OPEN FORUM

Mr. Paul McDonough, Mammoth Road came forward and stated his concern for the fire department due to people leaving gas tanks in their yards. He = also commented that there were some who burned without a permit. He suggested possibly selling (personalized/stamped) pavers in front of the new fire station and use the money toward landscaping or such. He then spoke about the Police Dispatcher and the hard work they per= form in that position. He was conc= erned with the sometimes long hours of the position and wondered if there was any= way to hire additional personnel. Mr. McDevitt asked that Mr. McDonough take one additional minute to conclude his comments. Mr. McDonough said = his comments would take longer than one minute so he decided to step away. Mr. McDevitt said the Selectmen we= re happy to provide people with five minutes to speak. He told Mr. McDonough he was welco= me to come back at the next meeting to speak.&nb= sp; Mr. McDonough left the meeting.&nbs= p;

After a brief recess, Mr.= Lynde believed that the Selectmen had established rules for Open Forum in the past year because they wanted to limit discussion. He said the Selectmen provide the opportunity for people to come in and address the Selectmen. He felt it was inappropriate for s= omeone to become upset when they are told they’ve run over their time. Mr. Lynde suggested if a person be= lieves they have a lot of ideas to share, they should put them in a memo and send = it to the Selectmen so they are prepared to hear the information.

Mr. McDevitt stated that = the Selectmen had adopted a policy a few years ago allowing anyone to come in a= nd have five minutes to speak. M= r. Lynde said Open Forum began approximately twelve years ago when he was Chai= rman of the Board. Mr. McDevitt sa= id the reason for having a five minute limit was due to the Selectmen having rigor= ous agendas on many nights that they needed to get through.

Mr. McDevitt stated that = there were alternate positions available for the Zoning Board of Adjustment and t= he Planning Board. Anyone with interest in what’s going on in Town was encouraged to come forward and submit an application at the Selectmen’s office. Applications are also available on= -line.

Ron Hannon, Director of PERC – PERC Building Changes

Director of PERC Ron Hann= on provided the Selectmen with a status update of the facility. He said they were continually look= ing at alternatives for compacting and hauling and maximizing the current facility. One thing he would = like to do is increase the (wall) opening at the waste building from 25ft. to 41ft.= This would allow them to have a 10= 0yard open top transfer trailer. Be= cause they were currently compacting into a 75yard container it limited what they could do; if they could get the larger container behind the building it wou= ld increase the load, decrease cost, hauling and trucking charges. The other way they could get reduc= ed cost is to compact trash. A structural engineer reviewed the building.= Mr. Hannon explained the process they would use to compact if the ch= ange was made to the building; this would allow for approximately 15 additional = tons per load and provide for great savings (approximately $100,000 in one year)= to the department. He commented = that he didn’t want to limit the facility to what they were currently doing when there was a possibility to do more.

Mr. Gleason asked if ther= e was a projected cost for making the building modifications. Mr. Hannon said it would cost $2,000-$3,000; the money would come out of the budget. Mr. Gleason asked the process of h= ow the material would get into the trailer. Mr. Hannon explained that the top of the trailer would be at floor height and the back hoe would compact the material from inside the building. Mr. Gleason asked w= hat the associated cost savings would be in doing the alteration. Mr. Hannon believed it would be in= the hundreds of thousands of dollars; however they were currently in the middle= of a contract. He said they were= looking at savings down the road. Mr. Gleason asked if the trailer had any associated costs. Mr. Hannon said there would be one= fixed cost with the trailer; no rental or hauling fee. A company would bring it as part of their service.

Mr. Haverty reviewed the photographs of the building and discussed what would be altered. Mr. Hannon said they would be leav= ing five feet of concrete on either side of the opening. There would be no danger of the ba= ck hoe knocking the wall.

Mr. Lynde asked if the 75= -yard trailers could currently be backed in and do the same function. Mr. Hannon answered no; the traile= rs had a roof on them. Mr. Lynde understood that the purpose of the modification was to gain additional capa= city through compacting materials. There was further discussion regarding the building alteration and the compacting process.

