P= UBLIC HEARING – Whether the Town Should Regulate Fireworks or Not?

Mr. McDevitt discussed how the Selectmen would conduct the Public Hearing. He explained that the Selectmen previously had a discussion with the Fire Chief. The purpose of that meeting was to update the Board what the State Rules and Regulations were about fireworks, what regulations were in the Town (there are none) and what regulations exi= sted in other towns. The meeting w= as precipitated because of an event that happened last summer where quite a few people were injured by fireworks. The Selectmen felt an obligation to have a discussion about whether = or not they should do anything about regulations, education etc. in the future. Two weeks ago was the= first discussion of any kind that the Selectmen had about fireworks and decided t= he best thing was to hear from the public.&nb= sp;

Mr. Gaydos noted if someone was unable to attend the meetings, they could e-mail the Board of Selectmen at BOS@pelhamweb.com. It was noted the co= pies of meeting minutes were available on-line (www.pelh= amweb.com) or at Town Hall.

Mr. McDevitt welcomed people to come forward.

Ms. Susan Boucher, 10 Katie Lane was in favor of fireworks regulations. She experienced neighbors who were= not considerate of the other neighbors and who set fireworks off until sometimes 2am. She wanted to know if a firework was considered an explosive.

Fire Chief James Midgley came forward to answer questions. He said fireworks were explosives;= there were different classifications of explosives and fireworks were deemed by t= he State as Residential Fireworks. He said an explosive was a type of device that reacts when ignited in a certain way.

Ms. Boucher asked if this type (Residential Firework) required a permit. Chief Midgley answered no. In the past the State had a permis= sible fireworks list; however, two years ago the New Hampshire Legislature took t= hat list and indicated if a device fell within a specific grain size (with a few exceptions i.e. firecrackers, bottle rockets) or amount of explosive within= the device it was permissible. Ms. Boucher was concerned that fireworks were explosives, and as shown over the summer, people were injured as a result of explosions. She thought explosiv= es would have been illegal or needed a permit. Another concern creating a potenti= al fire hazard from fireworks being set off in dry seasons and having them lan= d in other people’s yards. S= he said permits were needed to burn.

Mr. McDevitt said the State permitted fireworks. Ms. Boucher felt the Town should h= ave some sort of permit requirement to regulate fireworks and to know who was setting them off. She noted p= ermits were needed to set an explosive, to have a firearm, and to burn in a yard.<= span style=3D'mso-spacerun:yes'> There was a neighbor setting off fireworks that sounded like cannon balls being shot out of a cannon; they w= ere so loud the house shook. Ms. Boucher felt there should be a permit process so it was known who was setti= ng the fireworks off and have a timeframe to do set them off. She wasn’t seeking to totall= y ban fireworks. She believed firew= orks to be a noise factor and harmful.

Mr. Jay Tropea, 45 Dogwood Circle sympathized with those injured last summer but urged the Board not to act too hastily or draconian and outright ban fireworks. He agreed with the previous speaker that some sort of permit process would be a good place to start to tackle the issue; possibly something a kin to the fire burn permit. Mr. Tropea said he ha= d been to a number of displays in Pelham that were handled professionally by adults that took great issues to ensure children and other folks were a great dist= ance away, there was water source provided and that everyone had a safe and enjoyable time. He said this = person was considerate of the neighbors by stopping the show around 10:30pm-11pm.<= span style=3D'mso-spacerun:yes'> He noted that this neighbor typica= lly did the show around the holiday or weekend.

Sean and Michelle Piemonte, 45 Dogwood Circle came forward. Mr. Piemonte said he was one of the individuals that lighted shows each year.&= nbsp; He said they had lived in Pelham for approximately three years and o= ne reason for purchasing a home here was because they could do fireworks in To= wn. Almost yearly, he attends safety seminars for Atlas Professional Fireworks. Mr. Piemonte stated he took spec= ial precautions when doing his own shows and usually has fire extinguishers and hoses available. Shows are st= opped at a reasonable hour (approximately 10:30pm). He’s built his own racks to = keep everything secure. He felt te= rrible for the accident that occurred in Town, but didn’t feel fireworks sho= uld be banned. He believed people should be educated, which would solve a lot of issues.

Mr. Lynde asked Mr. Piemonte to comment on the Legislator expanding the allowed size of fireworks. It was Mr. Piemonte’s opinion that reloadables were safer than cakes. He’s seen cakes tip over bec= ause they weren’t on plywood. He said he had built racks that were designed for failure and faced away peopl= e. He found that mortars went straigh= t in the air; the only times they went sideways was when the tubes weren’t supported. He was pleased tha= t New Hampshire legalized reloadables. He agreed with not allowing bottle rockets, firecrackers etc. because using th= ose are when injuries can happen. Mr. Lynde commented that Mr. Piemonte’s knowledge might be a resource if = the Town crafted something. Mr. Piemonte said he would be glad to help in any way he could.

Mr. Viger questioned how reloadables were stored. Mr. Piemonte discussed the shows t= hat he put together on his cul-de-sac. He put the reloadables on the street in a safe area so in the event it was prematurely lit, it would go off but not damage anything. He said everything had to be laid out.

