2012 General Election RECAP

Mr. McDevitt said the Selectmen were given information on the election. He read the names of the State Representatives aloud. Congratulations were extended to Charlene Takesian and Patrick Culbe= rt, two Pelham residents that ran and were elected. Mr. McDevitt thanked Mr. Lynde for stepping forward in the election.

Mr. Gleason discussed the voter registration statistics; 81% of the registered voters voted on election day.

The Selectmen thanked the Moderator, Town Clerk and staff for their hard work a= nd dedication during the election.

2012 Tax Rate=

Mr. Gleason noted that the tax bills were mailed earlier in the day and had a response time of December 13, 2012. In April, tax payers were advised that there was an expected $3.60 t= ax increase. He was please to sa= y they were able to hold the tax rate down to a growth of $2.99 (14%) with the contribution from the fund balance to help offset it.

2011 Town Tax Rate - $6.38 / 2012 Town Tax Rate – $7.49   (increase of $1.11=3D 18%)

Mr. McDevitt noted that the Selectmen made a pledge last year to not build the increase due to the fire station back into the budget this year. The Selectmen kept that pledge.

Mr. Viger asked for a comparison of the evaluations from last year to this year. Mr. Gleason believed th= ey were consistent and noted the Selectmen had signed off with Corcoran.

Jeff Gowan, Planning Director Roundabout Update

Mr. Gowan noted that the State Department of Transportation (‘DOT’) held a pre-construction meeting on October 24, 2012 with Continental Paving (company awarded the contract for the job). For the next four to five months t= he main work will be utility, drainage and tree cutting. Fair Point (utilities) is currently doing their work in tandem with the DOT and Continental. Mr. Gowan will continue to corresp= ond with DOT to discuss critical details and remain a conduit for the construct= ion group to answer questions by the Selectmen and public. As soon as March, 2013 there will = likely be more visible work on the project. At this time the general plan is to build both roundabouts at the sa= me time doing construction from the center out to the roadway. Paving will likely be completed to binder; after over-wintering the final paving and landscaping will be done. It’s still yet to= be determined at what point sidewalks will be installed.

Mr. Gleason questioned if the State would have periodic meetings with Continent= al and other participants during which the Town would be able to attend to ove= rsee progress. Mr. Gowan recommend= ed the Town work with the DOT representatives and perhaps have them come in and provide updates. Mr. Gleason = recommended doing so. He asked when the t= wo roundabouts would be done. Mr. Gowan the State planned on getting the project as ‘done’ as they could next year with the understanding that final paving, landscaping etc. would be done in 2014. Mr. Gl= eason asked if a project schedule (critical path schedule) had been provided.   Mr. Gowan said a schedule ha= d not yet been provided. Earlier in= the day he received the unapproved minutes of the recent meeting. He didn’t think they were at= the stage yet to provide the details the Town was looking for. Mr. Gleason want= ed to keep pressure on them given the importance of having a schedule for planning. Mr. Gowan said they= were amenable to meeting with the Town as often as desired; he will keep the pressure on.

Mr. Lynde asked at what point the existing fire station would be taken down bec= ause he wanted to know if it was in alignment with when the new station would be completed. Mr. Gowan wasnR= 17;t aware of a specific date. He = said when the Fire Department was occupying the new building the old building co= uld be torn down. Mr. Gleason com= mented that during the recent meeting he asked the State if they were aware that t= he Fire Department would be moving in April to which the State indicated they = were well aware of that fact.

