OPEN FORUM

Mr. Paul McDonough, 29 Mammoth Road commented on the recently discussed dog park proposal. He didn’t see anything wrong= with locating it at Pelham Veteran’s Memorial Park. He felt the increased use would de= ter vandals. He believed having a= user fee would be good to help pay for maintenance, although he didn’t feel the money should be put into the Parks and Recreation account because it mi= ght cause confusion. Mr. McDevitt= told Mr. McDonough that the dog park discussion had been scheduled on the agenda, but he received an e-mail request to withdraw it. At this time, he was unsure if/whe= n the proposal would be made.

ANNOUNCEMENTS

Mr. McDevitt commented th= at some time ago property owner Paula Inglee brought suit against the Board of Adjustment contesting a decision that board made about her property. The Town has reached a settlement agreement which resulted in the property being transferred to the Town with restrictions. The land is tax= map 14/4-135-1; recognized as sitting between the Mammoth Road entrance to Muldoon Park and the residential lot at the North East corner of Mammoth and Nashua Roads. As part of the agreement, the Town= will keep this land as conservation land.

Mr. McDevitt stated he re= ceived an e-mail from Ms. Sally-Ann Majors relative to the dog park. She requested to have the dog park= issue removed from the agenda. The = e-mail indicated at this time it was not feasible to pursue this issue. Mr. McDevitt said he responded to = Ms. Majors that if at anytime she wanted to come back, she was welcome to do so.

APPOINTMENT(S)

Matt Leahy, Special Assistant for Policy and Projects of Senator Shaheen’s Office

Mr. Matt Leahy, who worke= d for Senator Shaheen in the Manches= ter office came forward to introduce himself so the Board would have a point pe= rson in the Senator’s office if issues or concerns came up with the Town o= r individual residents. He discussed the t= ypes of issues/topics that could be directed to him.

Mr. Gleason commented that Senator Shaheen visited with the Selectmen a year ago. At that time the Selectmen identif= ied to her some of the concerns the Town had with flooding. He asked Mr. Leahy to reiterate th= ose concerns. He said the Town wo= uld be initiating studies to look at it. He said the Town would appreciate being considered if there was any activity the Senator was aware of with the Corps. of Engineers in the near vicinity to address the water/flooding issues.

Mr. McDevitt said the Tow= n was pursuing low power FM license information through the FCC; the intent was to figure out a way to broadcast emergency information via low power FM to loc= al citizens when every other means were down/unavailable. He said the Town requested assista= nce from the Senator’s office. He said a response was received from the FCC indicating they would defer any licenses until 2013. He acknowledged the assistance received from Senator Shaheen’s office regarding that matter and commented the Town may seek assistance again (on other matters).

Mr. Gaydos stated if peop= le would like to make an appointment with Mr. Leahy or another representative for the Senator, they should contact the Town office: 603-508-3074 (speak with Mari= e) to make an appointment. Mr. L= eahy told the Selectmen that Executive Secretary Marie Maruca was terrific in working with his office and scheduling appointments. Mr. Gaydos said people should feel comfortable coming to meet with Mr. Leahy; it was a closed room in which private issues can be discussed.

Julie Chizmas, Senior Transportation Planner, NRPC – Road Safety Audits at the Sherb= urne Road Intersections in Hudson and Pelham

Planning Director Jeff Go= wan came forward for the discussion. H= e said there were several problem intersections in the Town prone to a higher frequency of accidents. He sa= id the Department of Transportation (‘DOT’) has a safety audit program= the Town participated in last fall during which both ends of Sherburne Road (intersection in Pel= ham and Hudson) were reviewed and observations were made. The DOT compiled a safety audit re= port and sent it back to the Town. Mr. Gowan noted that the Nashua Regional Planning Commission (‘NRPC’= ;) had applied on the Town’s behalf to conduct the same review process f= or the intersection of Route 38 and Old Gage Hill Road.

NRPC Senior Transportation Planner Julie Chizmas, DOT St= ate Highway Safety Engineer Stuart Thompson, and DOT Administrator Bureau of Highway Design Bill Oldenburg came forward for the discussion. Ms. Chizmas commented that she hel= ped coordinate the road safety audit (for the intersection of Mammoth Road and Sherburne Road) conducted October 19, 2011 and the DOT was present to discu= ss the conclusions of that audit.