Mr. Gleason started by thanking Mr. Piemonte for his diligence, concern, care a= nd precautions. He asked if he w= ould be in favor of having a permitting process for the Town. Mr. Piemonte answered yes; he woul= d have no issue with it. He commente= d that people would light them without a permit.&= nbsp; He said if the education was in place, it could prevent a situation = from happening. =

Lise and Michael Laforge, 1 Madison Avenue came forward with their son Christoph= er. Ms. Laforge told the Board that the= y did fireworks every July forth and took great precautions when doing so. They pick up their fireworks either night before, or the day of July forth.&nb= sp; Her son builds a platform for setting up the fireworks and they use = an igniter from a fireworks store.

Ms. Laforge agreed with having a ban on the time, and noted in dry weather they didn’t light their fireworks because of fire concerns. She suggested creating a safety li= st that was shown to the Fire Department indicating what they had for firework= s, how they would be set up and the safety precautions they were using. She also believed the local firewor= ks companies would be more than helpful to give a lesson on safety.

Mr. Laforge said they weren’t lighting fireworks off on weekends; they di= d a Fourth of July celebration. T= hey took safety precautions. He s= aid they have people wear glow sticks so they could see where there were at nig= ht. They had set areas where people weren’t allowed to go and there were only two people that set the fireworks off.

Mr. Gleason commended the Laforges for their diligence to safety precautions. He asked if they would be against a permitting process through the Fire Department. Mr. Laforge said he would like to understand the permitting process before agreeing to one. Mr. Gleason said the Selectmen were concerned for the potential of injury.&nbs= p; He believed education was key in making people aware of the dangers. Ms. Laforge wouldn&#= 8217;t mind going around to the local vendors to see if they would do a safety pro= gram during the Fourth of July timeframe.

Chief Midgley felt it was premature to come up with a conclusion. He said they were receiving good i= nput. Mr. Lynde said anything they did would be in the public. He said at this time the Board was taking input and discussed how the process would continue.

Mr. McDevitt said should the Board decide to take some action; there would be plenty of notice. He said sho= uld they make a decision to have a ban, or permit etc. they would conduct additional public hearings. <= o:p>

Mr. Dennis LaBrecque, 7 Tenney Road told the Board that he didn’t do fireworks displays, but attended them at neighbor’s houses. He said it was a tragedy that people got injured over the summer. He was concerned about the Selectmen imposing additional regulations= on the Town’s people. He n= amed some of the things other towns were trying to ban and said he liked living = in New Hampshire with the freedoms he had.&nb= sp; Mr. LaBrecque believed it was up to the people to be careful and use common sense and if they didn’t, they probably also wouldn’t se= ek to get a permit. He said the restrictions would be put on those people that were already trying to comply with safe practices.

Mr. Gleason commented that there was nothing currently in place. Mr. LaBrecque was opposed to the T= own having restrictions over what the State currently had. Mr. Gleason asked Mr. LaBrecque if= he was opposed to the Town having a permitting process. Mr. LaBrecque felt the curre= nt forum was an educational event. He said when his children attend an event, he cautioned them about safety. He said people attending shows had= to create their own safety and be diligent.&n= bsp;

Mr. Mark Thibeault, Leonard Drive didn’t want to see fireworks banned. He felt the theme was common sense= and was in favor of education. He= was surprised to find out that firecrackers were banned. Mr. Viger said firecrackers and bo= ttle rockets (among other items) were banned by the state; the Town currently didn’t have a ban. Mr. Thibeault commended the work of the Fire and Police Departments. He didn’t want to see a knee= jerk reaction to the situation that happened in the summer. He would rather not see fireworks banned, but was in favor of education and people using common sense

Mr. Shawn Murphy, 4 Chagnon Lane felt the tragedy that occurred (in the summer) should affect the residents. = He said responsible adults didn’t need any more rules to govern their li= ves. The State Motto is Liv= e Free or Die. He believed the Town = was having a knee jerk reaction to the tragedy that occurred. Mr. Murphy said an optional class = was a good idea for those that lit a lot of stuff off. He wasn’t in favor of having= a permit in New Hampshire and felt people should be responsible for their own actions.

Mr. Lynde said there were irresponsible people that may cause harm to individua= ls, property etc. He questioned h= ow the Town should respond when something was lit off and a house burned to the ground, or more people get injured. He felt there had to be some kind of balance and asked if Mr. Murphy agreed. Mr. Murphy believed p= eople had to be responsible. He said people couldn’t be individualized and didn’t want (rights) taken away from him.

Mr. Mike Carrier, 30 Ledge Road told the Board he had been lighting off firewor= ks his whole life. His father ta= ught him safety, and in turn he passed the information off to his son. He hoped that could continue becau= se if children stop being taught the proper way to do it they could get their han= ds on them because of being intrigued. He said the Town could end up with worse problems than they currently had. He said the event in the summer was tragic, although it was an accident. Mr. Carrier stated accidents happe= ned; people couldn’t be protected from every aspect of everything. He informed that some of the stores passed out guidelines. He understood what the Town was looking to achieve, but other than writing gui= delines maybe could sign that they received them.&= nbsp; He noted that a person had to be twenty one years of age to purchase fireworks, the same with alcohol. &nb= sp; He said people had to be aware that fireworks, right down to the smallest device, were explosives.

Mr. Scott Riley, 54 Dutton Road disagreed with trying to ban something that had already been approved by the State. He did (Class B) fireworks professionally for a company part time. He felt reloadable mortars were ve= ry safe. He said once a year he = did a fireworks show for his family at Fourth of July and treated it just like a professional show using safety measures.&n= bsp; Mr. Riley said the State went through a rigorous process to identify what was legal; information and strict guidelines are available on the State Fire Marshall’s webpage. He believed if people followed those guidelines and used common sense they wou= ld have a safe show. =

Mr. McDevitt said the purpose of the meeting was to find out what people thought. He said he received e-mails from people saying fireworks needed to be banned in Town.

