Mr. McDevitt read aloud a= public notice regarding the Mosquito Control Program – West Nile Virus and Eastern Equine Encephalitis. = Control of larvae mosquitoes in stagnant bodies of water will begin May 17, 2012. The primary method of control will= be a bacterium. Spraying to control larvae will continue as needed until November 30, 2012.&= nbsp; A description of treatment locations was provided; persons not wishi= ng their properties treated must contact, in writing, Marie Maruca, Board of Selectmen’s office, 6 Village Green, Pelham, NH 03076. Information on biological control agents, insecticides, areas likely to be treated or any potential hazards a= re available upon request to Municipal Pest Management Services Inc. at 603-431-0008 or e-mail swampfixer @myfairpoint.net.

APPOINTMENT(S)

Introduction: Corinne Chronopolous, Newly Appointed Pelham Libra= ry Director

Mr. McDevitt read aloud a= letter of introduction for the newly appointed Pelham Library Director Corinne Chronopolous. Ms. Chronopolou= s was invited to attend the meeting; at this time she came forward. She was excited for the opportunit= y to step into the role of director. She discussed some of the upcoming programs of the Library. She was seeking resident input, by= using a survey pelhampubliclibrary .org, to find out what the community’s i= nterests were for the library. An Eagle Scout (Jacob Wormald) built a patio for outdoor programs.

Hargreaves Memorial VFW Post 10722 Ladies Auxiliary Bronze Outstanding Achievement Citation Junior Girl Scout Award Winner – Emily Paquette<= o:p>

Ladies Auxiliary Presiden= t Rita McCabe stated they were asked to sponsor Girl Scout Emily Paquette in her efforts to earn her Girl Scout Bronze Award. At their Loyalty Day Ceremony = they recognized Ms. Paquette and several other scouts for their achievements.

Junior Girl Scout Emily P= aquette described her project for the Girl Scout Bronze Award. She updated Pelham’s Town ph= oto collage that was created in the late 1980’s by Girl Scout Troop 2065, which consisted of nine photos of the Town’s buildings and schools. With the help from her advisor, Ri= ta McCabe, the photo collage was updated.&nbs= p; Ms. Paquette explained the work she had done to raise funds and crea= te the project. She donated her collage as well as the previous collage to the Selectmen’s office to = be displayed in the new Town Hall so residents could view them.

The Selectmen were impres= sed with the project, how well it was researched and Ms. Paquette’s presentation.

(Gleason/Lynde) To formally accept Junior Girl Scout, Emily Paquette’s collage and agree to hang it in= the lobby.

Commander McCabe spoke ab= out the Memorial Day ceremonies and activities.&nb= sp;

Jeff Gowan, Planning Director

Plan NH Charrette – It was brought= to Mr. Gowan’s attention that Plan Charrette was offering a charrette (visioning) process to communities interested in focusing on their town center. With Pelham’s rounabouts coming to fruition and the library passing, it occurred to him t= hat they had come to the end of the Town’s last decade worth of planning.= He noted he would be proposing a M= aster Plan update in the upcoming budget. Mr. Gowan said he sent in an application noting that the Town was looking ahead toward the next 10-20 years and felt it would be a nice visio= ning process with the community. He received a response that they would love to work with the Town. There is no specific time established. The fee for a charrette is $5,000; Mr. Gowan was unsure at this time how the fee would be paid but would seek the necessary permissions. He envisioned the process occurrin= g this Fall, or next Spring. He disc= ussed the process, which would be to choose a location, provide food (possibly by working with local establishments) and have outreach efforts to inform peop= le. Mr. Gowan said there was value in = having outside people involved to provide a freshness of insight. They were all professional planner= s and engineers that did the work on a volunteer basis.

Sherburne & Mammoth Road Audit Response to Department of Transportation (‘DOT’) - During the previous Selectmen meet= ing, Mr. Gowan was asked to put together a response to the Safety Audit Presentation. Mr. McDevitt explained that the Selectmen had a long discussion with representatives from the Department of Transportation (‘DOT’) and the Nashua Regional Planning Commission at their last meeting.= They discussed low cost and effective alternatives to solve traffic problems at the intersection of Sherburne Road and Mammoth Road. <= /span>There were a number of items put forth that the Selectmen agreed to. Mr. Gowan was charged with the responsibility to draft a letter to the DOT summarizing what they agreed to do.

Mr. Gowan read aloud the = draft response letter to DOT. The Selectmen authorized Mr. McDevitt to sign the letter on their behalf.

Roundabout Update and Decisions Discussion – Mr. McDevitt stated that the Selectmen had been meeting regularly with the New Hampshire Department of Transportation (‘DOT’); also present were Selectm= en Gleason, Mr. Gaydos, Fire Chi= ef James Midgley and Mr. Gowan. = The meetings started out with many items to review and has now been reduced. The DOT was looking to wrap the discussions up in the next few weeks. There is a list of items that were reviewed at their last meeting.