Mr. Oldenburg discussed t= he content of the road safety audit beginning with outlining the process they followed for reviewing the area. He said now that the study has been completed they would like to know if their recommendations (either wholly or partially) made sense; they were seeking feedback. Mr. Oldenburg discu= ssed the data that had been collected; most of the accidents were due to left turning traffic from Sherburne Road turning left heading north on Mammoth R= oad. He spoke about the Highway Safety Improvement Program which is funded through the Federal Highway Administrat= ion; basically it’s a program that’s crash driven, there has to be a crash history at a location to qualify for funds. He outlined the safety issues at t= he Sherburne Road/Mammoth Road intersection and reviewed the improvements that could be done; some of which could be funded through the Highway Safety Improvement Program, noting some= of the larger items would have to be long-term and wouldn’t be funded un= der the program.

Mr. Gaydos understood the= methods discussed to try and create some gaps to accommodate vehicles on Sherburne Road, and believed what was being said is to accommodate one (vehicle), another would= be inconvenienced to a certain degree. Mr. Oldenburg answered yes. Mr. Gaydos asked if consideration had been given as to how much traf= fic would need to be generated to warrant a roundabout. Mr. Oldenburg said there was reall= y no warrant (analysis) for whether or not a roundabout should be put in. He said warrants referred to signal warrants; there were basically ten warrants that would be analyzed to see whether or not a signal should go in. He said they didn’t have to = meet a certain criteria to put in a roundabout.&n= bsp;

Mr. Gleason discussed the proposals. He felt narrowing = the Sherburne Road intersection would slow the southbound traffic on <= st1:address w:st=3D"on">Mammoth Road. His concern was introducing a long= er vehicle line on Sherburne Road if the right turn area from Sherburne onto Mammoth Road was eliminated, which would cause drivers to possibly take risks. Mr. Oldenburg noted th= at in the morning 83% of vehicles turned left&nb= sp; from Sherburne Road heading north onto Mammoth Road and in the eveni= ng 82% of vehicles turned left from Sherburne Road heading north onto Mammoth Road; the queue would increase by one or two vehicles, but the safety benef= it would be increased as well. <= /p>

Mr. Lynde felt the concep= t of slowing both north and south bound traffic on Mammoth Road made sense in the shor= t term because he saw no other solution for people getting out of Sherburne Road. He said with the number of cars that currently went through the intersection, he questioned what the future traf= fic situation would be in the area. He felt the long-term solution was to have a roundabout because the intersecti= on was ideal; it would be a simple design with not a lot of land taking. He said the Town would like to hav= e the project on the state transportation plan.&= nbsp; He said the question was if there was a concept as to what the future load and impacts would be would be and if there was a way for the Town to h= ave the project on the state plan, and possibly reimbursed by the state if the = Town funded it.

Mr. Gleason questioned ho= w many developments were currently planned for Sherburne Road. Mr. Gowan said there were a number= of developments taking place. Al= l that were active, or likely to become active, had been approved with a Planning Board exaction built in to contribute $2,250 per unit toward a solution tow= ards the Sherburne Road intersection. He believed they would collect over $100,000 and that number would grow because there were o= ther projects expected in the area. The ‘loose’ figure to construct a roundabout is $750,000- $1,000,000. Mr. Gowan noted t= hat money would be collected at the time a building permit is issued. He said they weren’t current= ly holding any money right now. = Mr. Gleason was concerned with the number of additional vehicles that would be = on Sherburne Road if the projects/houses were built. He questioned if there were any projection numbers for the houses that could be built. Mr. Gowan said he coul= d only calculate the approved projects. They didn’t have an analysis on what projects could come in. He asked that the Selectmen consid= er the short term solutions in the road safety audit to help resolve the situation until they were able to get the long term solution funds.

Mr. Oldenburg said they u= sually designed projects for twenty years out.&nb= sp; A typical increase would be approximately 50% more (traffic) than wh= at was currently in a location (2% per year increase in traffic). Recently, with the state of the ec= onomy, traffic projections have almost been dead flat; some roads have gone down.<= span style=3D'mso-spacerun:yes'> Ms. Chizmas commented that NRPC was currently working on updating their travel demand model and had used data provided by Mr. Gowan regarding the area developments. Mr. Oldenburg discussed the medium= risk safety issues outlined in the analysis.&nb= sp;

Mr. Haverty questioned if= there was a way to test the proposed solutions and do an additional traffic count. Mr. Oldenburg said they could do experiments to test the suggestions. He said the reduced radius could be tested by using traffic cones and having vehicles drive around them. He noted that the photographs show= ed the path that vehicles took, which didn’t come close to the edge of pavement. There were no tell = tale signs that people were having problems making it around the corner (at Sherburne Road). Mr. Lynde commented that the measu= re of success was if the back up traffic line on Sherburne Road is reduced.

