OPEN FORUM

Mr. Paul McDonough, Mammoth Road came forward and thanked the Police and Fire Departments for their duty during the recent storm. He then spoke about the Transfer S= tation and commented how nice they had been and how difficult their jobs were. He discussed the building and the = work that needed to be done to protect it.

Mr. McDevitt stated that the Police and Fire Departments did an excellent job of response during the recent storm. The Police Department received a total of 134 calls for service with= in at 24-36 hour period. The Fire Department had an additional 38 calls.&nbs= p; Mr. McDevitt commended the Fire Chief, as the Emergency Manager for = the Town, in making sure the Town was involved in conversations and setting meetings with utility officials and State of New Hampshire Homeland Security officials, Selectmen and a variety of other groups.

Trick or Treat has been reschedule= d from October 31, 2012 to Saturday, November 3, 2012 from 5pm to 8pm.<= /span>

Due to the recent storm, the Trans= fer Station will be accepting residential brush through Saturday, November 3, 2012. The State limit in size= (of branches accepted) is nothing larger that 4inches in diameter.

2013 Warrant Articles – Revi= ew & Vote

Mr. Gaydos provided the Selectmen with a list of draft warrant articles for review. The following are in = no particular order and have not been approved by the Selectmen. This was a review session only.

Article B – To raise and appropriate $62,813 to hire and equip a Communicatio= ns Center Supervisor. The funds = raised will cover the position from April through December, after which the positi= on will be funded through the Police Department operating budget. The position is considered non-union. Cost breakdown: $6= 1,823 for salary and benefits; $990 to equip.

Mr. Gleason was in favor of the proposed article.

Mr. Lynde asked if there were any offsetting cost savings as a result of the new position. Lieutenant Gary Fis= her came forward. He said there c= ould be a savings for overtime. It= was a Supervisor position, but the person would be trained to be a dispatcher, so= the overtime budget would show a savings. It would be difficult to assign a number to the savings, because the coverage would be for a vacation, sick leave etc.

Mr. McDevitt said the Chief didn’t ask for things not needed. However, he remained mindful of th= e fact that the Fire Department had been requesting a Deputy Chief, which he felt = they needed. The Fire Department h= ad been told for four years that it wasn’t a good time. At present, he didn’t feel i= t was good time to consider a Deputy Chief (for the Fire Department), but felt th= ey should consider that position before considering the additional assistance = in the communications center. <= /o:p>

Mr. McDevitt accepted a motion, with the understanding that the wording may nee= d to be adjusted.

MO= TION:

(Gleason/Haverty) To approve Warrant Article B (Communications Center Supervisor).

VOTE:

(4-1-0) The motion carried. Mr. McDevitt voted no.

Mr. Lynde suggested the following wording “The cost breakdown includes $61,823.00 for salary and benefits and $990.00 for equipment costs.” The suggested language was acceptable to those who made the moti= on; the proposed language would be included as part of the motion.

Article I – To raise and appropriate $25,000 from the Forest Maintenance Fund= for forest management, stewardship, security, public education and other costs associated with the maintenance and care of Town Forest land. Funds come from revenues produced = by timber harvesting, not property taxes.

Conservation Chairman Paul Gagnon came forward to discuss the proposed article. Mr. McDevitt said the proposed art= icle was somewhat standard, but the requested amount is considerably less than in the past. Mr. Gagnon explained wh= en timber was harvested the money went into the Forest Maintenance Fund. Those funds cannot be spent unless= the tax payers authorize it. Last= year the warrant article was for harvesting at Raymond Park, with a reinvestment with numerous improvements into Raymond Park. Mr. Gagnon said this year they wou= ld use the funds for the other conservation areas in Town. A list of how the funds were propo= sed to be spent was provided to the Selectmen.&nb= sp; He explained if they were authorized to spend a certain amount but hadn’t, that balance would carry forward. He told the Selectmen that they had approximately $20,000 that had not been spent from prior warrant articles, therefore this year’s request was less than previous years. If the proposed article was approv= ed (by voters) they would have approximately $45,000 in total to spend.

It was noted that the funds were not from property taxes; the funds were proce= eds from timber harvest.

Mr. Gleason said an agreement had been reached with the Trustees; if the funds = were authorized the money would go into the Town holding account for the Forestry Committee to expend. Mr. Gayd= os said they would take the total of the unspent balance and ask the Trustees = for that amount so there would be no confusion about what had been approved ver= sus unspent.