Mr. Gleason asked the audience how to effectively reach out to those who are not informed about fireworks and the precautions that should be taken, so those people can get the education they need.&nb= sp; Mr. McDevitt said if anyone had thoughts to the question after the meeting they could contact the Selectmen by telephone or e-mail (from Pelhamweb.com) to give the Board their feedback.

To address Mr. Gleason’s question, Mr. Viger commented that having a per= mitting process would be a start, but those that abused (precautions) wouldn’t utilize a permit. He said tho= se that were doing it correctly had no problem with permitting similar to gun control; those that were doing things properly had no problem registering t= heir firearms, it was the criminals that didn’t.

Mr. Haverty commented that there was no permit process or registration for a firearm. He said firearms, li= ke fireworks, rely on the person to educate themselves and take responsibility= for their own safety. When this doesn’t happen people get hurt. He said sometimes things happen from an unfortunate accident or negligence. He didn’t t= hink they could permit, or ordinance, or legislate out of some of those types of incidents. =

Ms. Piemonte agreed that people who were being safe didn’t have a problem getting a permit; it was the other people they were trying to address. She suggested near the beginning of summer that the Town possibly put out a one-sheet facts/guidelines e-mail to members, or post it on a website. She said this may help address the issues.

Mr. Thibeault understood this was a difficult issue with no magic answer. He said banning fireworks wouldn&#= 8217;t stop people and it would become difficult for the Police to chase them. He felt not banning fireworks was = the right direction to head. He understood there was a possibility for more accidents keeping fireworks legal. He would like to see programs conducted and people educated.&nb= sp;

Mr. LaBrecque said there would be an associated cost to run a permitting process and would rather see his tax dollars go toward an education.

Chairman of the New Hampshire Fireworks Association Steve Carbone and his wife Kim Carbone came forward to answer questions.&= nbsp; Mr. Carbone told the Board that they owned the Atomic Fireworks stor= e in Seabrook, NH. He said they ha= nded out a safety tips sheet to every customer. Usually they had a one-on-one discussion with customers to direct them to the fireworks they should be us= ing based on the size of their yard. He noted fireworks shot on an angle required a bigger yard. Mr. Carbone discussed reloadables = and stated they were all tested and approved by the Consumer Products Safety Commission. The base on a reloadable is approximately 4in.x4in.; it shoots up in the air and the tube might tip over, but because it’s only a single shot it doesn’t matter. Cakes are different b= ecause they contain multi-shots. Mr. Carbone believed on the injury rate, reloadables rated approximately 8% of = all fireworks injuries.

Mr. Viger asked Mr. Carbone if he would be interested in participating in an educational process. Mr. Carb= one said he had talked about doing that, but it’s never occurred. He noted New Hampshire had a firew= orks club that anyone could join. = They conduct meets and safety classes etc. He said he recommended safety points to customers. However, prior to July forth it was difficult to get into detail and believed it would be the same issuing perm= its because people would request permits a few days before the holiday. He told the Board that Seabr= ook, NH. had permits in the past, but had decided to do away with them. He said by State Law a person could light fireworks on their own property, or have permission by the property o= wner.

Mr. Gaydos asked Mr. Carbone if he had a website that contained some of the saf= ety information. Ms. Carbone offe= red to e-mail one of their safety pages for the Town to put on their website. Mr. McDevitt said the Selectmen wo= uld appreciate the information. M= r. Carbone believed the State Fire Marshall had a film on their site for safe procedures.

Mr. McDevitt said the Selectmen and Fire Chief would think about solutions. He asked how the Board would like = to proceed. Mr. Gleason suggested obtaining a list of options from the Fire Chief, scheduling the next meeting and conduct a round table discussion. Mr. Viger agreed and suggested that the next meeting be scheduled be= fore the audience members left.

The topic was date specified for October 16, 2012 at 6:45pm. There will be a discussion about t= he next steps, if any, among the Board of Selectmen, Fire Chief and Police Chi= ef. The discussion won’t be open= ed for public participation.

Mr. Viger commented that any feedback (up to the October 16^th meetin= g) would be accepted.

The public hearing was closed. Mr. McDevitt thanked the public for their input.

OTHER BUSINESS

Transfer Station:

-&nb= sp; Job Description

-&nb= sp; Contract

Mr. Gaydos read aloud the job advertisement for the Transfer Station/Recycling Center Supervisor. The Selectmen offered input to modify the qualifications being sought. Resumes and let= ters of interest should be submitted by October 26, 2012 by 4pmEST. Mr. Gaydos w= ill post the position. The Select= men then reviewed the job description; the modifications made to the advertisem= ent would be incorporated into the job description.

Mr. Gaydos told the Selectmen that the Town currently had a contract with Allied Waste contract (that would expire in 2015) to remove municipal solid waste. Shortly after the sign= ing the contract with Allied Waste the Town went to single stream and selected a vendor without going through a bid process. Allied has contacted the Town and indicated they would like= the opportunity to possibly handle the single stream and have offered to renegotiate a new agreement that would supersede the old agreement in trade= for picking up the single stream. Mr. Gaydos said Allied had offered a lower price for municipal solid waste if single stream was included in the contract. In the current contract the Town w= as paying $68/ton and $179/each haul; in December the rate will increase to $70.72/ton and in the following year the rate will increase to $73.55/ton.<= span style=3D'mso-spacerun:yes'> Allied has offered a rate of $66/t= on (good for one year) and the following year the rate would increase to $66.66/ton. The hauling rate = would decrease to $135. The new rat= es would reduce the budget initially by approximately $30,000.