Mr. Oldenburg said there = were really no low-risk things they came up with; the conclusion of the recommendation was that they would install retro-reflective signs, review t= he layout, investigate reconfiguring the intersection for review by either add= ing a median island/slip land on Sherburne Road and/or Mammoth Road; removal of pavement to decrease the Sherburne Road right turn radius; design effort to investigate a roundabout cost and impacts.= He welcomed feedback.

Mr. Gowan said with the e= xception of implementing a long-term solution (roundabout) questioned if any of the other suggestions were mutually exclusive such as to build/paint slip island and to build an island in the middle of the intersection. Mr. Oldenburg believed all the suggestions could be done at the same time or independently; they each had their own benefits.

Mr. McDevitt said it seem= ed as though queuing wouldn’t be eliminated, but it would be made safer. As drivers came to Mammoth Road (from Sherburne Road) the exit would be m= ade safer. The Board discussed ho= w they would like to proceed. The Selectmen asked Mr. Gowan to draft a response (for review by the Selectmen)= to Mr. Oldenburg indicating they would like to test/model the short term solutions. Mr. Oldenburg said= they should be able to monitor the intersection, possibly with the assistance of NRPC. Ms. Chizmas discussed h= ow they could conduct before/after analysis using the suggested recommendations. There was a = brief discussion about what tests could be done easily.

Mr. McDevitt said with NRPC’s cooperation and working with DOT, they could pursue experiments with test designs (using cones etc.) at the intersection. He said there seemed to be a conse= nsus that a roundabout was a good solution and would like to pursue having it pl= aced on the state’s plan.

The Selectmen appreciated= the time the Nashua Regional Planning Commission and Department of Transportati= on spent with them. Mr. McDevitt= said their time and effort were appreciated.&nb= sp; The Town looked forward to working with them in the future.

OTHER BUSINESS

New Council on Aging Appointment – Joanne Cornell

Mr. Gleason told the Boar= d that the nomination had withdrawn by the Council on Aging due to a minor technicality. The Council was actively looking for three members.

New Fire Station Groundbreaking

Mr. Gaydos said they woul= d have a construction schedule very soon. After reviewing the schedule a groundbreaking date will be announced= .

Flood Study Vendor Selection

Mr. McDevitt stated the v= oters had approved spending up to $25,000 on a flood study. He felt it was important for the Selectmen to decide what to do with the flood study in terms of how vendors would be approached and selected. Mr. Gaydos commented that the Army Corps. of Engineers were doing a study for the Town of Londonde= rry who had similar issues as Pelham. That study will include Windham and the dams in Derry. He recently contacted the Town Man= ager in Londonderry and the Town Administrato= r in Windham and agree= d to meet to find out the parameters and what the towns would be able to share, = or whether Pelham could be included in the study. Mr. Gaydos recommended Pelham start assembling a list of names for an RFP and at the same time find out what possibility Pelham would have to work with the other towns. He said he could work with Planning Director Jeff Gowan to put together an RFP for Selectmen review.

Mr. McDevitt’s conc= ern of working with the Corps. of Engineers was if their study would be granular enough so that it could talk specifically to the Town’s bridges, flood zones, water storage, etc. He wanted Mr. Gowan to maintain the primary responsibility of drafting an RFP, working with Mr. Gaydos, and submitting it to the Selectmen in two weeks for review. In the mean time, Mr. McDevitt asked that Mr. Gaydos pass along information gathered from the oth= er communities to also be reviewed/discussed during the meeting in two weeks.<= span style=3D'mso-spacerun:yes'>

DOT Letter Regarding Highway Street Lighting Assessment Proposal=

Mr. McDevitt read aloud a= letter (addressed to Mr. Gaydos) that was sent by Christopher Clement, Commissione= r of the Department of Transportation. &nb= sp; The letter alerted the Town that the Department of Transportation is proposing to assess street lighting on state highways and ultimately discontinue all lighting that is not needed for motorist safety. The current lighting situation is = being mapped and future needs are being evaluated. The department’s proposal was predicated on saving approximately $650,000 per year in electrical costs. The letter indicated that Pelham m= ay/may not be affected; if Pelham is affected the department will make contact in = the near future and make arrangements to meet and discuss the program, light locations and the schedule.