Mr. Lynde discussed the article wording. He said they weren’t ‘raising’ the money and wonde= red if the wording could be amended to read: “…authorize the Selectmen to withdraw $25,000…” Mr. Gaydos said the Department of R= evenue Administration (‘DRA’) wanted to see. He said the wording indicated they weren’t withdrawing, they were authorizing the Selectmen to expend. Mr. Gleason said it went into the = MS5 as an appropriation and then kicked back under Trust Funds.

MO= TION:

Meeting with School Board Representatives – Regarding School Administrative Unit Office Space

Mr. McDevitt said the Selectmen would have a discussion regarding the use of six classrooms within the Municipal Building.&= nbsp; He said there were six classrooms within the building that had not b= een remodeled or used, except for storage.&nbs= p; The School Board has indicated an interest in exploring the possible= use of that space for their offices.

School Board Representatives Andy Ducharme and Superintendent Elect Amanda Lecaroz came forward to discuss the School Administrative Unit (‘SAU’) office space. Ms. Lecaroz exp= lained there was an SAU#28 that was comprised of both the Pelham and Windham School Districts. Last March the Tow= n of Windham voted to separate from the Pelham School District and become its own SAU effective July 1, 2013. C= urrently the SAU was housed in a facility that was a combination of the two districts with a building located in Windham. Pelham needed to fin= d a facility and hire staff to work within their SAU.

An information packet was provided to the Selectmen. Mr. Ducharme reviewed this information. He discussed the benefits for housing SAU 28 at the Town Hall:

Utilizing Existing Town owned property-less= costs to the Town’s tax payers;
Consolidation of all senior management for = the Town and schools in one location-easy access for Townspeople;
Almost full utilization of the Town Offices= ;
Continued positive partnership between the = Board of Selectmen and the Pelham School Board.

The architectural firm of Lavallee/Brensinger summarized a preliminary project budget worksheet that School Business Administrator Adam Steel had reviewed= and initially could eliminate approximately $100,000 from the total ($600,171.00).

There were four alternatives that could be added to the plan: <= /p>

1) Entrance Wa= ll, Walkway Pavers & Shading - $59,807.00;

2) Rip and Re-= Roof - $44,940.00;

3) Floor Tiles= and Mastic Abatement - $23,250.00;

4) Demo and re= place windows with non-op store front - $69,550.00.

An architectural diagram of the office space was reviewed. Mr. Viger asked if the work that w= ould be done in the classroom space would bring that area up to code and in compliance. Mr. Ducharme believed it would. Mr. Lynde questioned if the amount= for floor tiles and mastic abatement would also include asbestos. Mr. McDevitt believed the answer w= as yes. Mr. Lynde asked if it was somethin= g that had to be done, or if it would be fine if it was left in place undisturbed. Ms. Lecaroz said= they could leave it and put the flooring over it. If it wasn’t disturbed they wouldn’t have to abate it. If they wanted to abate (the asbestos) there was an additional cost.

Ms. Lecaroz told the Board they had received the budget worksheet on Friday and hadn’t had the opportunity to adjust the figures or make cuts. They would like to see the price decrease and add windows to keep the aesthetic look of the building. The information was still prelimin= ary so they would have something for the Selectmen to review and determine if it w= as something they wanted to investigate.

Mr. Gaydos questioned if they had considered having a construction manager at risk. He discussed the method= used by the Town for the new fire station project and the benefits that could co= me from the process. Ms. Lecaroz= said they haven’t yet had conversations specific as to how they would proc= eed with a project.

School Board Chairman Rob Hardy joined the meeting.

Mr. Gleason asked how confident the school was about the prices listed given the limited amount of time the company had to put them together. Ms. Lecaroz said they were confide= nt that the prices were high. Th= ey would bid the project out and believed whatever bid they received would be lower that the prices in the worksheet.

Mr. Lynde commented that they had problems with the roof and questioned if it w= as something the Town would want to get ahead of if the School had included co= sts for the roof. Mr. Gaydos said= it would be addressed in when the formed the partnership. He said it was something that woul= d have to be done and had been included in an overall 5-year plan. Once they had more information fro= m the School the partnership and how costs would be shared needed to be discussed= .

Mr. Viger was glad they were taking steps to have discussions because he had concerns about how items such as the roof would be addressed. It would be in the Town’s be= st interest to permanently fix the roof. He appreciated the efforts being made.

Mr. Gleason asked for an explanation about the future classroom shown on the fl= oor plan. Ms. Lecaroz said during= the walk through of the space there had been discussion about the fact that hav= ing a ‘classroom’ that size may possibly allow them to do a joint venture between the School and the Town.&n= bsp; The space could potentially be turned into a meeting room; this woul= d be in addition to the conference in the front. Mr. Gleason questioned the parking= . Ms. Lecaroz believed parking would= be near the proposed entrance. P= arking spaces would be allocated to the SAU. Mr. Gaydos said parking in that area was not utilized during the day; there was plenty of space for their needs on that side of the building. Mr. Gleason wanted to know if ADA = compliance was reviewed.