Mr. McDevitt said it was understood that the area behind the existing station w= ould be used for a staging area. A= s soon as the existing station is taken down, the whole area will be used as a sta= ging area. Mr. Gowan anticipated t= hat a small office trailer would be located on the lot fairly soon. Mr. McDevitt recalled there was a website (put together by the Fire Chief) to keep people up to date regarding the progress of the fire station and questioned if something similar could = be done for the roundabout project. Mr. Gowan said there was link on the Town website that brought peopl= e to the DOT plan and a bulleted progress list.= He said that list would be updated.=

Mr. Haverty questioned the status of acquisition/eminent domain issues. Mr. Gowan stated he had stayed awa= y from that particular issue and hadn’t heard anything about it. He said he would investigate. Mr. McDevitt was aware of two prop= erty owners that had accepted a check from the State. Mr. Gaydos understood the State wouldn’t get started until they had taken all the property they needed. He said there was an = appeal process, but believed for all intents and purposes the land had been taken.

Mr. Gowan said he was aware that outreach had to be done to the citizens whose addresses would be change. He believed it could all be handled through a voluntary process and would enga= ge in such over the next month or two. Mr. McDevitt commented that it would be a good idea to provide a schedule to the School Administrative Unit because of possible impacts to school bus routes etc. Mr. Go= wan said he would do so.

Residential and Commercial Well Ordinance

Waste Disposal Systems Regulation – Chapter 295 (formerly Article K) – Update recommendations

Planning Director Jeff Gowan and Deputy Health Officer Paul Zarnowski came forward to discuss the Residential and Commercial Well Ordinance and the Waste Disposal Systems Regulation.

Mr. McDevitt said one of the matters was a subject for the Board of Health (whi= ch was the Selectmen), however for discussion purposes they remain as presently convened.   At the point a public hearing was to be conducted, they would convene as the Board of Health.

The discussion began with the Well Ordinance.&= nbsp; Mr. McDevitt said the Selectmen had been presented with a list from = Mr. Gowan and Mr. Zarnowski indicating problems they believe existed along with recommendations. Mr. Gowan capsulized the Regulation. He= and Mr. Zarnowski were convinced (through evidence seen) that buyers of new hom= es learn of serious water quality issues far too late in the purchase process, often times at closing. Many homebuyers are surprised and unable to meet the cost of mitigation potentia= lly leading to degradation of public health.&n= bsp; Likewise customers and employees of businesses that don’t fall under State jurisdiction are not protected with the existing Well Ordinance being for residential only.

It was noted that the current Regulation states information needs to be made available. Mr. Gowan said a production standard had to be hit for a well and the quality had to be made available to the Planning Department where it was shared with prospective buyers.

Mr. Gowan reviewed the first three recommendations:

1)&n= bsp;    Require preliminary well testing be done prior to the issuance of the framing permi= t to verify the yield test had been met and to ascertain the quality of the wate= r;

2)&n= bsp;    Yield thres= hold should be increased from the current 5 gallons per minute, over a two hour period, to now be 4 gallons per minute, over a four hour period;

3)&n= bsp;    Water quali= ty should be mitigated to meet the prevailing State of New Hampshire recommend= ed minimum standards for drinking water;

4)&n= bsp;    Water quali= ty treatment systems should be point of entry systems;

5)&n= bsp;    If treatmen= t is required, the builder must submit a post-mitigation water test prior to the issuance of a Certificate of Occupancy;

6)&n= bsp;    Revised Ord= inance should apply to all wells residential and commercial, except wells that are part of a public water system which fell under the State of New Hampshire jurisdiction

Mr. Gleason questioned if there was a disparity between the State and Federal Standards. He recalled in the= past when he had problems that the Federal Standards were much more severe than = the state. Mr. Zarnowski replied = it depended on what contaminants were reviewed. For example, the State Standards f= or Radon were less than the EPA Standard.&nbs= p; The State doesn’t govern private wells, only public, but they = had a set of guidelines that basically mirrored the EPA Standards. Mr. Gleason asked if capturing Rad= on was still a problem if wells had to meet the proposed requirements. Mr. Zarnowski said once it’s captured and concentrated it would go back to dilution some other way; there were a variety of treatment methods. Mr. Gleason understood that the frequency of Radon problems was high= er in Pelham. He questioned if t= hat fact would skew the policy. M= r. Gowan discussed Radon and Arsenic, both of which were prevalent. He felt the safe thing to do was g= o by the State Standard for public water systems.