Mr. Gowan read aloud the = agenda items and results from the last DOT meeting. The Selectmen discussed the items = that needed their input/decision. =

The Selectmen began by di= scussing the old fire station access road. Mr. Gowan said the options were: 1) to close the access road at the = Nashua Road= end and grass the closure point; 2) leave the road open; or 3) remove all pavement = so the access road would no longer be there.&= nbsp; He believed the consensus at the DOT meeting was that there was some value in maintaining that access road, but to be sure it wouldn’t be = used as a short cut around the roundabout. Mr. Gleason felt the use of the area should be determined prior to making a decision regarding the road. Mr. Lynde felt the Selectmen should hear the thought of the First Congregational Church since they were an interested party. Mr. McDevitt noted for the public = that the church parcel bordered nameless road (driveway) behind the fire station= , goes by the Lawrence property and also touched a point near Lyons Field. There was a question whether that = road was a Town road. Mr. Gaydos commented that the Town maintained the road. The Church could have access to th= eir property either through the road behind the fire station (if left in place)= or near the municipal building. = The Selectmen discussed if Town Meeting approval was needed to discontinue using the road. Mr. Gowan noted tha= t the road was posted as being closed to through traffic by order of the Selectme= n. Mr. Lynde said closing it as a thr= ough way wouldn’t change its status as a Town road.

The question about parkin= g was discussed. Mr. McDevitt said = he reviewed the site to see where parking could be located. He said one area was from the ston= e wall toward the fire station, which was sloped and the other space for parking belonged to the church and the Lawrence property (with restrictions). He said if the road remained they would need to discuss where parking would be located. Mr. Lynde said he wo= uld like to see as much green area as possible. If there was a need for parking he= felt it should be pushed as far into the Lawrence property as possible. It was = noted that the church had no existing buildings on the land. Mr. Gleason felt it appropriate to= speak with the church to find out if they were interested in parking or a right-of-way.

Ms. Angèle Diack, First Congregational Church Trustees Chairwoman, came forward to dis= cuss the land in question. She sai= d they hadn’t discussed what they would do with the property, but had a conc= ern regarding access in the event they would like to use it. They weren’t looking to have access through a parking lot.

Mr. Gleason questioned if= the church would be satisfied if the Town granted a right-of-way to the land through the Nashua Road exit. Ms. Diack was concerned= about the roadway being torn up if in the future the church wanted to sell the la= nd; they would then need to put a right-of-way in which would be expensive. Mr. Gowan said to ensconce a right-of-way they would need more than just the pavement currently in place. He said it wouldn̵= 7;t be a big project for an engineer, working on behalf of the Town, to do a plan showing potential (head in) parking and also define a right-of-way that cou= ld be recorded at the Registry of Deeds in the name of the church. He said during big events there wa= s a shortage of parking in the Town center.&nb= sp; He believed an additional 25-30 (head in) spaces (+/-) would be usef= ul. He said it would also be helpful for the DOT to know what the Selectmen wan= ted done there.

Mr. Lynde asked if the ar= ea of the existing station and parking would be removed and made into a green area. Mr. McDevitt said that = was the consensus. Mr. Lynde said= the road was effectively closed now and believed there would be adequate room f= or additional parking using the Lawrence property. Mr. Gleason noted d= uring the project the church would lose parking spaces. He wanted to know if parking in th= e area (currently behind the existing fire station) would be appropriate for church parking during their Sunday services and weekly affairs. Ms. Diack said they had just start= ed addressing parking, but had not made any decisions. She said there were large costs to repaving/adding a new parking lot. Mr. Gleason said one of the concerns was people trying to avoid the roundabout and using the road as a cut through. He wanted to know if there were restrictions on the Lawrence property that would preclude them from using it for parking. Mr. Viger was concerned that the church would have no access to the property if the road (from Nashua Road) was closed. He suggested maki= ng the access a dead end road in the area of the Lawrence property line so the church could maintain access.

There was further discuss= ion regarding the road, its classification and how to proceed. Mr. Gowan suggested seeking legal opinion to confirm the process for closing a road. He advised that they tell the DOT = they would like to see the road closed along Nashua Road and the pavement taken = out to the north of the church property. He said it was possible that the decision would be to leave it alone, but a good idea to have the budget in place to make changes. Mr. Gaydos understood that the con= cept was in terms of expediting the Town’s work with the DOT, they would t= ell the DOT to plan and budget even though a definite decision has not been made. Mr. McDevitt said the Selectmen were sensitive to the parking issue of the church because they’re missing parking spots as a result of the roundabout project.<= span style=3D'mso-spacerun:yes'> He said the Town also needed parking.