Mr. Viger asked if the main hallway was a necessary means of access for the Town Hall. Mr. Gaydos said the door would have to be able to be opened. He assumed during the day (during business hours) that the door would remain open. Mr. Viger was concerned about the security of the individual offices in the event the sch= ool was no longer in the space. M= r. McDevitt said the office doors could remain locked similar to the Town offi= ces were.

Mr. Ducharme said they provided two possible options, but remained open to suggestions. He reviewed the breakdown of each. Mr. Gaydos thought the proposed options were straight forward. He said the concern was to make th= e cost as low to the taxpayers as they could.&nbs= p; He discussed the option of the Town doing the project and how the co= sts could be structured. There was a question about how the cost of the space w= ould be paid; the Selectmen didn’t want taxpayers to be charged twice. Mr. Gaydos said with the assumptio= n that if the money was borrowed (by the Town), the payment (from the school) would cover that cost of the loan. = He agreed if the funds were raised at once, the taxpayer would have already paid.

Mr. Gaydos addressed the difference in the proposed options; one being the Town= had partnering input on build of new offices, and the other was the Town having minimal input on the build of the new offices. There was a brief discussion about= the accounting. Mr. McDevitt didn’t want to overstate the municipal cost at the benefit of the Sch= ool Board. He felt the School sho= uld be charged for the renovation/construction costs and the proportional HVAC and maintenance costs. Mr. Gaydos= said the Town would consider whatever the Town gave them as revenue so when taxes were computed they could show the expense of the bond and the income of the payment. They would also show= the projected income from the HVAC etc. and the projected expense. The School would be responsible for raising the money and giving it to the Town so it would be appropriately sh= own on the books.

Mr. Lynde discussed the proposals. He was in favor of (Option A) receiving payments from the School for a period of t= ime and the Town having partnering input on build of new offices. He felt the Town should look at th= eir specific needs that tied into the school project and consider tying in those Town needs as a single project. Mr. Gaydos discussed the status of the roof and the proposed repair and replacement. He said it would= be cost efficient and effective to have it done all at one time.

Mr. Lynde wanted to know what would happen if something wasn’t approved in the coming year. Mr. Ducharme= said contingency plans were being made. <= /span>They were currently speaking to real estate vendors for an interim time and talk= ing about possibly staying in the location in Windham. At present, the School felt the municipal offices were the best and most viable option for both the Town and School. Mr. Lynde felt they n= eeded comparables and contingency costs as they went forth to better understand t= he pros and cons of the project.

Mr. Haverty said there were things he liked/disliked about both options. He reviewed what was proposed. He wondered if there was a way to = have an option that was hybrid model of the two proposals. Mr. Lynde believed the Selectmen w= ould have to put forth a warrant article to do the building, with the understand= ing that the payments for the construction would be the responsibility of the School District. He said they= would have to budget to pay the rental cost, which would be equal to the amount b= eing paid on the note. =

Mr. Viger said the two proposed options seemed to have the same goal; raise $600,000 to get the project done either by the Town or the School raising t= he money. Mr. Gaydos discussed how a Town warrant article could be worded.

Mr. Gleason said with the space being in a Town building, the Town would put the warrant article out. He said = the Town would have an operating budget that increased, but at the same time th= ey would show enhanced revenue. = He also felt if the Town picked up the burden for the funds, the Town would ha= ve more say in how the space was built. He said the warrant article should indicate that there is a signific= ant cost savings by the proposal versus going into a new building.

Mr. Hardy said they had reviewed other options and found that to construct a new building (on the land across from the high school) had an estimate of $1.2million dollars. He agree= d that the case could be made that the proposal would be a significant cost saving= s to the Town’s people.

Mr. McDevitt said he had been asked by a citizen about the cost for proposal. When he told them it may cost approximately $500,000, that person was shocked. The person thought the classrooms = only needed to be freshened up and have a coat of paint. Mr. McDevitt realized no matter ho= w they proceeded, they needed to be clear that those classrooms were never touched. The classes still had school items on the wall. He said they intentionally didn= 217;t touch the classrooms because they felt it was an unnecessary cost at the time. He commented that there= was a considerable amount of work that needed to be done. He said if anyone wanted a tour of= the space they should contact the Selectmen’s office to set up a time. Mr. McDevitt noted if the burden of raising the money was on the Selectmen, it would keep the burden on the Sch= ool Board to explore the options and explain to the Budget Committee and voters= why it was the best option. =

Ms. Lecaroz said they had information on comparables that could be brought forward. She agreed that it w= ould be the School to bring the information forward as to why using the space wo= uld be the best option for the School and the Town.