Mr. Lynde asked if the current Ordinance made reference to the State Standards. Mr. Gowan said it currently didn’t, but would if the proposed changes were made. Mr. Gaydos commented that the Fede= ral and State Standards for public water systems are becoming more stringent and causing testing to go higher. He said at what point, by holding a residential homeowner to the same standard= as Pennichuck would it put unreasonable costs on them. He said if they had a baseline requirement the homeowner wouldn’t be held to an unreasonable threshold. =

Mr. Gleason asked if residents would be mandated to perform periodic testing if= the State Standards were set as the building criteria. Mr. Gowan said it would depend on = what they had and what the mitigation system was. There may be ongoing testing for a= given contaminant.

Mr. Gowan said the Town would require testing again to ensure that higher stand= ards are being met. He said the pr= oblem with establishing a specific standard is as those standards change over tim= e, the ordinance would need to keep changing.= It was his opinion, if the Pennichuck customers were benefitting from water meeting a State Standard, the Town should review it. He reiterated th= at the Ordinance would be for new homes.   Mr. Lynde said it was the Board’s responsibility to make sure people moving into a new home had= the safest product that met reasonable standards of quality and safety.

Mr. McDevitt recalled when Selectwoman Deb Casey was on the Board; she was real= ly good about reminding people to have their water tested and pointing out the relatively high levels of naturally occurring arsenic, radon and other chemicals in wells.

Mr. Gaydos said he would be interested to know everything a public water supply= had to test for. Mr. McDevitt sug= gested contacting Salem, NH or other surrounding towns, with similar regulation, w= ho has a public water supply to find out what standard they held people to. This would allow comparison. Mr. Gowan said if the Selectmen we= re interested in the recommendations, the next step would be to work on draft language. <= /p>

There was a brief discussion regarding community wells. The Municipal Building uses a comm= unity water system. Mr. Gaydos said= they had to have certain tests required by the State. He said they pay to have the tests= done, which are then submitted to the State on a quarterly basis. Mr. Zarnowski n= oted a community water system was considered to be basically twenty-five people/employees, or fifteen taps (number of units/houses serviced); there = were other criteria, but the numbers seemed to be the point used for a water sys= tem to turn into being considered public/community.

Mr. Gleason offered an amendment to have the name of the ordinance be labeled ‘New Residential and Commercial Ordinance’. He also suggested amending #6 by inserting the word ‘new’ with the words ‘..apply to all n= ew wells’. Mr. Gowan said = the proposal was done for Selectmen review; they would draft actual language later.

Mr. Lynde believed there should be some type of regulation for replacement well= s, whether the home was new or old. Mr. McDevitt explained why the Well Ordinance was originally drafted. There were new homeowners that discovered they couldn’t drink their water; that vulnerability prompt= ed the ordinance.

Moving forward, Mr. McDevitt said the Selectmen would be looking for a list of standards, or suggestions for what other communities were doing. Mr. Gowan said they would answer t= he questions and begin to draft language over the next few weeks. He would pass the information by t= he Department of Environmental Services to ensure nothing was missed.

Residents can find information regarding water testing/quality/treatment on the Department of Environmental Services website. Mr. Gowan said they would make informational brochures from the EPA and DES available to the public.

The Selectmen then discussed the Waste Disposal System Regulation (formerly Art= icle K). Mr. Gowan felt to begin with the Board of Health should ‘dial in’ the regulation and then have it removed from Zoning. There was overlap between the regu= lation and land use regulations. Mr.= Lynde recalled that Article K had been adopted by the Board of Health as a health ordinance. Subsequently the l= and use board decided to put it into Zoning.&n= bsp;

Mr. Zarnowski provided a history explaining that Article K was put into effect approximately 1976-1978, which then became Section 295 of the Health Ordinance. The latest revisio= n was done in 1990. Since that time technology had become far advanced but the Ordinance didn’t reflect it. He said the recommended c= hange was to mirror the Department of Environmental Services (‘DES’) regulations and remove the more restrictive language.