Mr. Gleason said they were in receipt of a letter from Empire who indicated they would give the Town a reduced rate. He asked why their offer wouldn’t be considered. Mr. Gaydos replied that the Town w= as currently in a contract with Allied Waste and couldn’t unilaterally cancel that contract. The fac= t that the Town didn’t have a contract for single stream allowed them the opportunity to improve their situation.&nb= sp; If the Town didn’t renegotiate, they would be paying higher ra= tes for several more years. The p= rice they would pay for single stream was identical to what the Town was paying = to Empire; therefore the Town wouldn’t have an increase for single stream and would save money with solid waste. Mr. Gleason asked which company prov= ided the Town with better quality. Mr. Gaydos said they were about the same in terms of service, however Empire had picked up metals (without a bid) and upon examination it was found that they were paying the same pricing for light iron as they were for aluminum, brass and copper which is considerably higher.&n= bsp; After the irregularity was found and brought to their attention, the= re was an initial discussion as to why they shouldn’t have to pay it, on being persistent, the money was refunded.&= nbsp; The Town has since moved that account away from them and back to the original vendor (Schnitzer). = Mr. Gaydos discussed the process and great relationship the Town had with the company.

Mr. Viger questioned how revenues/expenses would be handled. Mr. Gaydos said the Town would rec= eive a check net of the hauling cost for metals, aluminum, brass, copper and light iron. When the Town was with Empire, they were applying the income to the Town’s bill. Mr. Viger felt it was very importa= nt for the Town to show its revenue stream versus the expenses. This will allow the Town to get a t= rue handle of the budget process.

There was a brief discussion regarding how the Town handled municipal solid waste prior to single stream. Mr. L= ynde reviewed his understanding of how the Town would proceed; the Town would ta= ke their existing contract with Allied, extend the end date, and have an initi= al cost of $66/ton and a hauling cost of $135/load. Mr. Gaydos said that was correct.<= span style=3D'mso-spacerun:yes'> The per ton cost would increase by= 1% next year and 3% the next six years. Mr. Lynde asked if the hauling cost would stay the same or have a bu= ilt in escalator. Mr. Gaydos said= there would be a 3% increase the next three years on the hauling cost. The hauling cost for the single st= ream was $110. This would be a one= -year trial to see if the Town made money or wanted to lock in a rate. Mr. Lynde asked what size trailers= the Town currently used. Mr. Gayd= os said the Town used 75-yard trailers; increasing to 100-yard trailers the To= wn would still need to meet three hauls per week. He noted the Town had an annual vo= lume of 2900 tons. Mr. Lynde asked= if the use of 100-yard trailers was not allowed by the contract. Mr. Gaydos said it wasn’t of= fered under the contract.

Mr. Gleason discussed the previous process used for revenues and expenses and questioned if the invoices had been reviewed. Mr. Gaydos said the invoices were reviewed every month. Mr. Gle= ason said if the Town was to entertain an arrangement with Allied, they would ha= ve a clearly visible trail of expenses versus revenues. Mr. Gaydos answered yes. Mr. Gleason recalled the Transfer Station budget increasing last year. Mr. Gaydos said it did increase and the actual expenditures exceeded that figure. Mr. Gleason aske= d if the revenues increased last years. Mr. Gaydos answered yes; metals prices were high and the Town was st= ill using Schnitzer. <= /span>

Mr. McDevitt commented that he had been reluctant to get into who the vendor wa= s, but felt that there were some issues with the prior vendor that gave him a = lack of confidence in entertaining future proposals. The Town had been receiving the sa= me price for copper as they were for light iron; he’d like the company to discuss why they had done that. Until this occurs, he had no interest in signing a contract with them.

Warrant Article Discussions

The Selectmen had asked the departments to provide them with proposed warrant articles for the 2013 Town Meeting.

Article B – Proposed by the Police Department: To raise and appropriate $62,8= 13 for the purpose of hiring and equipping a Communications Center Supervisor. The funding will = cover the position from April through December; if approved the position will be funded after that time through the Police Operating Budget. The position will be considered non-union. =

Lieutenant Gary Fisher came forward and discussed the warrant article for the proposed supervisor in dispatch and how important the position was to the Police. He described all the duties of the people in the dispatch positions.

Mr. Viger asked if the requested position fit into the National accreditation t= he Department was seeking. Lt. F= isher said indirectly it would because they would assist with Department audits.<= span style=3D'mso-spacerun:yes'> He said the position would allevia= te duties placed on other employees that were above what the duties they were responsible for; duties that have nothing to do with their position. Currently there was a Sergeant in = charge of communications who was taking time away from their duties to be able to perform the job. <= /span>

Mr. Haverty asked if it was likely that an internal candidate would apply for t= he role, or if the Department would look outside for an individual with a spec= ific set of skills they didn’t have in house. Lt. Fisher believed just like any position that became available an in house person could apply. He said it’s a new position = that would be advertised to the public and applications would be taken. The position was more than dispatc= her, it was an administrative position, and the person hired would oversee the communications center and organize and run the day to day operations in that center.