Mr. McDevitt questioned w= hat would stop the trash from blowing around when it was dumped. Mr. Hannon said it would go into t= he containers just like the material that was currently there; the other containers were also open. Mr. Lynde questioned if the trailer would be covered when it left the facility.= Mr. Hannon answered yes; a tarp is= put over the top. Mr. Lynde wante= d to make sure that trash would not accumulate by the back fence. Mr. Hannon said they currently mad= e sure it didn’t accumulate. <= /p>

Mr. Gleason discussed the proposed building alterations to better understand what was proposed. He asked if there were any concern= s with OSHA or workplace regulations about protecting the welfare of workers in te= rms of a safe environment. He questioned if there were any requirements to have an OSHA inspection. Mr. Gaydos said they would check t= o see if there was a definition of the building ‘lip’ and ask the Building Inspector to find out how tall it had to be. Mr. Gleason wanted to know if they= had to inquire of a federal or state agency for making changes to the workplace= that might create a hazardous environment. He wanted to clarify that they had taken adequate precautions to make sure they weren’t jeopardizing the safety of any employees. Mr. Gaydos said a building permit = would be pulled and the Building Inspector would review the plans to see if they comply with OSHA. Mr. Hannon = said all he was looking to do at this point was cut out the back section; there = was nothing set to go in there now. He wanted the ability to do it in the future.= He said there were many different ways to alter the building and they would do whatever OSHA needed.

Mr. Haverty asked if the structural engineer provided any documentation in terms of the building and= its structural integrity. Mr. Han= non said the structural engineer said it wouldn’t be a problem to take the back section out. Mr. Haverty wanted to have documentation prior to the work being done. Mr. Gaydos commented that the over= all plan would be given to the Building Inspector when the permit was pulled. He said the structural engineer we= nt to the site last week to review the building and discuss different options of = what could and could not be done. = Mr. Haverty wanted documentation from someone who was qualified to make that ty= pe of decision, to the point that the insurance company would be happy if there was a problem that occurred. = Mr. Gaydos said documentation would be obtained.

Mr. Lynde recalled when t= he building was constructed and stated it was solid. He suggested contacting the LGC. Mr. Gaydos said it was the Town= 217;s due diligence to have a structural engineer review the building. He discussed some of the problems = the building currently had (with metal skin of the building coming loose), which would need to be fixed. He sa= id if there were problems with the building there were funds in a capital reserve they might rely on. He unders= tood that the department’s budget was tight, but when there is a problem t= hat needs to be corrected he felt they should help the budget get there to crea= te a safe environment. Mr. Gleason= said he wasn’t concerned with the work to be done, but now understood there was other work needed to be done. He would like to see a cost estimate for all the work that needed to= be done. He wanted to know how m= uch would come out of the budget and the capital reserve. Mr. Gaydos believed the cost for m= aking the improvements that were discussed (enlarging the opening in the waste building) could come out of the department’s budget. He said the building skin project = would be a different project they could get some prices for. He felt they should spend some tim= e and review it.

There was no objection to= Mr. Hannon moving forward with the project, other than obtaining something in writing from a structural engineer.

Gumpas Pond Access Discussion

Mr. McDevitt commented th= at the Town had acquired walking access to Gumpas Pond and had held two public hearings regarding such. One = of the neighbors provided input in the form of a letter that contained request for stipulations to be agreed to by the Town; the Selectmen told them they would hold a follow up meeting in April. Ms. Wendy Smigelski, 12 Lox Lane came forward for the discussion. She had been vocal at the previous meeting. Mr. McDevitt believe= d the discussion should center around who would be responsible for which items contained in the list of suggestions contained in the previous meeting minu= tes and as summarized in a letter dated February 12, 2012 submitted by the Gumpas/Gumpas Pond Association.

The list of suggested ite= ms was as follows:

Pedestrian Traffic Only &= #8211; Mr. McDevitt didn’t feel there was a question because he believed the intention

of the B= oard was to leave the area rough;

Allowable watercraft: can= oes, kayaks and nothing larger than a small electric trolling motor, no trailers= , no

jet ski&= #8217;s – There was no comment;

If a trolling motor is br= ought in, it must be cleaned in order to avoid invasive aquatic weeds in and out = of

the pond= – Mr. McDevitt believed he saw signs going into Maine about how to clean a bo= at and suggested they may possibly be able to do something similar;

No docks, raft, beach or = swimming – Mr. Gaydos said someone would need a permit to put out a dock or

raft. He said there wasn’t a beach there. Mr. McDevitt believed = they could handle ‘no swimming’

with a sign. Mr. Lynde said they couldn’t control someone jumping in the water if they were out on the pond. He said they weren̵= 7;t going to allow a beach to be established there;