A proposed motion was to = tell the DOT, for budgeting purposes, to leave all of the pavement from the south en= d of the unnamed road up to the church’s northern property line, and to te= ar out the rest of the pavement. Mr. Viger questioned if they could ask the DO= T to budget for the removal of the entire roadway with the rational that they co= uld later tell the DOT to remove half/some/none. This would ensure the entire cost = would be budgeted. It was noted tha= t the church had the right for legal access to their property and the Town had the obligation to provide such access. <= /span>

First Congregational Chur= ch Trustee, Mr. Dave Hennessey came forward.&= nbsp; He commented that the curb cut going into the parking lot that was a= lready there; the curb cut may be the solution.&n= bsp; He showed the Selectmen a ‘Google’ map of the area. He suggested closing the Nashua side, and = have an obvious stop/end on the other side and discuss possibly utilizing approxima= tely 15 parking spots.

Mr. Viger asked if the ch= urch would be meeting to discuss what they would like to accomplish and have for future plans. Mr. McDevitt sa= id it would be a good idea, if the decision was to remove some/all of the road for budgetary purposes, to have a Selectmen representative(s) meet with the chu= rch trustees and see in some detail a proposal. Mr. Gleason inquired of Ms. Diack whether the church had been compensated for any of the parking spaces lost = as a result of the state taking land for the roundabout. She indicated they did. After whic= h, the Selectmen can have a reaction to the proposal.

The motion was to tell the Department of Transportation, for budgetary purposes, to leave all the pave= ment at the south end of the road up to the Congregational Church property line = and tear out the rest. The motion= was modified to remove the entire pavement.&nb= sp; Mr. Viger asked that a note be added that a final decision would be = made after a joint meeting by the Selectmen with the church. Mr. McDevitt said the Selectmen ha= ve made a public commitment to do so. Mr. Haverty believed they needed information as to whether it was a road, which would guide them toward what they needed to do to close it.

Ms. Diack said they were concerned with losing the 8-10 parking spaces through the roundabout projec= t, but were happy to have someone come and speak with them to move forward. Mr. Lynde and Mr. McDevitt will me= et with the church at their next trustee meeting.

The Selectmen finalized t= heir motion as follows to tell the Department of Transportation, for budgetary purposes, to remove the entire pavement.&n= bsp; This refers to the road/driveway behind the existing fire station. <= span style=3D'mso-spacerun:yes'>

Mr. Gowan said there were= two ornamental lights put at the entrance to the Village Green as part of the m= unicipal building project. The Town roundabout (built in front of the Village Green) would require one of those lights to be removed. There w= as a brief discussion regarding the lights.&nbs= p; Mr. Gowan noted that the Town requires dark sky lighting in the regulations. The Selectmen re= viewed the area map where the existing lights were located. Mr. McDevitt wanted to know how cl= ose the nearest DOT light was located in comparison to the light they were aski= ng to be removed. There was a consensus to retain the southerly light and remove the northern light at the entrance of the Village Green. Mr. Gaydos said the light being removed could at some later time be relocated in another area of the Village Green. <= /span>

Mr. Gowan showed the Sele= ctmen a photographic example of the materials used in constructing a roundabout. Th= ere were five components: 1) pavement, 2) truck apron; 3) inner apron; 4) centr= al island and 5) edge treatments (that lead up to the sidewalks/cross walks).<= span style=3D'mso-spacerun:yes'> He also showed an aerial photograp= h of a roundabout constructed in Rye<= /st1:City>, NH that illustrated the edge treatments for discussion. Mr. Gowan said the proposed truck apron was brus= hed natural concrete. The option = was to have it textured. After a bri= ef discussion the following motion was made.

MOTION:

(Gleason/Haverty) To use textured/brushed concrete for the truck apron.

VOTE:

(4-1-0) The motion carried.= Mr. McDevitt voted no.

Mr. Gowan said the inner = apron had a lot of options. Mr. McD= evitt noted that removing the fire station took away the need for additional poro= us surfaces in the roundabout from the view point of how water is handled. Mr. Gowan said the engineers (at t= he DOT meeting) indicated with the ‘greening’ of the current fire stat= ion area, there would be a net reduction in impervious surfaces as a result of = the project. He discussed the ava= ilable options/recommendations.

MOTION:

(Haverty/Viger) To use the ‘= ;rusty brown’ material for the inner apron and other trimmings (including = the edge panels) to match the steel ramp.

VOTE:

(4-1-0) The motion carried.= Mr. Lynde voted no.

Mr. Gowan advocated that = the edge panel colors be consistent with the inner ring; these are the approaches fr= om the sidewalks to the crosswalks. Mr. Haverty commented that these areas were included in his motion to use the ‘rusty brown’ material for ‘other trimmings’.