There was a brief discussion regarding how to proceed. Mr. Lynde wanted to obtain cost estimates for the building’s roof and air conditioning so a determina= tion could be made if the project should include those items. Mr. Viger believed if the Selectmen moved forward with raising and appropriating the money, they should meet wi= th the construction manager to discuss how the project would proceed. Mr. Haverty felt the project shoul= d be focused on the space the school would use and handle the other items at a l= ater time. He felt they should hav= e some assurance what they would be building and questioned if the estimate was adequate. He questioned if the Selectmen wanted to put their name on the estimate provided, or if they wan= ted to have someone review the information.&nb= sp; Mr. Gleason was reluctant to put anything in a warrant that was more than what was necessary to get the building functional for the SAU. He also felt they couldn’t go forward with the quote; the number provided was an estimate. He said substantial review and bac= kup needed to be done to convince people that the proposal was valid.

Ms. Lecaroz agreed that the information wasn’t ready for a warrant yet. She said they came in to meet with= the Selectmen to find out if they were interested in pursuing the option. She noted they had money in their current budget for architectural and engineering fees. Those funds would be used to solid= ify a better/legitimate guaranteed maximum price. Mr. Gaydos said he could easily co= ntact Trident, with the information provided, to discuss what reasonable timeframe would be expected to come up with a number they could take in front of the Budget Committee. He said the School may want to review another option for a one year period to provide t= ime for the Town to determine a number.

Mr. McDevitt believed the Board supported the concept and asked if they could support it for the 2013 warrant. The Selectmen answered yes. <= /span>

Mr. Ducharme noted that the School had put $180,000 ($15,000/month) in the budg= et for rent. This number could possibly be cut down considerably if other opti= ons are pursued.

Mr. Lynde suggested authorizing Mr. Gaydos to meet with the School representati= ve to determine what needed to be done. He said if they needed additional authorization they could come back= to the Board. He felt the working relationship should begin immediately.&nbs= p; There was no objection. Mr. Gaydos said to get a frame work going Trident (Gino Beroni) would volunteer= advice. Mr. Haverty said there was a short window to get started. He ask= ed if they could have Eckman and Trident start formulating a plan given that the School had funding for architectural and engineering work. This would allow them to have some= thing for the warrant. He said they didn’t have time and believed they should move to resolution. Mr. Gaydos envisioned he would hav= e one meeting with the School and Trident to review the information they had and = what would be needed to move forward and the timeframe to get it done for the Bu= dget Committee. Ms. Lecaroz said t= hey had a meeting set up for Friday to review long-term school options and beli= eved they could carve out an hour or so to have a discussion with Mr. Gaydos.

Mr. McDevitt stated the Board had great confidence in Trident. If the project moved forward he be= lieved they would want to engage them in the project. Ms. Lecaroz said the School District had the same confidence; Trident had recently managed a number of their projects.

Mr. Lynde suggested that during the process they think about the future of the building and what may need to be done.&nbs= p;

Mr. Gleason believed it was the feeling of the Board to have Mr. Gaydos meet wi= th the School representative to determine what was needed to support a warrant article. Based on the input, = they would be proceeding with a warrant article. He said prior to then the Town cou= ld let the Budget Committee know they would be presenting a warrant article (for approximately $600,000) for renovating the building for the SAU with the pr= ice being finalized for reconsideration. Mr. Haverty felt Mr. Gaydos should get Trident and the School Distri= ct discuss what they needed for an estimate.&= nbsp; He wanted to make sure the Town was in the driver’s seat for t= he project being it was a Town building. He also wanted to make sure they were partnering with the School at = the same time. Trident would work= on the Town’s behalf, at the Town’s direction.

Ms. Lecaroz and Mr. Ducharme were in favor of the manner proposed by the Board = to move forward.

Mr. Gleason wanted to make sure that Trident did the presentation for the Budget Committee. =

2013 Warrant Articles – Revi= ew & Vote – Resumed…

Article A – To raise and appropriate $266,189 for repair, maintenance and upgrading Town roads to be offset by the State Grant for highway maintenance.

Article D – To raise and appropriate $30,000 to establish a Capital Reserve f= und for cistern repair. The Selec= tmen will be designated as agents to expend.&nb= sp; Mr. Gaydos commented that the department had a head start on the fun= ds; next year the request may be decreased.&nb= sp;

(Lynde/Gleason) To submit the article with the modification to make it expendable by the Selectmen.