No mooring of boats offsh= ore or stored on-shore – Mr. Gaydos said a state permit was needed to moor <= /p>

boats; <= /p>

Trash in and Trash out &#= 8211; Mr. McDevitt believed they could consider a sign for this item. He envisioned one

sign wit= h a lot of rules contained on it. Ms. Smigelski said if they created a flier similar to what

Bensons = is using, the Association would be more than willing to upkeep it. Mr. Gleason felt having a sign in = the parking area location would be effective.&= nbsp; Mr. Lynde liked the idea of having a sign;

Identification and contact information for the department who landowners can contact in the event there are

violatio= ns of any or all the items listed - Mr. McDevitt believed if ther= e is a minor issue during

the day = Police dispatch could be contacted. = Ms. Smigelski didn’t foresee a large amount of issues;

Parking area across the s= treet limited to 3 or 4 cars – Mr. Gaydos believed Conservation originally spoke

about fi= ve, but he felt four should be more sufficient.&nb= sp; Ms. Smigelski believed Conservation Chairman Paul Gagnon agreed to f= our because there was a parking area up the street;

Town residents identified= by a vehicular sticker – Mr. McDevitt didn’t believe that could be d= one at this

time bec= ause not everyone has a Transfer Station sticker.&n= bsp; Mr. Gaydos suggested possibly having people get a beach sticker sold= by the recreation department. Th= ere was a brief discussion regarding the process for issuing beach stickers. Mr. Gaydos suggested holding off i= ssuing stickers until they saw what type of action actually occurred in the area.<= span style=3D'mso-spacerun:yes'> He said if it became a problem they could deal with it. The decis= ion was to hold off on this item;

No parties or fires on th= e path, parking lot or private property surrounding the pond – Mr. McDevitt f= elt this

was an i= tem that could be held off on for now. He said the spirit of the Board was if there is a problem, they would work wit= h the Association;

Any/all improvements must= be after a discussion with Keith and Kathy Regan – Mr. McDevitt said the=

Selectme= n had agreed. Ms. Smigelski asked i= f Mr. Gagnon had been in contact with the Regans.

Mr. McDe= vitt didn’t know;

Liability concerns must be addressed – Mr. Gaydos said it was being drawn up now.

No access of private prop= erty along the shoreline including the island and dam – Mr. McDevitt belie= ved

property= owners along the shoreline would have to police the property themselves;

Request of a speed limit = – Mr. McDevitt said the law didn’t let them post as low as 20mph except= in a

school zone. Ms. Smigelski said they= had their own issues with speed on the road.&n= bsp; She said they

may cont= act the DOT to try and get the speed limit lowered. When they get to that point Ms.

Smigelsk= i will get back in touch with the Board;

Request discussion on pos= sible financial assistance with dam maintenance, repairs and state registration –

Ms. Smig= elski said as a pond association they pay taxes, state registration, repairs, maintain the

boards, = and meet with the state. She said ther= e was financial liability and the association couldn’t

afford t= o pick up the full tab. She said the= y had dues, but it wouldn’t be a great deal of money - $50 per year. Mr. McDevitt asked if the Town was expected to pay dues. Ms. Smi= gelski said it was optional for property owners; there were people on the pond that didn’t pay. It was note= d that the Town didn’t own the land, the Town had an easement. There was a discussion regarding t= he dues. Mr. Gaydos understood t= hat the Conservation Commission, who was purchasing and managing the property, indicated that should there be a financial need by the association they wou= ld work with them to try and raise money to meet it. Personally, Mr. McDevitt would lik= e to see Conservation or Park & Recreation contribute the $50 toward the association as honorary members because it would show the Town’s willingness to cooperate and work with the association;

Lack of toilet facilities= – Mr. McDevitt said there currently weren’t any. Ms. Smigelski said they had their =

own enfo= rcement issues.

Ms. Smigelski asked if th= e Town would like to be notified when the Association held their annual meeting (in August). Mr. Haverty said he = would like to attend.

Mr. McDevitt asked the co= st of the property taxes for the dam. Ms. Smigelski believed the tax was approximately $36/year. Mr. McDevitt said the Selectmen ha= d the ability to grant equitable waivers under certain circumstances under state = law. He said the owners would have to a= pply for it. Mr. Gaydos said to se= nd the Selectmen a letter for their review.

Mr. McDevitt believed the= y were done reviewing the list; the major thing was to determine the items that wo= uld be placed on a sign. Ms. Smig= elski will summarize in a letter the items that have been resolved and which items were currently on hold.