Mr. Lynde questioned the hours of the position. Lt. Fisher said the hours would be= on a flex time schedule that could deviate; they wouldn’t be locked into a particular time. <= /span>

Mr. Viger wanted to know if the person would go through an academy training process. Lt. Fisher said ther= e were training courses available. He reiterated that the position was more than only dispatch. They were looking at the possibili= ty of an administrator. Mr. Viger a= sked if they were looking for someone with an administrative knowledge first, ve= rsus having dispatcher knowledge. = Lt. Fisher said they might be able to find a dispatcher that had background experience who could do the job.

Mr. Gleason reviewed the salary and believed if it was prorated over twelve mon= ths would total $83,751. He wanted to know if that figure included benefits, or if there was more to add. Mr. Gaydos believed the salary was approximately $51,000. Lt. Fi= sher said the number he had included the benefits. Mr. Gleason asked what the salary = amount was based upon. Lt. Fisher sa= id there were other similar positions in the area. They reviewed the Local Government’s survey on salaries (with departments of Pelham’s s= ize) the number presented was the average between the minimum and maximum salary that they provided. The agenc= ies that were reviewed were: Amherst, Berlin, Claremont, Conway, Exeter, Hampto= n, Hanover, Hookset, Lebanon and Raymond.&nbs= p; Of those communities, two have it listed as a union position.

The Selectmen will vote on warrant articles at a later date.

Mr. Gleason anticipated warrant articles and asked the Selectmen to consider the following:

1)&n= bsp; Capital Res= erve for Cistern Repair;

2)&n= bsp; Willow Stre= et Bridge;

3)&n= bsp; Police Cont= ract;

4)&n= bsp; Trust Funds/Capital Reserves that should be reviewed – Pandemic Fund, Senior Bus, Senior Center Addition, Recycling Facility, Recycling Equipment.

Mr. McDevitt suggested that Mr. Gleason provide Mr. Gaydos with a list to be reviewed, possibly at the next meeting.&nb= sp;

Mr. McDevitt said there were two other warrant articles proposed. The first being a standard request= for road repair to be offset by the State Grant for Highway Maintenance. The second was to have the Town vo= te to sell three Town owned properties.

There was a brief discussion how the Selectmen would like to handle possibly sell= ing Town owned properties if an abutter (who owned an undersized lot) was interested in purchasing the Town land.&nb= sp; The Selectmen said they would have to first determine if it was in t= he Town’s best interest to sell the property. Mr. McDevitt said he would like to review a copy of the deed. He also felt it would be worth getting opinions from the Conservation Commission and Planning Board.

There were two additional properties that had been taken for back taxes. Mr. McDevitt believed there was a = 90-day buy back clause on properties taken for taxes because the State changed the law. Mr. Gaydos said a buyer = would have to research the property; there were many things to consider. He understood that the Selectmen w= anted additional back up information and to know the options.

Senior Center Landscape Plan

Mr. Gaydos said as part of the overall warrant article to build the Senior Cent= er (addition) understood that it included landscaping; however, the builder was not a landscaper so initially the decision was to construct the building and handle landscaping secondarily. He asked if the Board wanted to consider using some of the money remaining in = the warrant article for landscaping. Some time ago the Town’s landscaper, Boyden Landscaping, met w= ith the Senior Center Director and they devised a list of plants and a design f= or locating those. A photographic rendering was done to show how the landscaping would look.

Mr. Gleason said there was $4,500 in the warrant article. He said the landscaping was never included in the addition. The= y had since found that with the current design of the back door entrance had a st= air and one person had fallen and sustained a severe injury. Also, they have neglected to put A= DA doors at the back entrance. Mr. Gleason offered a different approach. He felt the warrant article money = could go back into the General Fund. He said there was currently (approximately) $6,200 that sat in a fund that was originally garnered by Planning as a voluntary contribution by developers.<= span style=3D'mso-spacerun:yes'> He received an opinion from Attorn= ey Ratigan that stated the money was treated as an impact fee and as such, pub= lic recreation facilities were a proper purpose for imposing and collecting the fees. Attorney Ratigan’s letter ended with the recommendation that the sum be expended within the six year period of being collected. Mr. Gleason believed they were nearing the six year period and recommended that they authorize the landscaping because it was an oversight that wasn’t done, and to put a concrete ramp in to preclude a serious injury and also p= ut ADA doors in. He felt the mon= ey was raised specifically for that purpose and his suggestion would be the proper disposition of such.

There was a brief discussion how to proceed.&nbs= p; The topic would need Board action once Mr. Gaydos came in, possibly = this year, with a proposal for the door and concrete step. A price could be obtained for the landscaping, but the work may not be done this year. Based on Attorney Ratigan’s letter, Mr. Gleason felt it might be appropriate to encumber the funds for = the specific purpose. =

Mr. Lynde questioned if they could credit the impact fees toward the improvemen= ts already made with the addition, and increase the remaining balance for use = on anything further. =

Mr. McDevitt said it might be appropriate for the Selectmen to vote to encumber= the impact fee money to be spent toward the ramp, ADA doors and landscaping, wi= th the expectation that it would spend most, if not all of the monies. Mr. Gleason said as good will to t= he taxpayers, any money remaining (in the warrant article) should be returned.

MOTION:

= (Gleason/Lynde) To encumber the impact fees for the Senior Center Housing Voluntary Fund = of $6,214.99 for the purpose of constructing an ADA compliant ramp and provi= ding ADA doors at the rear entrance and for providing landscaping for the faci= lity itself.