Article E – To raise and appropriate $100,000 to be placed in the Tallant Road/Willow Street Bridge Capital Reserve Fund for the purpose of prelimina= ry engineering and cost estimates.

Mr. Gaydos stated the next time money was available would be in 2023. He told the Selectmen he had a conversation with the head of the Bridge Division who indicated that there = was funding to pay 80% of the engineering costs up front and wouldn’t hav= e to wait until 2023. Mr. Lynde as= ked how much the engineering would cost. Mr. Gaydos believed if they went through a qualification based selec= tion of an engineering firm there would be no cost and it would provide the Town something to work on. Until n= ew estimates are received the engineering costs were unknown. There was a discussion regarding t= he status of the bridge.

Mr. Lynde felt if the Town could get reimbursement for the engineering study, t= hey should do so.

Mr. Gleason said another approach would be to ask the tax payers to take $100,0= 00 out of the fund for engineering. He said there was currently $250,000 in the capital reserve. Mr. Gaydos said the whole amount c= ould be taken out for preliminary and final engineering. Mr. Lynde said the reimbursement f= rom the State could go back into the fund.&nbs= p; There was no objection.

Mr. Gaydos said he could contact the State for an engineering number. He suggested wording. Mr. McDevitt said the Selectmen couldn’t vote on an unknown number.&= nbsp; Mr. Gaydos suggested bringing a figure of $175,000 to the Budget Committee. This figure could = be amended during reconsideration.

MO= TION:

(Gleason/Viger) To proceed with the Warrant Ar= ticle, remove $175,000 from the Tallant Road/Willow Street Bridge Capital Reserve for purposes of an engineering study.&nb= sp;

Article F – To authorize the Selectmen to enter into a 3-year lease-purchase agreement for $15,489 to obtain a new Ford Focus and to further raise and appropriate $5,329 for the first year’s payment. Mr. McDevitt asked if they had to = note a non-appropriation/ non-replacement clause as prescribed by statute. Mr. Gaydos said it could be elimin= ated. Backup information will explain th= at the agreement was for a lease-purchase; the Town would own the vehicle at the e= nd of the lease.

(Gleason/Lynde) To approve the Warrant Article= amended to remove the sentence regarding a non-appropriation/non-replacement clause.

Article G – To approve the cost items included in the three year Collective Bargaining Agreement ratified by the Selectmen and the Local 3657 American Federation of State County and Municipal Employees, Pelham Police with the = sum of $XXX to fund the first year of the agreement.

The article will alert the Budget Committee that a number is coming.

Article H – To increase the annual contribution to the Ambulance Fund from $25,000 to $60,000 funded from ambulance service fees collected in each calendar year.

The purpose of the article was to increase the amount set aside because the cos= t of ambulance replacement had gone up. <= /span>Mr. Gaydos amended the language to clearly state the cost was coming from revenues. The remainder of the article would read as written.

Roundabout Update

Mr. Gleason said a meeting was held with the State and the selected contractor Continental Paving. Continent= al will be moving quickly (within the month) to start work on Acorn Lane. A temporary road will be done behi= nd the fire station for heavy equipment access.&n= bsp; It was learned during the meeting that the roundabouts will be the l= ast thing done in 2014.

Mr. McDevitt commented that the person willing to donate $5000 toward the cost = of moving the trees had given confirmation of such. The Selectmen will need to hold a meeting to accept the donation. The person wanted to remain completely anonymous.

New Fire Station Update=

Mr. Gaydos provided an update of the new fire station progress. He also discussed the activities t= hat would be completed within the next couple weeks.

September 2012 Revenue & Expen= ses Review

Mr. Gaydos commented that all departments were doing very well, with the except= ion of legal. He said there were several issues they had to carry, plus the union negotiations with the Poli= ce.

SELECTMEN’S /= TOWN ADMINISTRATOR REPORTS

Mr. Gleason, Mr. Lynde and Mr. Viger had no reports.

Mr. Haverty updated the Board regarding the power outages due to the recent sto= rm. He commended the Fire and Police Departments for their hard work during storm. Mr. McDe= vitt researching appropriate signage for Raymond Park (where parcels are located and what names were allowed per deeds) (6/7/11 Mr. McDevitt sa= id research was completed and would like to discuss with the Board after = the meeting of 6/28/11)(7/5/11 – Mr. McDevitt said a discussion shou= ld be scheduled regarding the names at Raymond Park. Information is avail= able to educate the Selectmen.