The recommended amendments are:

1)&n= bsp;    Require 2ft between the bed bottom and seasonal high water table (rather than the curre= nt required 4ft at midpoint);

2)&n= bsp;    Change the = depth of ledge to 3ft from the currently required 6ft.;

3)&n= bsp;    Change the setback distances to conform with DES setbacks and suggest changes to Zoning Ordinance and land use regulations to conform with DES setback regulations;=

4)&n= bsp;    Change the = lot size requirement on conversion of existing seasonal residential structures;=

&n= bsp;

Mr. Lynde confirmed that the suggested changes were based on the new systems be= ing put in place. He questioned if there was any guarantee in the current ordinances that those would be the systems put in place. Mr. Zar= nowski answered no; he said even with a stone and pipe system 2ft would be the number. Mr. Lynde asked if sp= ecific systems would need to be named in the regulation. Mr. Zarnowski answered no; he felt= 2ft was adequate. He noted that the State had eliminated the ‘in kind/in place’ language; the new replacement criteria is that a construction/operational approval is needed for a new system. The new criteria also allows for 2= ft.

Mr. Zarnowski explained he would like to set up a check list and specific way t= hat the requirements had to be met for conversion.= Lot sizing was one of the waiver requests on most of the conversions even when a septic and well could fit.&nbs= p; The requirement would apply to existing structures, not lots. Mr. Gowan said this was an area th= at Zoning became very involved; any expansion of a non-conforming/pre-existing condition required going to the Zoning Board. He said required lot setbacks would remain in effect. =

Mr. McDevitt suggested drafting language; the Selectmen would then convene as t= he Board of Health to review. Mr. Gowan believed language could be drafted in the next six weeks. Mr. Zarnowski noted he would speak= to engineers, other towns and DES for input.&= nbsp; Mr. McDevitt asked if there would be a benefit by having the Town engineer review, or if it wasn’t necessary. Mr. Gowan said he held the engineer’s opinion in high regard related to land use, but didn’= ;t know if he had the level of expertise held by Mr. Zarnowski. He said they would have the opport= unity to obtain additional feedback from DES or others that reviewed. Mr. Zarnowski said once the drafts= were done they could be put out for public input. Mr. McDevitt said they would hold hearings. Mr. Gowan noted tha= t the DES was very willing to meet with the Board for a discussion. He said there might be value in ha= ving them come to discuss the importance of well testing.

OTHER BUSINESS

Moving Trees<= /u>

Mr. McDevitt said he would meet with the Conservation Commission to discuss the tree removal. He said the tre= es had been reviewed and there were some that shouldn’t be touched because t= hey probably wouldn’t make it. He said it was still possible to move most of the trees (approximately seven). The original proposal= was to move trees around the fire station, however they were found to be common trees that were in tough shape. The amount of money to move the trees was not from tax money; it would possibly come from existing money the Conservation Commission currently had. Additional information will be ava= ilable once Mr. McDevitt had the opportunity to meet with the Conservation Commission.

B= udget Committee Warrant Article Vote

Mr. Viger provided the Selectmen with an update = from the Budget Committee’s vote on the warrant articles. He said everything passed unanimou= sly, with the exception of the article to establish a capital reserve to erect a Highway garage, which had one member who voted no.

Friends of the Library in Pelham (‘FLIP’) Permission to Decorate New Tree at the Library

Mr. McDevitt said the Friends of the Library have requested permission to decor= ate the new tree at the library. = He recommended that the Selectmen approve the request and ask that they use wh= ite lights that don’t blink. There was no objection by the Board to grant permission to decorate = the tree (as specified).