Mr. Gaydos had e-mail correspondence with Matthew Powers, Civil Engineer and Utility Coordinator = who suggested a meeting on Friday. Mr. McDevitt said it appeared that the Town had been put on notice.

Items to Bring to School Board’s Attention<= /b>

Mr. McDevitt asked if the Selectmen had any items of mutual interest they would like to be brought to= the School’s attention. Mr. Gleason asked if there had been any interest in pursuing combined purchasin= g as done in the past. Mr. Gaydos = said the Town and School were planning on jointly purchasing diesel fuel and gasoline. They just completed= a project where they are buying electricity through a broker. He discussed the difficulties with purchasing combined office supplies because the Town and School used differ= ent products. He would be speakin= g with School Business Administrator Adam Steel to see if there were any items they could purchase jointly.

Mr. Gleason said he would= like a ‘heads up’ as soon as possible for what the school would do with the School Administrative Unit (‘SAU’). He said if the Town facility was g= oing to be pursued, he would like to be informed.

Mr. Haverty felt Mr. Gayd= os and Mr. Steel did a fine job coordinating joint procurements. He was looking to bring more long = term strategy items back to the School, such as sharing Town resources for an SAU or infrastructure projects.

Capital Improvement Plan Update

Mr. McDevitt said the Cap= ital Improvement Plan (‘CIP’) committee has begun their process. He said a note went out from the C= IP committee to the department heads looking for items that would be included in the cap= ital improvement plan. He said dur= ing a joint meeting between the Selectmen, Budget Committee and School Board peop= le felt strongly that much depended on the CIP in terms of leveling out the tax rate and getting things needing to be done on the ‘radar’. He understood that the CIP was in a hurry to get their process done. He said it seemed that the department heads could go ahead to the CIP, fill out the forms understanding there was a $75,000 threshold on capital improvement items. Mr. Haverty noted that= the CIP voted to change their by-laws and up the threshold from $50,000 to $75,= 000 and a useful life of three years.

Mr. Gaydos said a number = of department heads contacted him indicating that there was a short timeline.<= span style=3D'mso-spacerun:yes'> He explained to them the committee= was trying to expedite the process. The department heads were uncomfortable about submitting the plans to the Plann= ing Board when they felt the Selectmen should be advising them. He commented that everyone was loo= king to improve the process and said his advice to the department heads was to submit the item leaving the scope and cost to be determined. The department heads were concerne= d with picking a dollar amount and then being held to it down the road.

Mr. Viger felt the $75,00= 0 amount may be a little too low and the three-year life cycle was too short given t= he majority of items that would be $75,000 or less would be vehicles. He felt the Selectmen and Budget Committee over the last few years had done a good job with the vehicle replacement plan. He feared i= f the CIP got too big it would become a wish list making it difficult to prioritize. He would like to = keep the CIP as real a possible. <= /p>

Mr. Gaydos said he gave M= r. Gowan a copy of the vehicle replacement plan that included big ticket items such = as fire trucks, highway trucks etc. He understood the need to try and put a number, but the department heads had already provided equipment replacement needs. He believed it was construction an= d the types of fields that would need to be considered. He said each department was thinki= ng about their needs. He agreed = with the concept of having the vehicles handled separately. Mr. Haverty said the CIP was willi= ng to entertain a separate vehicle plan. He said the members would like to have the CIP done this year and recognized that they were already behind.&= nbsp; Given that the committee had a lengthy discussion regarding moving t= he figure from $50,000 to $75,000, Mr. Haverty believed they were less likely to contemplate moving the figure higher this year. Mr. Viger felt the plan should be = as real as possible so it could be followed.&= nbsp; Mr. Gowan said the schedule hadn’t run out for the last CIP. Mr. Gleason said the needs should = be identified and then the details could be filled in. There was a discussion regarding t= he process for compiling information to be contained in the CIP and the role of the Selectmen in that process.

Mr. Gowan stated that the= CIP was an advisory document. He said= the concept of a CIP was to get department heads thinking forward seven years w= ith the understanding that the items in the later years may be ‘fuzzy’. The CIP committee, as an exercise, does a prioritized rank of items including ‘R’ for research. Mr. Gowan said the statute empowers the Selectmen to manage the CIP process themselves. In his opinion, s= ince the Selectmen direct, through Mr. Gaydos, all the department heads he felt = it was appropriate for them to establish ground rules for what they wanted to = see coming in.   He noted he wasn’t a voting member of the CIP, but helped as a facilitator.

