a regular basis. = He said in June they would really have an idea of what was happening.

Relay For Life Request

Mr. McDevitt said a reque= st was received from Relay For Life to have a sign and garland on the gazebo (Town Center) as well as signs around the common from May 8, 2012 – June 10, 2012. Mr. Gaydos recalled there were rib= bons on the gazebo. Historically, he believed Town signs were allowed on the common, but advertising and politic= al signs hadn’t been allowed on any Town property. The conversation centered around i= f one organization was allowed to put signs up, any other organization would have= to be allowed to do the same. Mr. Gaydos believed last year they allowed for pink ribbons to be displayed on = the gazebo. Mr. Viger suggested creating an application process, similar to that for Sherburne Hall usage.<= span style=3D'mso-spacerun:yes'> Mr. Haverty believed the Board had= to have a uniform approach for everyone. There was further discussion as to how the Board would proceed.

Town Administrator / Selectmen’s Reports

Mr. Gleason said the NRPC= provided information that the various Town Boards would find helpful. He stated that the NRPC was lookin= g to rotating the various executive meetings between the towns and indicated they would like to come to Pelham. He said if there was to be a ‘ground breaking’ for the new fire station, it might be appropriate to have that meeting at the same time. Mr. Gleason ended by saying he wou= ld be meeting with the Council on Aging and would suggest that they submit their request for committee members.

Mr. Haverty stated a meet= ing was held by Eckman who outlined the bid process for the recently approved fire station project. There were seventeen different companies who came and listed to the presentation and submitted paperwork to be ‘kept in the loop’.

Mr. Viger and Mr. Gaydos = had no reports.

They previously had an agreement and didn’t believe that would change.)(8/2/11 Mr. Gaydos said he owes= Mr. Currier some materials)(8/9/11 – Mr. Gaydos is pulling together the plans from several years ago of = what was intended to be built in the event they were to build something behind t= he fire station – information to be provided to Mr. Currier)(8/30/11 –= Mr. Gaydos still pursuing with Mr. Currier) / 10/25/11 – Mr. Gaydos speaking to = Mr. Currier who is looking for drawings done approximately 6 years ago; 1/17/12 – Mr. Gaydos is working with Mr. Currier regarding the procedure to m= ove ahead if the fire station doesn’t pass.

·         Ob= tain status regarding Young’s Crossing and the flashing sign on Route 38/Gage Hill Road/Ledge Road intersection and from Police Chief. (8/9/11 Mr. Gaydos had a discussion with Police Chief= Roark regarding the flashing light and there may be less expensive alternatives.<= span style=3D'mso-spacerun:yes'> The Chief has requested a meeting = with the DOT district for Pelham)(8/30/11 – correspondence received from State – Mr. Gaydos to work with Police Chief Roark to compile accident statistics) / 10/25/11 – Mr. Gaydos said Chief Roark was heading this up – the same type of study = is being done at the Sherburne Road intersection.; 1/17/12 – still worki= ng with intersection (with state) in conjunction with Sherburne Road.