The Selectmen discussed t= he landscaping. The Garden Club = has offered to help with the landscaping for the center section of the roundabo= ut.

Mr. Gowan ended by tellin= g the Selectmen he would draft a response to the Department of Transportation for review.

OTHER BUSINESS

Fire Station Update

Mr. Gaydos said the bids = were accepted. He discussed the pr= ocess for reviewing the bids. He sa= id it would be up to Eckman Construction, who was providing a guaranteed price, to make sure each of the bidders hit every item. Mr. Gowan noted that a pre-constru= ction meeting has been scheduled for Tuesday morning.

CIP – Selectmen’s Submission

Mr. McDevitt said this ag= enda item was a reminder. Mr. Gleason s= poke about the six classrooms within the Municipal Building and felt t= he Selectmen should give some to thought to them for the future. The space could provide meeting sp= ace with better acoustics and seating. Mr. Gaydos said he would put something together.

2013 Budget Schedule

Mr. McDevitt stated it wa= s time to look at Selectmen meetings for budget discussions. A budget schedule outline was prov= ided to Selectmen for review. The = first budget only meeting is scheduled for July 17, 2012.

April Revenue & Expenses Review

Mr. Gaydos provided a qui= ck overview of the revenue and expenses for April.

Assignment of C= lass VI Road Obligation from Fisher Trust to James Fis= her

Mr. Gaydos said some time= ago a house was built on a Class VI road. As with the practice of the Selectmen, they asked that person to pro= vide liability for anything that may happen there because the Town does not main= tain the road. He said the liabili= ty had been held by the Fisher Family Trust, and that trust is now being dissolved leaving no assets to backup any liability claim. He said James Fisher requested tha= t the liability be transferred to him. The liability document has been reviewed by Attorney Paul DeCarolis, on behalf = of Mr. Fisher; and Attorney John Rattigan on behalf of the Town.

MOTION:

(Lynde/Gleason) To have the Selec= tmen agree to the amendment to the agreement and release relating to the Fisher Family Trust.

VOTE:

(5-0-0) The mo= tion carried.

DISCUSSION

Mr. McDevitt said a two-l= ot subdivision was proposed at the Planning Board meeting off Jericho Road. A portion of the map shows a tiny = piece of land (less than one acre) Lot 10-211.= He believed the land was probably = taken for taxes a long time ago and contained some junk, including junk cars. Jason Croteau of RGA Tire said he = would take the cars out of the land. Mr. Gaydos suggested Mr. Croteau review the area prior to beginning removal of items. There was no objection= to Mr. Croteau removing the cars.

SELECTMEN’S / TOWN ADMINISTRATOR REPORTS

Mr. Gaydos commented that= the announcement discussion at the beginning of the meeting was for testing only. If any residents contact Swamp Fix= er.com with an area around their home they’re concerned with, the company wi= ll come out for review and address the situation free of charge. People are urged to continue using= bug repellant.

Mr. Haverty reported that= CIP had received forms back from Park and Recreation, Fire, Police and the Library.= The next meeting will be held May 30, 2012 at= which time the School will give their presentation.&n= bsp;

There were no other Selec= tmen reports.

·         Mr. Gaydos to request from Comcast something in writing indicating there will b= e no additional charge for moving cable to new fire station location (8/2/11 Mr. Gaydos said there were several issues he would deal with all at once when Comcast returned the signed contract)(8/30/11 – contracts returned – Town will approach Comcast with two required follow up letters of agreement) / 10/25/11- Mr. Gaydos to ask Mr. Greenwood to follow up; 1/17/12 follow up needed for written agreement.

August = 2, 2011

·         Ob= tain status regarding Young’s Crossing and the flashing sign on Route 38/Gage Hill Road/Ledge Road intersection and from Police Chief. (8/9/11 Mr. Gaydos had a discussion with Police Chief= Roark regarding the flashing light and there may be less expensive alternatives.<= span style=3D'mso-spacerun:yes'> The Chief has requested a meeting = with the DOT district for Pelham)(8/30/11 – correspondence received from State – Mr. Gaydos to work with Police Chief Roark to compile accident statistics) / 10/25/11 – Mr. Gaydos said Chief Roark was heading this up – the same type of study = is being done at the Sherburne Road intersection.; 1/17/12 – still worki= ng with intersection (with state) in conjunction with Sherburne Road.

August = 16, 2011

·         Mr. Gaydos to research if there is legislation pertaining to dam water releases= for a future agenda item (8/30/11 –Mr. Gaydos working on response regarding dam water releases and hope= d it would also address the flood ordinance Mr. Gowan was working on)/ 10/25/11 – Mr. Gaydos said there was wording, but it didn’t have suffici= ent ‘teeth’ – an agenda item will be scheduled for Selectmen discussion; 1/17/12 – at a standstill between what the state is willi= ng to do and what the Town would like them to do.