Garden Club Tree Donation Discu= ssion

Mr. McDevitt said the Garden Group recently had a meeting and spent a lot of ti= me reviewing the right side of the Library.&n= bsp; After thinking about the fact that there was space for a fire lane a= nd future Library addition, it was thought that a better location for a tree w= ould be in the triangle shaped space near the parking lot. The tree being looked at is an 8ft. Colorado Blue Spruce. The tot= al price to have it installed is under the $500 threshold that would require a public hearing.

Mr. McDevitt asked for the Selectmen’s approval for the Garden Group to t= ake care of planting the tree. The group would work with Mr. Gaydos to ensure that planting the tree in the proposed location would not interfere with drainage or wires.

Mr. Viger asked if there was any expansion planned for the Library at this time. Mr. McDevitt said in lo= oking at a plan showing the Municipal Building and Library, there were dotted lin= es showing the architect’s vision of the area the Library could be expanded. <= /p>

Mr. Lynde commented that the tree would be more visible in the proposed location. <= /p>

Mr. Gleason asked where the fire cell tower would be located. Mr. Gaydos said it would be next t= o the fire station itself. He noted= that conduit had not been run yet from the Library to the Fire Station, so it wa= s a good time to discuss where it would be placed.

Mr. McDevitt noted that the tree would be planted by a professional landscaper using professional equipment at no cost to the taxpayers.

Proposal to Explore Space for S= AU offices

Mr. McDevitt read aloud a request from School Board Chairman Brian Carton submi= tted to the Selectmen. The request= asked that the Selectmen formerly consider allowing the School Administrative Unit (‘SAU’) to relocate to Pelham Town Hall (from Windham) given th= at Windham had voted to separate from SAU#28 leaving Pelham as the only remaining scho= ol district in that SAU as of July 1, 2013.&n= bsp; It was understood that a tour of the space was conducted for Pelham Superintendent Amanda Lecaroz and Business Administrator Brian Steel who returned to the School Board with a favorable impression indicating they thought it held real potential. The School Board voted to allow the use of $6,000 to develop a floor plan and g= et an accurate estimate of construction costs for that renovation. The School Board asked for the Selectmen’s input and if they could have some assurance of support.

Mr. Lynde said with the fact that the SAU had to move to Pelham and needed its = own space; there should be concern about how it got done and the costs. He would look favorably upon it if= the result was the Town having less expenditure for the space. He said it might also get them in a direction of using other spaces.

Mr. Gleason felt it was appropriate to tell the School Board that the Selectmen welcomed their investigation and feasibility of the area. He said any way they could save the taxpayers money was worth pursuing. He believed it was their responsibility to do a thorough analysis of= the facility and thorough investigation of the costs and for the Selectmen to h= ave confidence in the presentation. Mr. Gleason expected the pricing to be adequate to provide and maintain the facility and accommodate the Town’s concerns they may have relative to the structure. He had concern= s based on what he heard about the costs for the sprinkler system and HVAC not being adequate. He wanted to make c= ertain that it was communicated to the school that the Selectmen were willing and presumed that the school would do a thorough investigation of the cost. He wanted the Selectmen to have the ability to confirm the costs as being appropriate or the school would confi= rm through a third party the work could be done for the amount proposed.

Mr. Viger said the Town was responsible for the Town buildings and he took a lo= t of pride in the efforts the Selectmen took in getting to a ‘not to exceed’ number with the new fire station. He didn’t want to be in a situation where somebody else comes in and builds out space that the Town w= ould ultimately become responsible for. He believed at the least the Selectmen should have a say, or be part= of how it would be designed, how it checked out and what the ‘not to exceed’ number would be. He said it was very important to come forward with a real number because the T= own would have to take on the responsibility of it being in their building. Mr. Viger noted since the time he = had been on the Board, they hadn’t talked about the big picture or expans= ion because they had tried to hold the line (for the budget). They had previously discussed movi= ng the Cable Department, building a conference room or meeting space or cable stud= io and doing an expansion between the Police Station and Municipal Building. He understood the School Board was= under a crunch because their SAU was being separated; however, it’s been a discussion for six or seven years and their lack of planning shouldn’t constitute the Town’s emergency.&nbs= p; Mr. Viger said the Town had to look at those spaces (within the building) and look at the Town’s needs before they give them up to somebody else. He believed th= e Town could utilize those spaces. <= o:p>

Mr. Haverty agreed with Mr. Gleason. He felt that recently the track record had shown that the school had faced challenges with getting real numbers for the projects they were working on. If the Selectmen were goi= ng to allow the School to research, Mr. Haverty wanted to say to the school that = the Selectmen needed to also verify the numbers. He was in favor of letting t= hem use the space because it was the responsible thing to do. He said it would improve the servi= ces to the Town residents. He sugges= ted possibly having the Town develop the space and renting /leasing it back to = the School.

Mr. Lynde commented that he attended a meeting where a question came up regardi= ng the HVAC etc. and he was informed that the school’s numbers were good. He agreed they should w= ork on a plan for the space.

Mr. McDevitt said he had taken a tour of the space. He commented that the items in the= space weren’t stored efficiently. He believed the School Board was as= king if there was any reason that the Selectmen wouldn’t want them to use = the space. Further, they would like to have the Selectmen make a motion telling= the School Board that they had no objection to their taking the next step and g= ive conceptual support.