2013 Warrant Articles – R= eview of Sale of Town Owned Property Article

<= o:p>

Mr. Gaydos said over time (over the last year) t= hey had become aware of some pieces of property that some property owners in To= wn had questioned if there was a reason the properties hadn’t been sold. He said the properties = were reviewed and found there were some the Town had a purpose for wanting; howe= ver, others were suggested being sold and put up to the highest bidder. There were three properties: 1) a = small piece of property containing junk cars and other debris. The abutter is interested in combi= ning it with their lot. There are = other abutters that may take an interest. Mr. Gaydos said a proviso could be a minimum bid and time limit to remove the debris. 2) small s= trip of land located off Little Island Park (containing no water frontage). The people around it might find it= of interest. Mr. McDevitt noted = that the first two properties were tax deeds taken years ago. 3) landlocked property (approximat= ely 8 acres a portion being in the wetland) between Castle Hill Road (in Windham)= and Mammoth Road (in Pelham) with Beaver Brook running between. Mr. Gaydos said the deeds would ne= ed to be reviewed to determine if there is a driveway right-of-way access over so= me lot. He would report back to = the Board

Mr. Gleason felt it was appropriate to point out= that the land currently belonged to the Town and didn’t yield any tax revenue. He said the benefit = to the Town was the profit from the sale and continuing tax revenue. He noted that the Conservation Commission had expressed no interest in the land and believed it was advantageous to sell the property. <= /span>Mr. Gaydos said he would like to check back with the Conservation Commission regarding the property. =

Mr. Gaydos recommended to the Board, if they were interested in proceeding, he would research to determine if there was information of interest to set a minimum bid, compose the proper form of deeding, and details needed to sell the property. Mr. McDevitt suggested that the properties were submitted to the Conservation Commission, Planning Board and Planning Department for their review and comment. Through information at the Assessor’s office, Mr. McDevitt said the Town has a 15ft. walking easement through the third parcel from Mammoth Road. When the front parcel was subdivid= ed the Town requested access. Mr. Ly= nde asked if the walking path could also be a driveway. Mr. McDevitt reviewed the deed and= read a portion aloud, which only specified ‘…subject to a 15ft. wide easement to allow access to Town property as shown on plan…’ Mr. Gleason recommended formulating warrant article language pending input from the boards. There was a brief discussion how t= he properties would be disposed of and noted that the voters would have the opportunity to vote regarding such.

New Fire Station Update

Mr. Gaydos provided the Selectmen with a status update regarding the new fire station project. <= /span>

ACTION ITEM REVIEW

Mr. McDevitt asked the Selectmen to consider adding 1) fireworks education R= 11; Mr. Viger; 2) SAU office space; and 3) Well Ordinance and Article K Ordinan= ce.   There was no objection.=

Mr. Gaydos said the school agreed to have Trident explore the available alternatives for an SAU location and ‘pin down’ the costs. The costs received from the school= were construction costs that didn’t include soft costs (architectural fees, builder’s fees etc.). He said a meeting was scheduled for next week; = more information would be forthcoming.

Mr. Lynde asked if the Budget Committee had any feedback. Mr. Viger said the Budget Committee looked forward to receiving the Selectmen’s feedback. They emphasized that multiple site= s be reviewed, not just the classrooms in the Municipal building. They anticipated something brought= in during reconsideration. Mr. G= aydos believed the Budget Committee was pleased with the process of having an independent group represent the Town.

SELECTMEN’S /= TOWN ADMINISTRATOR REPORTS

Mr. Gleason reported he attended a Nashua Regional Planning Commission broadband meeting earlier in the day and was surprised to find out New Hampshire was second in the country for broadband capability. He noted that the Council on Aging = was finalizing their non-profit status. He said there had been defective duct work found in the basement of = the Senior Center that the Council would like the Selectmen to consider repairing. He said Mr. Gaydos= had agreed to have that happen this year.