Ms. Smigelski commented t= hat Lox Lane fe= d off Hinds Lane = and didn’t have a street sign because it was a private lane they maintained. She asked if they= could post a sign indicating ‘no public access’. Mr. McDevitt questioned if the Town provided street signs through the E911 process. Mr. Gaydos believed they had. Mr. McDevitt said the Town would p= ut a sign up.

Ms. Smigelski questioned = if the hours of use would be limited. Mr. Gaydos said the hours would be limited from dawn to dusk. This item would be added to the si= gn.

Mr. McDevitt told Ms. Smi= gelski to contact the Selectmen if anything was forgotten and they would take it up.

Jeff Gowan, Planning Director – Flood Mitigation Update

Mr. McDevitt stated some = time ago the Town met with residents that were concerned about flooding primarily al= ong Beaver Brook. He said several meetings were held, one of which was at the Senior Center during which residents were invited to attend and a gentleman from the state came and made a presentation about flood mitigation. He said they owed that group a res= ponse as to the next step of what the Town would do.

Planning Director Jeff Go= wan came forward for the discussion. He noted that the topic was separate from the flood study supported in the war= rant article. He said this related= to residents who have had repetitive flood losses to their structures, not bec= ause of a portion of their property becoming wet. He summarized the meeting conducte= d at the Senior Center. He said Lance Harbor of Homeland Security and Emergency Management was present for the meeting and reviewed programs available to municipalities. Mr. Gowan provided information to the Selectmen that included a ‘punch list’ of items that would need to occur if the Selectmen were interested in engaging in the process of obtaining FEMA grants. He outlined the process. He said the items that were the mo= st problematic was the FEMA e-grants application process which prior to applyi= ng required attendance at FEMA’s e-grants workshop and a cost benefit analysis training. He said it= was an incredibly robust process that represented a significant time commitment. Mr. Gowan contact= ed NRPC to find out if there were pieces they could assist with. They offered to supply 100 hours of staff time to the project for a cost of $5,000. He discussed the type of assistanc= e the NRPC would provide. He said t= he process would have the potential to benefit a couple folks who are acutely impacted by flooding, but aside from the time commitment and the cost there= is also a monetary local match needed. He noted that Mr. Harbor would be happy to meet with the Selectmen f= or a discussion.

Mr. Gleason asked what the objective would be. He said it seemed to be a labor intensive effort and wanted to understand what it would yield. He asked how many hous= es were involved and whether or not they fell into the categories the federal government was usually receptive to. He also questioned what the potential outlay would be over time. Mr. Gowan said a resident would ha= ve to demonstrate that they’ve been FEMA insured and had repetitive paid out losses. He spoke with the Fire Chief to review a map of affected areas.&n= bsp; There’s one example on Glenside Drive that has a probability of being a candidate. Mr. Gowan believed= they were only talking about a commitment of time and resources that would help potentially very few people. = Mr. Gleason saw an article that indicated the Army Corps of Engineers would be coming into Londonderry to address the B= eaver Brook flooding situation. He = asked if the Town was aware of it. = Mr. Gaydos said that was a different topic.&nb= sp; He said he was following up on it.&= nbsp;

Back to topic, Mr. Gaydos= said it was private property, and once the Town owned it they would have to do something with it, such as take the house down which would be an added cost. Mr. Gowan said the proc= ess was not something to enter into lightly, they had to be sure what they were doing.

Mr. Lynde’s thought= was the beneficiary of the process would be FEMA because if they had a property that kept getting hit, they just as soon get rid of it so it didn’t contin= ue to have problems. He believed= they should know what those properties were.&nb= sp; He didn’t see any true benefit to the Town; it seemed like a l= ot of effort and cost. He said he would have to be convinced to proceed and understand the benefit to the Town.

Mr. McDevitt said there w= as no benefit to the Town. He didn&= #8217;t believe that FEMA worked directly through the homeowner. Mr. Gowan said it = was FEMA funds, but the homeowner had to demonstrate that those repetitive loss= es had come in and settled. He s= aid it was a big project that would potentially benefit a few; he wasn’t convinced it was something the Town should launch into given what is known = to be a tremendous amount of effort without certainty of payback. He didn’t want to minimize t= he importance to the affected individuals, but it was a cost benefit analysis = situation.

Mr. Haverty felt the Town= should seriously look at providing some relief for affected people in the limited areas. Mr. Lynde didn’t= know what the relief would be. He = said eventually the topic would go to Town Meeting with a request for money.