Mr. Haverty said the School Board was asking the Selectmen if it was okay for t= hem to spend $6,000 on a floor plan to be able to proceed to the next step. And that once a floor plan was developed, the Selectmen wouldn’t change their mind. Mr. Haverty was unsure if a suffic= ient and comprehensive plan could be developed for $6,000; one that was enough f= or the Selectmen to say yes or no. He also didn’t know if he could say definitively that he didn’t wa= nt more control over the space, regardless if it was an SAU, Town space or office. Mr. Haverty said the Selectmen needed to have a conversation about the space and if they wanted = to develop it as a Town building project.&nbs= p; He didn’t think the Selectmen could give the School Board the answer they were seeking at this time.

Mr. Viger said the Selectmen needed to take responsibility for what was current= ly in the space and see if there was an alternative space for use.

Mr. Gleason was unsure what portion (the number of rooms) the School was looking at. There should be some init= ial dialog as to what they were looking at.&nb= sp; Mr. Lynde believed once the determination was made to move into the space, the entire area should be developed at the same time. Mr. Gaydos said the code would require that the whole area be developed, which was one reas= on the Town didn’t develop the space in the past. He discussed the practicality of u= sing the space and that consideration would need to be given to individual locki= ng doors. He also questioned how= the School would feel if they didn’t use all the space, and the Town util= ized a portion of it. <= /span>

Mr. Haverty questioned the logistics of the timing if it went on the 2013 ballo= t; if it were to pass, the School would have three months to rehabilitate the space and move in. He said th= ere was a lot more information the Board needed. As the School Board Representative= , Mr. Haverty asked the Selectmen for the ability to speak with the School Board = about their plan and the timing and then report back the findings.

Mr. McDevitt felt it was difficult, with people about to receive a hefty tax bi= ll, to look a voter in the eye and say the Town had the empty space but wouldn’t let the School use it. As an individual taxpayer he has strong opinions about what happens = at the school, but as a Selectman he didn’t want to ‘play’ School Board. He said if they= think they can come up with a realistic number for $6,000, they’re responsi= ble to the voters to do so. Mr. McDevitt was strongly in favor of the School Board taking this step and believed it would be extremely difficult for the Selectmen to say no. He wasn’t in favor of the To= wn being the developer and then renting the space to the School.

Mr. Haverty agreed that allowing the School Board to use the space showed good faith, cooperation between the two departments, and Yankee ingenuity of recycling things that made good economic sense. He also agreed under normal circumstances it wasn’t up to the Selectmen to tell the School Board = what to spend money on, but he drew the line when they want to spend that money = on a Town building. He wanted to m= ake sure what they were doing was done right.&= nbsp; Mr. Haverty felt the Town ought to develop the space because then the Town could control the renovation and modification to a Town building.

Mr. Gleason said the Town would face a crunch when the tax bill was done and pe= ople were not going to be happy. H= e said if the School Board wanted to renovate it would be their responsibility. He believed the discussion lead to= the conclusion that it was the right thing to do for the Town, fiscal responsibility and the tax payers. He felt the Selectmen should let the School Board proceed and come b= ack to the Selectmen with a plan.

Mr. Haverty felt it was a unique opportunity for the Town and the School to come together on a project. Mr. Gl= eason was concerned that there was a need for an SAU and believed the taxpayers w= ould accept it. He didn’t th= ink the taxpayers would be in favor of renovating the space for the Town to have conference space etc. He said= the two needs should be isolated: 1) specific time-driven need for an SAU facil= ity, and 2) Town’s concern about the building.

Mr. Lynde said a summation could be that the Selectmen supported the School Boa= rd relocating the SAU to the space in the Municipal Building of the six classrooms. Note that the Sel= ectmen were concerned that all issues being addressed and they come up with a plan that is consistent with how the building functions. Mr. Lynde commented that the Selec= tmen needed to start thinking of what they wanted to do in the future with the space.

Mr. Haverty was uncomfortable giving the School six classrooms without knowing = more information. He said it seeme= d that the School wanted to know if they spent the $6,000 that they would be able = to move forward. Mr. McDevitt as= ked what the Selectmen should know in order to be comfortable. Mr. Haverty said under normal circumstances he would be looking for a plan that showed what would be done= to the building, the associated cost and an indication what it would look like when they were done. He said = that was more than a $6,000 plan. In e= ffect, he believed the School Board was asking the Selectmen to trust them and he didn’t know if he was prepared to make that judgment at the present time.

Mr. Lynde believed that the School would try to do the best they could. Because there were unknowns as to h= ow things would proceed, he felt the Selectmen should give the School assuranc= es that they would support them, but once they knew how they would move forward they should discuss the process with the Selectmen. He commented that Mr. Haverty and = Mr. Gaydos should work with the School to make sure all bases were covered.

Mr. McDevitt asked Mr. Haverty to speak with the School Board Chair and express= the Selectmen’s concerns. T= he Selectmen will address the topic in two weeks. Mr. Gleason believed the Selectmen= could say they were supportive, provided the school could give them some assurances.