Meals on Wheels Funding Elimination – Hillsborough County Budget

Mr. Gleason informed that= the Town was advised that the state was cutting funding; one of the residual effects was the elimination of funding for Hillsborough County Meals on Whe= els program. There are approximat= ely 23-26 Pelham residents involved. He said the Town could contact the District 2 representative and communicate t= he concerns about the elimination of the funding and the hardship and burden it places on the Town and those in need of assistance.

Mr. Gaydos posed the ques= tion if all the affected towns be willing to contribute their fair share of the $64= ,000.

Mr. Lynde believed it wou= ld be up to the county to decide whether they wanted to continue the service and fun= d it because they would assess the Town for the cost.

Mr. Viger was in favor of= Mr. Gaydos exploring options. Mr. Gleason would like to politely ask the county to re-look at their priorities before cutting funding; the service is a defined need for homebound seniors.

Mr. McDevitt said he spok= e with Sara Landry, Senior Center Director and questioned who would be affected by= the cut. He said she indicated it= was a safety net issue because it would affect the feeblest of the feeble; these = are the people that the bus can’t bring them to the Senior Center because they can’t get out of the house. He commented that the Town couldn’t pick up the service on their own. He said Town would have to either = ask Hillsborough County to please continue the serv= ice or agree to pay a share. Mr. Gay= dos was asked to make contact.

TOWN ADMINISTRATOR / SELECTMEN’S RE= PORTS

Mr. Haverty reported that= the CIP held their first meeting and set dates for their next meetings. He said there would be a lot of ac= tivity this month and would provide regular updates to the Selectmen.

Mr. Gaydos said the Town = was beginning to receive complaints about landscaping trucks parking equipment = in the traveled way. He made not= e of the complaints and passed information to the Highway Safety Committee for discussion. There were also c= alls received from people concerned with exiting their driveways due to increased traffic. Mr. Gaydos forwarded ‘blind driveway’ requests to the Highway Safety Committee.

Mr. Viger had no report. =

Mr. Lynde commented that = the suit relative to redistricting was heard at Superior Court. There are now five suits involved; because it will escalate to Supreme Court, the suits were trying to consoli= date themselves.

Mr. Gleason reported that= he attended the VFW Community Volunteer Loyalty Day Awards where a lot of people were recognized who had contributed significantly. In the course of the awards a Girl= Scout made a presentation to the Town. He asked if the presentation could be brought in and formally made to the Selectmen. She will be asked = to attend the meeting of May 22, 2012. Mr. Gleason informed that he attended the DARE ceremony (at the Elementary School). He commen= ded the Police Department’s visibility and wonderful rapport they had with the children.

Mr. McDevitt provided a b= rief summary of the recent Planning Board meeting.

·         Mr. Gaydos to request from Comcast something in writing indicating there will b= e no additional charge for moving cable to new fire station location (8/2/11 Mr. Gaydos said there were several issues he would deal with all at once when Comcast returned the signed contract)(8/30/11 – contracts returned – Town will approach Comcast with two required follow up letters of agreement) / 10/25/11- Mr. Gaydos to ask Mr. Greenwood to follow up; 1/17/12 follow up needed for written agreement.

·         Ob= tain status regarding Young’s Crossing and the flashing sign on Route 38/Gage Hill Road/Ledge Road intersection and from Police Chief. (8/9/11 Mr. Gaydos had a discussion with Police Chief= Roark regarding the flashing light and there may be less expensive alternatives.<= span style=3D'mso-spacerun:yes'> The Chief has requested a meeting = with the DOT district for Pelham)(8/30/11 – correspondence received from State – Mr. Gaydos to work with Police Chief Roark to compile accident statistics) / 10/25/11 – Mr. Gaydos said Chief Roark was heading this up – the same type of study = is being done at the Sherburne Road intersection.; 1/17/12 – still worki= ng with intersection (with state) in conjunction with Sherburne Road.

·         Mr. Gaydos to research if there is legislation pertaining to dam water releases= for a future agenda item (8/30/11 –Mr. Gaydos working on response regarding dam water releases and hope= d it would also address the flood ordinance Mr. Gowan was working on)/ 10/25/11 – Mr. Gaydos said there was wording, but it didn’t have suffici= ent ‘teeth’ – an agenda item will be scheduled for Selectmen discussion; 1/17/12 – at a standstill between what the state is willi= ng to do and what the Town would like them to do. Mr. Gaydos felt the flood study wo= uld aid in an outcome. =