Mr. McDevitt said he had a happenstance conversation with the person in Londond= erry who managed the program. He s= aid they weren’t very encouraging. His initial reaction was to suggest setting the topic aside and see = what happens with the flood study. He recognized it was a big deal, but didn’t feel the Town had the staff = to do it.

Mr. Gleason asked if it w= as necessary for the municipality to do, or if the private citizens could undertake the process on their own. Mr. Gowan said the municipality had to be in the process. He said they would have to sign up= and do the work in order to get to the end result.

Mr. McDevitt felt the peo= ple who attended the flood meeting should be provided with a letter communicating t= he status. He said he would work= with Mr. Gowan and run the letter by the Board for comment.

OTHER BUSINESS

Fire Station Discussion

Mr. Gaydos said a job fai= r was held for any local contractor that was interested in participating or seeing how they could participate in the fire station project. There were twenty-two people in at= tendance; additional people have come forward. Eckman is working with those companies to see if they qualify for the necessary work.

Request to Name New Muldoon Park Egress

Mr. McDevitt informed tha= t an e-mail request had been received to name the new Muldoon Park egress after Tony Luciano. He= knew that the Board had a number of opportunities to name things within Muldoon Park and had run up against the de= ed restrictions. After conducting research, Mr. McDevitt said it wasn’t clear that they could easily and comfortably name the egress after anyone other than George Muldoon.

Mr. Lynde said he was rel= uctant to pick specific people to name a road after. He said the Town had a road naming policy. He didn’t know = how to honor people, but suggested possibly naming the egress Coaches Way and then establishing a plaque listing names being honored.

Mr. Haverty said they have received similar requests for naming and felt the Selectmen should create a= policy for handling requests to memorialize people.

There was a discussion ho= w to proceed. Mr. McDevitt said pe= rhaps the Highway Safety Committee would consider Coaches Way.

Flood Study – Vendor

Mr. McDevitt said as an a= ction item from Town Meeting the Selectmen had to act upon the flood study. Mr. Gaydos suggested suspending the discussion until he’d been able to contact the people in Londonderry to find out what they were doing. He said he would work with Mr. Gow= an to see if there was something to coordinate.&= nbsp; After which they could discuss an interview process.

Mr. McDevitt said ultimat= ely they would need to put an RFP together. <= /span>Mr. Gaydos to discuss further in two weeks (at next Selectmen’s meeting).=

NRPC Partnership Agreement

Mr. Gleason had provided Selectmen with an NRPC partnership agreement for approval. Mr. Gleason said he would be meeti= ng at NRPC Thursday and would like to bring an executed agreement with him. He said in September, 2011 the Tow= n was asked to sponsor a request for a grant; they have succeeded in obtaining th= at grant and a requirement (as a member community) is to execute a partnership agreement. He discussed the s= tudy and the Town participation. <= /p>

(Lynde/Haverty) To authorize Mr. Gleason to sign the NRPC partnership agreement.

2012 Budget Discussion

Mr. Gleason informed ther= e would be a joint meeting with the Budget Committee and School Board. He felt the Selectmen needed to se= t the tone for the Town and asked the Board to consider: a) telling the departmen= ts to try and limit their spending; and b) any anticipated overages should have Selectmen approval before their incurred.&= nbsp; Mr. McDevitt agreed and suggested that Mr. Gaydos tell the department heads if they anticipate a problem with their budget that they inform the Selectmen.

TOWN ADMINISTRATOR / SELECTMEN’S RE= PORTS

Mr. McDevitt informed tha= t a joint meeting with the Selectmen, Budget Committee and School Board would be held Thursday, A= pril 12, 2012 at 7pm at Sherburne Hall to discuss common issues.&n= bsp;

Mr. Gleason stated he wou= ld be attending a meeting at NRPC to discuss the broadband stakeholders initiative. He received notification from NRPC that there would be a household hazardous waste and electronic collection held on Saturday, April 14, 2012 8am-12pm at the Nashua Public Works garage, 9 Stadium Drive, Nashua.

Mr. Lynde said he would be attending an LGC meeting on Friday.

Mr. Haverty and Mr. Gaydo= s had no report.

Mr. McDevitt said they we= re coming to the end of interviews for a code enforcement person. He believed the Selectmen had a de= sire to meet with the finalist. The Selectmen would like to meet the finalists, review their resume and hear Mr. Gowan’s recommendation.

<= ![if !supportLists]>· Mr. Gowan to advise Selectmen whether the CIP will be instituted; 8/9/11 – Mr. Gaydos believed they had a complete list of all the equipment in Town.