Mr. Viger said the Selectmen could propose a motion giving the School Board permission to proceed and explore renovating the classrooms, spending $6,00= 0 and that the Selectmen reserve the right to review those and change their mind after looking at the conceptual plan. Mr. Lynde didn’t want to put doubt in their mind that the Selectmen would look at the plan and say no. He believed the School Board wante= d to know if they spend the money and come up with a workable plan demonstrating that the space could be renovated that the Selectmen wouldn’t then say no. He felt the Selectmen sho= uld be saying they would support a plan that demonstrated they could successfully convert those spaces into the needs for the SAU. And if the Selectmen understand the impacts to the building, they would support it. Mr. McDevitt said the risk was wit= h the School Board; especially if the Selectmen didn’t like the plan.

Mr. Haverty said he was happy to ask the School to come up with a plan for the Selectmen to review, but he didn’t believe that’s what they were asking. He believed they were asking for the Selectmen to give them an agreement to proceed. Mr. Gleason believed the School Bo= ard wanted to know if the Selectmen had any opposition to them using the building. He said the answer = was no. He said the ultimate deci= sion was with the voters. He didn’t want the SAU to be forced to look for a new facility.

Mr. Viger believed the Selectmen were fiscally responsible for making sure the product was safe, significant and corners were cut when it came time to build. He said if they couldn’t do that in the proposed $6,000 plan, he didn’t want to give up his ability to tell them it wasn’t a good plan.

Mr. Haverty said the Selectmen seemed to agree with the notion of the School us= ing the six classrooms, but believed the difficulties were in the details of do= ing so. He said the Selectmen nee= ded to retain the right to say no. <= o:p>

Mr. Lynde suggested the following motion: The Board of Selectmen support the concept of the SAU making use of those unused classrooms, if your study demonstrates it could be done feasibly and in accordance with all the codes= . Mr. Haverty added: and is verifiab= le by a third party of the Selectmen’s choosing. Mr. Lynde didn’t feel that n= eeded to be said. Mr. McDevitt beli= eved they could do it anyway. He questioned who would pay for it. He wanted to include: that the Selectmen would have a ‘seat at the table= ’, the right to be part of the decision making process and the right to grant final approval over the plan.

After discussion, Mr. Lynde offered the following motion: The Board of Selectmen supports the concept of the SAU making use of the unused classrooms in the Municipal Building and the building housing Municipal Building offices. The Selectmen anticipate they will= work in conjunction with the School Board in reaching the final design of those = offices.

Mr. McDevitt said although it was the people’s building, the Selectmen we= re the ‘landlord’. P= eople couldn’t build something in the building without the Selectmen’s approval. <= /p>

SELECTMEN’S /= TOWN ADMINISTRATOR REPORTS

Mr. McDevitt said he had a conversation with Dav= id Mermelstein of Trident (builder’s representative of the fire station construction) regarding the trees along Marsh Road. When the roundabout is put in, mos= t of the large trees in front of the Municipal Center will be cut down and remov= ed; they are in the way of construction. The road will become wider and the State will plant new trees. Mr. Mermelstein indicated he knew = someone that could move the trees. Mr. McDevitt will give the Selectmen a copy of the proposal. He was working on a way to have it funded not through property taxes. &n= bsp; He asked the Selectmen to think about whether the trees should be cut down, or moved. Mr. Gleason s= aid it could be discussed at the upcoming Department of Transportation meeting. He believed they had money in the = budget to remove the trees. Mr. McDe= vitt believed there was a source of funds that wasn’t property tax dollars= .

Mr. Haverty asked if there was anything signific= ant about the trees, such as were they donated, or in memorial. Mr. McDevitt said some of the tree= s were in memorial. He spoke to Elea= nor Burton and Jane Provencal to find out who the trees were dedicated to. If the trees were in memorial, Mr. Haverty gave a general support (not using taxpayer money) to move the trees.

Mr. Gleason said he attended a meeting with Mr. Gaydos, Planning Director Jeff Gowan and the Nashua Regional Planning Commission Project Man= ager Jeff Belanger at which he learned the Federal Government had funded $3,000,= 000 to come up with a comprehensive regional plan. The plans to be created will incor= porate planning principals such as land use, transportation, economic development, housing and the environment. = Mr. Gleason said the effort was funded by the government, but there were no Fed= eral Regulations associated with it for the Town; it would be advisory only. He said when meetings were conduct= ed in other towns there were demonstrations and picketers. Mr. Gaydos said the perception of = NRPC was people were misunderstanding the intent and by accepting the money they would give up some of their rights regarding planning. He said Keri Diers of NRPC didn= 217;t think that was a correct perception. Mr. Gleason said a hazardous waste and electronics collection would= be held at Nashua Public Works, 9 Stadium Drive, Nashua NH from 8am to 12pm; Pelham residents are invited to participate. The cost is $10 user fee per vehic= le and covers up to ten gallons or twenty pounds of additional electronics and recycling. =

Mr. Lynde reported on a recent Supreme Court decision regarding retirement costs. =

Mr. Viger reported the status of the Town budget review by the Budg= et Committee. <= /span>

Mr. Haverty said the Fire Chief had presented the Emergency Operati= ons Plan and the Selectmen wanted to ensure the department heads had signed off= on the plan. Mr. Gaydos believed= that most of the department heads had signed off. He would be meeting with the Fire = Chief to discuss what challenges they had to get them finished.

Mr. Gaydos told the Selectmen that bids had been opened for the connection of Surrey Lane; unfortunately they only received one bid. He spoke with Steve Keach of Keach Nordstrom who recommended the Town decline the bid and rebid next year. It was felt that there wasn’t sufficient time to have the work done this year. There was no objection to by the Selectmen to follow Mr. Keach’s recommendation.
